The proposed church would have a maximum 1, 842 seat capacity. The church representatives feel that the Planning Commission did not understand or respond to aspects of the project including traffic, pollution, time of use, noise, or impacts to Seacliff Office Park, Pacific Ranch and the City of Huntington Beach. RECOMMENDATION• STAFF RECOMMENDATION 1. "Motion to approve Negative Declaration No. 90-13 . " 2 . LOCATION• Northeast corner of Seacliff Office Park (northeast corner of Main Street and Yorktown Avenue) ISSUES• The church proposes to construct a new 42, 000 square foot church building and subterranean parking structure, and to utilize up to 450 of Seacliff Office Park' s existing parking spaces . This joint use of parking is further discussed below. The proposed two-story building includes a 1, 842 seat sanctuary, classrooms, multi-use rooms, offices, a bookstore and small chapel . In addition to 53 surface parking spaces, 111 spaces will be provided in a one-level subterranean structure. An existing 6 foot high to 14 foot high slump block wall separates the site from adjacent residences and carports at Pacific Ranch, and is proposed to remain. The two primary issues are parking, and compatibility of the proposed church with surrounding office and residential uses . The applicant is requesting joint use of parking with Seacliff Office Park, in accordance with Section 9602 of the Huntington Beach Ordinance Code. The code states that a reduction in the total number of parking spaces required by the sum of separate uses may be RCA - October 1, 1990 -2- (7020d) granted when it can be shown that the various uses have divergent needs in terms of daytime versus nighttime hours, or weekday versus weekend hours . The primary use of the church building will be on weekends and weeknights, as opposed to weekdays for the office complex. The weekday users of the church building can be parked on the church site, without need for joint use parking with the offices . The Huntington Beach Company, owners of both Seacliff Office Park and the church site, have agreed to the proposed joint use parking agreement (see attached letter dated May 31, 1990) , and a formal agreement will be recorded prior to issuance of building permits . Staff, however, has remained concerned with the level of activity on the site, and its potential impacts on the parking lot and surrounding area. The applicant has down-scaled the original request due to concerns of staff and the adjacent residents that the proposed number of people on the site, particularly on weeknights and Saturdays, may be incompatible with adjacent residential uses . The noise, lights, auto traffic and activity associated with a large church use on the site will exceed the intensity normally associated with an office park in an OP (Office Professional) Zone. The following chart shows the maximum number of spaces available at various times on the church site and office park, the maximum occupancy allowed by code for the church based on three (3) seats per parking space, the church' s currently requested occupancy, and a modified recommendation by staff : Max. In support of this statement, the applicant has submitted a tabulation of average weekly attendance and major program attendance at their current facility at Seacliff Shopping Center. (Attached to Planning Commission Staff Report dated August 7, 1990) . Staff feels that at the revised occupancy for weeknights, Friday nights and Saturdays, most people will be able to park in the subterranean structure beneath the church, and enter the building through the structure. This will reduce noise and disturbance to residential neighbors . A public hearing review should be held after six months, and again after one year of occupancy, to allow the Planning Commission to review the conditions of approval for adequacy, and to add, delete or modify conditions as appropriate. The applicant may request revised maximum occupancy limits after one year. If, at such public hearing, the Planning Commission finds that the church' s on-going activities are not compatible with adjacent residents, the church may be required to reduce the intensity of use. Staff has received a petition containing 81 signatures in opposition to the construction of the church, as well as 17 letters of opposition. ENVIRONMENTAL STATUS: Pursuant to the environmental regulations in effect at this time, the Department of Community Development advertised draft Negative Declaration No. 90-13 for a twenty-one (21) day review and comment period prior to the hearing date. The staff, in its initial study of the project, has recommended that a negative declaration be issued. The Huntington Beach Environmental Board commented on the Draft Negative Declaration, and- staff has responded to the comments . These items are attached to the Planning Commission Staff Report dated June 19, 1990 . Prior to any action on Conditional Use Permit No" 90-16, it is necessary for the City Council to review an act on Negative Declaration No. 90-13 . FUNDING SOURCE: Not Applicable. The location, site layout, and design of the proposed church, combined with the proposed occupancy and hours of operation as modified by staff, properly adapts the proposed structure to streets, driveways, and other adjacent structures and uses in a harmonious manner. The building is compatible with adjoining offices and is oriented away from residential development . 2 . The combination and relationship of one proposed use to another on site are properly integrated. 3 . The access to and parking for the proposed church does not create an undue traffic problem because adequate parking will be available for joint use, and a Transportation Management Program will be required to further reduce trips . CONDITIONS OF APPROVAL: 1. The site plan, floor plans and elevations received and dated June 6, 1990, shall be the conceptually approved layout with the following modification: a. Surface compact spaces shall have minimum 15 foot long paved surface. 2 . Prior to submittal for building permits, the applicant/owner shall complete the following: a . Depict all utility apparatus, such as but not limited to backflow devices and Edison transformers, on the site plan. They shall be prohibited in the front and exterior yard setbacks unless properly screened by landscaping or other method as approved by the Community Development Director. b. Floor plans shall depict natural gas stubbed in at the locations of cooking facilities, water heaters, and central heating units; and low-volume heads shall be used on all spigots and water faucets . c. Elevations shall depict colors and building materials as approved by the Design Review Board on May 17, 1990 . d. All rooftop mechanical equipment shall be screened from any view. Said screening shall be architecturally compatible with the building in terms of materials and colors . If screening is not designed specifically into the building, a rooftop mechanical equipment plan must be submitted showing screening and must be approved. RCA - October 1, 1990 -6- (7020d) e. If outdoor lighting is included, energy savings lamps shall be used. All outside lighting shall be directed to prevent "spillage" onto adjacent properties and shall be noted on the site plan and elevations . f. