(c) Dogs in the care, custody and control of nonresidents who are traveling through the city, or
temporarily staying in the city for a period not exceeding thirty (30) days, or dogs temporarily
brought into the city for the exclusive purpose of being entered in a bench show or dog
exhibition,provided such dogs are so entered and not kept elsewhere in the city;
(d) Dogs under the care, custody or control of, or owned by senior citizens remain obligated to
license their dog(s) regardless of the license fee exemption, and they shall be obligated to pay

(e)Therapy dogs.
7.08.080 License--Shown to license inspector. No person shall fail or refuse to show to the City
Animal License Inspector or any police officer, the license and the tag for any duly registered dog
kept or remaining in any home or upon any enclosed premises under his immediate control. A
violation of this section is an INFRACTION, and upon conviction thereof shall be punishable by

7.08.090 Removal of tags and collars. No unauthorized person shall remove from any dog or cat
any collar, harness, or other device to which is attached a registration tag for the current year or
to remove such tag therefrom. A violation of this section is an INFRACTION, and upon a
conviction thereof shall be punishable by a fine not to exceed one hundred dollars ($100).

7.08.100 Counterfeiting tags. No person shall imitate or counterfeit the tags in this chapter
provided for, or shall use any imitation or counterfeit of such tag. (885-1/62, 1279-2/67, 1905-3/74,

7.08.110 License--Vaccination certificate. Every person applying for a dog license must exhibit
a certificate issued by a person licensed by the state to practice veterinary medicine,which
certificate shall show that the dog for which the license shall be issued, either has been
vaccinated in accordance with the provisions of the ordinance of the county of Orange, or should
not be so vaccinated by reason of age, infirmity or other disability. Such exemption shall be
valid for a period not to exceed one (1) year. A license for any dog shall not be issued unless and

7.08.120 Guard dog registration.
(a) No person owning, having custody, charge, control or possession of a dog bred or trained
formally to attack shall fail to register such animal as a guard dog by so indicating in the
space provided on the animal license form.
(b) No person owning, having custody, charge, control or possession of a guard dog on
nonresidential property shall fail to post signs of sufficient size and design on his premises
giving adequate notice and warning to the public of the presence of such guard dog.
(c) Any person owning, having custody, charge, control or possession of a guard dog who fails or
refuses to comply with any provision of this section, and who causes,permits or allows such
guard dog to harm or injure any city employee while acting within the scope of his official
duties, shall be guilty of a MISDEMEANOR, and upon conviction thereof shall be punished
by a fine of$500 or six (6)months in the county jail, or by both such fine and imprisonment,
and each day or portion thereof such person fails or refuses to comply with the provisions of
this section shall be deemed a separate offense, and shall be punishable as provided herein.

In Orange County all dogs over the age of four (4) months are required by law to be licensed and vaccinated
against rabies. Residents owning or having custody of any dog must license the dog within 15 days of
acquisition or within 15 days after the license becomes due. Residents must provide proof of a California
approved rabies vaccination to obtain a license (OCCO 4-1-70). Failure to comply with the above time
frames will result in a late fee of$32.00.

Communication from Councilmembers Cathy Green and Joe Carchio transmitting the following
Statement of Issue: Since 2002 the Bakersfield City Council has displayed the national motto
that appears on all United States currency, "In God We Trust," in their City Council Chambers.
Recently we received a request from Bakersfield City Councilmember Jacquie Sullivan
encouraging Huntington Beach along with other cities to join the 30 California cities that now
proudly display this national motto in their chambers. To that end, we would like to recommend
the following:
Recommended Action: Motion to:
1. Approve in concept a display of the motto, "In God We Trust," in the City
Council Chambers.
2. Appoint an Ad Hoc Council Committee to return in a timely fashion with
recommendations on the appearance and location of the display.
Councilmember Green expressed interest in serving on this ad hoc committee.
Attached (in the agenda packet) is information from Bakersfield Councilmember Sullivan. It
includes a list of the cities and photos of some of the displays as well as some legal background
on such displays.

