SUBJECT: HEBREW ACADEMY(CUP 98-90) PUBLIC NOTIFICATION
The public notification labels that were mailed to City of Westminster residents regarding the
Hebrew Academy's appeal to the City Council comply with Section 248.04 of the HBZSO. They
were checked against the WIN DATA 2000 property owner verification software. This software is
furnished monthly by TRW. Per TRW, the property owner information contained in the software is
approximately 45 to 60 days old when received by the City.
The subject labels were checked between September 10 and September 15, 1999 for the October 4,
1999 City Council Meeting. Since the information provided on the software is no more than 60
days old when received by the City, the property owner information is more current than the June
Tax Rolls.

c. The developer shall submit a separate utility plan showing water system improvements,
including service connections to each building, fire hydrant,valves,backflow devices and
other appurtenances in accordance with applicable U.P.C., City ordinances, Public Works
Standards and Water Division design criteria. These plans shall be approved by the
Public Works Water Division and the City of Huntington Beach Fire Department prior to
any construction. (PW)
d. All Public Works fees shall be paid. (PW)
5. During construction,the applicant shall:
a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp
enough to prevent dust raised when leaving the site:
b. Wet down areas in the late morning and after work is completed for the day;
c. Use low sulfur fuel (.05%)by weight for construction equipment;
d. Attempt to phase and schedule construction activities to avoid high ozone days (first
stage smog alerts);
e. Discontinue construction during second stage smog alerts.
6. Prior to f nal building permit inspection and approval,the following shall be completed:
a. All work within City right-of-way shall require a Public Works Construction Permit.

b. The proposed driveway on Willow Lane shall be 27 feet wide (radius type)per Standard
Plan No. 211. (PW)
c. The red curb along the frontage of the project shall be repainted. (PW)
d. A street light shall be placed on the existing pole at the front of the school. (PW)
e. Buses leaving the student drop-off area must be able to turn left with one movement, (no
backing up). Presently,the busses have to utilize the driveway opposite theirs. (PW)
f. The parking lot shall be lit. The lighting shall utilize energy saving lamps. All outside
lighting shall be directed to prevent"spill-over" onto adjacent properties and shall be
shown on the site plan and elevations. Lighting shall be capable of being dimmed to a
minimum-security level during the hours of non-operation of the facility. (PW)
g. The applicant shall obtain the necessary permits from the South Coast Air Quality
Management District and submit a copy to Planning Department.

h. The applicant shall restripe the parking lot so that it conforms to provisions of Chapter
231 of the Huntington Beach Zoning& Subdivision Ordinance.
i. The Hebrew Academy must hire or dedicate an employee to serve as traffic monitor in
order to direct traffic entering and leaving the school site during the time students arrive
and depart each day.
j. All improvements to the property shall be completed in accordance with the approved
plans and conditions of approval specified herein, including:
1) Landscaping;
2) Fire extinguishers will be installed and located in areas to comply with Huntington
Beach Fire Code Standards. (FD)
3) The fire alarm system shall be extended to the new construction and shall comply
with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop
drawings will be submitted to and approved by the Fire Department prior to
installation. The system will provide the following:
a) manual pulls;
b) smoke detectors
c) annunciation; .
d) supervision; and
e) audible alarms (FD)
4) Fire hydrants must be installed before combustible construction begins. Prior to F
installation, shop drawings shall be submitted to the Public Works Department and
approved by the Fire Department. Your project requires one (1) fire hydrant and
shall be installed in compliance with City Specification No. 407). (FD) "
5) Exit signs and exit path markings will be provided in compliance with the
Huntington Beach Fire Code and Title 24 of the California Administrative Code.
Low level exit signs will be included. (FD)
6) The fire access road(Willow Lane extension south of Maple Street) shall be red
curbed with FIRE LANE NO PARKING stenciled in four(4) inch high white
letters. Include dimensions of all access roads in the Circulation Plan. (FD)
7) For Fire Department approval, submit a Fire Protection Plan in compliance with
City Specification No. 426. (FD)
8) Address numbers shall be installed to comply with City Specification No. 428. (FD)
9) All building spoils, such as unusable lumber,wire,pipe, and other surplus or
unusable material, shall be disposed of at an off-site facility equipped to handle them.

7. The use shall comply with the following:
a. The school enrollment shall be limited to no more than 400 students. Any expansion in
number shall require approval by the Planning Commission. (from CUP 88-29
approval)
b. All employee vehicles, student vehicles and school buses shall not be parked on any
public street. They shall be parked on-site or in the Seventh Day Adventist Church
parking lot off of Maple.
c. The loading and unloading driveway at the entrance to the Academy shall be used for
loading and unloading only, no parking. Once students are off or on the buses, the
buses shall be moved so that area shall remain clear for emergency vehicle access.
Buses shall be parked in their designed area on-site when not in use.
8: The existing caretaker's trailer, located adjacent to the south parking lot, shall be replaced
with a permanent building, or completely removed,within five (5)years (by July, 2004) of
this approval. If a permanent building is built,the existing trailer shall be removed from the
premises. The permanent building shall be reviewed and approved by the Design Review
Board prior to issuance of building permits for the structure.
9. A review of the use shall be conducted by the Staff within six(6)months of the issuance of
Certificate of Occupancy or final building permit approval for the first building constructed
to verify compliance with all conditions of approval and applicable Chapters of the
Huntington Beach Zoning & Subdivision Ordinance. Staff will forward a report of the
findings to the Planning Commission.
10. The Planning Director ensures that all conditions of approval herein are complied with. The
Planning Director shall be notified in writing if any changes to the site plan, elevations and
floor plans are proposed as a result of the plan check process. Building permits shall not be
issued until the Planning Director has reviewed and approved the proposed changes for
conformance with the intent of the Planning Commission's action and the conditions herein.
If the proposed changes are of a substantial nature, an amendment to the original entitlement
reviewed by the Planning Commission may be required pursuant to the HBZSO.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:
1. Conditional Use Permit No. 98-90 shall not become effective until the ten-day appeal
period has elapsed.
2. Conditional Use Permit No. 98-90 shall become null and void unless exercised within one
year of the date of final approval or such extension of time as may be granted by the
Director pursuant to a written request submitted to the Planning Department a minimum 30
days prior to the expiration date.
3. The Planning Commission reserves the right to revoke Conditional Use Permit No. 98-90,
pursuant to a public hearing for revocation, if any violation of these conditions or the
Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs.