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on-site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities . g. The site is within the Alquist-Priolo region and must be investigated for evidence of faulting prior to issuance of any permits . Evidence of faulting will require the entire project to be re-reviewed by the Planning Commission. The completed geotechnical report, including recommendations for the acceleration to be used for designing the structures on the site, or a statement that the adopted Uniform Building Code is adequate for the seismic design of the structures on the site, shall be submitted to the Public Works Department. The Public Works Department will obtain an independent analysis of the completed geologic report. The cost of this analysis will be paid by the applicant. When the report has been amended to the satisfaction of the Public Works Department, the City will file the report with the State Geologist. Construction drawings along with calculations and the approved geologic report shall be submitted to the Department of Community Department to complete the permit plan review. h. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. 3 . Prior to issuance of building permits, the applicant/owner shall complete the following: a. A Landscape Construction Set must be submitted to the Departments of Community Development and Public Works and must be approved. The Landscape Construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect and which includes all Proposed/existing plant materials (location, type, size, quantity) , an irrigation plan, a grading plan, an approved site plan, and a copy of the entitlement conditions of approval . The landscape plans shall be in conformance with Section 9608 and Article 963 of the Huntington Beach Ordinance Code. The set must be approved by both departments prior to issuance of building permits . b. Landscape irrigation system shall be designed and constructed to include a separate water line for the use of reclaimed water subject to Water Department approval . RCA - October 1, 1990 -7- (7020d) c. A grading plan shall be submitted to the Department of Public Works for review and it must be approved (by issuance of a grading permit) . A plan for silt control for all water runoff from the property during construction and initial operation of the project may be required if deemed necessary by the Director of Public Works. d. All applicable Public Works fees shall be paid. e. The applicant and the owner of Seacliff Office Park shall record a covenant which guarantees that the office parking lot will be available for use by the church after 6 : 00 PM on weeknights and from 8 : 00 AM to 9 : 00 PM on weekends . Said covenant shall remain in effect for the life of the church use on the site. The covenant shall be approved as to form and content by the City Attorney' s office and the Department of Community Development. The covenant may be amended or rescinded only after approval by the City and property owners . 4 . Fire Department Requirements are as follows : a. An automatic fire sprinkler system and fire alarm system shall be approved and installed pursuant to Fire Department regulations . b. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. c. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. d. Two on-site fire hydrants shall be provided at locations specified by the Fire Department prior to combustible construction. e. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances, standards and specifications . f . Development shall meet all local and State regulations regarding installation and removal of all underground storage tanks . g. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 12 . During construction, the applicant shall : a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough to prevent dust raised when leaving the site; b. Wet down areas in the late morning and after work is completed for the day; c. Discontinue construction during second stage smog alerts . 13 . Construction shall be limited to Monday - Saturday 7: 00 AM to 8 : 00 PM. Construction shall be prohibited Sundays and Federal holidays . 14 . Conditional Use Permit No. 90-16 ,shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. Should a Traffic Impact Fee be adopted by the City Council, the applicant/property owner shall be responsible for paying such fee prior to issuance of a Certificate of Occupancy and/or final building permit approval. 16 . The developer will be responsible for the payment of any additional fees adopted in the upcoming Water Division Financial Master Plan. 17 . A review of the use shall be conducted within six (6) months of the issuance of Certificate of Occupancy and one year after issuance of Certificate of Occupancy. Said review shall be conducted by the Planning Commission at a duly noticed public hearing. The Planning Commission may add, delete or amend conditions of approval as necessary to resolve problems identified at such public hearing. If, at that time, there is any violation of these conditions or the Huntington Beach Ordinance Code, the Planning Commission may revoke Conditional Use Permit No. 90-16 . The applicant may request revised occupancy limits and/or hours of operation at the one-year review. 18 . Prior to issuance of a Certificate of Occupancy, the applicant shall obtain approval of a Transportation Management Plan by the Director of Community Development . The Plan shall outline steps which the applicant will implement to reduce parking demand. Steps may include development of a ridesharing program, incentives to utilize public transportation, or other appropriate measures . Staff Report - 8/7/90 -2- (6677d) The applicant had based the July 10, 1990, request on the maximum occupancy possible, given the number of parking spaces that the Huntington Beach Company was willing to grant for joint use in the office parking lot at a given time. The following chart shows the maximum number of spaces available at various times on the church site and office park, the maximum occupancy allowed at three (3) seats per parking space, and the currently requested occupancy. In support of this statement, the applicant has submitted a tabulation of average weekly attendance and major program attendance at their current facility at Seacliff Shopping Center (see Attachment 2) . Prior to the July 10, 1990 hearing, staff received a petition from the residents of Pacific Ranch opposing the use of