On February 4, 2008, the City Council directed staff to amend chapter 7.08 of the Huntington
Beach Municipal Code relating to the licensing provisions of dogs and cats and adding the
requirement to display a business license number in any advertisement that offers dogs or
cats for adoption, sale, barter, or other transfer of ownership.

Analysis:
The proposed ordinance amends Chapter 7.08 of the City of Huntington Beach Municipal
Code (HBMC) relating to licensing provisions for dogs and cats. If the City Council adopts
this ordinance, the licensing fees Huntington Beach residents pay will be as established by
the County of Orange Animal Care Services. A copy of the current County Fees is attached.
The proposed amendment would also require any person advertising to the public the
availability of any dog or cat for adoption, sale, barter, or other transfer to display a business
license number in the advertisement and to provide a business license number to any
person adopting or purchasing a dog or cat that is bred in the City of Huntington Beach.

Education of the community regarding opportunities to become involved in reducing
pet overpopulation through incentive based licensing fees and requiring any person

number to any person adopting or purchasing a dog or cat that is bred in the City of
Huntington Beach.
City Services
The proposed program would improve the level of service provided to the City of
Huntington Beach by reducing the number of adoptable pets euthanized and the
number of pets picked up as strays by OCACS.

AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING CHAPTER 7.08 OF THE HUNTINGTON BEACH MUNICIPAL
CODE RELATING TO LICENSING PROVISIONS FOR DOGS
The City Council of the City of Huntington Beach does hereby ordain as follows:
SECTION 1. Section 7.08.010 of the Huntington Beach Municipal Code is hereby
amended to read as follows: .
7.08.010 License and registration required. No person owning, having an interest in, or having
control, custody or possession of any dog shall fail, neglect or refuse to license and register such
dog if over six (6) months of age in compliance with the terms of this chapter. A violation of
this section is an INFRACTION, and upon a conviction thereof shall be punishable by a fine not

SECTION 2. Section 7.08.030 of the Huntington Beach Municipal Code is hereby
deleted in its entirety.
SECTION 3. Section 7.08.050 of the Huntington Beach Municipal Code is hereby
amended to read as follows:
7.08.050 License--Owner duty to obtain. Any owner, with the exceptions herein provided, of a
dog over the age of six (6) months in the city shall obtain a license and pay an original or
renewal license fee as established by the County of Orange Animal Care Services on or before
the effective date of this section and July 1 of each year thereafter.
The license fee shall beas established by the County of Orange Animal Care Services.
Except that the license fee shall be one-half(1/2) the regular fee for the following:
(a) Any owner of a dog establishing residence in the city after December 31 of any year;
(b) Any owner of a dog acquired after December 31 of any year;
(c) Any owner of a dog which had not reached the age of six (6) months by December 31 of a
year.
Original license fees shall be due and payable within thirty (30) days after any dog is acquired
and comes into the care, custody and control of any person in the city. (885-1/62,

SECTION 4. Section 7.08.060 of the Huntington Beach Municipal Code is hereby
amended to read as follows:

7.08.060 License--Penalty fees. Any person who fails to pay the required dog license fee prior
to August 1 each year, shall pay, in addition to the license fee, a penalty fee as set forth by the
County of Orange Animal Care Services.
Any person who fails to obtain an original license within thirty (30) days after his/her owning
any dog or any dog coming into his/her care, custody and control in this city shall pay in addition
to the original license fee, a penalty fee as set forth by the County of Orange Animal Care

SECTION 5. Section 7.08.070 of the Huntington Beach Municipal Code is hereby
amended to read as follows:
7.08.070 License--Exempted animals. No license fee shall be required for the following:
(a) Seeing-eye dogs;
(b) Dogs honorably discharged from the armed forces of the United States;
(c) Dogs in the care, custody and control of nonresidents who are traveling through the city, or
temporarily staying in the city for a period not exceeding thirty (30) days, or dogs
temporarily brought into the city for the exclusive purpose of being entered in a bench show
or dog exhibition,provided such dogs are so entered and not kept elsewhere in the city;
(d) Dogs under the care, custody or control of, or owned by senior citizens remain obligated to
license their dog(s) regardless of the license fee exemption, and they shall be obligated to pay

SECTION 6. This ordinance shall become effective 30 days after its adoption.

