City Administrator's Comments Approve recommended action. 17 Xllft Statement of Issue, Recommendation, Analysis, Funding Source,Alternative Actions: STATEMENT OF ISSUE: Transmitted for your consideration is Ordinance No. 2038, an ordinance that has received its first reading by the City Council on February 2, 1976. Because of the delay for a second reading, the Attorney' s Office has recommended a new first reading of this ordinance. This ordinance is for a zone change from R2 to C4 for the property located on the north side of Ronald Road approximately 118 feet west of Beach Boulevard. RECOMMENDATION: The Planning staff is recommending that the City Council have a new first reading on Ordinance 2038 in order to finalize the subject zone change (Zone Case No. 75-10) . ANALYSIS• APPLICANT: Alan Klingensmith and James Lange 17791 Beach Boulevard Huntington Beach, California LOCATION: North side of Ronald Road, 118 feet west of Beach Boulevard. REQUEST:. A change of zone from R2 to C4 PLANNING COMMISSION ACTION ON DECEMBER 16, 1975: ON MOTION BY BAZIL AND SECOND BY PARKINSON, ZONE CASE NO. 75-10 WAS APPROVED WITH THE FOLLOWING FINDINGS AND BY THE FOLLOWING VOTE: 1 AYES: Parkinson, Bazil —Fi.nley.,_.__Slates, Shea, Boyle, Kerins NOES: None ABSENT: None �J ABSTAIN: Non PIO 3/7e 10 Page ,2 FINDINGS: 1. The close proximity of the subject site to the high traffic volume state highway indicates that the parcel ' s best use would be commercial vs . residential. 2 . The orientation of the subject site to the commercial property to the east will provide for additional commercial development alternatives, resulting in the highest and best use of the property. 3 . The general plan designation on the site is an area providing transition from residential to commercial land uses, and since commercial-related uses have been determined as the most appropriate for the site the request is in conformance with the general plan. DISCUSSION: On December 16 , 1975, the Planning Commission heard Zone Change 75-10 , a request to change the existing R2 zoning (medium density residential) to C4 (highway commercial) on the property located on the north side of Ronald Road approximately 118 feet west of Beach Boulevard. After cieneral discussion, the Planning Commission found that the requested zone change was in conformance with the City' s General Plan and that the property would much better serve the general area as commercial vs . residential . On February 2, 1976, the Planning Commission transmitted to the City Council its recommendation regarding Zone Change No. 75-10 . The City Council reviewed the Planning Commission' s action and directed the City Clerk to read Ordinance 2038 for the first time. The second reading on the subject zone case was held up in order to allow the appli- cant time to file a parcel map consolidating the subject parcel with the contiguous property to the east. Due to a number of delays, the applicant finally recorded his parcel map on October 26 , 1978 . However, the recordation of this map was not known by the staff until late 1979 . Therefore, in order to complete Zone Change No. 75-10 , the staff is recommending that the Council have a new first reading on Ordinance No. 2038. ENVIRONMENTAL STATUS: At the February 2, 1976 City Council meeting, the City Council adopted by unanimous vote Negative Declaration No. 75-79, which addressed the environmental concerns on the subject zone change. FUNDING SOURCE: Not applicable. ALTERNATIVE ACTION: The City Council may consider returning Zone Change No. 75-10 to the Planning Commission for additional review and reconsideration. Zoning, on the other hand, is a single-purpose, short range tool for implementing the General Plan. Just as it is important that the General Plan reflect the desires of the com- munity, it is equally important that zoning is consistent with the PFW intent of the General Plan. This is a matter of law as well as reason. Section 65860 (a) of the Government Code stipulates, "County or City zoning ordinances shall be consistent with the General Plan. . . " Consistency between zoning and the General Plan is not as simple as determining exactly which one zoning classification should implement a specific General Plan land use designation. Several zoning classifications may be consistent with a particular land use desig- nation depending on whether they meet the intent of the General Plan. This relationship is necessary so that zoning can implement very spe- cifically the land uses which appropriately reflect the intended character of an area as delineated in the General Plan. !W N. 101 r,c A zone is consistent with the General Plan in any specific appli- cation if the zone furthers or possessea a measure or significant degree of compatibility with the General Plan policies and programs. Determination of consistency is to •be made by reference .to the 'policies and programs of all .of the elements of the General Plan. 4. 