The building design incorporates quality architectural treatment on all sides. 5. The Planning Commission finds that the project will not have a significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA)pursuant to section 15303, Class 3 of the CEQA Guidelines, because the project is designed for an occupant load of 30 persons or less and will not be constructed in conjunction with the building of four or more such structures. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 98-89: 1. The site plan, floor plans and elevations received and dated March 25, 1999 shall be the conceptually approved layout for the subject parcel and shopping center parcel with the following modifications: a. Elevations shall depict the proposed colors in accordance with the colors and materials palette dated March 25, 1999. b. Parking lot striping detail shall comply with Chapter 231 of the Zoning and Subdivision Ordinance and Title 24, California Administrative Code. (Code Requirement) c. Depict all utility apparatus, such as but not limited to back flow devices and Edison transformers on the site plan. Utility meters shall be screened from view from public rights-of-way. Electric transformers in a required front or street side yard shall be enclosed in subsurface vaults. Backflow prevention devices shall be prohibited in the front yard setback and shall be screened from view. (Code Requirement) d. All exterior mechanical equipment shall be screened from view on all sides. Rooftop mechanical equipment shall be setback 15 feet from the exterior edges of the building. Equipment to be screened includes, but is not limited to, heating, air conditioning, refrigeration equipment,plumbing lines, ductwork and transformers. Said screening shall be architecturally compatible with the building in terms of materials and colors. If screening is not designed specifically into the building, a rooftop mechanical equipment plan showing screening must be submitted for review and approval with the application for building permit(s). (Code Requirement) e. Depict all gas meters, water meters, electrical panels, air conditioning units, mailbox facilities and similar items on the site plan and elevations. If located on a building, they shall be architecturally designed into the building to appear as part of the building. They shall be architecturally compatible with the building and non-obtrusive, not interfere with sidewalk areas and comply with required setbacks. f. If outdoor lighting is included, energy saving lamps shall be used. All outside lighting shall be directed to prevent "spillage" onto adjacent properties and shall be shown on the site plan and elevations. g. The parking lot restriping plan for the shopping center parcel (including Carl's Jr.) shall be improved with landscaping improvements valued at a minimum of 10,000 dollars. 2. Prior to issuance of grading permits the following shall be completed: a. The developer shall submit a Landscape Construction Set,prepared by a licensed Landscape Architect, to the Park, Tree and Landscape Division for their approval showing all proposed plantings for the subject parcel and adjacent shopping center. The Landscape Construction Set must be approved by the Departments of Public Works and Planning. The Landscape Construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which identifies the location, type, size and quantity of all existing plant materials on the subject parcel and adjacent shopping center to remain, existing plant materials to be removed, and proposed plant materials; an irrigation plan; a grading plan; an approved site plan and a copy of the entitlement conditions of approval. The landscape plans shall be in conformance with Chapter 232 of the Zoning and Subdivision Ordinance and applicable Design Guidelines and condition l.g. herein. Any existing mature trees that must be removed shall be replaced at a two to one ratio (2:1) with minimum 36 inch box trees and shall be incorporated into the project's landscape plan. (PW) (Code Requirement) b. A grading plan,prepared by a Registered Civil Engineer, shall be submitted to the Department of Public Works for review and approval. (PW) c. A detailed soils analysis shall be prepared by a registered engineer. This analysis shall.include on-site soil sampling and laboratory testing of materials to provide detailed recommendation for grading, chemical and fill properties, retaining walls, streets, and utilities. (PW) d. A "Water Quality Management Plan" shall be prepared in accordance with NPDES requirements by a Civil or Environmental Engineer. (PW) 3. Prior to submittal for building permits, the following shall be completed: a. Zoning entitlement conditions of approval shall be printed verbatim on the cover page of all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing). b. All Fire Department requirements per these conditions shall be noted on the building plans. (FD). c. A detailed soils analysis shall be prepared by a registered Soils Engineer and submitted with the building permit application. This analysis shall include on-site soil sampling and laboratory testing of materials to provide detailed recommendations regarding: grading, foundations, retaining walls, streets, utilities, and chemical and fill properties of underground items including buried pipe and concrete and the protection thereof. (Code Requirement) d. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the subject property. All structures within this development shall be constructed in compliance with the g- factors as indicated by the geologist's report. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review prior to the issuance of building permits. (Code Requirement) 4. Prior to issuance of building permits, the following shall be completed: a. Submit copy of the revised site plan, floor plans and elevations pursuant to Condition No. 1 for review and approval and inclusion in the entitlement file to the Planning Department. b. A grading permit shall be issued. (PW) c. All Public Works fees shall be paid. (PW- Code Requirements) d. Floors shall be designed to drain to an approved oil separator or trap discharging to sewers in accordance with the Plumbing Code per UBC 311.2.3.1. (BD) e. Automatic sprinkler systems shall be installed in the basement area per Uniform Building Code Section 904.2.2 and the Huntington Beach Fire Code Section 1003.2.2. Shop drawings shall be submitted and approved by the Fire Department prior to system installation. (FD) f. A fire alarm system will be installed to comply with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. The system will provide the following: (FD) 1) Water flow, valve tamper and trouble detection 2) Audible alarms 3) Smoke detectors g. Fire extinguishers will be installed and located in areas to comply with Huntington Beach Fire Code Standards. (FD) h. Fire lanes will be designated and posted to comply with City Specification No. 415. (FD) i. Address numbers will be installed to comply with City Specification No. 428. The size of the numbers will be sized a minimum of six (6) inches with a brush stroke of one and one-half (1-1/2) inches. (FD) j. Installation and/or removal of underground flammables or combustible liquid storage tanks shall comply with the Orange County Environmental Health and Huntington Beach Fire Department requirements. (FD) k. The subject property shall provide an irrevocable offer to dedicate reciprocal driveway and parking easement(s) between the subject site and adjacent service station property to the west. The legal instrument shall be submitted to the Planning Department a minimum of 60 days prior to building permit issuance. The document shall be approved by the Planning Department and the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy of the recorded document shall be filed with the Planning Department. (Code Requirement) 1. An interim parking and/or building materials storage plan shall be submitted to the Planning Department to assure adequate parking and restroom facilities are available for employees, customers and contractors during the project's construction phase and that adjacent properties will not be impacted by their location. The applicant shall obtain any necessary encroachment permits from the Department of Public Works. m. Submit a letter of map revision from FEMA declaring the lot(s) exempt from floodplain requirements or submit a copy of completed FEMA Elevation Certificate(s)to the Planning Department. 5. During construction,the applicant shall: a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough to prevent dust raised when leaving the site: b. Wet down areas in the late morning and after work is completed for the day; c. Use low sulfur fuel (.05%) by weight for construction equipment; d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts); e. Discontinue construction during second stage smog alerts. 6. Prior to occupancy and commencement of use, the following shall be completed: a. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District and submit a copy to Planning Department. b. The parking lot shall be restriped and landscaping valued at a minimum of 10,000 dollars, shall be installed on the commercial shopping center parcel. c. The existing water service serving the site may potentially be utilized for irrigation purposes if it is of adequate size, conforms to current standards, and is in working condition as determined by the Water Division. The existing water meter must be replaced with a touch-read meter, and a new conforming back flow protection devices must be installed on the domestic and irrigation water systems. (PW) d. The proposed building shall have a separate fire service and backflow protection device. (PW) e. All improvements to the property shall be completed in accordance with the approved plans and conditions of approval specified herein, including: (PW) 1) The bus zone curb on Adams Avenue, along the frontage of the subject property, shall be re-painted red; 2) The existing driveway on Adams Avenue shall be removed and replaced with a radius driveway per Standard Plan No. 211; 3) The Traffic Impact Fee shall be paid prior to issuance of a certificate of occupancy; 4) The site shall drain through a clarifier and filter system,then to the street; 5) A 6" VCP sewer lateral shall be required f. Compliance with all conditions of approval specified herein shall be accomplished and verified by the Planning Department. Smull Family Trust to establish a 4,631 sq. ft. two-story, drive-through vehicle equipment repair facility (Jiffy Lube) and re-stripe an existing shopping center to include compact parking. The proposed facility is intended to serve consumers within the immediate vicinity. The days and hours of operation are Monday through Friday from 8am to 6pm; Saturday lam to 5pm; and Sunday 9am to 5pm. The project site is zoned and designated in the General Plan for commercial uses. The property constitutes a separate parcel on the north side of the"Drug Emporium/Carl's Jr."commercial center and is subject to recorded CC&Rs and easements, inclusive of parking and access, for the subject retail center. The proposed building will replace an existing 2,482 sq. ft. single-story freestanding building formerly used as a real estate office. STAFF RECOMMENDATION: Staff has evaluated the project with regard to general planning/land use compatibility issues and determined that the subject request will not implement General Plan land use and urban design goals. Staff recommends denial of Conditional Use Permit No. 98-89 for the following reasons: • The project is inconsistent with goals, objectives and policies of the General Plan which encourage distribution of land uses and patterns of development that preserve, enhance and establish a distinct identity for the City's neighborhoods,corridors and centers. • The project is inconsistent with goals objectives and policies of the General Plan which advocate land use distribution to increase shopping centers' viability as centers of community activity. The siting and use of the structure does not facilitate nor encourage pedestrian use. PC Minutes 3 (99PCM525) The proposed automobile-oil change/service drive-through facility would hinder future redevelopment of the existing retail center, including its intensification and re-use to improve its character and identity,by introducing an automotive service facility at a location(along Adams Avenue) which best lends itself to be developed with a pedestrian oriented use/activity. The building does not meet the General Plan intent of quality planning and design. • The proposed parking and circulation would negatively affect pedestrian use/activity on the commercial center. • The proposal is inconsistent with the intent of HBZSO design standards which encourage. minimizing visual intrusion of service bays on surrounding streets and properties and limit the maximum number of service bays to three (3)per site,none of which are permitted to face a public right-of-way. THE PUBLIC HEARING WAS OPENED. Christian Fanticola, 978 Amelia, San Dimas,representing applicant, stated that they have redesigned the proposed project several times to incorporate staff s suggestions and feels the use will enhance the center and be compatible with the neighborhood. Charles Ball, 17631 Fitch Street,Irvine, representing center property owner, gave a brief history of the site and stated that the proposed use will be a viable use in the area. Robert Curry,485 N. Citrus Avenue,#60, Escondido,representing Oilmax, stated that their company is already providing a similar business use in the area and does not believe that the proposed business will be viable. James Kawamura,2355 Main Street,Irvine,representing applicant, stated that the proposed use is of high quality and conforms to the General Plan policies. He stated the proposed use will not hinder future redevelopment of the center and adequate screening is being provided along Adams Avenue. Hal Tucker, 19332 Sangous Lane,representing Oilmax, stated that there are currently ten(10) similar businesses in the area so there is no void in the market for the proposed use to fill. He also agrees with the staff report that the proposed use will not enhance the area. John Dilouro,2355 Main Street,architect representing applicant, stated the business will be run by experienced operators,will have adequate traffic circulation and adequate screening along Adams Avenue. Hamid-Kalhor, 8481 Grace Circle, owner Mobile Station,spoke in opposition to the request as. there are three (3) schools in the area and there are already too many similar uses in the area. Stanley E. Cameron, 9862 Adams,Manager Oilmax, stated the center is currently an eyesore and the proposed use will not encourage redevelopment of the center. Don Untch,20072 Shorewood, concerned with generation of additional traffic and accidents and a concentrated use of similar businesses in the area. Janice Powell, 9191 Adams Avenue, spoke in opposition to the proposed request because it is too close to a residential neighborhood with foot traffic and children playing. She also stated that she is opposed to the increased traffic and noise the proposed use will generate and a _. possible decline in property values for the area. PC Minutes 4 (99PCM525) THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. ( The Commission discussed concerns that the proposed use will increase the dilapidation of the center. It was suggested that the General Plan goals and policies be followed. Other I Commission members felt it complied with the General Plan and with additional conditions of approval would be a viable use for the site. Conditional Use Permit No. 98-89 for the establishment,maintenance and operation of a 4,361 sq. ft. vehicle equipment repair facility and re-striping of the commercial center to include 65 compact spaces will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. The project will improve the overall appearance of the intersection and complement the adjacent commercial center. The proposed Jiffy Lube would also act as the impetus for future redevelopment of the existing retail center and will provide an additional service to the residents and a revenue source to the City. 2. The conditional use permit will be compatible with surrounding uses due to the commercial character of the neighboring center and the existing service stations at the Adams and Magnolia Avenue intersection. The proposed service bay screen walls are properly. integrated within the building design. 3. The proposed vehicle repair facility will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located. The project complies with the development standards,parking and landscaping requirements of Chapter 211,231, and 232 respectively. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of General Commercial on the subject property. In addition, it is consistent with the following goals and policies of the General Plan: PC Minutes 5 (99PCM525) Policy LU 10.1.4 Require that commercial buildings and sites be designed to achieve a high level of architectural and site layout quality. Submit a letter of map revision from FEMA declaring the lot(s) exempt from.floodplain requirements or submit a copy of completed FEMA Elevation Certificate(s)to the Planning Department. 5. During construction,the applicant shall: a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough to prevent dust raised when leaving the site: b. The existing water service serving the site may potentially be utilized for irrigation purposes if it is of adequate size, conforms to current standards, and is in working condition as determined by the Water Division. The existing water meter must be replaced with a touch-read meter, and a new conforming back flow protection devices must be installed on the domestic and irrigation water systems. (PV ) d. The proposed building shall have a separate fire service and backflow protection device. ('W) e. All improvements to the property shall be completed in accordance with the approved plans and conditions of approval specified herein,including: (PW) 1) The bus zone curb on Adams Avenue, along the frontage of the subject property,shall be re-painted red; 2) The existing driveway on Adams Avenue shall be removed and replaced with a radius driveway per Standard Plan No. 211; 3) The Traffic Impact Fee shall be paid prior to issuance of a certificate of occupancy; 4) The site shall drain through a clarifier and filter system,then to the street; 5) A 6"VCP sewer lateral shall be required f. Compliance with all conditions of approval specified herein shall be accomplished and verified by the Planning Department. g. All building spoils, such as unusable lumber,wire,pipe, and other surplus or unusable material, shall be disposed of at an off-site facility equipped to handle them. h. If the lot is not considered exempt by FEMA, a second elevation certificate shall be submitted to the Planning Department for the project"as built." 7. The use shall comply with the following: a. There shall be no outside storage of vehicles,vehicle parts, equipment or trailers. c. All repair work shall be conducted wholly within the building;no servicing of vehicles outside of the building. d. Hours of operation shall be limited to between 7:00am—8:00pm(Monday through Sunday). e. Only the uses described in the narrative attached to the May 25, 1999 Planning . Commission Staff Report shall be permitted. f. No vehicles shall encroach into the 24 ft. wide reciprocal access to the adjacent service station. 