7.08.020 License--Transferability. No dog license is transferable, except in the following
circumstances:
(a) Upon payment of a two dollar($2) fee, a new license may be issued to a new owner of a dog
that was previously licensed by the city when said license is still current.
(b) Upon payment of a two dollar($2) fee, a new resident of the city may be issued a new license
for his dog in the following circumstances:
(i) The dog was previously licensed in another jurisdiction and said license is current and
valid through June 30 following the date of application;
(ii) Said previous license is presented for cancellation; and
(iii)The owner presents a valid rabies inoculation certificate which is effective through June
30 following the date of application.
Any new license issued pursuant to this section shall be renewed pursuant to section 7.08.050 of

(a) A metallic tag or other means of permanent identification, such as tattooing, and license

The City Council of the City of Huntington Beach does hereeb ordain as follows:
SECTION 1. Section 7.08.010 of the Huntington Beae'h Municipal Code is hereby
amended to read as follows:
7.08.010 License and registration required. No person owning, having an interest in, or having
control, custody or possession of any dog or cat shall fail, leglect or refuse to license and register
such dog or cat if over six (6) months of age in comp}-lance with the terms of this chapter. A
violation of this section is an INFRACTION, and upon a conviction thereof shall be punishable

or cat that was previously licensed by the city when said license is still current.

7.08.120 Guard dog registration.
(a) No person owning, having'custody, charge, control or possession of a dog bred or trained
formally to attack shall fail to register such animal as a guard dog by so indicating in the
space provided on the Aimal license form.
(b) No person owning, having custody, charge, control or possession of a guard dog on
nonresidential property shall fail to post signs of sufficient size and design on his premises
giving adequate notice and warning to the public of the presence of such guard dog.
(c) Any person owning, having custody, charge, control or possession of a guard dog who fails or
refuses to comply with any provision of this section, and who causes,permits or allows such
guard dog to harm or injure any city employee while acting within the scope of his official
duties, shall be guilty of a MISDEMEANOR, and upon conviction thereof shall be punished
by a fine of 9500 or six (6)months in the county jail, or by both such fine and imprisonment,
and each day, or portion thereof such person fails or refuse to provisions of

7.08.010 License and registration required. No person owning, having an interest in, or having
control, custody or possession of any dog/shall fail, neglect or refuse to license and register such

7.08.020 License--Transferability/No dog license is transferable, except in the following
circumstances:
(a) Upon payment of a two dollar($2) fee, a new license may be issued to a new owner of a dog
that was previously licensed by the city when said license is still current.
(b) Upon payment of a two'dollar($2) fee, a new resident of the city may be issued a new license
for his dog in the following circumstances:
(i) The dog was previously licensed in another jurisdiction and said license is current and
valid through June 30 following the date of application;
ii Said previous license is resented for cancellation; and

(iii)The owner presents a valid rabies inoculation certificate which is effective through June
30 following the date of application.
Any new license issued pursuant to this section shall be renewed pursuant to section 7.08.050 of

7.08.040 License--Tags, certificates issued.
(a) A metallic tag or other means of permanent identification, such as ta/Aimal

exhibition,provided such dogs are so entered and not kept elsewhere in the city;
(d) Dogs under the care, custody or control of, or owned by senior citizens remain obligated to
license their dog(s)regardless of the license fee exemption, and they shall be obligated to pay

(e)Therapy dogs.
7.08.080 License--Shown to license inspector. No person shall fail or refuse to show to the City
Animal License Inspector or any police officer,the license and the tag for any duly registered dog
kept or remaining in any home or upon any enclosed premises under his immediate control. A
violation of this section is an INFRACTION, and upon conviction thereof shall be punishable by

7.08.090 Removal of tags and collars. No unauthorized person shall remove from any dog or cat
any collar,harness, or other device to which is attached a registration tag for the current year or
to remove such tag therefrom. A violation of this section is an INFRACTION, and upon a
conviction thereof shall be punishable by a fine not to exceed one hundred dollars ($100).