the site as a church. The petition contained approximately 100 signatures and was based on concerns with traffic and . noise. Despite the applicant ' s revised request, staff continues to be concerned that the regular intensity of use on Saturdays and weeknights will far exceed an acceptable intensity of offic park uses which maybe a possible detriment to adjacent residents . Therefore, the following modifications and conditions of approval are suggested. Staff Report - 8/7/90 -3- (6677d) The weeknight, Friday night, and regular Saturday attendance (bold print in previous chart) should be reduced for a minimum period of one year, as follows : Weeknights 6 pm - 10 pm - 300 people Friday nights 6 pm - 10 pm - 300 people Saturday 8 am - 6 pm - 200 people At this occupancy, most people will be able to park in the subterranean structure beneath the church, and enter the building through the structure. This will reduce noise and disturbance to residential neighbors . A public hearing review will be held after six months , and again after one year of occupancy, to allow the Planning Commission to review the conditions of approval for adequacy, and to add, delete or modify conditions as appropriate. The applicant may request revised maximum occupancy limits after one year. If, at such public hearing, the Planning Commission finds that the church' s on-going activities are not compatible with adjacent residents, the church may be required to reduce the intensity of use. 4 . 0 RECOMMENDATION: Staff recommends that the Planning Commission approve Negative Declaration No . 90-13 and Conditional Use Permit No . 90-16 as modified by staff, with the following findings and conditions of approval : FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 90-16 : 1. The location, site layout, and design of the proposed church, combined with the proposed occupancy and hours of operation as modified by staff, properly adapts the proposed structure to streets, driveways, and other adjacent structures and uses in a harmonious manner . The building is compatible with adjoining offices and is oriented away from residential development . 2 . The combination and relationship of one proposed use to another on site are properly integrated. 3 . The access to and parking for the proposed church does not create an undue traffic problem because adequate parking will be available for joint use, and a Transportation Management Program will be required to further reduce trips . CONDITIONS OF APPROVAL: 1. The site plan, floor plans and elevations received and dated June 6, 1990, shall be the conceptually approved layout with the following modification: a. Prior to submittal for building permits, the applicant/owner shall complete the following: a . Depict all utility apparatus, such as but not limited to backflow devices and Edison transformers, on the site plan. They shall be prohibited in the front and exterior yard setbacks unless properly screened by landscaping or other method as approved by the Community Development Director. b. Floor plans shall depict natural gas stubbed in at the locations of cooking facilities, water heaters , and central heating units; and low-volume heads shall be used on all spigots and water faucets . c. Elevations shall depict colors and building materials as approved by the Design Review Board on May 17, . 1990 . d. All rooftop mechanical equipment shall be screened from any view. Said screening shall be architecturally compatible with the building in terms of materials and colors . If screening is not designed specifically into the building, a rooftop mechanical equipment plan must be submitted showing screening and must be approved. e. If outdoor lighting is included, energy savings lamps shall be used. All outside lighting shall be directed to prevent. "spillage" onto adjacent properties and shall be noted on the site plan and elevations . f . A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on-site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities . g. The site is within the Alquist-Priolo region and must be investigated for evidence of faulting prior to issuance of any permits . Evidence of faulting will require the entire project to be re-reviewed by the Planning Commission. The completed geotechnical report, including recommendations for the acceleration to be used for designing the structures on the site, or a statement that the adopted Uniform Building Code is adequate for the seismic design of the structures on the site, shall be submitted to the Public Works Department. The Public Works Department will obtain an independent analysis of the completed geologic report . The cost of this analysis will be paid by the applicant. When the report has been amended to the satisfaction of the Public Works Department, the City will file the report with the State Geologist. Construction drawings along with calculations and the approved geologic report shall be submitted to the Department of Community Department to complete the permit plan review. Staff Report - 8/7/90 -5- (6677d) , h. The .site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. 3 . Prior to issuance of building- permits, the applicant/owner shall complete the following: a . A Landscape Construction Set must be submitted to the .Departments of Community Development and Public Works and must be approved. The Landscape Construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect and which includes all proposed/existing plant materials (location, type, size, quantity) , an irrigation plan, a grading plan, an approved site plan, and a copy of the entitlement conditions of approval . The landscape plans shall be in conformance with Section 9608 and Article 963 of the Huntington Beach Ordinance Code. The set must be approved by .both departments prior to issuance of building permits . b. Landscape irrigation system shall be designed and constructed to include a separate water line for the use of reclaimed water subject to Water Department approval . c. A grading plan shall be submitted to the Department of Public Works for review and it must be approved (by issuance of a grading permit) . A plan for silt control for all water runoff from the property during construction and initial operation of the project may be required if deemed necessary by the Director of Public Works . d. All applicable Public Works fees shall be paid. e. The applicant and the owner of Seacliff Office Park shall record a covenant which guarantees that the office parking lot will be available for use by the church after 6 : 00 PM on weeknights and from 8 : 00 AM to 9 : 00 PM on weekends . Said covenant shall remain in effect for the life of the church use on the site. The covenant shall be approved as to form and content by the City Attorney' s office and the Department of Community Development . The covenant may be amended or rescinded only after approval by the City and property owners . 