Analysis On October 16 2007 the County of Orange Board of Supervisors declared that
the condition of a 3,700 linear feet long section of the northerly East Garden Grove -
Wintersburg levee (Facility No C05) constitutes an emergency due to the severely eroded
levee conditions which will expedite installation of sheet pilings to protect nearby homes
from potential flooding if the levee were to fail This emergency declaration allows for an
expedited solicitation and award of bids for the construction which will occur fully within the
County s right-of-way
Public Contract Code 21020 9 requires that the Orange County Flood Control District seek
approval from the municipality in which their proposed project takes place in order for the
work to commence City staff has reviewed the plans and take no exception
Strategic Plan Goal (1-1) Improve the City s plan for funding and completing infrastructure
needs and develop strategies for resolving crucial infrastructure problems to preserve the
physical foundation of the community and enable the community s value to grow

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH APPROVING PLANS AND SPECIFICATIONS
FOR THE CONSTRUCTION OF EAST GARDEN GROVF-WINTERSBURG
CHANNEL EMERGENCY PROJECT FROM 3700 FEET DOWNSTREAM OF
GRAHAM STREET TO GRAHAM S4 REET BY THE ORANGE COUNTY
RESOURCES AND DEVELOPMENT MANAGEMENT DEPARTMENT AND
FUNDED BY THE ORANGE COUNTY FLOOD CONTROL DISTRICT
WHEREAS the Orange County Resources and Development Management Department
on behalf of the Orange County Flood Control District proposes to construct emergency flood
control improvements to the East Garden Grove-Wmtersburg Channel from 3700 feet
downstream of Graham Street to Graham Street which project has been found to have beneficial
impacts within the City of Huntington Beach and
Approval of plans and specifications for this project by the City of Huntington Beach is
required under provisions of the California Public Contract Code
NOW THEREFORE the City Council of the City of Huntington Beach does hereby
approve plans and specifications for the proposed emergency project to place steel sheet pile into
the existing flood control levee from 3700 feet downstream of Graham Street to Graham Street
by the Orange County Resources and Development Management Department
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof held on the 5th day of November 2007

Hello, HB City Council,
I wish to support item #E-5, the emergency flood control levee work by the County of
Orange, with one caveat: that the City insist that Shea Homes fully cooperate with the
County.
At a community meeting on October 29, County officials told residents that they had asked
Shea for permission to place temporary barriers
(k-rail) against the Kenilworth wall on the very northern edge of their property. It is
strictly precautionary, and once the county work is completed after 3 months the barriers
would be removed. Because the work is at the very edge of the field, the County activity
would not interfere with Shea's farming operations.
Although Ron Metzler of Shea Homes spoke at the Board of Supervisors meeting to say Shea
supports the emergency work, County officials said Shea denied them permission to install
the temporary barriers!
How can Shea possibly be against something that is only TEMPORARY?
Since the County can't order Shea to cooperate, I ask you, City officials, who have
jurisdiction over Shea's property, to include as part of your E-5 resolution that Shea
Homes will cooperate with the County while the emergency repair project is conducted.