7.08.100 Counterfeiting tags. No person shall imitate or counterfeit the tags in this chapter

7.08.110 License--Vaccination certificate. Every person applying for a dog license must exhibit
a certificate issued by a person licensed by the state to practice veterinary medicine, which
certificate shall show that the dog for which the license shall be issued, either has been
vaccinated in accordance with the provisions of the ordinance of the county of Orange, or should
not be so vaccinated by reason of age, infirmity or other disability. Such exemption shall be
valid for a period not to exceed one (1)year. A license for any dog shall not be issued unless and

7.08.120 Guard dofz registration.
(a) No'person owning, having custody, charge, control or possession of a dog bred or trained
formally to attack shall fail to register such animal as a guard dog by so indicating in the
space provided on the animal license form.
(b) No person owning, having custody, charge, control or possession of a guard dog on
nonresidential property shall fail to post signs of sufficient size and design on his premises
giving adequate notice and warning to the public of the presence of such guard dog.
(c) Any person owning, having custody, charge, control or possession of a guard dog who fails or
refuses to comply with any provision of this section, and who causes, permits or allows such
guard dog to harm or injure any city employee while acting within the scope of his official
duties, shall be guilty of a MISDEMEANOR, and upon conviction thereof shall be punished
by a fine of$500 or six (6)months in the county jail, or by both such fine and imprisonment,
and each day or portion thereof such person fails or refuses to comply with the provisions of
this section shall be deemed a separate offense, and shall be punishable as provided herein.

The City Council of the City of Huntington Beach does hereby ordain a follows:
SECTION 1. Section 7.08.010 of the Huntington Beach Municipal Code is hereby
amended to read as follows:
7.08.010 License and registration required. No person owning, having n interest in, or having
control, custody or possession of any dog or cat shall fail, neglect or re se to license and register

Attention Huntington Beach City Council Members:
I deeply object to any drafted ordinance that bans the advertisement of any dog
or cat for sale or transfer, unless the seller(or transfer) posts a Huntington Beach
City business license number in the ad. If you have followed the ads for animals
in the Wave,there are few, if any ads from sellers in Huntington Beach. This is
just another unfair nanny ordinance aimed at discriminating against pet owners
and taking away their rights. Why are business license numbers not required to
be posted in advertisements for people having garage sales, estate sales,
jewelry sales, furniture sales etc.... It just doesn't make sense to continually treat
the responsible Huntington Beach pet owning community unfairly!
I strongly urge you not to support such an unfair ordinance which discriminates
against the pet owning community. Surely you people must be able to find

I vehemently oppose the draft resolution No 2008=5 for the proposed Spay,Neuter, and,
11Zicrochip(SN)ti}Chdinance No. 3798 and urge the ma}or and all council members to.
reject it. The drafted resolution is not what was agreed on by the council on November'5.
2007. The council agreed to drop the ordinance and raise license fees instead. The
current voluntarti'licensing for cats would chance to become required licensing for cats.
License fees would be increased, using a tiered scale with fee reductions for spay, neuter,
and;or microchips. Advertisements for dogs and cats in the Wave were also discussed.
7.08.121 Spay and neutering of dogs and cats
The drafted resolution contradicts the council's agreement to drop the mandatory Spay
and Neuter proposed ordinance. The draft continues to mandate spay and neutering for
all dogs and cats over six months of age.
The draft states: ";\%o person may own, keep, or harbor a dog or cat
over the age of six months in violation of this section
unless such.person pays unaltered animal fee as set forth
by resolution<f the City Council or qualifies for an
exemption under Section ^08.0"0 of this chapter."
7.08.122 Microchip identification of dogs and cats
The drafted resolution contradicts the council's agreement to drop the mandatory
microchip proposed ordinance_ The draft continues to mandate microchips.
The draft states: ",a'o person may own, keep, or harbor a dog or cat
over the age of six months that does not have a
microchip identification device_"
�� 7,08.010 License and registration required
Councilman Bohr suggested an addition to the resolution to include the requirement for a
business license for newspaper advertisements in the Wave for the sale ofpuppiesrdogs_
and kittens cats. I oppose this requirement as it is discriminatory. If a business license is
required for advertisements in the Wave, then it should apply to all ads"for sale' posted
in the Wave, such as merchandise, garage'sales, etc. :also, the resolution does not specifti-
ads in the Wave, but instead suggests: any and all public advertisements
for the availability of any dog or cat for adoption, sale, barter
or other transfer must prominently display the business license number in
the advertisement. "
7.08.050 License—Owner duty to obtain
The fee schedule is unrealistic and will likely prevent most owners from licensing at all.
Statistics for Huntington Beach dogs euthanized due to shelter overcrowding do not
support the need for a mandated ordinance. I firmly oppose any mandated spay, neuter,
or microchip ordinance. Furthermore. I oppose any discriminatory legislation. I urge .
you to reject the drafted resolution, and stick to.your agreement. Too much time and tax
payer dollars have been Masted on this unnecessary proposal already_