4 . Fire Department Requirements are as follows : a . An automatic fire sprinkler system and fire alarm system shall be approved and installed pursuant to Fire Department regulations . b. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. c. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. Staff Report - 8/7/90 -6- (6677d) d. Two on-site fire hydrants shall be provided at locations specified by the Fire Department prior to combustible construction. e. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances, standards and specifications . f . Development shall meet all local and State regulations regarding installation and removal of all underground storage tanks . g . City Specifications 422 and 429 , "Oil Well Abandonment Process" and "Methane Overlay District Requirements" must be adhered to. 5 . Hours of operation and maximum occupancy shall be limited as follows : Weekdays 8 am - 6 pm 164 Weekday National Holidays 1842 Weeknights 6 pm - 10 : 30 pm 300 Friday Night 6 pm - ll. pm 300 Saturday 8am - 6 pm 200 Sunday 8 am - 10 pm 1842 6 . Seating in the sanctuary shall be limited to 1, 842 seats (a maximum of 2, 763 linear feet of pew seating) . 7. There shall be no use of outdoor bells, chimes, public address systems , music, or other source of sound which may disturb adjacent residents . 8 . The parking structure shall incorporate a textured, non-squeal surface. 9 . The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 10 . All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off-site facility equipped .to handle them. 11 . Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 12 . During construction, the applicant shall : a . Wet down areas in the late morning and after work is completed for the day; c. Discontinue construction during second stage smog alerts . 13 . Construction shall be limited to Monday - Saturday 7 : 00--AM to 8 : 00 PM. Construction shall be prohibited Sundays and Federal holidays . 14 . Conditional Use Permit No. 90-16 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 15 . Should a Traffic Impact Fee be adopted by the City Council, the applicant/property owner shall be responsible for paying such fee prior to issuance of a Certificate of Occupancy and/or final building permit approval . 16 . The developer will be responsible for the payment of any additional fees adopted in the upcoming Water Division Financial Master Plan. 17 . A review of the use shall be conducted within six (6) months of the issuance of Certificate of Occupancy and one year after issuance of Certificate of Occupancy. Said review shall be conducted by the Planning Commission at a duly noticed public hearing. The Planning Commission may add, delete or amend conditions of approval as necessary to resolve problems identified at such public hearing. If, at that time, there is any violation of these conditions or the Huntington Beach Ordinance Code, the Planning Commission may revoke Conditional Use Permit No . 90-16 . The applicant may request revised occupancy limits and/or hours of operation at the one-year review. 18 . Prior to issuance of a Certificate of Occupancy, the applicant shall obtain approval of a Transportation Management Plan by the Director of Community Development . The Plan shall outline steps which the applicant will implement to reduce parking demand. Steps may include development of a ridesharing program, incentives to utilize public transportation, or other appropriate measures . Staff has received no new information since the last meeting . 3 . 0 ANALYSIS: The Planning Commission has requested that the proposed project also be analyzed as if it were being converted to an office use. At current parking ratios (1 space per 300 square feet) , office use 1� -5 A-F M-23C of the building would require 143 spaces . At proposed ratios pursuant to Code Amendment No . 88-12 ( 1 space per 250 square feet) the building would require 172 spaces . A total of 164 spaces are provided on the church site . . If- the lower (subterranean) section of the building totalling 6, 009 square feet were utilized as storage area upon conversion to office use, it would be possible to reduce the required parking count to 154 using the proposed ratio of 1/250 . The proposed'. building would conform to all applicable zoning standards for the Office Professional zone if it were converted to office use . The requirements as to setbacks , building height, percentage of landscaping, etc . are the same for a church as for an office building . As can be seen from the zoning matrix in the June 19 staff report, all aspects of the building are in conformance with the code. Although joint use of parking with Seacliff Office Park would not be appropriate for an office use, a reciprocal access agreement with Seacliff Office Park would be necessary to obtain access to the site from Yorktown Avenue or Main Street . At the June 19 Planning Commission meeting, staff distributed a handout which suggested modification of one condition of approval and addition of three conditions . These are as follows : MODIFY: 3 . By reducing the church' s parking demand through ridesharing or other methods, it is less likely that a conflict will occur should another user of the office park wish to park at the site during church hours . Project Description: The Church of Religious Science currently holds services at the Seacliff Shopping Center, as approved by the Planning Commission in 1983 . The congregation' s growth, however, has necessitated new facilities . The proposed, project is located at the northeast corner of Seacliff Office Park.' The site is currently undeveloped except for oil wells , which will be abandoned prior to construction of the church. Access to the site is from Main Street and Yorktown Avenue via the Seacliff Office parking lot . The church proposes to construct a new 42,.000 square foot church building and subterranean parking structure, and to utilize Seacliff Office Park' s existing parking spaces . This joint use of parking i's further discussed below. The proposed two-story building includes a 1, 935 seat sanctuary, classrooms , multi-use rooms , offices , a bookstore and small chapel . In addition to 53 surface parking spaces , 111 spaces will be provided in a one-level subterranean structure. An existing 6 foot high to 14 foot high slump block wall separates the site from adjacent residences and carports at Pacific Ranch, and is proposed to remain. The church facility is to be used primarily on Sundays , at 9 : 00 AM and 11 : 00 AM services . The Planning Commission may grant a reduction in the total number of parking spaces required by the sum of separate uses when it can be shown that the various uses have divergent needs in terms of daytime versus nighttime hours, or weekday versus weekend hours . The distance from the church to the