Flynn, CMC, City Clerk SUBJECT: Approve for Introduction Ordinance No. 4009 thereby adding sections2.07.155, 2.07.165 and 2.07.175 to the Huntington Beach Municipal Code to require electronic filing of campaign statements and reports, approving electronic signatures, and ensuring filing procedures are in accordance with Government Code Section 84615 Statement of Issue: The City Council is being asked to approve an ordinance that requires all elected officers, candidates, committees, or other persons required to file campaign disclosure documentation, to file the information electronically through NetFile, the City's web-hosted and state-approved filing application. Financial Impact: Annual use and maintenance agreement included in the FY 2013/2014 budget. Recommended Action: Approve for Introduction Ordinance No. 4009 "An Ordinance of the City of Huntington Beach Amending Chapter 2.07 of the Huntington Beach Municipal Code Relating to Campaign Reform." Alternative Action(s): Do not introduce Ordinance No. 4009 Analysis: In 2008 the City entered into a contract with NetFile to develop and maintain an Electronic Filing (E- File) system that permits the City of Huntington Beach and authorized users to file Fair Political Practices Commission (FPPC) Campaign Disclosure forms electronically. The E-filing and administrative system for campaign disclosure was implemented and offered freely and voluntarily to all active candidates and campaign committees in 2008. The E-filing and administrative system for filing the Statement of Economic Interest (SEI) — Form 700 was introduced and implemented in 2012 as a free, mandatory process for all individuals required by resolution to file annual conflict of interest statements. In September 2012, the California Secretary of State filed Assembly Bill No. 2062, Davis. Political Reform Act of 1974: statements of economic interests: electronic filing. In response to the passage of the bill, in 2013 the City sought and received certification by the FPPC to receive and accept E-filed SEI forms. On July 13, 2012 the California Secretary of State filed Assembly Bill No. 2452, Ammiano. Political Reform Act of 1974. As codified, Section 84615 states, "A local government agency may require HB -5931- Item 10. - I Dept. ID CK 14-001 Page 2 of 2 Meeting Date:3/3/2014 an elected officer, candidate, committee, or other person required to file statements, reports, or other documents required by Chapter 4..." and requires that, "The legislative body for the local governmental agency shall adopt an ordinance approving the use of online or electronic filing, which shall include a legislative finding that the online or electronic filing system will operate securely and effectively and would not unduly burden filers." Huntington Beach has an electronic filing system in compliance with the legislation above which: • only accepts filings in standardized record format developed by and compatible with the Secretary of State and associated filing system; • includes a procedure for filers to comply with the requirement that they sign statements and reports under penalty of perjury pursuant to GC §81004; • ensures the integrity of the data transmitted and shall include safeguards against efforts to tamper with, manipulate, alter, or subvert the data; • makes all data available on the Internet in an easily understood format that provides the greatest public access; and, • enables filers to complete and submit filings free of charge. Why make this change? As Local Filing Official, the City Clerk is responsible to receive, review, store and make accessible to the public campaign disclosure information. In tandem with Section 84615 of the Political Reform Act of 1974 (Act) that allows local government agencies to require e- filing of campaign disclosure documents, this action would support the City's ongoing green efforts to reduce the paper and fuel waste necessary to print and deliver campaign documents to City Hall. It would reduce staff time as the electronic filing system automates pre-deadline and late-filer notices and also incorporates an initial review process that alerts the filer of errors at the time he or she is entering their information, thereby minimizing the need for staff to request amendments. The system also automatically redacts without the need for staff to do so before posting. It will increase transparency as documents will be available on the City's Website immediately upon filing and while the data filed cannot be changed, it can be downloaded for sorting and comparing, versus static information received from a PDF of the non electronic form. Approval of mandated electronic filing would also close the final loop in the six-year move from paper to electronic filing. What about those who do not have computers? There are computers available in the public library, but also one will be made available in the City Clerk's office for any filer who needs to utilize it. PowerPoint Item 10. - 2 HB -594- ATTACHMENT # 1 ORDINANCE NO. 4009 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING CHAPTER 2.07 OF THE HUNTINGTON BEACH MUNICIPAL CODE RELATING TO CAMPAIGN REFORM The City Council of the City of Huntington Beach does hereby ordain as follows: SECTION 1. The City Council of the City of Huntington Beach hereby makes the following findings: A. The electronic filing system will operate securely, ensure the integrity of the data transmitted, and shall include safeguards against efforts to tamper with, manipulate, alter, or subvert the data. B. The electronic filing system will operate effectively and will not burden filers. C. The requirement of electronic filing of campaign statements and reports furthers the purpose of campaign reform by providing greater public access to campaign finance data. SECTION 2. Section 2.07.040 of the Huntington Beach Municipal Code is hereby amended to read as follows: 2.07.040 