PROJECT PROPOSAL Applicant: City of Huntington Beach, 2000 Main Street, Huntington Beach, CA 92648 Location` - City-wide-Residential Zoning Districts (RL, RM, RMH, RH and RMP) Zoning Text Amendment No. 06-05 proposes to allow Large-family Day Care uses in all residential zones (RL, RM, RMH, RH and RMP) with an Administrative Permit (Neighborhood Notification: 300-foot radius) and no applicable fee. Additionally, the Huntington Beach Zoning and Subdivision Ordinance will be amended so that applicants will not be required to submit architectural plans as part of the application process. Specifically, Section 210.04 of the HBZSO is being amended by adding an "L-6" for Large- family Day Care uses on the Land Use Controls Table (Page 2 of the Legislative Draft and Ordinance). The "L-6 is explained in Additional Provisions (Page 3 of the Legislative Draft and Ordinance) which spells out the neighborhood notification process and that no architectural plans are required. B. BACKGROUND On May 1, 2006, the City Council discussed the issue of eliminating the Conditional Use Permit (CUP) requirement for Large-family Day Care uses (7-12 children) in residential -2 12/5/2006 10:38 AM REQUEST FOR CITY COUNCIL ACTION MEETING DATE: 12/18/2006 DEPARTMENT ID NUMBER: PL06-29 zoning districts. Consideration of eliminating the CUP requirement was brought up due to the costs associated with applying for a CUP. After discussion of the issue, the City Council directed staff to further review the subject and present options for the City Council's consideration. _ It should be noted that there are no zoning requirements for Small-family Day Care uses (up to 6 children). At the June 5, 2006 City Council meeting, a motion was approved to direct staff to initiate a Zoning Text Amendment amending the Huntington Beach Zoning and Subdivision- Ordinance so that Large-family Day Care uses are permitted in residential zoning districts with an Administrative Permit (Neighborhood Notification: 300-foot radius) with no applicable fee or architectural plans required. C. PLANNING COMMISSION MEETING On October 10, 2006, the Planning Commission held a study session to review the proposed zoning text amendment. The Planning Commission public hearing was held on November 14, 2006, at which time Zoning Text Amendment No. 06-05 was approved. One person spoke in favor of the item. The Planning Commission discussed the intent and purpose of the Zoning Text Amendment D. STAFF ANALYSIS AND RECOMMENDATION Currently, a Large-family Day Care, allowing up to 12 children plus two additional children if they are over the age of six and reside in the home, requires a CUP from the Zoning Administrator. The fee for this type of CUP is $3,568. The process generally takes about 2-3 months and requires a 500-foot radius notification and a public hearing. Additionally, the `California State Department of Social Services, Community Care Licensing Division regulates the licensing of these uses. In comparison with other Orange County cities, the City of Huntington Beach has one of the highest zoning entitlement fees for large-family day care uses according to a -survey conducted by the Orange County United Way Local Investment In Child Care (LINCC) Project (Attachment No. 3). The survey also indicates that there is a greater need for childcare in the City of Huntington Beach than is currently being met. Because the costly CUP process may deter a potential large-family day care operator from applying to provide childcare services in the City, a no-fee Administrative Permit is being proposed. PowerPoint Presentation -4- 12/6/2006 2:13 PM ATTACHMENT NO. 1 FINDINGS FOR APPROVAL ZONING TEXT AMENDMENT NO.06-05 FINDINGS FOR PROJECTS EXEMPT FROM CEQA: The Planning Commission`finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to City Council Resolution No. 4501, Class 20, which supplements the California Environmental Quality Act. The project is exempt because it involves an amendment to the Huntington Beach Zoning and Subdivision Ordinance that does not change the intensity or density of the affected districts. FINDINGS FOR APPROVAL-ZONING TEXT AMENDMENT NO. 06-05: 1. Zoning Text Amendment No. 06-05 to permit large family day care uses with a no-fee administrative permit is consistent with the goals, objectives and policies of the General Plan. The General Plan Land Use 'Element calls for the inclusion of service uses that support the resident needs within residential neighborhoods. Elimination of the CUP requirement for large family day care will create more opportunities for large family day care operators to offer childcare services in the City that may have been deterred in the past due to the costly CUP application fees. ZTA No.-06-05 provides for the further accommodation of community-serving uses in residential neighborhoods as stated in the policies of the General Plan Land Use Element. 2. In the case of general'land use provisions, the zoning text amendment is consistent with the uses authorized in, and the standards prescribed for, the zoning district for which it is proposed. ZTA No. 06-05 proposes to amend Chapter 210.04 of the'HBZSO by eliminating the CUP requirement for large family day cares and instead requiring a no-fee administrative permit. This will allow for a planning review and approval but does not place'the burden of expensive entitlement fees' on a potential childcare provider. 'ZTA No. 06-05 does not propose to change existing land use designations and is consistent with the uses permitted in Chapter 210.04 of the HBZSO in that large family day cares will still be permitted in residential zoning districts but will no longer require a CUP in order to obtain approval., 3. A community need is demonstrated for the proposed zoning text amendment. The City of Huntington Beach has one of the highest zoning entitlement fees for large family day care homes in Orange County. There is also a need for more childcare services in the City. -ZTA No. 06-05 proposes to eliminate the CUP requirement and implement a no-fee administrative permit, thereby reducing the costly entitlement fees and shortening the application;processing time. The simplified process will allow potential childcare providers to better serve the needs of the community. ATTACHMENT NO. 1.1 4. The adoption of ZTA No. 06-05 will be in conformity with public convenience, general welfare and good zoning practice. ZTA No. 06-05 will lessen the land use controls for large family daycare uses and make it easier for operators to obtain approvals. The proposed zoning text amendment will enable childcare providers to obtain permits with less restrictions butstill allow for planning approval