8. The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan,elevations and floor plans are proposed as a result of the plan check process. Building permits shall not be issued until the Planning Director has reviewed and approved the proposed changes for conformance with the intent of the Planning Commission's action and the conditions herein. If the proposed changes are of a substantial nature, an amendment to the original entitlement reviewed by the Planning Commission may be required pursuant to the HBZSO. Conditional Use Permit No. 98-89 for the establishment, maintenance and operation of a 4,361 sq. ft. vehicle equipment repair facility and re-striping of the commercial center to include 65 compact spaces will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. The project will improve the overall appearance of the intersection and complement the adjacent commercial center. The proposed Jiffy Lube would also act as the impetus for future redevelopment of the existing retail center and will provide an additional service to the residents and a revenue source to the City. 2. The conditional use permit will be compatible with surrounding uses due to the commercial character of the neighboring center and the existing service stations at the Adams and Magnolia Avenue intersection. The proposed service bay screen walls are properly integrated within the building design. 3. The proposed vehicle repair facility will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located. The project complies with the development standards, parking and landscaping requirements of Chapter 211,231, and 232 respectively. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of General Commercial on the subject property. In addition, it is consistent with the following goals and policies of "the General Plan: Policy LU 10.1.4 Require that commercial buildings and sites be designed to achieve a high level of architectural and site layout quality. Policy LU 10.1.12 Require that Commercial General uses be designed and developed to achieve a high level of quality, distinctive character, and compatibility with existing uses and development including the consideration of g. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off-site facility equipped to handle them. h. If the lot is not considered exempt by FEMA, a second elevation certificate shall be submitted to the Planning Department for the project"as built." 7. The use shall comply with the following: a. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. c. PROJECT PROPOSAL: Applicant: KHR Associates/Tamara Schippers 2355 Main Street Irvine, CA 92614 Location: One hundred and sixty (160) ft east of the Adams Avenue and Magnolia Street intersection, on the south side of Adams Avenue. Conditional Use Permit No. 98-89 represents a request for the following: A. Construct a 4,631 sq. ft. two-story (plus basement) structure pursuant to Section 211.04 CO, CG, and CV Districts: Land Use Controls; B. Establish a drive-through vehicle equipment repair use (Jiffy Lube) pursuant to Section 211.04 Vehicle Equipment Repair, and L-5 Limited Facilities, of ZSO; and C. Re-stripe the commercial center parking area to include compact parking pursuant to Section 231.20. Compact Parking of the ZSO. The proposed facility will replace an existing, vacant 2,482 sq. ft. real estate office building. The subject parcel is part of a commercial center with reciprocal parking and access. The Jiffy Lube structure consists of three levels. A customer waiting area and six service/repair bays are proposed to be located on the ground level. Technicians will perform vehicle repairs from the basement level, thus eliminating the need to install pneumatic lifts. Storage and mechanical equipment area will be accommodated on the third level. A gazebo and trellis/screen wall is proposed adjacent to Adams Avenue. The facility will operate Monday through Friday from 7:00 am to 8:00 pm. Thirteen employees consisting of a manager, assistant manager, cashier and 10 automotive technicians (5-9 employees per shift) will be present at the facility at any one time. Six vehicles may be serviced within the building at one time. The applicant anticipates that the facility will serve a maximum of 50-75 customers per day, with weekend business being higher but not exceeding 100 customers per weekend day. Re-striping of the subject parcel, adjacent Carl's Jr. parcel and commercial center parcel are part of the request. This involves elimination of 11 of the 12 parking spaces on the subject parcel and an increase of the parking on the commercial center and Carl's Jr. site from 333 to 360 parking spaces (inclusive of 65 compact spaces which constitute 18% of total parking). HistooL A request for the establishment of a similar facility (CUP No. 96-58/ Jiffy Lube) was presented to the Planning Commission in 1996. Staff did not support the request due to concerns related to vehicular circulation egress/ingress to the building, lack of adequate on- site parking, inconsistency with the General Plan and automobile repair bay screening. The applicant continued the project three times in order to work out a mutually acceptable circulation plan with Carl Karcher Enterprises (adjacent Carl's Jr.) who opposed the development at that time. The case was closed in September 1997 for failure to submit revised plans and payment of fees required for two public hearing continuances. B. PLANNING COMMISSION MEETING AND RECOMMENDATION: On May 25, 1999 the Planning Commission considered Conditional Use Permit No. 98-89 associated with the development of the Jiffy Lube facility. Four speakers representing the applicant spoke in favor of the project. Six additional members of the public spoke against the project raising concerns relating to project inconsistency with General Plan goals and objectives, land use incompatibility with adjacent residential areas and overconcetration of automotive service uses in the immediate vicinity. Staff recommended denial of the Conditional Use Permit. The Commission discussed concerns that the proposed use will further contribute to the dilapidation of the center and hinder future redevelopment of the existing retail center. It was suggested that the General Plan goals and policies be followed. The Planning Commission evaluated additional pertinent project issues and approved the project with conditions requiring landscaping improvements on the shopping center parcels to bring it in conformance with the ZSO. The reason for the upgrade was due to the fact that the majority of the required parking for the Jiffy Lube facility is on the shopping center parcel, there is reciprocal access and parking between all shopping center parcels including the Carl's Jr. parcel, and the Jiffy Lube and shopping center parcels are owned by the same property owner. C. APPEAL: On June 3, 1999, L. C. Smull (project property owner) dba Business Properties Development Company, submitted an appeal of the May 25, 1999, Planning Commission action to approve Conditional Use Permit No. 98-89 with conditions requiring landscape improvements on the shopping center parcels adjoining the Jiffy Lube parcel (ATTACHMENT NO. 5). The cited reasons for appealing the imposed landscaping conditions on the adjoining shopping center parcels are as follows; the Carl's Jr. parcel is owned by a separate entity, the review and scope of conditions for the Jiffy Lube application in relation to the shopping center site should be limited to adequacy of parking and circulation and should exclude landscaping, implementation of Planning Commission's conditions requiring additional landscaping will reduce the amount of parking for the shopping center and thereby adversely limit the allowable uses on the site. On June 4, 1999, Oil Max and Mobil Oil submitted an appeal of the Planning Commission's action (ATTACHMENT NO. 6). The cited reasons for the appeal were; project non- compliance with the General Plan, opposition by adjacent property owners, traffic, overconcentration of automotive service facilities within immediate area, non-pedestrian friendly nature of subject land use, land use inconsistency with development of neighborhood commercial businesses along Adams Avenue. D. STAFF ANALYSIS AND RECOMMENDATION: The project site is located on the south side of Adams (designated Primary path/ Image corridor/ Landscape corridor) and east of Magnolia Street, (designated secondary path/Image corridor), within a "Commercial Node" /General Plan subarea (8A). According to the General Plan this commercial node, centrally located within the City's Southeast Residential District, is intended to act as a focal point of activity and primarily serve the surrounding residential neighborhood and the greater community. The existing commercial center within which the subject parcel is located, due to its site design, architecture and lack of pedestrian orientation, currently lacks distinctive character and identity and contributes to Adams and Magnolia Avenues' lack of character and clarity of location. CD99-52 -5- 07/26/99 5:17 PM REQUEST FOR ACTION MEETING DATE: August 2, 1999 DEPARTMENT ID NUMBER: CD99-52 An analysis of the proposal in terms of its compliance with General Plan (goals, objectives and policies) and applicable Zoning and Subdivision development standards (parking, landscaping, circulation etc.) follows. 