f STATEMENT OF ISSUE
There is a need for City Council to establish a policy regarding permitting local
service clubs to operate beer booths on the Fourth of July Parade route.
RECOMMENDATION
Establish a policy that beer booths not be allowed on the Fourth of July Parade
route.
ANALYSIS
For the past several years, the Lion's Club of Huntington Beach has operated two
beer booths on the Fourth of July along the parade route from 8:00 a.m. to 12:00
noon. These beer booths are a major fund-raiser for the Lion's Club and have
been permitted with a one -day ABC permit.
Following the trouble associated with alcohol consumption at various parties
downtown last year on the Fourth of July, the Downtown Residents Association
is requesting that the city establish a policy of no open sale of beer on the parade
route during the Fourth of July parade. It is the association's contention that al-
cohol consumption is hard enough to control from just the sale points of markets
and liquor stores and that outdoor beer booths add to the "party" atmosphere and
serve to encourage alcohol consumption on the Fourth of July.
The Lion's Club has agreed to tighten control and regulation of the beer booths so
that no minors can buy alcohol and that all customers are limited to a maximum
number of beers they can purchase. In addition, the beer must be consumed
within the beer garden area around the booth.

Past city policy has focused on the issue that providing controlled areas for beer
consumption and socialization is better than unsupervised beer drinking along
the parade route. The Downtown Residents Association, however, disagrees with
this philosophy and believes the city should set an example that open alcohol
consumption on the Fourth of July will not be tolerated.
The Lion's Club beer booths have been so popular in the past and provide a major
source of the club's revenue for charities. If Council wishes to allow them to con-
tinue, staff is recommending permitting the activity subject to a temporary condi-
tional use permit issued after review of the application by the Zoning Administra-
tor. The Lion's Club would first obtain an ABC one -day alcohol permit before the
Zoning Administrator would review the application and issue a temporary CUP.

ALTERNATIVE ACTION
Adopt a City Council policy that would allow the beer booths along the Fourth of
July Parade route and instruct the Zoning Administrator to review all requests
for such temporary conditional use permits.
