Submitted by the Planning Director. Funding Source: Not applicable. Councilmember Sullivan requested continuance of the item to study whether affordable rental unit should be affordable for 60 years rather than 30 years and to make it available at a more affordable income rate. (City Council) Approve Hiring One Police Officer to Fill Vacated Position in the Investigation Bureau When an Officer is Assigned to OCATT (Orange County Auto Theft Task) Force as an Exception to the Hiring Freeze Adopted by the City Council on May 19, 2003 (310.20) — 1. Approve the hiring of one new Police Officer to fill the vacated position in the Investigation Bureau when an officer is assigned to the OCATT Force as an exception to the current hiring freeze and allow for immediate recruitment; 2. Approve the appropriation of$132,704 from the unreserved, undesignated General Fund Balance, to be reimbursed by the grant from the OCATT Task Force Committee; and 3. Authorize the expenditure of funds not to exceed $132,704 to reimburse the OCATT Officer's costs including, salary, benefits, overtime and supplies. Submitted by the Chief of Police. Funding Source: As stated Above. Police Chief Small responded to inquiries from Councilmember Sullivan re: the workings of the Task Force. Approved 7-0 E-8. (City Council) Approve Hiring One Detention Police Officer and Two Police Records Supervisors as an Exception to the Hiring Freeze Adopted by the City Council on May 19, 2003 (310.20)—Approve the hiring of one Detention Officer and two Records Supervisor positions as exceptions to the current hiring freeze and allow for immediate recruitment. Submitted by the Chief of Police. Funding Source: The existing, approved Police Department budget can absorb the cost of one Detention Officer and two Records Supervisors. The funds are available in the Police Department's General Fund Accounts for Jail and Records. Approved 7-0 • (c) In Contracts: "There shall be no discrimination against or segregation of any person, or group of persons on account of race, color, creed,religion, sex, sexual orientation, marital status,national origin or ancestry in the sale, lease, sublease,transfer, use, occupancy, tenure or enjoyment of the land, nor shall the transferee himself or any person claiming under or through him, establish or permit any such practice or practices of discrimination or segregation with reference to the lessees, subtenants, sublessees or vendees of the land." 7. COVENANTS TO RUN WITH THE LAND. Declarant hereby subjects the Site and the Unit to the covenants,reservations,and restrictions set forth in this Declaration. Declarant hereby declares its express intent that all such covenants,reservations, and restrictions shall be deemed covenants running with the land and shall pass to and be binding upon the Declarant's successors in title to the Site;provided, however, that on the expiration of the term of this Declaration said covenants, reservations and restrictions shall except the nondiscrimination covenants contained in Section 6 and Section 6.1 shall remain in perpetuity. All covenants without regard to technical classification or designation shall be binding for the benefit of the City, and such covenants shall run in favor of the City for the entire term of this Declaration, without regard to whether the City is or remains an owner of any land or interest therein to which such covenants relate. 8. ATTORNEYS' FEES. In the event that any legal action arises by reason of the breach of any covenant in this Declaration, or otherwise arising out of this Declaration, each party shall bear its own attorneys' fees, and the prevailing party in such action shall not be entitled to recover from the non-prevailing party reasonable attorneys' fees and costs. Attorneys' fees shall include attorneys' fees on any appeal, and in addition, all other reasonable costs for investigating such action, including the conducting of discovery, and expert witness fees. 9. AMENDMENTS. This Declaration shall not be amended without the express prior written consent of the City, and it shall be amended only by a written instrument executed by the Declarant or its successors in title, and duly recorded in the real property records of the County of Orange. 10. NOTICE. If any provision of this Declaration shall be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining portions hereof shall not in any way be affected or impaired thereby. 11.2 Waiver. A waiver of the performance of any covenant or condition herein shall not invalidate this Declaration nor shall it be considered a waiver of any other covenants or conditions, nor shall the delay or forbearance in exercising any remedy or right be considered a waiver of, or an estoppel against,the later exercise of such remedy or right. 12. USE RESTRICTIONS. During the Affordability Period, Declarant shall take all reasonable steps necessary to ensure that each Tenant of an affordable Unit and all assignees and transferees of such Tenant have knowledge of all terms and conditions of this Agreement by including in each and every lease and rental agreement a clause which identifies this Agreement by reference and makes this Agreement available for review by each Tenant. In addition,during the Affordability Period, the lease for any of the Affordable Unit shall contain provisions that the Affordable Unit shall be occupied, used, and maintained as follows: (a) the dwelling unit shall be used only for private dwelling purposes, with appurtenant facilities, and for no other purposes; (b) the Tenant shall not permit or suffer anything to be done or kept upon the premises which will increase the rate of insurance on any building, or on the contents thereof, or impair the structural integrity thereof or which will