4. All applicable Public Works fees shall be paid. The developer will be responsible for the
payment of any additional fees adopted in the"upcoming" Water Division Financial Master
Plan. (PV )
5. An encroachment permit shall be required for all work within the right-of-way. (PW)
6. The Traffic Impact Fee shall be paid prior to issuance of certificate of occupancy.
7. A Certificate of Occupancy must be issued by the Planning Department prior to occupying
the building.
8. The development shall comply with all applicable provisions of the Municipal Code,
Building Division, and Fire Department as well as applicable local, State and Federal Fire
Codes, Ordinances, and standards, except as noted herein.
9. Development shall meet all local and State regulations regarding installation and operation
of all underground storage tanks. (FD)
10. Construction shall be limited to Monday- Saturday 7:00 AM to 8:00 PM. Construction
shall be prohibited Sundays and Federal holidays.
11. All signs shall conform to the HBZSO. Prior to installing any new signs, or changing sign
faces, a building permit shall be obtained from the Planning Department.
12. All landscaping shall be maintained in a neat and clean manner, and in conformance with
the HBZSO. Prior to removing or replacing of landscaping, written approval must be
obtained from the Departments of Planning and Public Works. Substantial changes shall
require approval by the Planning Commission.
13. The applicant shall submit a check in the amount of$38.00 for the posting of the Notice
of Exemption at the County of Orange Clerk's Office. The check shall be made out to
the County of Orange and submitted to the Planning Department within two (2) days of
the Planning Commission's action.

Statement of Issue:
Transmitted for your consideration is an appeal by the City of Westminster of the Planning
Commission's approval of Conditional Use Permit No. 98-90. This application represents a
request by the Hebrew Academy to construct a 4,043 square foot kindergarten building (four
(4) classrooms), establish a 4,260 square foot administration building, expand the existing
parking lot by adding 18 parking spaces, and redesign of the student drop-off area.
The Planning Commission approved the request and is recommending approval
(Recommended Action) because: 1) Expansion of the parking lot and the redesign of the
student drop-off area will improve circulation and reduce traffic and parking impacts on the
site and surrounding neighborhood; 2) Ongoing maintenance problems on the property have
been resolved; 3) Maximum enrollment of 400 students, conditioned in a previous
entitlement, remains the same. Staff is recommending approval because: 1) The expanded
parking lot and new classroom and administration buildings are located on the interior of the
school site and are adequately buffered from the surrounding neighborhood; 2) The
expanded parking lot and new classroom and administration buildings will be compatible with
the surrounding neighborhood in that the operation of the Hebrew Academy is similar to an
elementary school for which the site was previously used; and 3) The project is consistent
with the land use designation of Public/Semipublic of the General Plan and conforms with all
applicable provisions of the Huntington Beach Zoning and Subdivision Ordinance.

The appeal is based on the City of Westminster's assertion that the expansion of the Hebrew
Academy is not exempt from CEQA processing and should be continued for further
environmental analysis (Alternative Action No. 1). The City of Westminster claims that the
Hebrew Academy improvements are incompatible with the surrounding neighborhood (The
site is bounded on the north and east by the City of Westminster) and requests that a traffic
study and mitigated negative declaration or focused EIR be prepared to address the
following issues: 1) Increased vehicle trips and traffic congestion; 2) Insufficient on and off-
site parking; 3) Inadequate emergency access; 3) Increase in noise levels; and 4) Air quality
degradation.

detrimental to the general welfare of persons working or residing in the vicinity or
detrimental to the value of the property and improvements in the neighborhood. The new
classroom and administration buildings will be located within the interior of the school and
buffered from the residential neighborhood by the existing playing field. A landscape planter
will buffer vehicles from the expanded parking lot to the residential neighborhood, and the
driveway width for the student drop-off area will be widened to better accommodate busses
entering and leaving the school site.
2. The conditional use permit will be compatible with surrounding uses because buffering for
all proposed uses will be provided by the playing field or other landscaping. In addition,the
operation of the Hebrew school is similar in nature to that of an elementary school and is
therefore compatible with the residential neighborhood. Additionally, the student drop-off
area has been expanded and will now allow school busses to exit without encroaching onto
adjacent properties
3. The proposed classroom and modular administration buildings,parking lot expansion, and
redesigned student drop-off area will comply with the provisions of the base district and
other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision
Ordinance and any specific condition required for the proposed use in the district in which it
will be located. The classroom and administration buildings conform to setbacks and
building height, and the parking lot and student drop-off area conform to drive aisle width,
landscaping, setbacks and all other provisions of the Huntington Beach Zoning and
Subdivision Ordinance. -
4. The granting of the conditional use permit will not adversely affect the General Plan. It is
consistent with the Land Use Element designation of Public on the subject property. In
addition, it is consistent with the following goals and policies of the General Plan:
a. L U 13.1 Provide for the continuation of existing and development of new uses,
such as governmental administrative,public safety,human service, cultural, educational,
infrastructure, religious, and other uses that support the needs of existing and future
residents and businesses.
b. L U 13.1.2 Allow for the continuation of existing and development of new religious
facilities in any land use zone where they are compatible with adjacent uses and subject
to the City review and approval.

