Iteury H, Duke and I were preparing to leave to attend the hearing on Jan. 16 , 1968 when we both were called to the telephone on business. As a result, 'we arrived at the hearing at 7130 PM, Just soconds after the vote had boon taken on thin particular case . We Nrere informed by the clerk that a re-opening would not be considerod by the commission after it had been acted on , and that our only ?lobes would be an appeal to the City Council, Strice Mr. Dulre ' s home, and miner have property lines common to those of the property in question it �.s my belief that what we have to :,ay should have some boaring on the decision of this matter . i For clarificaticn, i would like an examination of the zoning history of this parcel of lend . If any mewory clods not rail me , I believe that we will find that in 1962 the Lutherin Church cintered into an agreement to purchase said property from Doyle & Sheilds, developers of.' the area , on the condition of obtaining n zoning variance to permit a church and a school to be build . The variance was granted. As a result of this action I entered into an agreem©nt to purchase: a Dome adjacent to said property from Doyle & Sheilds in Ontober, 1962, lam sure that all nay neighbors t-rho purchased on this street warp informed of the intent of the Lutheran Church in glowing terms . 'However, in 1964 ( approx) the Lutheran Church applied for a zone change on this parcel Identical to the one now before, you. At the hearing soveral oi.• my neighbors ind I appeared to voice our objections and presented a petition of dismissal , which was signed by hundreds of near by property ownors. It is interesting to note that this petition was started on the east side of Springdaln Street. It is hA for mo to believe that all of these people have changed their minas on this matter, a sn' t this a situation similar to the gasoline service station problem? Who needs i.t with others so O.ose4 ..2• I can vision the volume of trash accumulated by the nature of this proposed business , And the ants , the c( :kreetche s , and the rodents which invariably accompany such trash. My house 'zas only a 24 foot set ?pack from the rear property ling . I can also imagine the late business hours, the delivery trucks coming and going, and the increasing number of teenagers who climb my Ponce and use my yard as a tborofa-rr; rather than entering the tract: at clubhouse Lane or Meadowlark Drive .