1) General Plan— Land Use Compatibility The proposed project is inconsistent with goals and objectives of the City's General Plan and the Land Use Element designation of General Commercial (CG) on the subject property which encourage introduction of a diversity of uses in commercial centers that improve their relationship with the surrounding residential neighborhoods and increase their viability as places of community activity; and siting and design of structures to facilitate and encourage pedestrian activity. Specifically the development plan does not comply with the following General Plan goals, objectives and policies: Goal LU8 Achieve a pattern of land uses that preserves, enhances, and establishes a distinct identity for the City's neighborhoods, corridors and centers. Objective LU8.1 Maintain the pattern of existing land uses while providing opportunities for the evolution, including intensification and re-use, of selected subareas in order to improve their character and identity. Objective LU 10.1 Provide for the continuation of existing and the development of a diversity of retail and service commercial uses that are oriented to the needs of local residents, serve the surrounding region, serve visitors to the City, and capitalize on Huntington Beach's recreational resources. Policy LU 10.1.11 Promote the introduction of a diversity of uses in Commercial General centers, particularly those containing anchor grocery stores that improve their relationship with surrounding residential neighborhoods and increasing their viability as places of community activity. These may encompass such uses as adult or child daycare facilities, community meeting rooms, "neighborhood"restaurants, entertainment, and cultural facilities. Based on the 1996 General Plan which specifies City goals objectives and policies that advocate re-planning and re-use of areas to establish a distinct identity for City neighborhoods, corridors and centers, and promote pedestrian oriented development proposals, findings for project approval can not be supported by staff. Staffs position is based on the following: The Land Use element of the General Plan identifies as an "issue" the fact that the City contains few well-defined places that are characterized by community activity and a high level of identity. It states that most areas of the City have been developed as automobile- oriented environments that pose a challenge to neighborhood interactions. The Urban Design Element of the General Plan largely attributes lack of character and clarity of location for Path/ Image corridors to the array of strip commercial centers, such as the "Drug Emporium/Carl's Jr." retail center, along primary and secondary paths. Current City land use policies are intended to address the aforementioned issues. The General Plan sets forth "city-wide" as well as "by land use category" goals objectives and policies for future distribution and pattern of development in order to achieve a pattern of land uses that preserves, enhances and establishes a distinct identity for the City's neighborhoods, corridors, and centers (Goal LU 8). It is the City's objective (Objective LU 8.1) to maintain the pattern of existing land uses while providing opportunities for the evolution, including intensification and re-use of selected sub-areas in order to improve their character and identity. General Plan goals, objectives, and policies for General Commercial (CG) land uses encourage introduction of a diversity of uses in commercial centers (LU 10.1, LU 10.1.11,), particularly those containing anchor stores such as grocery and drug stores, to improve their relationship with the surrounding residential neighborhoods and increase their viability as centers of community activity. These include uses such as adult or daycare facilities, community meeting rooms, "neighborhood" restaurants, entertainment, cultural facilities etc. The General Plan advocates design and development policies which encourage siting and design of structures to facilitate and encourage pedestrian activity and siting of building in proximity to the street frontage to convey a visual relationship to the street and sidewalk (LU 10.1.12). Based on the above information, staff finds the proposed demolition of an existing office/retail structure and its replacement with an automotive repair facility at the subject location contrary with the intent of City goals objectives and policies and planning principles which encourage pedestrian oriented community supporting uses/site design. Furthermore, partial redevelopment of the site would hinder future attempts to comprehensively redevelop the commercial center as a unit thus eliminating or diminishing the negative impact of"strip commercial center" appearance and improving the economic viability of the shopping center and aesthetic quality/character of Adams and Magnolia. CD99-52 -9- 07/26/99 5:01 PM REQUEST FOR ACTION MEETING DATE: August 2, 1999 DEPARTMENT ID NUMBER: CD99-52 2) Building Design— Orientation: The ZSO defines vehicle/equipment repair as the "Light repair and sale of goods and services for vehicles, including brakes, muffler, tire shops, oil and lube, and accessory uses, but excluding body and fender shops, upholstery, painting\ and rebuilding, or reconditioning of vehicles." The proposed oil and lube service functions similarly to a service station but without the sale of motor fuel. The applicant indicates that in addition to the oil and lube service, the technicians vacuum vehicles interior, wash windows, check tire pressure, and provide additional services such as changing other vehicle fluids and replacing windshield wipers. These services are often found in full-service service stations which are subject to design standards contained in Section 230.32 of the ZSO. ZSO Section 230.32.D.3 states: "Service bay openings shall be designed to minimize the visual intrusion on surrounding streets and properties. A maximum of 3 service bays shall be permitted per site, none of which shall face a public right-of-way." The proposed building is designed with six (6) overhead doors, three (3) along Adams Avenue and three (3) on the rear of the building facing south towards the front of other businesses in the commercial center. The three door and service bays oriented towards Adams Avenue will be partially screened by a berm/wall/open lattice screen. Staff believes that the proposed design does not meet the intent of the code and City requirements pertaining to full screening/enclosing service areas previously imposed by the Planning Commission on similar businesses within the immediate vicinity such as the Oil Max at 9868 Adams Ave which was approved in 1986. At that location the building is setback considerably from Adams Avenue and the three service bays facing Adams Avenue are fully screened. With regard to the proposed architectural building design, staff believes that although "in a vacuum" the building design and materials are acceptable, in the context established by General Plan goals and objectives and policies, it does not meet the intent for quality planning and design. 3) Parking: The drive-through auto service facility is proposed to be constructed on a parcel which is currently occupied by a freestanding one-story building, formerly used as a real estate office. The subject site and adjoining multi-tenant commercial center are owned by the same entity. The property was developed in conjunction with the commercial center and is subject to common CC&Rs and reciprocal access and parking agreement associated with the shopping center development. A total of 353 parking spaces were required for the entire center based on a ratio of one parking space per 200 square feet of commercial area. The developer provided 356 parking spaces. In July of 1996, the Zoning Administrator approved Conditional Use Permit No. 96-38 to allow 10% of the floor area of the entire commercial center to be parked at a warehouse ratio because of the amount of warehousing/storage areas included in the commercial center. This action effectively reduced the parking requirement for the center to 345 parking spaces. The parking requirement for the Jiffy Lube facility (15 parking spaces) is greater than that of the existing retail space (12 parking spaces) which is proposed to be demolished. In addition modifications in the mix/ square footage occupied by shopping center tenants has further changed the number of parking spaces required for the shopping center and parking lot area re-striping is necessary to comply with ZSO parking requirements. The applicant has submitted information on current tenant/use of the center and based on this data it was determined that a total of 359 parking spaces should be provided, inclusive of the 15 parking spaces required for the Jiffy Lube facility, to comply with ZSO parking requirements. It should be noted that the 359 minimum parking requirement takes into account the reduction in parking previously allotted for warehouse/storage areas within the subject commercial center site. The submitted plan depicts 361 parking spaces (296 standard/ 65 compact), however, modification to the proposed parking stall striping across from the commercial center's easterly property line, adjacent to building F, will be necessary to meet minimum parking width requirements. This modification will result in a loss of two parking spaces and reduction of total parking stalls for the commercial center to 359 stalls. Commercial Center CUP.9638Appro►red71! Stacking for six vehicles has been provided in two rows behind the service bays on the subject parcel. A four ft. wide landscaped planter is proposed to separate vehicular traffic accessing the adjacent drive- through restaurant (Carl's Jr.) and Jiffy Lube patrons. Customer parking would be available across the driveway separating the Jiffy Lube facility from the rest of the commercial center. The applicant projects (Attachment No. 3) that the proposed express lube business would serve between 50-75 customers per weekday and up to 100 customers per weekend day. Vehicles will be driven in /out of the service bays by employees only and the vehicle service process will take a maximum of 5 minutes to complete. The applicant states it would be highly unlikely the proposed six vehicle queuing area will ever be completely occupied at any given time. Even with all service bays occupied and assuming 10% of the total customer traffic generated present within a 5 minute period the queuing area would provide sufficient area to accommodate customer vehicles and keep the shared driveway south of the facility clear of inbound traffic. In addition the applicant anticipates, since most customers call before going to an express lube facility, the operator would be able to schedule arrivals, if necessary, to minimize traffic congestion and customer waiting. Staff believes that although the proposed building/land use siting is not optimum, the applicant has satisfactorily addressed vehicle stacking and sight distance requirements. It is anticipated that the proposed land use would not impact on street traffic patterns/ circulation, however, the nature of the proposed automotive service land use, and inherent circulation pattern associated with it would negatively affect pedestrian use/activity on the commercial center site. In addition, staff wishes to note the possibility of potential vehicle stacking area overflow onto the southerly shared driveway if the aforementioned volume or service performance time projections by the applicant are exceeded. Also, the location of customer parking is undesirable. Those seeking a service estimate will park on the east of the driveway aisle and walk across the driveway to the customer service office. This poses a safety concern. Ideally the driveway should be closed and parking provided adjacent to the building. 