Definitions. (a) "City Candidate"means any person who is a candidate for city Council, City Clerk, City Treasurer, or City Attorney of the City of Huntington Beach. (b) "Elective City Officer" means any person who is Mayor, a member of the City Council, City Clerk, City Treasurer, or City Attorney of the City of Huntington Beach. (c) "Electronic filing" means the submission of required campaign statements and reports in an electronic format approved by the Secretary of State and the City Clerk. (d) "Non-elected City Official'means any person who is a member of a City of Huntington Beach board, committee, or commission, and who is not elected to that position. (e) "Person"means an individual, proprietorship, firm, partnership,joint venture, syndicate, business trust, company, corporation, association, committee, and any other organization or group of persons acting in concert. 13-3854/100358 1 Ordinance No. 4009 SECTION 3. Section 2.07.155 of the Huntington Beach Municipal Code is hereby added to read as follows: 2.07.155 Requirement to file statements and reports electronically. (a) An Elective City Officer, City Candidate, Committee, or other person required to file campaign statements or reports under this Chapter and Title 9, Chapter 14 of the California Government Code (commencing with Section 84100), who receives contributions totaling one thousand dollars ($1,000) or more, or make expenditures totaling one thousand dollars ($1,000) or more, in a calendar year must submit all campaign statements and reports as an electronic filing. Once an elective City Officer, City Candidate, Committee or other person is required to submit campaign statements or reports as an electronic filing, that Elective City Officer, City Candidate, Committee or other person shall continue to use electronic filing until the Committee has officially terminated or the Elective City Officer, City Candidate or other person has no further filing obligations. 1. An Elective City Officer, City Candidate, Committee, or other person that must file pursuant to this Chapter, but has not met the $1,000 threshold, may submit required statements or reports as an electronic filing or in paper format. 2. In any instance in which the original campaign statement, report, or other document is required to be filed with the Secretary of State and a copy of that campaign statement, report or other document is required to be filed with the City of Huntington Beach, the copy may be submitted as an electronic filing. SECTION 4. Section 2.07.165 of the Huntington Beach Municipal Code is hereby added to read as follows: 2.07.165 Filing procedures. (a) Electronic filing procedures shall be administered in accordance with Government Code Section 84615 as may be amended from time to time. (b) Notwithstanding any other provision of law, any campaign statement, report or other document submitted as an electronic filing shall serve as the filing of record and shall not be required to be filed with the City Clerk in paper format. SECTION 5. Section 2.07.175 of the Huntington Beach Municipal Code shall be added to read as follows: 2.07.175 Statements and reports—signature and verification requirements. Campaign statements and reports filed under this Chapter shall be signed under penalty of perjury and verified by the filer. The verification shall state that the filer has used all reasonable diligence in its preparation, and that to the best of his or her knowledge, it is true and complete. A campaign statement or report filed by a Committee shall be signed and verified by a responsible officer of 13-3854/100358 2 Ordinance No. 4009 the organization or by an attorney or a certified public accountant. Every person who signs or verifies any campaign statement or report required to be filed under this Chapter which contains material which he or she knows to be false is guilty of perjury. For a campaign statement or report submitted as an electronic filing, a secure electronic signature shall meet the requirements of this Section. SECTION 7. This ordinance shall become effective 30 days after its adoption. This Chapter shall be known and may be cited as the "City of Huntington Beach Campaign Reform Law." (3220-1/94) 2.07.020 Purpose. The purpose of this Chapter is to ensure that the financial strength of certain individuals or organizations does not permit them to exercise a disproportionate or controlling influence on the election of City candidates. To achieve such purpose, this Chapter is designed to reduce the influence of large contributions, to ensure that multiple contributions in excess of the contribution limits do not originate from the same source of funds, to ensure that individuals and interest groups continue to have a fair and equal opportunity to participate in electing City candidates, and to maintain public trust in governmental institutions and the electoral process. (3220-1/94) 2.07.030 Relation to Political Reform Act of 1974. This Chapter is intended to supplement the Political Reform Act of 1974. Unless the term is specifically defined in this Chapter, or the Huntington Beach Municipal Code Chapter 2.07 Page 1 of 6 contrary is stated or clearly appears from the context, words and phrases shall have the same meaning as when they are used in Title 9 of the California Government Code, in which the Political Reform Act of 1974 is codified, as the same may be, from time to time amended. (3220-1/94) 2.07.040 Definitions. (a) "City Candidate" means any person who is a candidate for the city Council, City Clerk, City Treasurer, or City Attorney of the City of Huntington Beach. (3220-1/94) 2.07.050 Campaign contribution limitations. No person shall make to any City candidate or the controlled committee of any such City candidate, and no such candidate or committee shall accept from any such person, a contribution or contributions totaling more than five hundred dollars ($500) in a City Council, City Clerk, City Treasurer, or City Attorney election cycle. Thereafter said contribution limitations shall increase by the October consumer price index (CPI) of Los Angeles, Long Beach, and Anaheim areas, rounded to the nearest $10, effective at the beginning of each new election cycle. (3220-1/94,3452-3/00,3599-2/03, 3803-6/08) 2.07.070 Election cycle. (3749-9/06) (a) City Council, City Clerk, City Treasurer, and City Attorney Elections. For purposes of the limits of this Chapter, as applied to elections for City Council, City Clerk, City Treasurer, and City Attorney, the final date for contributions shall be December 31 of the year in which the election for the open position was held. Contributions made after the final date shall be deemed contributions for the next election cycle. Notwithstanding the foregoing, contributions made after the final date to an elected Council Member who is ineligible for a further consecutive term, shall be deemed a contribution for the most recent election cycle in which such Council Member was eligible, and such contributions shall be subject to all other limitations and regulations in effect during said election cycle. For purposes of the limits of this Chapter, campaign contributions made at any time after a committee has been formed, pursuant to the provisions of the Political Reform Act, in support of a recall election or after the City Clerk has approved a recall petition for circulation and gathering of signatures, whichever occurs first, shall be considered contributions during a recall election cycle. A recall election cycle shall end whenever any of the following occur: (3220-1/94) (1) The recall proponents fail to return signed petitions to the City Clerk within the time limits set forth in the California Elections Code. (3220-1/94) (2) All committees formed in support of the recall have been terminated pursuant to the provisions of the Political Reform Act. (3220-1/94) (3) Ten (10) days after a recall election has been held. (3220-1/94) 2.07.080 Prohibition on multiple campaiLm committees. A City candidate or an elective City officer shall have no more than one campaign committee which shall have only one bank account out of which all qualified campaign and office holder expenses related to that City office shall be made. This section does not prevent a City candidate or an elective City officer from establishing another campaign committee solely for the purpose of running for a state, federal, local, or other City office. This section also does not prevent an elective City officer from establishing another campaign committee solely for the purpose of opposing his or her own recall. (3220-1/94) 2.07.090 Prohibition on transfers. (a) No funds may be transferred into any city candidate or elective city officer's campaign committee from any other campaign committee controlled by a candidate (including said City candidate) or by an elective City officer(including said elective City officer.) (3220-1/94) Huntington Beach Municipal Code Chapter 2.07 Page 3 of 6 (b) No City candidate and no committee controlled by a City candidate or elective City officer shall make any contribution to any other City candidate running for office or to any committee supporting or opposing a City candidate for elective City office, nor to any committee supporting or opposing a recall of an elective City officer. This section shall not prohibit a City candidate from making a contribution from his or her own personal funds to his or her own candidacy or to the candidacy of any other candidate for elective City office. (3220-1/94) The provision of this section shall not apply to the candidate or elected officer who forms a new committee for purposes of reelection to the same office and, to close out the prior committee, transfers the money or debt from the prior committee to the new committee and, in so doing, complies with all regulations of the political Reform Act of 1974, and as amended. (3220-1/94) 2.07.100 Loans to City candidates and elective City officers and their controlled committee. (a) A loan shall be considered a contribution from the maker and the guarantor of the loan and shall be subject to the contribution limitations of this Chapter. (3220-1/94) (b) Every loan to a City candidate or elective City officer or their controlled committees shall be by written agreement which shall be filed with the candidate's or committee's Campaign Statement on which the loan is first reported. (3220-1/94) (c) The proceeds of a loan made to a City candidate or elective City officer by a commercial lending institution in the regular course of business on the same terms available to members of the public shall not be subject to the contribution limitations of this Chapter if the loan is made directly to the City Candidate or elective City officer or his or her controlled committee. The guarantors of such a loan shall remain subject to the contribution limits of this Chapter. (3220-1/94) (d) Extensions of credit (other than loans pursuant to Section 2.07.100(c) for a period of more than thirty (30) days are subject to the contribution limitations of this Chapter. (3220-1/94) (e) This section shall apply only to loans and extensions of credit used or intended for use for campaign purposes or which are otherwise connected with the holding of public office. (3220-1/94) (f) The monetary limitations or provisions of this section shall not apply to a candidate's loan of his or her personal funds to his or her own campaign committee. (3220-1/94) (g) No City candidate and no committee controlled by a City candidate or elective City officer shall make any contribution to any other City candidate running for office or to any committee supporting or opposing a City candidate for elective City office, nor to any committee supporting or opposing a recall of an elective City officer. This section