nearest point of the parking lot at Seacliff Office Park is approximately 50 feet . The primary use of the building will be on weekends and weeknights , as opposed to weekdays for the office complex. The weekday users of the church building (approximately 75 people) can be parked on the church site, without need for joint use parking with the offices . The Huntington Beach Company, owners of both Seacliff Office Park and the church site, have agreed to the proposed joint use parking agreement (see attached letter dated May 31, 1990) , and a formal agreement will be recorded prior to issuance of building permits . d . Noise: Noise impacts generated by the number of people using the site on Sunday mornings may affect adjacent residents at Pacific Ranch. Several factors , however, tend to mitigate these impacts . The main entryway to the church faces southwest, away from most residences , and. toward the offices and parking lot . Residences to the north and west will be buffered by a 6 foot wall , carports and drive aisles , and will be a minimum of 105 feet from the exterior of the church building . Residences to the east and southeast are buffered by a 6 foot to 14 foot wall, and distances of approximately 75 feet from the exterior of the building . Staff is recommending conditions of approval to require that the parking structure incorporate textured, non-squeal surfaces, and to prohibit outdoor music, bells , chimes , public address systems , etc. e. Future Uses : The proposed church building will be designed for eventual conversion to an office. It is architecturally compatible with the surrounding office buildings , and will provide enough on-site parking to accommodate conversion to 41, 000 square feet of office use (at 250 square feet per parking space, in accordance with proposed Code Amendment No . 88-12) . The Design Review Board would review and approve any such future modifications . 11. 0 RECOMMENDATION: Staff recommends that the Planning Commission approve Negative Declaration No . 90-13 and Conditional Use Permit No . 90-16 with the following findings and conditions of approval : Staff Report - 6/19/90 -5- (6097d) FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 90-16 : 1 . The location, site layout, and design of the proposed church properly adapts the proposed structure to streets , driveways , and other adjacent structures and uses in a harmonious manner . The building is compatible with adjoining offices and is oriented away from residential developments . 2 . The combination and relationship of one proposed use to another on site, are properly integrated . 3 . The access to and parking for the proposed church does not create an undue traffic problem because adequate parking will be available for joint use . CONDITIONS OF APPROVAL : 1 . The site plan, floor plans and elevations received and dated June 6 , 1990, shall be the conceptually approved layout with the following modification: a . Surface compact spaces shall have minimum 15 foot long paved surface . 2 . Prior to submittal for building permits , the applicant/owner shall complete the following : a . Depict all utility apparatus, such as but not limited to backflow devices and Edison transformers, on the site plan. They shall be prohibited in the front and exterior yard setbacks unless properly screened by landscaping or other method as approved by the Community Development Director. b. Floor plans shall depict natural gas stubbed in at the locations of cooking facilities, water heaters , and central heating units; and low-volume heads shall be used on all spigots and water faucets . C. Elevations shall depict colors and building materials as approved by the Design Review Board on May 17, 1990 . d. All rooftop mechanical equipment shall be screened from any view. Said screening shall be architecturally compatible with the building in terms of materials and colors . If screening is not designed specifically into the building, a rooftop mechanical equipment plan must be submitted showing screening and must be approved. e. If outdoor lighting is included, energy savings lamps shall be used. All outside lighting shall be directed to prevent "spillage" onto adjacent properties and shall be noted on the site plan and elevations . Staff Report - 6/19/90 -6- (6097d) t f . A detailed soils analysis shall be prepared by a registered Soils Engineer . This analysis shall include on-site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties , foundations , retaining walls , streets , and utilities . g . The site is within the Alquist-Priolo region and must be investigated for evidence of faulting prior to issuance of any permits . Evidence of faulting will require the entire project to be re-reviewed by the Planning Commission. The completed geotechnical report , including recommendations for the acceleration to be used for designing the structures on the site, or a statement that the adopted Uniform Building Code is adequate for the seismic design of the structures on the site, shall be submitted to the Public Works Department . The Public Works Department will obtain an independent analysis of the completed geologic report . The cost of this analysis will be' paid by the applicant . When the report has been amended to the satisfaction of the Public Works Department, the City will file the report with the State Geologist . Construction drawings along with calculations and the approved geologic report shall be submitted to the Department of Community Department to complete the permit plan review. h. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. 3 . Prior to issuance of building permits , the applicant/owner shall complete the following : a . A Landscape Construction Set must be submitted to the Departments of Community Development and Public Works and must be approved. The Landscape Construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect and which includes all proposed/existing plant materials ( location, type, size, quantity) , an irrigation plan, a grading plan, an approved site plan, and a copy of the entitlement conditions of approval . The landscape plans shall be in conformance with Section 9608 and Article 963 of the Huntington Beach Ordinance Code. The set must be approved by both departments prior to issuance of building permits . b. A grading plan shall be submitted to the Department of Public Works for review and it must be approved (by issuance of a grading permit) . A plan for silt control for all water runoff from the property during construction and initial operation of the project may be required if deemed necessary by the Director of Public Works . c . The subject property shall enter into a joint use of parking agreement between the subject site and adjacent Seacliff Office Park. A copy of the legal instrument shall be approved by the Community Development Department and the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder . A copy shall be filed with the Department of Community Development . 