obstruct or interfere with, the rights of other occupants, or annoy them by unreasonable noises or otherwise, nor shall any Tenant commit or permit any nuisance on the premises or fail to keep the premises free of rubbish, clippings, and trash or commit or suffer any illegal act to be committed thereon; (c) the Tenant shall comply with all of the lawful requirements of all governmental authorities with respect to the premises; (d) there shall be no structural alteration, construction, or removal of any building,fence, or other structure on the Site (other than repairs or rebuilding permitted herein) without the approval of City; (e) no person shall be permitted to occupy the premises for transient or hotel purposes; and (f) the Tenant shall comply in all respects with this Declaration and any failure by the Tenant to comply with the terms of this Declaration shall be a default under the Tenant's lease. 02agreeicovenants/8/30/02 6 13. SUBORDINATION TO TRUST DEEDS. Notwithstanding any other provision in this Declaration to the contrary,the covenants and restrictions established in this Declaration at all times shall be junior and subordinate to the lien of any mortgage or deed of trust recorded by or on behalf of a lender to secure a loan for the financing of the Site or the Project, including without limitation any deed of trust recorded concurrently herewith. City agrees, at no expense to City,to execute such documents as may be reasonably requested by Declarant, any successor or assign to Declarant's right,title, and interest in and to all or any portion of the Site, or any lender of any such person subordinating City's rights and interest under this Declaration to the lien of any trust deed recorded or to be recorded by a lender securing a loan for the acquisition or improvement of the Site. Declarant, its successors or assigns, or the benefited lender shall be responsible for preparing the document(s) creating such subordination of City's interest. 14. GOVERNING LAW. This Declaration shall be governed by the laws of the State of California. A condition of approval for the project requires one off-site single family rental unit to be affordable to a median income household for a period of thirty years. Staff recommends that the City Council review and approve the affordable housing agreement. Funding Source: Not applicable. PROJECT PROPOSAL: Applicant: Lakeside Utica, LLC Location: 5051 Pheasant Lane (affordable off-site unit) A. REQUEST: Review and approve an affordable housing agreement that will restrict one off-site unit at a median income category for a period of thirty years. The off-site rental unit is an existing three bedroom single family home located at 5051 Pheasant Lane. B. STAFF ANALYSIS AND RECOMMENDATION: The City approved the construction of seven detached single family residential units on March 10, 2001, at 2101-2113 Alabama Street. A condition of approval required the equivalent of 10 percent of the units (one unit) to be affordable. The Agreement (Attachment No. 1) provides for one residential off-site unit to be rented to a median-income household for a period of thirty years from the date of the signed agreement. The median-income household level is based on the Orange County median income and relative to the household size. As an example, the maximum income for a one-person household is $52,900 and for a three-person household is $68,050. The maximum rent for a three bedroom unit would be approximately $1,890.00 at the median income level. The submitted document complies with the affordable housing requirements of the condition of approval, and has been reviewed and approved by the City Attorney's Office. Therefore, staff recommends the City Council approve the Agreement. Environmental Status: The subject request is exempt from review under the California Environmental Quality Act, pursuant to Section 15061 (b) (3). As used in this Declaration, the term"Affordable Rent" shall mean annual rentals whose amount does not exceed the maximum percentage of income that can be devoted to rent as specified in the "affordable housing cost" for Median Income Households, as specified at California Health &Safety Code Section 50053, or its successor and the implementing regulations specified at Section 6910 et seq., of Title 25 of the California Code of Regulations, whichever is less. Generally, Affordable Rent shall not exceed thirty percent (30%)times one hundred percent (100%) of the Orange County median income, adjusted for family size appropriate for the Unit, as set forth in the regulations issued by HCD at 25 California Administrative Code Section 6910 et seq. (the "HCD Regulations"). 1.2 Eligible Tenant. As used in this Declaration,the term"Eligible Tenant" shall refer to persons who are Eligible Median Income Tenants, and who are eligible to rent a Unit. 1.3 Median Income Households. shall mean persons or families earning not more than one hundred percent (100%) or less of the Orange County median income. 1.4 Orange County Median Income. For purposes of this Declaration, the term "Orange County Median Income" shall mean the median income for the Orange County Primary Metropolitan Statistical Area, with adjustments for household size, as determined from time to time by United States Department of Housing and Urban Development as set forth in Health and Safety Code Section 50079.5, or a successor statute. 1.5 Unit. As used in this Declaration, the term"Unit" shall mean rent restricted, three-bedroom affordable rental dwelling unit located at 5051 Pheasant Lane, Huntington Beach, California 92649, as more particularly described in the legal description attached hereto as Exhibit`B". The term"Unit" and"Units" shall be used as the context mandates and shall be reasonably interpreted in light of the context in which the term appears. 