5) Landscaping: The submitted plans depict a 16.5 ft. wide landscape planter area along Adams Avenue in front of Jiffy Lube. A two ft. high landscaped berm is proposed in conjunction with a screen wall structure, evergreen flowering vines, shrubs and accent plants within this planter. CD99-52 -12- 07/26/99 5:17 PM REQUEST FOR ACTION MEETING DATE: August 2, 1999 DEPARTMENT ID NUMBER: CD99-52 Additional landscaping areas will be provided along the westerly and easterly building walls, and between the Jiffy Lube parcel and the southerly-adjoining portion of the shopping center parking lot. Three existing end-parking isle planters are proposed to be reconfigured/ relocated to accommodate the proposed development plan and existing affected trees are proposed to be relocated as necessary or removed and replaced, in accordance with HBZSO landscaping requirements, with new trees. A total of approximately 2,766 sq. ft. of landscaped area (18.4%) will be provided on the Jiffy Lube site exceeding the minimum applicable 8% landscaped requirement. E. REVISED SUBMITTAL On June 29, 1999 a revised site plan for the subject development proposal with landscaping improvements on the shopping center site to comply with ZSO requirements and Planning Commission conditions of project approval for the Jiffy Lube facility was submitted to the Planning Department (ATTACHMENT NOA). The subject plan provides the necessary landscaping improvements along street frontages and is in compliance with parking ratio and landscaping requirements for the overall site. The project property owner (L.C. Smull - Appellant) has recognized that the revised shopping center site plan complies with the Planning Commission's landscaping improvement conditions and ZSO requirements but does not endorse the plan because it would require relocation of one driveway and restriping of the parking lot area thus, in his opinion, deeming this solution cost prohibitive. Staffs opinion is that the revised site plan is superior to that previously presented by the Jiffy Lube applicant because it provides landscaping in compliance with ZSO requirements for the entire shopping center, accommodates parking stalls adjacent to the Jiffy Lube facility to serve the subject use, improves the Carl's Jr. drive through traffic and adjacent parking circulation. F. SUMMARY Staff is not able to support this project because of fundamental underlying issues related to the type of land use, its location and service bay orientation to a major arterial/ image path/ landscape corridor. Staff finds the proposed development inconsistent with General Plan goals and objectives which encourage distribution of land uses and patterns of development that preserve, enhance and establish a distinct identity for the City's neighborhoods, corridors and centers. In fact staffs opinion is that development of the drive-through auto-service facility will not increase the shopping center's viability as a center of community activity and would hinder its future redevelopment by introducing an automotive service facility at a location which should be developed with a use which would foster pedestrian use. CD99-52 -13- 07/26/99 5:17 PM REQUEST FOR ACTION MEETING DATE: August 2, 1999 DEPARTMENT ID NUMBER: CD99-52 Staff recognizes and agrees with the General Plan statement that correcting existing problems, related to fundamental land use patterns, distribution and form of development, will necessitate the recycling and reuse of numerous sites, a process which inherently is much more difficult to achieve than the development of vacant properties due to costs and possible opposition to change. This recycling and reuse process is necessary to improve the quality of life for the citizens of Huntington Beach. Shortsighted or incremental decisions for the development of individual parcels inconsistent with the General Plan's vision for the City would be detrimental in achieving long term General Plan goals. Redevelopment of the subject parcel with a freestanding building and introducing an automotive service facility at the proposed project site will diminish opportunities for comprehensive redevelopment of the center with a pedestrian orientation. The proposed project, by virtue of its location and land use operation, will preclude future opportunities to re-plan the commercial center in a manner that would establish a well defined continuous street edge and would create a desirable pedestrian environment, screen parking, reduce underutilized service areas, encourage public use of space, and visually strengthen the Adams/Magnolia Avenue intersection, thus improving the character and identity of the Magnolia and Adams corridors. Staff recommends denial of the proposal based on noncompliance with the General Plan and HBZSO issues outlined in the analysis section of this report. Environmental Status: The proposed project is categorically exempt pursuant to Class 3, Section 15303 of the California Environmental Quality Act which states commercial buildings on sites for such use, if designed for an occupant load of 30 persons or less, if not constructed in conjunction with the building of four or more of such structures, and if not involving the significant use of hazardous substances are exempt from environmental review. Conditional Use Permit No. 98-89 for the establishment, maintenance and operation of a 4,631 sq. ft. vehicle equipment repair facility and re-striping the commercial center to include 65 compact parking spaces will be detrimental to the value of the property and improvements in the neighborhood. The project is inconsistent with goals objectives and policies of the General Plan which encourage distribution of land uses and patterns of development that preserve, enhance and establish a distinct identity for the City's neighborhoods, corridors and centers. It negatively affects pedestrian use/activity on the commercial center. The building design does not meet the General Plan intent of quality planning and design. 2. The conditional use permit will not be compatible with surrounding uses. The project is inconsistent with goals objectives and policies of the General Plan which advocate land use distribution to increase shopping centers' viability as centers of community activity. In addition, the proposed Jiffy Lube facility would hinder future redevelopment of the existing retail center, including its intensification and re-use to improve its character and identity, by introducing an automotive service facility at a location which lends itself to be developed with a pedestrian oriented use/activity. 3. The proposed vehicle equipment repair facility will not comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance. The proposal is inconsistent with the intend of HBZSO design standards which encourage minimizing visual intrusion of service bays on surrounding streets and properties and limit the maximum number of service bays to three (3) per site, none of which are permitted to face a public right-of-way. 4. The granting of the conditional use permit will adversely affect the General Plan. Such action will not be consistent the following goals and policies of the General Plan: Goal L U8 Achieve a pattern of land uses that preserves, enhances, and establishes a distinct identity for the City's neighborhoods, corridors and centers. Objective LU8.1 Maintain the pattern of existing land uses while providing opportunities for the evolution, including intensification and re-use, of selected subareas in order to improve their character and identity. Policy LU 10.1.11 Promote the introduction of a diversity of uses in Commercial General centers,particularly those containing anchor grocery stores that improve their relationship with surrounding residential neighborhoods and increasing their viability as places of community activity. These may encompass such uses as adult or child daycare facilities, community meeting rooms, "neighborhood" restaurants, entertainment, and cultural facilities. The Planning Commission finds that the project will not have a significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA)pursuant to section 15303, Class 3 of the CEQA Guidelines, because the project is designed for an occupant load of 30 persons or less and will not be constructed in conjunction with the building of four or more such structures. Conditional Use Permit No. 98-89 for the establishment,maintenance and operation of a 4,361 sq. ft. vehicle equipment repair facility and re-striping of the commercial center to include 65 compact spaces will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. The project will improve the overall appearance of the intersection and complement the adjacent commercial center. The proposed Jiffy Lube would also act as the impetus for future redevelopment of the existing retail center and will provide an additional service to the residents and a revenue source to the City. 2. The conditional use permit will be compatible with surrounding uses due to the commercial character of the neighboring center and the existing service stations at the Adams and Magnolia Avenue intersection. The proposed service bay screen walls are properly integrated within the building design. 