4 . Fire Department Requirements are as follows : a . An automatic fire sprinkler system and fire alarm system shall be approved and installed pursuant to Fire Department regulations . b. Service roads and fire lanes , as determined by the Fire Department , shall be posted and marked. C . Fire access lanes shall be maintained . If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred . d. Two on-site fire hydrants shall be provided at locations specified by the Fire Department prior to combustible construction. e. The applicant shall meet all applicable local , State and Federal Fire Codes , Ordinances , standards and specifications . f . Development shall meet all local and State regulations regarding installation and removal of all underground storage tanks . g . City Specifications 422 and 429, "Oil Well Abandonment Process" and "Methane Overlay District Requirements" must be adhered to . 5 . Hours of operation shall be limited to Monday through Friday, 8 : 00 AM to 10 : 00 PM; Saturday, 8 : 00 AM to 9 : 00 PM; Sunday use shall be limited to two (2) services . Other use of the building on Sunday shall be ancillary only. 6 . Seating in the sanctuary shall be limited to 1, 935 seats (a maximum of 2, 902 . 5 linear feet of pew seating) . 7 . Construction shall be limited to Monday - Saturday 7 : 00 AM to 8 : 00 PM. Construction shall be prohibited Sundays and Federal holidays . 14 . Conditional Use Permit No . 90-16 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 15 . Should a Traffic Impact Fee be adopted by the City Council, the applicant/property owner shall be responsible for paying such fee prior to issuance of a Certificate of Occupancy and/or final building permit approval . 16 . The Huntington Beach Church of Religious Science occupies approximately 22,000 square feet and includes a 900 seat sanctuary, a chapel, a bookstore, class rooms, ad- ministration offices and counseling facilities. It serves an active congregation of ap- proximately 3,000 people and a visitor mailing list in excess of 16,000 people, predominately comprised of Huntington Beach residents. The church is primarily utilized on Sunday, with three morning services held at approximately 8:00, 9:45 and 11:30. For several years, the church has been "bursting at the seams" in its current facility. The inadequate size of the sanctuary has compelled the church to move from two over-flow- ing services to three highly attended ones. Unfortunately, this third service, which occurs at 11:30, impacts the parking for patrons of the SeaCliff Shopping Center. The church's tremendous success in spiritually serving the community of Huntington Beach has forced it to look for larger facilities. The new facilities must satisfy the following four conditions: 1. For the continued success of the Huntington Beach Church of Religious Science, it must remain near its current location. Churches are as demographically sensitive as com- mercial businesses. Historically, churches struggle and sometimes fail when they move Attachment A ... .._....... a significant distance from their current location. The citizens of Huntington Beach who at- tend the church strongly advocate a relocation,near it3 currant Sits. 2. Huntington Beach Church of Religious Science must occupy larger facilities. The three Sunday services currently provided by the'chu_-ch barely az, ommodate its burgeoning membership. Therefore, for operational and growth reasons, the church chooses to return to two Sunday services.Two Sunday services will greatly diminish the parking impact in the neighborhood, simply because the parking time involved is reduced by one-third. The proposed new facility will house a sanctuary holding 2,000 people, thereby adeWately ac- commodating the congregation in two services. 3. Huntington Beach Church of Religious Science strongly adheres to a policy of en- vironmental and economic responsibility. A 2,000 seat church necessitates a parking lot of approximately six acres. Covering six acres of earth with asphalt does not respect the resources of the church or the city, especially when that asphalt would be maximally used for only three to four hours per week. Joint-use parking and functionally integrated mixed- use projects are a must in our intensely developed Southern California home land. 4. A portion of the success of the Huntington Beach Church of Religious Science comes from its integration into a commercial facility. Our church members are proud to be contributing members of-the business mainstream of Huntington Beach and to have their church home located in a viable commercial center. The new facility is designed for later conversion into an office building, including adequate on-site parking to meet city regula- tions. Should any abandoned oil wells or tanks be encountered, the Fire Department shall be notified and current standards met as required by Article 15 of the Huntington Beach Ordinance Code. Control fugitive dust by regular watering, paving construction roads, or other dust preventive measures. b. Maintain equipment engines in proper tune. 9. Traffic-.Congestion :The .Seacliff Office Park has only half the r*t.mber of entrances of Seacliff S hoppifig Center, and they are Within a half block of Pacific Ranch' s Yorktown and Main Street entrances . The Church' s plop. to reduce Sunday morning services from 3 to 2, puts 1.2- -to 2 times the current number of churchgoers per sery ce:-tiIrough 2 c.s"ttiaZiy entrances . Traffic can enter Seacliff Shopping Center on ` 3 sides of the block; Seacliff Office Par`k' s entrances are between Pacific Ranch entrances on 2 sides of': the block. As Paci.flc Ranch neared build-out, residents were asked to avoid using the Yorktown entrance during peak traffic to reduce back--up on Yorktown. In case of emergency/ disaster (earthquake/explosion/fire) , up to 2000 people from". the church and 1200 to 1500 people from the housing complex would compete for the same exit areas . Pacific Ranch has 4 gates for entering anti leaving the complex directly to the street (Clay, Huntington, Yorktown,and Main) . An additional gate leads into the Yorktown entrance of the Seacliff Office Park -- the Pacific Ranch Board of Directors had investigated eliminating that gate to provide more parking space in the complex. The complex was .not permitted to do that -- . 