The expansion of the existing Hebrew Academy school facility conforms to the goals and
policies of the General Plan in that the Academy supports educational, cultural and religious
activities for those attending the school as well as the surrounding community. Additionally,
the school site is compatible with the surrounding residential neighborhood as its operation is
similar in nature to an elementary school for which the school site was previously used.
5. The City Council finds that the project will not have any significant effect on the
environment and is exempt from the provisions of the CEQA pursuant to Section 15301 of
the CEQA Guidelines because it is a minor alteration of existing facilities involving less than
10,000 square feet in area and the project is in an area where public services and facilities are
available to allow for maximum development permissible in the General Plan.
CONDITIONS OF APPROVAL—CONDITIONAL USE PERMIT NO. 98-90
1. The site plan, floor plans and elevations-received and dated April 22, 1999 shall be the
conceptually approved layout with the following modifications:
a. Elevations shall depict colors and building materials proposed as approved by.the Design
Review Board.
b. The parking lot shall be restripped to include dedicated parking spaces for school buses
when not in use and a student drop-off/pick-up area. Parking lot striping detail shall
comply with Chapter 231 of the Zoning and Subdivision Ordinance and Title 24,
California Administrative Code. (Code Requirement)
c. Depict all utility apparatus, such as but not limited to back flow devices and Edison
transformers on the site plan. Utility meters shall be screened from view from public
rights-of-way. Electric transformers in a required front or street side yard shall be
enclosed in subsurface vaults. Backflow prevention devices shall be prohibited in the
front yard setback and shall be screened from view. (Code Requirement)
d. All exterior mechanical equipment shall be screened from view on all sides. Rooftop
mechanical equipment shall be setback 15 feet from the exterior edges of the building.
Equipment to be screened includes,but is not limited to, heating, air conditioning,
refrigeration equipment,plumbing lines, ductwork and transformers. Said screening shall
be architecturally compatible with the building in terms of materials and colors. If
screening is not designed specifically into the building, a rooftop mechanical equipment
plan showing screening must be submitted for review and approval with the application

e. Depict all gas meters, water meters, electrical panels, air conditioning units, mailbox
facilities and similar items on the site plan and elevations. If located on a building,they

2. Prior to the issuance of grading permits, the following shall be completed:
a. A Grading Plan,prepared by a Registered Civil Engineer, shall be submitted for review

The Planning Commission reviewed and approved the request on July 13, 1999, which is in
compliance with the mandatory processing date to the Planning Commission. The request
was subsequently appealed on July 22, 1999.
Conditional Use Permit No. 98-90 represents a request to upgrade and expand a portion of
an existing Hebrew School (preschool to 12.. grade). Specifically, the Hebrew Academy is
proposing:
■ A 4,043 square foot kindergarten building consisting of four (4) classrooms ranging in
size from 650 square feet to 828 square feet, a 180 square foot kitchen, a 483 square
foot office area, and a 100 square foot bicycle storage yard;
■ The consolidation of six (6) vacant modular trailers, recently donated to the Hebrew
Academy, into a single 4,260 square foot modular administration building;
■ The expansion of the existing 19,470 square foot parking lot with 56 spaces to a 25,656
square foot parking lot with 74 spaces; and
■ The redesign of the student drop-off area at the main entrance to the school.
Additionally, the design theme, reflected in the new kindergarten building, will be expanded
to the remaining buildings on the school site through a phased program and as the school's
budget will allow.
B. PLANNING COMMISSION MEETING AND RECOMMENDATION:
This entitlement was originally presented to the Planning Commission during their June 22,
1999 meeting. At the meeting several people spoke in opposition of the project, stating that
any expansion would further increase traffic congestion in the neighborhood. Additionally,
maintenance on the subject property has been an ongoing issue including overgrown
vegetation, accumulated rubbish and inoperable vehicles in public view. The Planning

Commission continued the request to the July 13, 1999 meeting in order to perform a site
visit and directed staff to research and report on the previous code enforcement issues on
the school site.
During the June 22"d public hearing portion of the Planning Commission, five people spoke
to the Commission regarding the request: three in opposition and two in support. Those in
opposition own property within the adjacent City of Westminster neighborhood. Rabbi
Newman, Director for the Academy, spoke in support of the request. He advised that the
school was constructed in 1960 and the request would improve the aesthetics and parking
problems on the site. Gary Simon, a resident of Phelps Lane stated that his two.children
attend the Academy, which provides an enhanced educational program and a safe
environment.
Steve VanderShaaf, whose mother owns the property directly across the street from the
school spoke in opposition of the project. He stated that with the current configuration of the
student drop-off area, buses must encroach on his mother's property in order to turn back
onto the public street when leaving the site. Further, he was concerned that if enrollment
were to increase, traffic in the neighborhood would worsen. Gladys Hernandez, a resident of
Mahogany Avenue, stated that traffic congestion is especially problematic in front of the
school when children are being dropped off and picked up. Many of the parents park in the
middle or on the opposite side of Willow Lane and allow their children to jaywalk across the
street to enter the school site. She also stated that before the site was purchased by the
Hebrew Academy, the former Clara Cook school had a population of approximately 280
students who mostly walked to school rather than the 400 student now being bused or
dropped off by their parents. Bob Meade, a resident of Glacier Avenue, also spoke in
opposition of the request. He voiced his concerns regarding the potential for increased
traffic on the surrounding neighborhood and the poor condition of the school site. Mr. Meade
also presented photographs to the Planning Commission, which depicted a dilapidated
caretaker's trailer, accumulated rubbish and overgrown vegetation.
On July 6, 1999 staff received .a petition, which was signed by 71 City of Westminster
residents concerned with the potential increase in traffic and noise impacts (Attachment No.
4}. The petition was presented to the Commission during their July 13, 1999 meeting.
Additionally, a letter dated June 28, 1999 was received from Steve VanderSchaaf, who
spoke in opposition of the request at the June 22"d meeting (Attachment No. 5). He
retracted his opposition to the project as he later met with school officials and the applicant's.
representative, who satisfied his concerns.
During the July 13, 1999 Planning Commission meeting, staff presented the previous code
enforcement issues, which were then discussed by the Commission. Several of the
Commissioners had visited the site and stated they did not see a maintenance problem with
the property and felt there were no outstanding code enforcement issues. The
Commissioners discussed the caretaker's trailer, stating that if approved the trailer should be
replaced with a permanent building, or completely removed within five (5) years of the
approval (Included as a condition of approval).