3. The proposed vehicle repair facility will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located. The project complies with the development standards,parking and landscaping requirements of Chapter 211,231, and 232 respectively. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of General Commercial on the subject property. In addition, it is consistent with the following goals and policies of the General Plan: Policy LU 10.1.4 Require that commercial buildings and sites be designed to achieve a high level of architectural and site layout quality. Policy LU 10.1.12 Require that Commercial General uses be designed and developed to achieve a high level of quality, distinctive character, and compatibility with existing uses and development including the consideration of a. incorporation of site landscape,particularly along street frontages and in parking lots; (99CL05254) b. linkage of buildings by common architectural design, landscape and pedestrian systems, to avoid the appearance of independent freestanding structures surrounded by parking; The proposed structure incorporates variable massing and modulation, a gazebo structure and open space trellis screen,providing an interesting fagade along Adams Avenue. The building design incorporates quality architectural treatment on all sides. 5. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 98-89: 1. The site plan,floor plans and elevations received and dated March 25, 1999 shall be the conceptually approved layout for the subject parcel and shopping center parcel with the following modifications: a. Elevations shall depict the proposed colors in accordance with the colors and materials palette dated March 25, 1999. b. Parking lot striping detail shall comply with Chapter 231 of the Zoning and Subdivision Ordinance and Title 24, California Administrative Code. (Code Requirement) c. Depict all utility apparatus, such as but not limited to back flow devices and Edison transformers on the site plan. Utility meters shall be screened from view from public rights-of-way. Electric transformers in a required front or street side yard shall be enclosed in subsurface vaults. Backflow prevention devices shall be prohibited in the front yard setback and shall be screened from view. (Code Requirement) d. All exterior mechanical equipment shall be screened from view on all sides. Rooftop mechanical equipment shall be setback 15 feet from the exterior edges of the building. Equipment to be screened includes,but is not limited to,heating, air conditioning, refrigeration equipment,plumbing lines, ductwork and transformers. Said screening shall be architecturally compatible with the building in terms of materials and colors. If screening is not designed specifically into the building, a rooftop mechanical equipment plan showing screening must be submitted for review and approval with the application for building penmit(s). (Code Requirement) e. Depict all gas meters, water meters, electrical panels, air conditioning units,mailbox facilities and similar items on the site plan and elevations. If located on a building,they shall be architecturally designed into the building to appear as part of the building. They shall be architecturally compatible with the building and non-obtrusive, not interfere with sidewalk areas and comply with required setbacks. (99CL0525-5) f. If outdoor lighting is included, energy saving lamps shall be used. All outside lighting shall be directed to prevent "spillage" onto adjacent properties and shall be shown on the site plan and elevations. g. The parking lot restriping plan for the shopping center parcel (including Carl's Jr.) shall include landscaped areas in accord with Chapter 232 of the Zoning Subdivision Ordinance. Section 232.12,Exceptions of the Zoning Subdivision Ordinance would apply. 2. Prior to issuance of grading permits the following shall be completed: a. The developer shall submit a Landscape Construction Set,prepared by a licensed Landscape Architect,to the Park,Tree and Landscape Division for their approval showing all proposed plantings for the subject parcel and adjacent shopping center. The Landscape Construction Set must be approved by the Departments of Public Works and Planning. The Landscape Construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which identifies the location,type, size and quantity of all existing plant materials on the subject parcel and adjacent shopping center to remain, existing plant materials to be removed and proposed plant materials; an irrigation plan; a grading plan; an approved site plan and a copy of the entitlement conditions of approval.- The landscape plans shall be in conformance with Chapter 232 of the Zoning and Subdivision Ordinance and applicable Design Guidelines. Any existing mature trees that must be removed shall be replaced at a two to one ratio (2:1)with minimum 36 inch box trees and.shall be incorporated into the project's landscape plan. The rest of the shopping center shall be brought up to the HBZSO landscaping requirements including a minimum 10' wide landscaped planter along Adams Avenue,minimum 6' wide landscaped planter along Magnolia Street, 6%of the site landscaped, one 24"box tree well for every 10 parking spaces. One 36"box tree per 45 feet of linear frontage, and irrigation systems providing 100%coverage. (PW) b. A grading plan,prepared by a Registered Civil Engineer, shall be submitted to the Department of Public Works for review and approval. (PW) c. A detailed soils analysis shall be prepared by a registered engineer. This analysis shall include on-site soil sampling and laboratory testing of materials to provide detailed recommendation for grading, chemical and fill properties,retaining walls, streets,and utilities. (PW) d. A"Water Quality Management Plan"shall be prepared in accordance with NPDES requirements by a Civil or Environmental Engineer. (PW) (99CL0525-6) ( - C 3. Prior to submittal for building permits, the following shall be completed: a. Zoning entitlement conditions of approval shall be printed verbatim on the cover page of all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing). b. All Fire Department requirements per these conditions shall be noted on the building plans. (FD). c. A detailed soils analysis shall be prepared by a registered Soils Engineer and submitted with the building permit application. This analysis shall include on-site soil sampling and laboratory testing of materials to provide detailed recommendations regarding: grading, foundations, retaining walls, streets,utilities, and chemical and fill properties of underground items including buried pipe and concrete and the protection thereof. (Code Requirement) d. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the subject property. All structures within this development shall be constructed in compliance with the g-factors as indicafed by the geologist's report. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review prior to the issuance of building permits. (Code Requirement) 4. Prior to issuance of building permits,the following shall be completed: a. Submit copy of the revised site plan,floor plans and elevations pursuant to Condition No. 1 for review and approval and inclusion in the entitlement file to the Planning Department. b. A grading permit shall be issued. (PW) c. All Public Works fees shall be paid. (PW-Code Requirements) d. Floors shall be designed to drain to an approved oil separator or trap discharging to sewers.n accordance with the Plumbing Code per UBC 311.2.3.1. (BD) e. Automatic sprinkler systems shall be installed in the basement area per Uniform Building Code Section 904.2.2 and the Huntington Beach Fire Code Section 1003.2.2. Shop drawings shall be submitted and approved by the Fire Department prior to system installation. (FD) (99CL0525-7) f. A fire alarm system will be installed to comply with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. The system will provide the following: (FD) 1) Water flow,valve tamper and trouble detection 2) Audible alarms 3) Smoke detectors g. Fire extinguishers will be installed and located in areas to comply with Huntington Beach Fire Code Standards. (FD) h. Fire lanes will be designated and posted to comply with City Specification No. 415. (FD) i. Address numbers will be installed to comply with City Specification No. 428. The size of the numbers will be sized a minimum of six(6)inches with a brush stroke of one and one-half (1-1/2) inches. (FD) j. Installation and/or removal of underground flammables or combustible liquid storage tanks shall comply with the Orange County Environmental Health and Huntington Beach Fire Department requirements. (FD) k. The subject property shall provide an irrevocable offer to dedicate reciprocal driveway and parking easement(s)between the subject site and adjacent service station property to the west. The legal instrument shall be submitted to the Planning Department a minimum of 60 days prior to building permit issuance. The document shall be approved by the Planning Department and the City Attorney as to form and content and,when approved, shall be recorded in the Office of the County Recorder. A copy of the recorded document shall be filed with the Planning Department. (Code Requirement) 1. An interim parking and/or building materials storage plan shall be submitted to the Planning Department to assure adequate parking and restroom facilities are available for employees, customers and contractors during the projects construction phase and that adjacent properties will not be impacted by their location. The applicant shall obtain any necessary encroachment permits from the Department of Public Works. m. Submit a letter of map revision from FEMA declaring the lot(s) exempt from floodplain requirements or submit a copy of completed FEMA Elevation Certificate(s)to the Planning Department. 