5 gates were required. : In practical terms, Seacliff Office Park and Pacific Ranch would cancel out each others ability to exit promptly onto Yorktown and Main Street any time mo$t of the residents were home when church services were being conducted. That' s every weekend and evening. I can not believe it would be prudent to add a large capacity auditorium of any sort into a single block, when three quarters of it is covered with high density housing. The scope of this project will also effect our weekend quality of life to the unbearable. When we bought at Pacific Ranch we were told that adventually there would be office buildings on the site-which we do not object to. The noice barriors (existing block walls) will serve no purpose when it comes to noice. Due to the fact the top of the walls are even with our elevated:L-Tront=.ygrds. The staff report states that this is adiquite-we feel this has not been looked into. What about the air conditioning noice which will probably be located on the roof ???? We question the safty of the church access! ! ! Thesis no street access, just parking lot entrances that service the office complex, which were not designed for this use. I see major problems with emergencies like fire. How would cars get out ??? The scope of this church is far to great for this location. If and when a church of this calabar is built, it should -be on a site much better suited for thier.:request. And much more compatible with its neighbors. The parking situation and no direct street access seems to me a reason for the city to reject their request. This church is a growing church and is growing fast. -fhey state they have 3000 active members. Why is the church requesting a 1935 setting facility with 2 sessions on sunday if they don' t plan on additional members???? Where will the new members park as this rapidly growing church grows????? First United Methodist , 2721 Delaware at the corner of 17th St. and Clay was incorporated June 24, 1904. I have been a pastor for 34 years and many of those years I lived next to the church. I have had to answer to neighbors complaining about youth groups, weddings , parties, concerts, parking, organ music, early morning prayer groups , children' s activities, singing and nightly meetings . I have never had more than the 400 members that are at my present church. There is no way that a church the size of the proposed church would be able to conform to the small space surrounded by a residential community. Our church moved to its present location in 1967 when it was alone out here; the neighbors chose to move next to us and they do complain. I chose to move to Pacific _Ranch so I could be near my church, within walking distance. My wife and I inquired as to what would be in that location and we were told it would be an officz- complex. Had we been informed that it would be a church we .would never had bought in Pacific Ranch. Our taxes are very high and we would believe that we could receive some additional study before this would be allowed to happen. Our United Methodist Church has.a board of "Building and Location" and they approve every site for a proposed church. I can assure you they would never allow a church even half the size to be placed in that area. Since we have several "Mega Churches" in Orange County I suggest that a study be made of Calvary Church in Santa Ana, Calvary Chapel in Costa Mesa , E.V. Free in Fullerton, Crystal Cathederal in Garden Grove, St . Andrews Presbyterian in Newport Beach and South Coast Community. Church in Irvine, to name a few. See how much land they have and what types of communities they are in and what problems they have encountered. The proposed church is as large as most of these churches with similar if not more activities than any average church: Church is more than an hours worship on a Sunday morning it is a community and a celebration. We gather to be with our friends. We leave the service happy and full of greeting. We linger in the parking lot and fellowship with people we haven' t seen. We laugh, we sing, we praise the LorcT-and our neighbors don' t understand. We have weddings, pot lucks, concerts and we love to sing. I would not want to be the one to tell 2000 people they can' t celebrate. In order to communicate you need microphones , amplifiers and loud musical instruments. I know how my 200 sound when they are singing "Joy to the World". I can just imagine 2000 singing in a residential neighborhood. Parking has always been a problem for most churches and I know it will be for this one because it is now. I would that we would have many more churches in Huntington Beach and I hope they would all grow as much as the proposed church has grown but to force a large church in between a very nice residential community is not in the best interest of the community of residents or the Community of Faith. We own our home and have lived here for almost five ( 5 ) years now. As you no doubt know, it has taken the residents of Pacific Ranch some time to become aware of the serious impact this application would have on their lives and the value of their property if approved. Frankly, most of them who had heard anything about the application thought the plan was to build the church north of Seacliff Shopping Center . Now that they understand the proposal is to put maybe one of the largest churches in the whole City of Huntington Beach , on that isolated little piece of property surrounded on all four sides by Pacific Ranch residences , they are shocked, angry and feel betrayed by the property owner who assured them, before they purchased their property, that nothing with more dense use than office buildings would be located on that property. They feel this application does not offer acceptable planning. Enclosed you will find an additional Petition signed by more Pacific Ranch residents who - strongly urge you to deny the above referenced application. While it is difficult to asses the impact of the application because it seems like just before every scheduled hearing the Applicant changes his application specifications , it is very clear that this church is very large and is growing at an exceptional rate . It is a shame the Staff Reports I have seen talk about average attendance figures in the past instead of doing any projections on what the attendance figures will be in two ( 2 ) to three ( 3) years when the facility would be completed and occupied. At that time it is obvious the hours of use and numbers of people would be even more overwhelming than the numbers we are talking about now. (Cont'd Next Page ) Chairwoman Geri Ortega, Page 2 . Like so many of the other surrounding residents , I am very concerned about the excessive traffic , the noise , the light , the exhaust fumes , the parking problems and the potential effects of the hazardous waste that is on the property as a result of its use for so many years for oil and gas production. However, another aspect of this application has bothered me from the beginning and that is the potential for a major disaster if the building should catch on fire or if we should have an earthquake with approximately two ( 2) thousand people in the building . Most public buildings , like the one proposed, are located on a major public street where the building occupants would have a reasonable chance of escaping the area and all different types of emergency vehicles would have reasonable access to the building . This is not the case with this proposal . All of these people would be trapped back in a corner surrounded on nearly all four sides by walls and buildings with very limited exit and entrance passage ways that could be critically blocked by people or one or two vehicles ! In closing , as a resident of the City of Huntington Beach, I want to express my sincere appreciation to ,.you for the many many hours of important service you have given to everyone in the community with your work on the Planning Commission. At the last Huntington Beach Planning Commission meeting on August 7 , 1990 , the Planning ,Commission voted 6 to 1 that the Conditional Use Permit No . 