The City Council rejected Keith Bohr.'s ordinance to mandate the castration hysterectomy
micro-chipping of all dogs and cats i.n the city. Mayor Debbie Cook with the council
then decided that we should abandon the Bohr ordinance and add a.tiered licensing
system to what already existed. as a tier system; however when staff was directed to come
up with the new ordinance they set the fees so high (over $200 for an unaltered pet) that it
was so invasive of our pocketbooks the whole council conceded it was not good.
Now Mayor Cook's new idea: that council will direct all decisions for licensing
"As Set forth by the Orange County Animal Control Services" Section
7.08.050 and 7.08.060 and abandon our citizens to the Orange County Anitnal Control
Services and OC Board of Supervisors who are not responsible to our citizens. This is
taxation without representation in its simplest form.
Additionally, Mayor Cook and council now demands the following Proposed new City
Ordinance Section 7.08.010 change.
"any person in the city that wishes to advertise the availability of any dog or
cat for adoption, sale, barter, or other transfer must prominently display
their business license number in the advertisement. The license number
shall also be provided to any person adopting or purchasing any dog or cat

Honorable Mayor Cooly and honorable councilmembers:
I urge you to vote NO on proposed ordinance 3800.On February 4,2008,the City
Council voted 6-0 against proposed ordinance 3798. Each of you who voted against the
exorbitant fee schedule proposed in 3798 on February 0 should vote against the new proposal in
3800 for exactly the same reason.The problem with 3798 was that the high fees set for licensing
unaltered dogs and cat would have amounted to a de facto mandatory spay and neuter
requirement due simply to the cost of owning an unaltered pet.The new proposal shifts the
responsibility for SETTING THE FEES for unaltered dogs and cats from the City Council to
Orange County Animal Care Services. This is extremely dangerous. If this passes,Keith Bohr
and his animal rights activist friends will be able to accomplish their goal of imposing de facto
mandatory spaying and neutering of our pets by simply going to OCACS and getting the fees
charged for unaltered dogs and cats raised there. The proposed changes to Huntington Beach
Municipal Code sections 7.08.050 and 7.08.060 would be a disaster for pet owners in Huntington
Beach.
Additionally,the proposed changes in the above-mentioned sections would set a bad
precedent of allowing local fees charged to Huntington Beach Residents to be set at the county
level. ShiRung the process for setting fees to the OCACS places the responsibility for managing a
local issue to a more remote government agency where there is little opportunity for public input
and virtually no accountability to the residents of Huntington Beach.The city would not give the
slightest consideration to a proposal to shift the responsibility of setting the city fees for building
permits,annual beach parking passes,or business licenses to the county or state government.
You should not do so with the unaltered dog and cat license fees either.
Another section of the proposed ordinance requires advertisers of pets to include a
business license in the ad. While this section of the proposal is unacceptable and if passed would

be unenforceable and fail under a first amendment lawsuit,it is a red herring intended to draw