1 Zoning Consistency with the Elements of the General Plan In practice, consistency between a zoning proposal and the General ..Plan will be determined by considering all of the policies and pro- grams of each element of the General Plan and their relationship to the proposed zoning. The. Land Use Element policies can be translated into a form suit- able for relatively easy analysis of consistency questions. Ref- erence may be made to the Zoning and Land Use .Element Matrix (Figure 4-1) to determine which zoning classifications are clearly consistent with which land use designations. If a zone is not . shown as clearly consistent with a particular land 'use designation, reference may be made to the size criteria for determining land use designations (Figure 3-15) . If the size criteria therein do not disallow the possibility of a finding of consistency, then a finding of consistency between the zone and the Land Use Element may be-made by reference to the locational criteria contained in the Land Use Element. Unlike the Land Use Element policies, the policies of the other elements of the General Plan are not easily organizable into matrix form. Consequently determination of consistency must be made through a policy by policy analysis of each element. .4. 2 Finding of Consistency A finding of consistency may only be made after analysis of the proposed zoning in terms of all nine elements of the General Plan. A finding of consistency with only one of the elements, such as the Land Use Element, is not sufficient for a finding of consis- tency with the General Plan. Gentlemen: Transmitted herewith is a copy of Resolution No 441, a resolution of the City Planning Commission recommending approval of Zone Case 441. This case proposes to amend the Master Plan of Land Use by adopting an amendment entitled "Master Plan of Land Use, Sf-udy Area III. " This plan encompasses the property within the city located generally north of Ellis Avenue, west of Goldenwest Street and south- of Bolsa Avenue and consists of 6.3 square miles . The City Planning Commission first held a public hearing on . this matter on April 21, 1964, at which time it was the concensus of the Commission to continue this matter for further study. On May 26, 1964, the Planning Commission unanimously approved Study Area III and recommended approval of Zone Case 441 to the City Council for adoption. It was the consensus of the minority of the Planning Com- mission that the entire area should be rezoned R1 for the following reasons: 1. Sphere of influence to the north, northeast, south- east, and south is Rl - low density. 2. Integrity of the R1 single family neighborhood would be degraded if the area were developed for apartment use. 3. Any plan which the potential developer has would have to be changed as a 30 ft. wide strip of land along the west side of the area in question will be used for street purposes. 4. If the zoning is approved as submitted, the intrusion of the R3 area adjacent to the R1 area is questionable "good planning". 5. As .directed by the City Council, they considered re- zoning the property from R2 to R1. It was the consensus of the Planning Commission that although the property could be developed as an R1 subdivision, the present R2 classification should not be changed for the following reasons: 1. The property is master planned for medium residential development and has been for several years. 2. The property has been zoned R2 since 1964; and, because the property is proposed for development, it is un- reasonable to rezone the property to R1. 3. An economic feasibility study of an R1 development has not been made. 4. A plot plan for the proposed apartment development will be reviewed by the Planning Commission. However, the City must formulate and adopt a master plan for the area in question and the interim zone is valid for only one year. The commercial zones provide for automobile service stations but no mention is made of "boat service stations." After discussion, it is the ,unanimous recommendation of the Planning Commission that the Council determine that marine fueling stations are similar to and not more objectionable to the other uses permitted in commercial zones and thus permit such facilities in the commercial zones. It is not the duty or the purpose of the Huntington Beach City Elementary School District to say how land should or should not be zoned, or as to what density is or is not desirable, This district believes that it does have the responsibility of pointing out to the citizens of the community what effect the various changes in density will have upon the educational system of the community and consequently upon the taxpayers of the community. On the following page we have attempted to estimate the costs at various levels of saturation on a per acre basis. Column one is the number of living units per acre. These are the densities which can be bu,lt under present zoning regulations. In column two we have taken the factor used by the State Department of Education in projecting student population. This factor in 1. 21 students per unit for kindergarten through 8th grade. Column three gives the annual operating cost. We have used the figure of $400. 00 per student. This figure is considerably under the present operating costs, but is a figure we are conscientiously working toward. In column four we are using the figure of $1, 250. 00 per student for capital investment (buildings and land. ) Our present costs for a 1000 student capacity school is approximately $1, 250, 000. 00.