5. During construction,the applicant shall: a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough to prevent dust raised when leaving the site: (99CL0525-8) b. Wet down areas in the late morning and after work is completed for the day; c. Use low sulfur fuel(.05%)by weight for construction equipment; d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts); e. Discontinue construction during second stage smog alerts. 6. Prior to occupancy and commencement of use,the following shall be completed: a. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District and submit a copy to Planning Department. b. The parking lot shall be restriped and landscaping installed on the commercial shopping center parcel so that it conforms to provisions of Chapter 231 and 232 of the Huntington Beach Zoning& Subdivision Ordinance per Conditions l.g. and 2.a..herein. c. The existing water service serving the site may potentially be utilized for irrigation purposes if it is of adequate size, conforms to current standards, and is in working condition as determined by the.Water Division. The existing water meter must be replaced with a touch-read meter,and a new conforming back flow protection devices must be installed on the domestic and irrigation water systems. (PW ) d. The proposed building shall have a separate fire service and backflow protection device. (PW e. All improvements to the property shall be completed in accordance with the approved plans and conditions of approval specified herein, including: (PW ) 1) The bus zone curb on Adams Avenue,along the frontage of the subject property, shall be re-painted red; 2) The existing driveway on Adams Avenue shall be removed and replaced with a radius driveway per Standard Plan No.211; 3) The Traffic Impact Fee shall be paid prior to issuance of a certificate of occupancy; 4) The site shall drain through a clarifier and filter system,then to the street; 5) A 6"VCP sewer lateral shall be required f. Compliance with all conditions of approval specified herein shall be accomplished and verified by the Planning Department. g. All building spoils,such as unusable lumber,wire,pipe, and other surplus or unusable material, shall be disposed of at an off-site facility equipped to handle them. (99CL0525-9) h. If the lot is not considered exempt by FEMA, a second elevation certificate shall be submitted to the Planning Department for the project"as built." 7. The use shall comply with the following: a. There shall be no outside storage of vehicles,vehicle parts, equipment or trailers. c. All repair work shall be conducted wholly within the building; no servicing of vehicles outside of the building. d. Hours of operation shall be limited to between 7:00am—8:00pm(Monday through Sunday). e. Only the uses described in the narrative attached to the May 25, 1999 Planning Commission Staff Report shall be permitted. f. No vehicles shall encroach into the 24 ft. wide reciprocal access to the adjacent service station. 8. The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan,elevations and floor plans are proposed as a result of the plan check process. Building permits shall not be issued until the Planning Director has reviewed and approved the proposed changes for conformance with the intent of the Planning Commission's action and the conditions herein. If the proposed changes are of a substantial nature, an amendment to the original entitlement reviewed by the Planning Commission may be required pursuant to the HBZSO. INFORMATION ON SPECIFIC CODE REOUIREMENTS: 1. Conditional Use Permit No. 98-89 shall not become effective until the ten-day appeal period has elapsed. 2. Conditional Use Permit No. 98-89 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 3. The Planning Commission reserves the right to revoke Conditional Use Permit No. 98-89, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4.. All applicable Public Works fees shall be paid. (PV ) 5. Traffic Impact Fees shall be paid at the time of final inspection or issuance of a Certificate - of Occupancy. (PV ) (99CL0525-10) 6. All signs shall conform to applicable Planned Sign Program for the retail center. Prior to installing any new signs, or changing sign faces, a building permit shall be obtained from the Planning Department. 12.The applicant shall submit a check in the amount of$38.00 for the posting of the Notice of Exemption at the County of Orange Clerk's Office. The check shall be made out to the County of Orange and submitted to the Planning Department within two (2)days of the Planning Commission's action. The site currently contains a 2,500 SF frame and stucco building that has been vacant since February of 1995. .The proposed project would entail demolition of the existing building and replacement with new construction of a lube facility. The lube facility will contain a cashiers service desk, a small waiting area, and restrooms, In addition,an exterior gazebo has been designed for customers who wish to wait outside. The project's land use zoning designation is Commercial General (CG) which allows for automobile services with a Use Permit. The project architecture, building materials, colors and site plan are designed to complement the existing shopping center and the proposed use. The proposed project js designed under the Huntington Beach Zoning Ordinance Zone CG development standards, and has lot coverage of 13%. Per an October 2, 1998 letter from Amy Wolfe, this site is designated in the General Plan Sub- area map as Community' Commercial. Ms. Wolfe's letter referred to the Community Development Chapter of the Land Use Element in regard to site development requirements. The goal (LU 10) of Commercial Districts and Corridors is to "achieve the development of a range of commercial uses", and the objective (LU 10.1) is to "provide for the continuation of existing and the development of a diversity of retail and service commercial uses that are oriented to the needs of local residents,"and"serve the surrounding region". Per a Staff Report by Susan Pierce dated November 12, 1996, the project is consistent with the goals and objectives 'of the General Plan's Land Use Element Commercial General designation and complies with the CG General Commercial requirements of that zone. It is our understanding that the project has been previously denied because the use is not pedestrian friendly. As the specific use of this building will not be attracting pedestrians, this is not seen to be art issue. '..The balance of the center is very pedestrian friendly, and this particular building is well separated from pedestrian uses. However, to better accommodate any pedestrian traffic, access has been provided to the project via sidewalks to both the front and the adjacent parcel through the gazebo. This project either meets or exceeds every development standard set for zone requirements. The staff objection'to the orientation of the building has been addressed by the addition of a trellis structure as an integral part of the landscape plan. This structure, in addition to a 2' landscape berm, will act as a support for flowering evergreen vines that will visually screen the _ service bay doors from Adams Avenue. 2355 Main Street -Suite 120 (949)756-6440 . We feel that the propose_d building greatly complements s the existing center in both use and design. Tqe staff concern of possible circulation conflict with the drive-through traffic will not occur because of the way the site circulation is designed. All customers leaving the Carl's Jr. to the east will use the drive aisle immediately in front of the shopping center buildings until they reach the aisle to the exit driveway. There are only ten parking spaces in the center's_ parking - lot that may, because of their northward orientation, create any potential for exiting through the driveway adjacent to the proposed Jiffy Lube project. The drive aisle at this access is currently designed at 28' minimum; and expands to 32'-35' at the turn radius to allow a maximum of flexibility. The odds of all ten cars exiting through the proposed project drive aisle atone time, which would be the;only way to create a potential conflict, are highly improbable. In general, the express tube business has proven to be an extremely low generator of traffic. Statistics show that even the most successful express lube facilities generate between 50 and 75 customers per day in 3-bay facilities capable of servicing 8 vehicles (2 per bay in tandem) at any given time.Weekend counts are generally higher, but rarely approach 100 per weekend day. Operationally, during non-peak hours of business, a service writer is available to greet customers as they drive up to the entrance queuing area. Since the services offered at an express lube are .limited (i.e., fluid and filter changes only, no repair), and since most customers know what services they want (e.g. oil change), the service writer is able to immediately fill out the necessary forms and direct the customer to the cashier inside the building. This process takes a maximum of five minutes to complete. Once inside, services are paid for immediately, and the customer is then free to wait for service to be completed. It should be noted that, once information on a customer is entered into the operator's computer system, any subsequent service visits are automatically entered .by simply coding In the vehicle license pla±e number - thereby speeding up customer service in the queuing area. Vehicles are driven into and out of the service bays by employees only. By OSHA law, and from a liability point of view, customers are not allowed in the.service bays. Due to the low number of customers generated per day by express lube facilities, it is highly unlikely that the queuing araa will ever by completely.occupied at any given time. Even with all service bays occupied, and if 10% of the total customer traffic generated showed up all at once within a 5 minute period, a six vehicle queuing area would provide sufficient capacity to keep the shared driveway completely clear of inbound customer traffic. Furthermore, since most customers call before going to an express tube facility, the operator is able to schedule arrivals, if necessary. By the very competitive nature of the business, where quick service is critical to building repeat customers, it is not in the interest of the operator to make customers wait too long for service. As the owner of the land on which Jiffy Lube filed the subject C.U.P. 98-89 and owner of a portion of the adjacent commercial property in accordance with Chapter 248 of the Huntington Beach Zoning and Subdivision Ordinance Section 248.20, we appeal the condition above mentioned for the following reasons: 1. The "adjacent commercial property" is not entirely owned by us and we have no control of compliance with such condition by the owner of the Carl's Jr. property. 