The Planning Commission approved Conditional Use Permit No. 98-90. The Commission
indicated that the proposed upgrades to the school would improve the aesthetics of the site
and reduce the traffic and on-street parking impacts on the surrounding community.
C. APPEAL:
An appeal to the Planning Commission's approval was filed by the City of Westminster on
July 22, 1999 (Attachment No. 2) pursuant to Section 248.20 of the Huntington Beach
Zoning and Subdivision Ordinance. A summary of the appeal is as follows:
■ The City of Westminster states that although the Hebrew Academy is located in the City
of Huntington Beach, access to the school is from Maple Street and Willow Lane in the
City of Westminster. It is this access, proximity to homes in Westminster, and issues
related to traffic, parking, pedestrian safety, noise and air quality, which would negatively
impact City of Westminster property owners and residents if the request were to be
approved.
■ Based on proposed construction, increased enrollment, additional traffic, and related
environmental impacts, the proposed project is not exempt from the California
Environmental Quality Act (CEQA) and, therefore, would require the preparation of a
traffic study and mitigated negative declaration or focused environmental impact report.
Based on Section 248.20.D of the Huntington Beach Zoning and Subdivision Ordinance, the
Conditional Use Permit is reviewed by the City Council as a new matter.
E. STAFF ANALYSIS AND RECOMMENDATION:
The project proposal is fully analyzed in the attached Planning Commission Staff Reports
dated June 22 and July 13, 1999 (Attachment No. 3). The major issues with respect to this
request include land use compatibility, traffic, parking and circulation and appeal issues.
Land Use Compatibility
The Hebrew Academy was established on the former Clara Cook Elementary School site in
August of 1977. The Academy initially leased the site but later purchased it from the
Westminster School District in 1984. At that time the Academy had an enrollment of
approximately 250 students. That number has since expanded to its current population of
approximately 360 students. The Planning Commission in 1988 approved Conditional Use
Permit No. 88-29 to allow an increase in enrollment to a maximum of 400 students. In
comparison, per a representative of the Westminster Unified School District, the average
number of students currently attending an elementary school within the District is
approximately 500. Thus, if the subject property had remained a public elementary school, it
is perceived that the enrollment rate would be similar with that of the remaining school
district. The operation of the Hebrew Academy is similar to an elementary school for which
the site was previously used.

Parking/Traffic/Circulation
As expressed by City of Westminster residents during the Planning Commission meeting,
when delivered by their parents, most students of the Hebrew Academy are dropped-off on
either side of Willow Lane. Congestion often results from both vehicular movements,
including U-turns, as well as school age pedestrians crossing the street between cars, even
though a crosswalk is provided at the intersection of Willow Lane and Maple Street. The
proposed expansion of the parking lot and redesign of the student drop-off area will
decrease much of the traffic on Willow Lane and provide for increased land use
compatibility.
The student drop-off area is located at the front of the school adjacent to the administration
building and is designed in a circular shape. This area is used primarily to drop-off students
from private vehicles and by buses that have picked students up at predetermined locations.
Due to the circular design of the drop-off area, buses, which have a wider turning radius
must encroach onto the residential lot across the street when leaving.the school grounds.
The applicant is proposing to eliminate this problem by installing a drop-off area that will
utilize wider vehicle lanes and increased driveway widths. With the redesign, the turning
radius for buses and vehicles will increase resulting in an exit pattern that will not encroach
on any adjacent properties.
With the addition of two (2) kindergarten classrooms, three (3) additional parking spaces are
required for the site. The Hebrew Academy is increasing the north parking lot from 19,470
square feet with 56 spaces to 25,656 square feet with 74 spaces (an increase of 18 spaces)
bringing the total on-site spaces to 85. With the parking lot expansion, the number of
driveways will increase from one to two, thereby improving the circulation on the lot.
In an effort to further respond to the concerns of the surrounding neighborhood, the Hebrew
Academy will:
■ Periodically send notices.home with students encouraging parents to drop-off students in
designated areas only;
■ Paint the curbface red in front of the school along Willow Lane (Condition of Approval);
and
■ Hold semiannual neighborhood meetings so to keep abreast of neighborhood concerns.
Appeal
The City of Westminster asserts that the proposed project should be continued for further
environmental analysis (mitigated negative declaration or focused EIR) so that traffic and its
associated impacts can be addressed. In addition to further environmental analysis, the City
of Westminster also requests the following conditions be incorporated into the Conditional
Use Permit:

■ Require a master development plan for the Academy;
■ Place a cap on enrollment;

■ Require all Academy buses to access the site via the drive located on the east side of
Fairview Lane north of Briarcliff Drive in the City of Huntington Beach.
When a project has the potential to increase negative environmental impacts on a particular
area, further environmental analysis is warranted. However, staff has determined that the
Hebrew Academy's proposed improvements have the potential to only reduce existing
negative impacts on the surrounding neighborhood. Maximum student enrollment has been
conditioned as part of a previous entitlement. Therefore, vehicular traffic and its associated
impacts, such as circulation, air quality and noise will not increase as it relates to this
entitlement. The proposed improvements to the subject property together with conditions
imposed by the City of.Huntington Beach and voluntary measures proposed by the applicant
will reduce impacts on the existing surrounding neighborhood. The following is staffs
response to the conditions of approval requested by the City of Westminster:
■ A master development plan for the Academy is not neccesary. A previous cap has been
placed on the number of students the Hebrew Academy can enroll. After the
construction of the new kindergarten building the Academy will have the desired student
to teacher ratio. No other new buildings are planned, only aesthetic upgrades to existing
buildings.
■ As part of the Conditions of Approval, the Hebrew Academy must hire or dedicate an
employee to serve as traffic monitor in order to direct traffic entering and leaving the
school during the time students arrive and depart each day.
■ The existing parking lot is being expanded by 6,186 square feet and 18 additonal parking
spaces. A dedicated student drop-off/pick-up area and school bus parking will be
provided on the lot. To prohibit parking on the street, the curb face will also be painted
red.
■ The drive located on the east side of Fairview Lane north of Briarcliff Drive is only a 15
foot wide walkway between two existing single family homes. Per the City of Huntington
Beach Traffic Division, the walkway and adjacent street would be significantly inadequate
to allow for bus activity at this location.

F. SUMMARY
Staff is recommending approval of the Conditional Use Permit based on General Plan and
land use compatibility and mitigated traffic and parking concerns as follows:
■ The project is consistent with the goals and objectives of the City's General Plan and the
Land Use Element designation of Public with an underlying General Plan land use
designation of Residential Low Density on the subject property.
■ An enrollment cap of 400 students has previously been placed on the school and this
project does not affect the cap. ,
■ The existing parking lot and student drop-off area will be expanded and as a condition of
approval, the curbface along Willow Lane will be painted red, thereby reducing negative
traffic and parking impacts on the surrounding neighborhood.
■ Staff has determined the project is exempt from CEQA processing under Section 15301
Class 1. Per CEQA, when exempting a project under this Section, "the key
considersation is whether the project involves negligible or no expansion of an existing
use." Since the Academy's improvements occur entirely within the school site and
student enrollment is not being increased, staff has determined the use is not being
significantly expanded.
Environmental Status:
Staff has determined that the need for a traffic study and preparation of a negative
declaration or focused environmental impact report is not warranted and that the project is
exempt from CEQA for the reason listed below:
■ The proposed project is categorically exempt pursuant to Class 1, Section 15301 of the
I California Environmental Quality Act which states the operation, repair, maintenance, or
minor alteration of existing public or private structures, facilities, mechanical equipment,
or topographical features_involving negligible or no expansion of use beyond that
previously existing, including but not limited to structures that are 10,000 square feet in
area or less and that the project is in an area where public services and facilities are
available to allow for maximum development permissible in the General Plan.

shall be architecturally designed into the building to appear as part of the building. They

2. Prior to the issuance of grading permits,the following shall be completed:

a. Submit copy of the revised site plan, floor plans and elevations pursuant to Condition No.
1 for review and approval and inclusion in the entitlement file to the Planning

b. A Landscape Construction Set must be submitted to the Department of Public Works and
approved by the Departments of Public Works and Planning. The Landscape
Construction Set shall include a landscape plan prepared and signed by a State Licensed
Landscape Architect which identifies the location,type, size and quantity of all existing
plant materials to remain, existing plant materials to be removed and proposed plant
materials; an irrigation plan; a grading plan; an approved site plan and a copy of the
entitlement conditions of approval.
The landscape plans shall be in conformance with Chapter 232 of the Zoning and
Subdivision Ordinance and applicable Design Guidelines. Any existing mature trees
(trunk greater than 24" in diameter)that must be removed shall be replaced at a two to

c. The developer shall submit a separate utility plan showing water system improvements,

f. The parking lot shall be lit. The lighting shall utilize energy saving lamps. All outside

g. The applicant shall obtain the necessary permits from the South Coast Air Quality

h. The applicant shall restripe the parking lot so that it conforms to provisions of Chapter
231 of the Huntington Beach Zoning& Subdivision Ordinance.
i. The Hebrew Academy must hire or dedicate an employee to serve as traffic monitor in
order to direct traffic entering and leaving the school site during the time students arrive
and depart each day.
j. All improvements to the property shall be completed in accordance with the approved
plans and conditions of approval specified herein, including:
1) Landscaping;
2) Fire extinguishers will be installed and located in areas to comply with Huntington

3) The fire alarm system shall be extended to the new construction and shall comply
with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop
drawings will be submitted to and approved by the Fire Department prior to

4) Fire hydrants must be installed before combustible construction begins. Prior to
installation, shop drawings shall be submitted to the Public Works Department and

5) Exit signs and exit path markings will be provided in compliance with the
Huntington Beach Fire Code and Title 24 of the California Administrative Code.