2. TERM OF RESTRICTIONS; RESIDENTIAL RENTAL PROPERTY. The term of the restrictions established by this Declaration shall be thirty (30) years from the date of the final inspection of the first unit on the site. The Unit is to be owned, managed,and operated as a project for Eligible Tenants for the term of this Agreement. To that end, and for the term of this Declaration,the Declarant hereby declares, represents, covenants, warrants and agrees as follows: 2.1 Purpose. The Unit has been made available for the purposes of providing Eligible Tenants affordable rental housing. 2.2 Facilities. The Unit shall contain facilities adequate for living, sleeping, eating, cooking and sanitation in accordance with all applicable federal, state and local laws and codes. 2.3 Residential Use. The Units in the Project will at no time be utilized on a transient basis or will ever be used as a hotel, motel, dormitory, fraternity house, sorority house, 02agree/covenants/8/30/02 2 rooming house, nursing home, hospital, sanitarium, or trailer court or park without the prior written consent of the City of Huntington Beach. 2.4 Maximum Occupancy. The maximum number of persons in a household that may occupy the unit may not exceed seven persons. 2.5 Preference to Eligible Tenants. The Unit will be made available for rental in accordance with the terms of this Declaration, and the Declarant shall not give preference to any particular class or group in renting the Units in the Project, except to the extent that the Unit is required to be leased or rented to Eligible Tenants. 2.6 Liability of Declarant. Declarant and the management agent shall not incur any liability under this Declaration as a result of fraud or negligent or intentional misrepresentation by a tenant. 3. OCCUPANCY OF PROJECT BY ELIGIBLE TENANTS. Declarant hereby declares, represents, warrants, and covenants as follows: 3.1 Income Restrictions. Except as expressly provided herein, throughout the term of this Declaration, the one rent restricted, affordable Unit shall be rented only to Median Income Tenants. 3.2 Rental Rates. Monthly rent for the Unit excluding any supplemental rental assistance from the State of California, the federal government or any other public agency shall not exceed one-twelfth(1/12) of the Affordable Rent adjusted for family size appropriate for the Unit. The rental rate for the Unit shall be adjusted annually based upon current updates of HUD income and rent standards. In no event shall the Unit be rented at a rate greater than the Affordable Rent applicable to the particular Unit. DECLARANT UNDERSTANDS AND KNOWINGLY AGREES THAT THE MAXIMUM RENTAL PAYMENTS TO BE ESTABLISHED BY THIS FORMULA ARE NOT NECESSARILY EQUAL TO THE FAIR MARKET RENT FOR THE AFFORDABLE UNIT, AND MAY BE ESTABLISHED AT A LEVEL SUBSTANTIALLY BELOW THE FAIR MARKET RENT LEVELS. Declarant covenants and agrees to submit to the City an annual report (the "Annual Report")which shall include for the Unit,the rental rate, and the income and family size of the occupants. The income information shall be supplied by the tenant 02agree/covenants/8/30/02 3 in a certified statement on a form provided by the City. The Declarant shall submit the Annual Report on or before the end of the first calendar quarter of the year following the year covered by the Annual Report. The Declarant shall provide for the submission of such information in its leases with tenants. City shall not charge Declarant a fee for reviewing the Annual Report. 5. NONDISCRIMINATION. There shall be no discrimination against or segregation of any person, or group of persons, on account of race, color, creed, religion, sex, sexual orientation, marital status, national origin or ancestry in the sale, lease, sublease,transfer, use, occupancy, tenure or enjoyment of the Unit, nor shall Declarant, or any person claiming under or through it, establish or permit any such practice or practices of discrimination or segregation with reference to the selection, location,number, use or occupancy of tenants, lessees, subtenants, sublessees or vendees of the Site, or any part thereof, or in the awarding of contracts for the Project(except as permitted by this Declaration). Declarant shall comply with all applicable federal, state and local nondiscrimination, fair housing, and equal opportunity requirements. In addition, Declarant shall conduct affirmative marketing and minority outreach activities as required by federal regulations. 6.1 Form of Nondiscrimination and Nonsegregation Clauses. The Declarant shall refrain from restricting the rental, sale or lease of the Unit on the basis of race, color, creed, religion, sex, sexual orientation, marital status, national origin or ancestry of any person. All such deeds, leases or contracts shall contain or be subject to substantially the following nondiscrimination or nonsegregation clauses: (a) In Deeds: "The grantee herein covenants by and for himself, his heirs, executors, administrators and assigns, and all persons claiming under or through him, that there shall be no discrimination against or segregation of, any persons or group of persons on account of race, color, creed, religion, sex, sexual orientation, marital status, national origin or ancestry in the sale, lease, sublease, transfer, use, occupancy, tenure or enjoyment of the land herein conveyed, nor shall the grantee himself or any person claiming under or through him, establish or permit any such practice or practices of discrimination or segregation with reference to the selection, location, number, use or occupancy of tenants, lessees, subtenants, sublessees or vendees in the land herein conveyed. The foregoing covenants shall run with the land.