2. The "adjacent commercial property" was developed prior to June 7, 1983. Section 232.08 Al. requires 8% of the total net site area to be landscaped and Section 232.08 Cl. requires a 10 foot wide landscaped strip adjacent to street. However, Section 232.2 Exceptions requires 6% and a 6 foot wide planter for property built prior to June 7, 1983. The condition is therefore, ambiguous. The scope of the.review and conditions on the Jiffy Lube application should be limited to adequacy of parking and vehicular circulation as to the adjacent commercial property. 4. In this report, the staff strongly recommended against this proposal based on several legal qualifications, which are not in compliance with the General Plan for the City of Huntington Beach. As a result of our research and the Staff Report, we strongly urge the City Council of Huntington Beach to reject the proposed project. We respectfully request the Council to adhere to the guidelines set forth in prior commercial development proposals regarding established planning practices and deny the Conditional Use Permit as proposed. The summation of our research and that of the staff report clearly focuses on those items that are inconsistent with the General Plan. They are as follows: 1.) The project does not comply with the city's goals, objectives and policies as it strictly pertains to the General Plan which encourages land uses to enhance community centers, neighborhoods and corridors regarding General Commercial use. 2.) The project does not comply with land uses and patterns of development for the City's General Plan and urban design goals. 3.) The project does not enhance the land use of the shopping center nor does it increase the centers viability as a place for community activity as it pertains to the General Plan. 4.) The project does not facilitate nor encourage pedestrian use. In fact,the higher volume of vehicle traffic entering and exiting the proposed facility could cause potential harm to pedestrians. It will also inhibit the accessibility to the center by foot traffic. 5.) The project does not meet the General Plan of quality planning and design with compliance to building standards currently in use for the existing shopping center and its facilities. 6.) The project does not lend itself as a positive addition to the community when it puts local residents and its pedestrians in competition with"right- of-way"use with larger volumes of vehicle traffic ranging from compacts to large trucks. Page 2 of 2 Denial Findings 7.) The project does not fulfill a community nor residential"need". 8.) The project does not lend itself to sound business practices when applied to all the principles of the General Plan. In fact, three of the four major US oil companies on the corner of Adams and Magnolia have failed in their attempts to operate a lube%oil business forcing them into operating "gas/convenience store"types of facilities. Only one remains after years of competition--Mobil. This is a strong indication that another such facility is not warranted,particularly in this area. 9.) The project does not comply with the General Plan regarding parking and pedestrian use/activity in a commercial center. The proposed facility will mandate redesign of the parking area. The proposed replacement of "compact parking"is not in compliance with other standards required by other commercial centers. By allowing excessive"compact"parking spaces in lieu of"standard" size parking spaces sets an inappropriate precedent and negates those who previously had to comply with the General Plan. Previous projects coming into our community have had to comply in strict accordance with parking requirements. 10.) The project does not meet with the intent of HBZSO design standards which encourage min• i�ng visual intrusion of service bays of any kind on surrounding streets and properties. 11.) The project does not meet the three (3)bay per site requirement when the design purely indicates bays will be in length sufficient to handle not one car per bay but two (2)cars per bay in automotive industry language known as"piggyback bays". This is usually done with the intent of dealing with high volumes of business and traffic. 12.) The project does not meet the HBZSO design standards when any of the service bays face a public right-of-way(Adams Avenue)regardless of whether there is a barrier such as a hedge or even a large amount of lattice work. Even a large frontage wall to hide the open bays is not in compliance with the General Commercial concept of enhancing the center. In fact, it will serve to visually block some of the center's retail outlets. rJMMUN!'rt PErM uh We acknowledge by signature that we oppose the plan and concept of allowing another automobile lube center, known as Jiffy Lube, to open in our immediate area. The area of concern is at the corner of Adams Avenue and Magnolia-- Avenue. Our local area has far too many similar facilities and does. not need another. Therefore, we the residents, ratepayers. and local business owners of Huntington Beach formally request the Council'to reject this proposed business entity on August 2, 1999. My husband and 1 are very-concemed with the - property being altered and rebuilt-as a Jiffy Lube, and would like the Planning Commission to hear our.... - concerns before any decisions are made. We own it-home just south of the.Drug Emporium shopping center, and we see the traffic problems that exist on a daily basis. There is not a'signal.to get out of the main entrance/exit of that shopping center, and we have personally witnessed too many close calls.with vehicles trying to turn into traffic. This is especially true when there are cars trying to come out.from the bon.Jose/Zubie's parking lot.across they street of the sametime..We feel that building a two story building as proposed would further complicate an already complicated#ask by blocking the,view of vehicles:trying to go into and come out of the shopping center, thus causing_more traffic problems. Living so close to this shopping center,we are also concerned with the added noise this type of business could-bring. We would ask that the Commission consider the residents directly,adjacent to the center,..:. and what we alreadyhave to put up with in.terms of noise brid traffic, before making a decision.; -As business owners ourselves,,we are all for new business ventures and competition, as long as it does not impose on nearby residents. However,there are already too many businesses in this area that provide the same types of services as the"proposed business...There are two locations right at Beach 8 Adams,-an.Oil Max and Goodyear.at Brookhurst&Adams; another Goodyear at Brookhurst&Garfield, along with a Jiffy.Lube soon to open on Magnolia'&Warner. The item was continued from the February 9, 1999 meeting to allow the Planning Commission to establish a sub-committee of three Commissioners to work with staff on issues identified during the public hearing. The sub-committee met with staff over the past three months, including a walking tour of the downtown area's existing outdoor dining establishments. On May 11, 1999 the Planning Commission conducted a study session to review the proposed ordinance, resolution, and license agreement and then continued the public hearing to May 25, 1999. STAFF RECOMMENDATION: Staff recommends the Planning Commission recommend approval of Zoning Text Amendment No.98-4 to the City Council for the following reasons: • The proposed zoning text amendment provides specific standards and procedures for consumption of alcoholic beverages in conjunction with outdoor dining within the Downtown Specific Plan. • The zoning text amendment will contribute to the atmosphere and ambiance of the Downtown area by attracting a clientele consistent with the redevelopment of the downtown. • The proposed zoning text amendment will not adversely impact the City's review and public hearing process. The proposed zoning text amendment is consistent with the goals and policies specified in the Land Use and Economic Development Elements of the General Plan. THE PUBLIC HEARING WAS OPENED. Loretta Wolfe, 411-6t' Street,Downtown Residents Association, spoke in opposition to the request stating that the bars currently operating in the downtown area are a problem and the proposed outdoor dining with alcohol with aggravate the problem. Marie St. Germain, 505 Alabama Street, Downtown Residents Association, spoke in opposition to the request stating that the bars currently operating cause too many problems especially when they close down at night. She stated that this proposal will aggravate the problem. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The Commission suggested a continuance of the proposed request to allow time for staff to explore regulatory options proposed by the Commission,to receive input from the Police Department.
