If any term, covenant or condition of this Lease or the application thereof to any person or circumstance shall, to any extent, be invalid or unenforceable, the remainder of this Lease, or the application of such tcrm, covenant or condition to persons or circumstances other than those as to which it is held invalid or unenforceable, shall not be affected thereby and each term, covenant or condition of this Lease shall be valid and be in force to thc fullest extent permitted by law. 17.14Financial Statements. If Landlord desires to finance, refmance or sell the Property, or any portion thereof, Tenant hereby agjees to deliver to any lender or purchaser designated by Landlord, such current financial statements of the Tenant as may be reasonably available to Tenant. All such financial statements shall be received by Landlord, such lender and/or purchaser in confidence and shall be used only forthc purposes herein sct forth. 17.15Authorit of Tenant. Inthe event that Tenant is a limited liability company, corporation or a partnership, each individualexecuting this Lease on behalf of said limited liabilitycompany, corporation or partnership represents and warrants that he is duly authorized to execute and deliver this Lease on behalf of said entity, in accordance with the governing documents of said limited liability company, corporation, or said partnership, and that this Lease is binding upon said entity. 17.16Capped Well. Tenant acknowledges that there is a capped oil well on the Property. Such capped oil well is no longer in use and is evidenced by a vent on the Property, near the center of the Property. Tenant, and Tenant's employees, contractors, agcnts and invitees, shall not touch, disturb, manipulate, tamper with or otherwise handle any portion of the capped oil well, including but not limited to, the vent pipe or the area surrounding it. 17.17 Survival. All provisions dealing with such matters as indemnification, attorney's fees and obligations and remedies after a default or after termination shall survive the termination of this Agreement.