OPPOSITION to giving the Orange County Animal Control Services control
of Our city's pets and their licensing.
The City Council rejected Keith Bohr's ordinance to mandate the castration hysterectomy
micro-chipping of all dogs and cats in the city. Mayor Debbie Cook with the council
then decided that we should abandon the Bohr ordinance and add a tiered licensing
system to what already existed as a tier system; however when staff was directed to come
up with the new ordinance they set the fees so high (over$200 for an unaltered pet)that it
was so invasive of our pocketbooks the whole council conceded it was not good.
Now Mayor Cook's new idea: that council will direct all decisions for licensing
"As Set forth by the Orange County Animal Control Services"Section
7.08.050 and 7.08.060 and abandon our citizens to the Orange County Animal Control
Services and OC Board of Supervisors who are not responsible to our citizens. This is
taxation without representation in its simplest form.
Additionally, Mayor Cook and council now demands the following Proposed new City
Ordinance Section 7.08.010 change.
"any person in the city that wishes to advertise the availability of*any dog or
cat for adoption, sale, barter, or other transfer must prominently display
their business license number in the advertisement The license number

Honorable Mayor and Council Members:
OPPOSITION to giving the Orange County Animal Control Services control
of our city's pets and their licensing.
The City Council rejected Keith Bohr's ordinance to mandate the castration hysterectomy
micro-chipping of all dogs and cats in the city. Mayor Debbie Cook with the council
then decided that we should abandon the Bohr ordinance and add a tiered licensing
system to what already existed as a tier system; however when staff was directed to come
up with the new ordinance they set the fees so high(over$200 for an unaltered pet) that it
was so invasive of our pocketbooks the whole council conceded it was not good.
Now Mayor Cook's new idea: that council will direct all decisions for licensing
"As Set forth by the Orange County Animal Control Services"Section
7.08.050 and 7.08.060 and abandon our citizens to the Orange County Animal Control
Services and OC Board of Supervisors who are not responsible to our citizens. This is
taxation without representation in its simplest form.
Additionally, Mayor Cook and council now demands the following Proposed new City
Ordinance Section 7.08.010 change.
"any person in the city that wishes to advertise the availability of any dog or
cat for adoption, sale, barter, or other transfer must prominently display
their business license number in the advertisement. The license number
shall also be provided to any person adopting or purchasing any dog or cat
that is bred in the City of Huntington Beach"
I the undersigned am a registered voter and taxpaying citizen, I respectfully ask that these
changes to our Municipal Code relating to licensing and sale of dogs and cats be withdrawn or
defeated. I ask that you vote NO when this is presented. The control of our animals should
never be assigned to the County we are a city and the control of our ordinances should remain in
the city; and, since there are no commercial kennels in Huntington Beach we don't need to get

Dear Council members.
I urge you to OPPOSE Item G-la - Spay/Neuter/Microchip Ordinance.
This unenforceable ordinance if BEGGING for litigation which is SURE TO FOLLOW.
It is a direct frontal attack on property rights which you have sworn to protect.
The unintended consequences are numerous.
It is morally bankrupt to allow outside interests to set the council's agenda.
This action will do nothing to address irresponsible pet owners who will continue to be
irresponsible
pet owners and serves only to create new criminals out of otherwise LAW ABIDING
CITIZENS.
It will not have any effect on reducing the number of unwanted pets.
I urge you to vote NO on G-1a.
P.S.
Save our Strays does NOT HAVE A [BUSINESS LICENCE.
We are subsidising Save our strays $50,000 per year.
Save our strays office is located in a tiny upstairs apartment
in downtown HB. Attached it a picture of Save Our Strays Headquarters.
It appears taxpayers have been subsidising someone's apartment accommodation.
Is this where they are performing spay / neuter operations? Is this area zoned
for their activities?
In any case, keeping animals locked in a hot upstairs apartment is cruel
to say the least.
Funding SOS was a bad mistake.
Please don't jump the gun and make another bad mistake with G-1a.
I urge you to vote NO on G-1a.