to ensure that proposed` large family day care homes will not significantly impact the surrounding properties and be compatible with the adjacent residential uses. After discussion of the issue, the City Council directed staff to further review the subject and present options for the City Council's consideration. It should be noted that there are no zoning:requirements for Small Family Day Care uses (up to 6 children). At the June 5, 2006 City Council meeting, a motion was approved to direct staff to initiate a Zoning Text Amendment amending the Huntington Beach Zoning and Subdivision Ordinance so that large family day care uses are permitted in residential zoning districts with an Administrative Permit (Neighborhood Notification: 300-foot radius) with no applicable fee or architectural plans required. The fee for this type of CUP is $3,568. The process generally takes about 2-3 months and requires a 500-foot radius notification and a public hearing. Additionally, the California State Department of Social Services, Community Care Licensing Division, regulates the licensing of these uses. In comparison with other Orange County cities, the City of Huntington Beach has one of the highest zoning entitlement fees for large family day care uses according to a survey conducted by the Orange County United Way Local Investment In Child Care (LINCC) Project (Attachment No. 4). The survey also indicates that there is a greater need for childcare in the City of Huntington Beach than is currently being met. Because the costly CUP process may deter a potential large family day care operator from applying to provide childcare services in the City, a no-fee administrative permit is being proposed. The state of California has made clear its desire to promote child care within its borders and has noted that, "affordable,quality licensed child care is critical to the well-being of parents and children in this state."' Additionally, the state legislature has found that ".many parents prefer child day care located in their neighborhoods in family homes"2 which are "conducive to healthy and safe development."3 The Public Law Center believes that the city's proposal goes a long way in implementing these policy objectives. Specifically,by streamlining the permit application process and by waiving the permit fee,the proposal provides for adequate protection of city interests and at the same time minimizes the burden on providers. We commend the city for its consideration of this important issue and encourage the City Council to adopt zoning code modifications that promote child care within the city. Nevertheless, we would like to bring to your attention three areas of non-compliance with state law in the hope that minor amendments can be made to facilitate the proposal's implementation. 1. Definition of a Large Family Day Care Home The first area of non-compliance is the definition of a large family day care home. Huntington Beach defines "Large-Family Day Care" as "[n]on-medical care and supervision for 7 to 12 persons, or up to 14 persons if two of the persons are six years of age or older on a less than 24- hour basis. Children under the age of 10 years who reside in the home shall be counted for purposes of these limits."4 This definition can be found under the heading"Public and Semipublic Use Classifications" in the city's zoning code. While this definition is mostly compliant with state law, there are some minor problems. I encourage the council members to review Sections 1596.78(b) and 1597.465 of the California Health& Safety Code,which explain the state licensing definition. Additionally,I encourage city staff to reference large family day care as serving 7-14 children as opposed to 7-12, as used in the agenda and request for city council action, to fully incorporate the 1996 state law amendments. Il. _ Conditions,of PermitAp r� oval Additionally, the city should clarify the conditions upon which the permit may be approved or denied. State law limits local restrictions on large family day care homes to "reasonable" standards, restrictions,or requirements addressing only(1) spacing and concentration, (2)traffic control, (3)parking, and (4) noise control.5 Local restrictions that are unreasonable or unrelated to those four factors are not permitted under state law. The Huntington Beach Zoning and Subdivision Code does not include any of these standards, restrictions, or requirements. Nevertheless, the city can and does consider these four areas when deciding whether to grant a permit. For example, the city has required that people coming to a home for the purpose of utilizing day care services only park in the driveway or along the curb in front of the provider's house.6 Thus, it is important for the city's code to ensure that a permit application will only be conditioned on compliance with these four areas and to ensure that any conditions will be reasonable, III. Neighborhood Notification The third issue I would like to address is the neighborhood notification required under the proposal. I encourage the city to amend its proposal to make the permit compliant with Section 1597.46(a)(2) of the Health and Safety Code. This provision allows a city to require a permit,but to grant it without neighborhood notification or a public hearing.' This process guarantees that the permit will be granted if the large family day care home complies with reasonable local ordinances meeting the four acceptable criteria described above and any regulations adopted by the State Fire Marshal. By amending the permit process to a 1597.46(a)(2)process, multiple interests will be served. This type of permit will achieve the city's goals of enabling child care providers to obtain permits in a fast and cost-efficient manner and will save the city time and much needed funds by further streamlining the process: However, if Huntington Beach wishes to retain a permit process under Section 1597.46(a)(3) of the Health and Safety Code, which requires neighbor notification,8 Huntington Beach should adopt a zoning code provision specific to large family child care as opposed to using the general section 241.24. State law mandates specialized law for large family child care home permits, including notice to all property owners within a 100 foot radius of the exterior boundaries,rather than,the 300 feet provided in Section 241.24. Additionally, as mentioned above,the notice should specifically instruct neighbors that the city can only consider reasonable restrictions in the four areas mentioned earlier. Finally, the ordinance should make clear that a public hearing should be scheduled only if the applicant or another affected person requests one.