6) The fire access road(Willow Lane extension south of Maple Street) shall be red
curbed with FIRE LANE NO PARKING stenciled in four(4) inch high white
letters. Include dimensions of all access roads in the Circulation Plan. (FD)

City Specification No. 426. (FD)
8) Address numbers shall be installed to comply with City Specification No. 428. (FD)
9) All building spoils, such as unusable lumber,wire,pipe, and other surplus or

7. The use shall comply with the following:
a. The school enrollment shall be limited to no more than 400 students. Any expansion in
number shall require approval by the Planning Commission. (from CUP 88-29
approval)
b. All employee vehicles, student vehicles and school buses shall not be parked on any
public street. They shall be parked on-site or in the Seventh Day Adventist Church
parking lot off of Maple.
c. The loading and unloading driveway at the entrance to the Academy shall be used for
loading and unloading only, no parking. Once students are off or on the buses,the
buses shall be moved so that area shall remain clear for emergency vehicle access.
Buses shall be parked in their designed area on-site when not in use.
8. The existing caretaker's trailer, located adjacent to the south parking lot, shall be replaced
with a permanent building, or completely removed, within five (5) years (by July, 2004)of
this approval. If a permanent building is built,the existing trailer shall be removed from the
premises. The permanent building shall be reviewed and approved by the Design Review
Board prior to issuance of building permits for the structure.
9. A review of the use shall be conducted by the Staff within six(6)months of the issuance of
Certificate of Occupancy or final building permit approval for the first building constructed
to verify compliance with all conditions of approval and applicable Chapters of the
Huntington Beach Zoning & Subdivision Ordinance. Staff will forward a report of the
findings to the Planning Commission.
10. The Planning Director ensures that all conditions of approval herein are complied with. The
Planning Director shall be notified in writing if any changes to the site plan, elevations and
floor plans are proposed as a result of the plan check process. Building permits shall not be
issued until the Planning Director has reviewed and approved the proposed changes for
conformance with the intent of the Planning Commission's action and the conditions herein.
If the proposed changes are of a substantial nature, an amendment to the original entitlement
reviewed by the Planning Commission may be required pursuant to the HBZSO.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:
1. Conditional Use Permit No. 98-90 shall not become effective until the ten-day appeal
period has elapsed.
2. Conditional Use Permit No. 98-90 shall become null and void unless exercised within one
year of the date of final approval or such extension of time as may be granted by the
Director pursuant to a written request submitted to the Planning Department a minimum 30
days prior to the expiration date.
3. The Planning Commission reserves the right to revoke Conditional Use Permit No. 98-90,
pursuant to a public hearing for revocation, if any violation of these conditions or the
Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs.

4. All applicable Public Works fees shall be paid. The developer will be responsible for the
payment of any additional fees adopted in the "upcoming" Water Division Financial Master

6. The Traffic Impact Fee shall be paid prior to issuance of certificate of occupancy.

12. All landscaping shall be maintained in a neat and clean manner, and in conformance with
the HBZSO. Prior to removing or replacing of landscaping, written approval must be
obtained from the Departments of Planning and Public Works. Substantial changes shall
require approval by the Planning Commission.
13. The applicant shall submit a check in the amount of$38.00 for the posting of the Notice
of Exemption at the County of Orange Clerk's Office. The check shall be made out to
the County of Orange and submitted to the Planning Department within two (2) days of
the Planning Commission's action.

The City of Westminster appeals Conditional Use Permit 98-90 (Hebrew Academy) which
was approved by the Huntington Beach Planning Commission at its meeting of July 13,
1999. Enclosed is a check made payable to the City of Huntington Beach in the amount
of$1,490 for the required appeal fee.
Although the Academy is in Huntington Beach, access to the property is from Maple
Street and Willow Lane in Westminster and the property is adjacent to single family homes
also located in Westminster on the south side of Chinook Avenue. It is this access,
proximity to homes in Westminster, and issues related to traffic, parking, pedestrian
safety, noise, air quality, and expansion of the school facility which could negatively
impact property, property owners, and residents in Westminster that necessitates our
appeal.
According to the staff report prepared by the City of Huntington Beach Planning
Department dated June 22, 1999, "The proposed project is categorically exempt pursuant
to Class 1, Section 15301 of the California Environmental Quality Act which states the
operation, repair, maintenance, or minor alteration of existing public or private structures,
facilities, mechanical equipment, or topographical features involving negligible or no
expansion of use beyond that previously existing, including but not limited to structures
that are 10,000 square feet in area or less and that the project is in an area where public
services and facilities are available to allow for maximum development permissible in the
General Plan."
Based on the proposed construction, increased enrollment, additional traffic,and related
environmental impacts, we believe the proposed project is not categorically exempt from
the California Environmental Quality Act pursuant to Class 1 Section 15301. This Section
of the Act exempts a number of projects including additions to existing structures,
however, it does not exempt new"structures. Also, for additions, this Section allows an
exception if the project is in an area where all public services and facilities are available to
allow for maximum development (Residential Low Density) permissible in the General
Plan and the area is not environmentally sensitive. Since Willow Lane and Maple Street
which serve the Academy site are not fully improved, it is possible their current condition
would not allow maximum development of the site. It is also possible sewer, gas, water,
and drainage are not adequate to support maximum development. These factors, if
confirmed, would also preclude a determination that the Academy's new construction is
categorically exempt.
We believe that due process requirements mandate that the hearing on CUP 99-90 must be
readvertised to allow for another public hearing by the Planning Commission after a traffic
study and a mitigated negative declaration or focused EIR have been prepared to address
a number of issues including:

• Potential incompatibility with existing land use in the vicinity
Air Qualky
• Potential degradation
Transportation and Circulation
• Potential increased vehicle trips or traffic congestion
• Potential inadequate emergency access
• Potential insufficient parking onsite or off-site
• Potential hazards or barriers for pedestrians or bicyclists
• Potential increase in noise levels
Public Services
• Potential increased maintenance of streets
Aesthetics
• Potential creation of light or glare
After reviewing the plans and reports prepared by Huntington Beach Planning and the
Academy's architect and receiving comments from area residents, at this time we believe
adoption of the following conditions (in addition to what the traffic study and mitigated
negative declaration or focused EIR would require) would go a long way to make the
Academy, which is in Huntington Beach, more compatible with the residential and
industrial areas in Westminster which all Academy traffic now drives through.
` • Require a master development plan for the Academy site showing maximum build out.
• Place a cap on the enrollment.
• Require the Academy to have a traffic monitor on duty during the time students arrive
and depart each day.
• Require adequate parking for all student, faculty, staff, and visitor vehicles to be
parked on the Academy property.
• Require all Academy buses to access the Academy site via the drive located on the
east side of Fairview Lane north of Briarcliff Drive in the City of Huntington Beach.

proposed 4,043 square foot kindergarten classroom building consists of four(4) classrooms ranging in
size from 650 square feet to 828 square feet, a 180 square foot kitchen, a 483 square foot office area, and
a 100 square foot bicycle storage yard. The request also includes the consolidation of six (6)modular
trailers,recently donated to the Hebrew Academy, into a single 4,260 square foot modular administration
building. Also,the expansion of the existing 19,470 square foot parking lot with 56 spaces to a 25,656
square foot parking lot with 74 spaces and the redesign of the student drop-off area at the main entrance to
the school.
Staff recommends approval of Conditional Use Permit No. 98-90 for the following reasons:
The project will not be detrimental to the general welfare of persons residing in the vicinity. The new
classroom and administration buildings and expanded parking lot are located on the interior of the
school site and will be buffered from the residential neighborhood.
• The new classroom and administration building, and the expansion of the parking lot will be
compatible with surrounding uses. The operation of the Hebrew school is similar to an elementary
school for which the site was previously used.
• The new classroom and administration buildings and expanded parking lot is consistent with the
Public/Semipublic Land Use designation in the General Plan.
• The project exceeds minimum requirements for setbacks, building heights,required parking spaces
and all other provisions of the Huntington Beach Zoning and Subdivision Ordinance.

and a 100 square foot bicycle storage yard. The new classroom building will be located at the front of the
school site adjacent to the main parking lot. The design theme for the proposed classroom building
consists of a slate tile roof, stucco and brick building facades, and stucco tower elements that contain
recessed circular elements. Along with the parking lot expansion,this is the first phase of school's
updating process and will be followed by future project phases as funds become available. It is the
intention of the Hebrew Academy to continue project phasing every one to two years. In addition to the
new classroom building,the applicant is proposing consolidation of six recently donated modular trailers
into a single 4,260 square foot modular administration building. The new administration building will be
located on the southeast portion of the school site and will occupy a small part of the school's playing
field. Parking for the administration's staff of ten will be accommodated on the 11 space parking lot
located directly to the north. The school operates from 8:00 AM to 3:30 PM Monday through Friday with
periodic meetings occurring occasionally during'the early evening.
The proposed parking lot expansion will increase the existing 19,470 square foot parking lot with 56
spaces to 25,656 square feet with 74 spaces. The existing parking lot will be expanded approximately 84
additional feet along the northern property line adjacent to an existing single-family residential
neighborhood. The proposal for the expanded parking lot includes a new seven and a half-foot wide
landscape planter between the parking lot and adjacent residential neighborhood. In addition to the
landscape planter a six-foot high perimeter block wall will provide a buffer between the parking lot and
adjacent residential uses. In addition to the parking lot expansion,the applicant also proposes to redesign
the student drop-off area and include 5 new parking spaces. The spaces are located adjacent to the main
entrance of the school. With its current configuration,the student drop-off area cannot accommodate the
turning radius for the school busses. Due to their wide turning radius,busses must encroach onto the
residential property across the private drive from the student drop-off exit. The redesigned student drop-
off area will incorporate wider driveways,which will allow for a greater turning radius for busses exiting
the site.
The Hebrew Academy was established on the former Clara Cook Elementary School site in August of
1977. The Academy initially leased the site but later purchased it from the Westminster School District in
1984. At that time the school had an enrollment of approximately 250 students. That number has since
expanded to its current population of approximately 400 students and 50 teachers. With the addition of
the new kindergarten classroom building,the Hebrew Academy will include five (5) classroom buildings
with four classrooms each and one classroom building with two (2)classrooms each for a total of 22
classrooms and a student ratio of approximately 17 students per classroom. The applicant is requesting
the expansion to accommodate a recent slight addition to enrollment and to decrease existing class sizes.

The Departments of Building,Public Works,Fire,and Police have recommended conditions that would
be incorporated into the conditions of approval. The Economic Development Department has no
concerns.
Public Notification:
Legal notice was published in the Huntington Beach/Fountain Valley Independent on February 25, 1999,
and notices were sent to property owners of record within a 300 ft. radius of the subject property,the
applicant, and interested parties. As of June 16, 1999,no written or verbal comments for or against the
project have been received.
ANALYSIS:
Staff has reviewed the project and identified the primary issues with the proposed use that are discussed
below: Parking/circulation,Design Theme.
Parking/circulation
The student drop-off area is located at the front of the school adjacent to the administration building and is
designed in a circular shape. This area is used primarily to drop-off students from private vehicles and by
busses that have picked students up at predetermined locations. Due to the circular design of the drop-off
driveway,busses, which have a wider turning radius must encroach onto the residential lot across the
private drive to leave the project site. The applicant is proposing to eliminate this problem by installing a
drop-off area that will utilize wider vehicle lanes and increased driveway widths. With the redesign,the