shall not prohibit a City candidate from making a contribution from his or her own personal funds to his or her own candidacy or to the candidacy of any other candidate for elective City office. (3220-1/94) 2.07.130 Transmittal of campaign contributions in city office buildings. (a) No person shall receive or personally deliver or attempt to deliver a contribution in any office which the City owns or for which the City pays the majority of the rent where the business of the City is conducted. (3220-1/94) (2) "Receive" includes the receipt of a campaign contribution delivered in person. (3220-1/94, 3803-6/08) 2.07.140 Disclosure of occupation and employer. No campaign contribution shall be deposited into a campaign bank account of a City candidate or elective City officer unless the disclosure information required by the Political Reform Act, including the name, address, occupation and employer of the contributor, or, if self employed, name of business, is on file in the records of the recipient of the contribution. This information is to be reported on each Campaign Statement required to be filed by the Political Reform Act. (3220-1/94) 2.07.150 Reporting of cumulative contributions. A cumulative contribution for each contributor shall be based on an election cycle and shall be reported on each Campaign Statement required to be filed by the Political Reform Act. Committee, or other person required to file campaign statements or reports under this Chapter and Title 9. Nothing in this Chapter shall exempt any person from applicable provisions of any other laws of this state or jurisdiction. (3220-1/94) 2.07.230 Severability. If any provisions of this Chapter, or the application of any such provision to any person or circumstances, shall be held invalid, the remainder of this Chapter, to the extent it can be given effect, or the application of such provision to persons or circumstances other than those as to which it is held invalid, shall not be affected thereby, and to this extent the provisions of this Chapter are severable. The bill would exempt the city and counties that participated in the existing pilot program from paying the$1,000 fee.The bill would also authorize the Commission to conduct discretionary audits of an agency's electronic filing system to evaluate its performance and compliance with the requirements of this bill. The bill would require the Commission to accept electronic copies of statements of economic interests forwarded to it by an agency that has received an electronically filed statement from filers. The bill would authorize a city or county that developed an electronic filing system pursuant to the pilot program to continue to use that system during the time it takes the Commission to adopt the regulations to govern the electronic filing system program, but would require the city or county to submit a description of its electronic filing system to the Commission for approval and certification after the Commission's regulations take effect, as specified. Existing law makes a knowing or willful violation of the Political Reform Act of 1974 a misdemeanor and subjects offenders to criminal penalties. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. (d)An agency's proposed electronic filing system shall meet the following requirements: I (1)A statement of economic interests filed electronically shall include an electronic transmission that is submitted under penalty of perjury and that conforms to subdivision(b)of Section 1633.11 of the Civil Code. f (2) (A)The agency's filing officer shall issue to a person who electronically files his or her statement of economic interests or amendment an electronic confirmation that notifies the filer that his or her statement of j economic interests or amendment was received. The confirmation shall include the date and the time that the statement of economic interests or amendment was received by the filing officer and the method by which the filer may view and print the data received by the filing officer. "It's a smart thing to do. I've always believed in open government. This just makes it a little easier for those who want to find out, from government, clear information that's available right away. It's the right time and the right thing to do," said Jim Wood, Oceanside's Mayor. 0 In July 2012, the California Legislature approved AB 2452, authorizing local jurisdictions to require the filing of campaign statements and reports in electronic formats. "When we saw the positive feedback and the benefits it could provide to the taxpayers of Oceanside, we thought it would be a good time to implement it here before the 2014 General Election," said Zack Beck, City Clerk. City leaders say this system and what it offers has little, if any, drawbacks for Oceanside residents. It's not the first time Oceanside has offered electronic access to campaign records. The city launched an in-house pilot program in 2009 that required staff to scan, redact and upload documents. "That program was scrapped because it took too much staff time do the work," officials said. "Whatever technology we can use to improve the efficiency of our department as well as saving some tax dollars, I think it's a win-win for everyone involved." As a past candidate and current treasurer,working with hand written reports is quite cumbersome. Additionally having to drive to City Hall to submit wet signatures is arcane at best and at worst it wastes time and fuel. It's time to move into the 21"Century in Huntington Beach and pull everyone else kicking and screaming into the digital world.The reports look nicer, it cuts down on staff time and helps people doing records searches by allowing the documents to be index searchable. While I have my problems with NetFile, it is leaps and bounds beyond doing one's paperwork by hand. Please support requiring electronic filing for candidates raising more than $1000.
