NOTICE IS HEREBY GIVEN that on Monday, October 15, 2007, at 7:00 p.m. in
the City Council Chambers, 2000 Main Street, Huntington Beach, the City Council will
hold a Public Hearing regarding Ordinance No. 3784. Ordinance No. 3784 will amend
Huntington Beach Municipal Code Chapter 17.56, which adopted the Uniform Fire Code,
2000 Edition and the California Fire Code, 2001 edition, including Appendices I-A, I-B,
I-C, II-A, II-C, II-D, II-E, II-K, II-H, III-A, III-C, and IV-A. The amendment concerns
permissible fire sprinkler omissions.
NOTICE IS FURTHER given that a copy of the proposed ordinance is on file in
the Office of the City Clerk, 2000 Main Street, Huntington Beach, California, for
inspection by the public.
ALL INTERESTED PERSONS are invited to attend said hearing and express

Statement of Issue: Whether to adopt an ordinance amending Municipal Code Section

Introduce Ordinance No. 3784 Amending Municipal Code Section 17.56.060 regarding fire
sprinklers, direct the City Clerk to publish Notice of a Public Hearing pursuant to Government

Analysis: The City's current fire sprinkler ordinance does not make provisions for sprinkler
omissions when an addition is added to an existing public assembly building. Currently, the
Huntington Beach Fire Code requires adding either a four hour fire wall separating the
addition from the existing building, or installing fire sprinklers in the new addition and the
non-sprinklered portions of the existing building.
To address this situation City Councilmember Hansen proposed that the Huntington Beach
Municipal Code be amended to allow for the omission of fire sprinklers in the original legally
existing public assembly buildings in limited cases.
Accordingly, attached is an ordinance amending Chapter 17.56 of the Municipal Code to
allow for the omission of fire sprinklers in the legal existing portion of public assembly
buildings which are undergoing expansion. Fire sprinklers would continue to be required in
that portion of the building which is being added. The ordinance also includes additional
conditions that must be met when the omission is applied.
If the ordinance is introduced at this meeting, a public hearing would be scheduled for the
City Council meeting of October 15, 2007, at which time adoption could also take place. The
ordinance would become effective 30 days after its adoption.

AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING HUNTINGTON BEACH MUNICIPAL CODE
CHAPTER 17.56-THE HUNTINGTON BEACH FIRE CODE-
PERTAINING TO SPRINKLERS
The City Council of the City of Huntington Beach does hereby ordain as follows:
SECTION 1. Section 17.56.060 of the Huntington Beach Municipal Code is hereby
amended to read as follows:
17.56.060 CFC Section 1003.4 Permissible Sprinkler Omissions.
ADD 6. When the gross square footage of the building is divided into nonsprinklered 5,000
square feet units by four hour masonry fire resistive separation walls, the four hour masonry
walls shall have no openings, shall have parapets 30 inches above the roofline, and extend
horizontally to separate exterior combustible cornices, canopies, etc. EXCEPTION: If four
hour masonry walls are not extended horizontally, a 5 foot distance shall be provided
between the four hour masonry wall and exterior combustible cornices, canopies, etc.
ADD 7. An addition may be made enabling any building to exceed 5,000 square feet of gross
floor area which houses an assembly occupancy as defined by the Building Code without
installing automatic fire sprinklers, provided all the following conditions are satisfied:
I. The public assembly was lawfully established prior to November 30 1989.
2. Automatic fire sprinklers are installed in the area of the addition.
3. The area of the addition is separated from the original building by a fire barrier
wall. The fire barrier wall shall be constructed equivalent to a two-hour fire
resistive occupancy separation as specified in the 2001 California Building Code.
All provisions pertaining to openings, through and membrane penetrations, duct,
fire and smoke damper provisions as specified in said code affecting occupancy
separations shall also apply.
4. The area of the addition shall not exceed 20% of the floor area of the original
building, or 5,000 square feet, whichever is less.
5. No other additions or other changes of occupancy to the building may be made in
the future without installing sprinklers.
6. The Fire Chief or designee determines that the omission of requiring the
installation of fire sprinklers in the original building does not increase the
intensity of use of the original assembly area. or increase the risk to life or
property due to fire in the original building.

Analysis: This is the Public Hearing and second reading of the accompanying ordinance
(Attachment 1). The first reading was on September 17, 2007.
The City's current fire sprinkler ordinance does not make provisions for sprinkler omissions
when an addition is added to an existing public assembly building. Currently, the Huntington
Beach Fire Code requires adding either a four hour fire wall separating the addition from the
existing building, or installing fire sprinklers in the new addition and the non-sprinklered
portions of the existing building.