90- 16 be denied . The Commission chairwoman stated that she and other Commissioners did not believe the Seacliff Office Park was . a compatible site for the church . They were concerned that putting a church at * that site would cause traffic and noise pollution . They also noted that the site is tucked back inside the Office Park, and there are not adequate entrances or exits for up to 300 cars . I am personally concerned about the accessibility of fire trucks to reach the new facility in case of a fire , especially -during peak usage . I would not _want to be on the City Council and approve such a high density facility , knowing the access is really limited and lives will-_ be .in -.jeopa-idy. The noise , auto traffic, lights and activity associated with a large church use on that site will exceed the intensity normally associated with an office park. We were at the city planning—meeting August 7, 1990 and are aware that the permit was denied. We are also aware the Huntington Beach Church of Religious Science has appealed that decision. My husband and myself oppose this project in this location very much. When we bought at Pacific Ranch we were told by Urban West that when the site was releaved of the existing oil wells that there would be an extension of the exisitng office park, which we did not object to. ( Pacific Ranch was a joint : venture between Urban West and the Huntington Beach Company) We did our homework before we purchased at Pacific Ranch and found that this site had Uses and Zoning for oil production or residential. We were told that it would be office park which all would be acceptable neighbors in our oppinion. We once owned a home neighboring a church of this population, it was a nightmare and one of the reasons we sold and bought at Pacific Ranch. As you can see by _their request the church conducts business every day and very late every night. We feel this conflicts with the piece and tranquility of Pacific Ranch residents . The scope of this project and the amount of its membership using this site night and day will greatly affect our quality of life. The parking situation and no direct street access seems to me reason enough to not allow approximatly 1000 cars on that site at one time. This church is a very fast growing church and will rapidly grow into thier 42, 000 square foot building and beyond. The scope of this church is far to great for this site and will greatly effect Pacific Ranch and the exisiting office park. If and when a church of this calabar is built, it should be on a site much .better suited for their request and much more compatible with its neighbors . I represent Pacific Ranch Homeowners Association and have been appointed chairman of the committee overseeing this project. Pacific Ranch residents are strongly opposed to the granting of this request. We feel that more than sufficient time has elapsed since the Planning Commission's decision was made against the proposed site being placed in such close proximity to a residential community. It is important to note that the applicant was not willing to accept Staff recommendations on occupancy and maximum numbers at the time of the last hearing before the Planning Commission. They are basing their continuance request on the time needed to meet with the land owner and architectural firm to create parking and building use modifications that will satisfy 'neighbors' who are resistant to the project. Considering that we are within less than fifty feet on three surrounding borders of their 'proposed' site, I must assume we are those 'neighbors' they are referring to. This application was denied by the Planning Commission on August 7. This allowed them 55 days in which to come up with an alternate plan, being more than aware of our objections. We have been notified by mail of the time and date of their appeal before the City Council, and many concerned residents have. canceled prior commitments, meetings, classes, etc. in order to attend this hearing and voice their concerns and objections. In addition to this, we have been in an emotional turmoil since being made aware of this project and it will do nothing but further upset our lives if this is postponed. R The Holidays are fast approaching, and we would like this issue resolved so that everyone may relax and appreciate these Important moments spent with our families. Anything less than the finding of an alternate site for their purposes will be considered unacceptable by the residents of Pacific Ranch. We are in agreement that no compromise can be met, given the close proximity to our homes and the subsequent problems this will create, as the residents have shared with you over the past several months. In all honesty, we consider this a stall tactic on the part of the applicant in order to await.the installing of new Council members who are unaraare of the entire situation and will possibly not be given the time needed to be informed by Pacific Ranch residents of the seriousness of the consequences to our community. We ask that you not allow this continuance to occur, based on the time frame that has already been given to the applicant, and on the fact that there is no alternate plan that will be acceptable to the residents of Pacific Ranch. I have spoken to Shelley Stice (Mike Adam' s secretary) about the church's request for a continuance of the above referenced City Council hearing. After conferring with Mike, Shelley instructed me that a letter to you would °suffice to request both the continuance and the delay of the hearing notification mailing to the neighborhood. The church is working with the Huntington Beach Company, the land l�- owner, and Hanes Mencer and Associates, the architectural firm, to create parking and building use modifications that will satisfy the neighbors who are resistant to the project. We do not have sufficient time prior to October 1 for design modifications and exploration of church operational alternatives. We need at least 60 more days and prefer to wait to seta hearing date until we are closer to completion of our plan changes.