turning radius for busses and vehicles will increase resulting in an exit pattern that will not encroach on
any adjacent properties.
The existing main parking lot is located on the northeast portion of the school site and contains 56 parking
spaces on 19,470 square feet. The applicant is proposing to expand the existing parking lot to 25,656
square feet with 74 spaces. This expansion will accommodate the increased enrollment the school has
experienced over the past several years and the subsequent increase in the number of teachers and staff
needed to operate the school. With the parking lot expansion,the number of driveways will increase from
one to two, thereby improving the circulation on the lot. A seven and one half-foot wide landscape
planter has been provided along the north property line, which in addition to the six foot high block.wall
will serve as a buffer between the parking lot and the adjacent residential neighborhood.
As part of the review process, and as the subject site is located adjacent to the City boundary, staff
solicited comments from the City of Westminster. In regard to traffic,the City of Westminster
commented that when delivered by their parents,most students of the Hebrew Academy are dropped-off
on either side of Willow Lane. Congestion often results from both vehicular movements, including U-
turns, as well as school age pedestrians crossing the street between cars even though a crosswalk is
provided at the intersection of Willow Lane and Maple Street. With the expansion,the parking lot will be
able to accommodate an additional drop-off area and thereby relieve some congestion on Willow Lane.
Part of the request for this conditional use permit includes installation of a modular administration
building. This building will be located southeast portion of the site. Parking for the building's ten
administrative staff members will be provided on the adjacent parking lot.
Design Theme
The proposed design theme for the new kindergarten classroom building will incorporate slate tile roofs,
stucco and brick building facades,and a stucco tower element that contains a recessed circular element.
This same design theme will be carried on to the remainder of the school buildings, as fagade upgrades
are needed. The applicant has provided a timeline for the improvements,which states most fagade
upgrades will be completed within the next five years.
SUMMARY:
Staff recommends approval of the Conditional Use Permit based on the following:
• The project will not be detrimental to the general welfare of persons residing in the vicinity. The new
classroom and administration buildings and expanded parking lot are located on the interior of the
school site and will be buffered from the residential neighborhood.
• The new classroom and administration building, and the expansion of the parking lot will be
compatible with surrounding uses. The operation of the Hebrew school is similar to an elementary
school for which the site was previously used.
The new classroom and administration buildings and expanded parking lot is consistent with the
Public/Semipublic Land Use designation in the General Plan.
• The project exceeds minimum requirements for setbacks,building heights, required parking spaces
and all other provisions of the Huntington Beach Zoning and Subdivision Ordinance.

(c) Description of project and services:
The"project consists of a facade remodel and tenant improvement at the
existing 2850 S.F. Kindergarten classroom building with a 92 S.F.
restroom addition and an 81 S.F. mechanical yard addition onto the south
side. An 1100 S.F. classroom and office addition will be located at the
northeast corner of the building. The existing 19,470 S.F. parking lot will
be increased to 28,760 S.F. and an existing drive will be reworked to
accommodate parking and a bus stop. The classrooms will be open for
instruction from 8:00 a.m. to 6:00 p.m. Monday through Friday.

STATEMENT OF ISSUE:
Conditional Use Permit No. 98-90 represents a request by the Hebrew Academy to permit construction of
a new kindergarten classroom building, consolidation of six existing trailers into a single administration
building, expansion of an existing parking lot, and the redesign of the student drop-off area.
At the June 22, 1999 meeting,the Planning Commission discussed the history of code enforcement
problems regarding the landscaping and general maintenance of the property and whether or not the
existing caretaker's trailer was allowed by entitlement. The Planning Commission continued the request
and directed staff to:
1. Research the code enforcement history of the property;
2. Research if the existing caretaker's trailer was allowed by entitlement.
In addition, staff has provided a more detailed analysis of the parking requirements. Also,there have
been two (2)letters received by staff since the last meeting.
Code Enforcement History
The following is the code enforcement history in descending chronological order as it pertains to the
Hebrew Academy. Each date indicates that a Notice of Violation was issued,the reason for the notice,
and the code section that had been violated.

on east side of the school property. In addition, several trailers were moved to site
without proper permits (HBZSO 214.06).

The above code enforcement history reflects that the Hebrew Academy has complied with all violations.
Caretaker's Trailer
The caretaker's trailer,presently located adjacent to the south parking lot was approved by the Planning
Commission as part of Conditional Use Permit No. 77-19 on September 7, 1977;the original entitlement
that established the Hebrew Academy at the former Clara Cook Elementary School. At that time the
caretaker's trailer was located at the north side of the site where the school's swimming pool is now
located.
On August 16, 1988,the Planning Commission approved Conditional Use Permit No. 88-29. This was a
request to expand school enrollment from 250 students, allowed in 1977 when the school was established,
to 400 students. In addition,the request included replacement of four(4) existing modular classrooms
and one caretaker's trailer with five new modular units. Per the staff report,"the caretaker's unit would
be primarily used as the living quarters for the caretaker. The Academy found that having someone live
on the grounds greatly reduced vandalism." It should be noted that the request also included a variance to
parking that was denied.
Condition No. 11 of Conditional Use Permit No. 88-29 required that a six-month review be conducted to
ensure compliance with the conditions of approval. Per the staff report to the Planning Commission dated
March 21, 1989, addressing the six-month review, four(4)new modular units had been installed to
replace the previous modular units. However,the caretaker continued to reside in the old trailer,which
had now been moved to the south side of the school grounds. Rabbi Newman,representing the Hebrew
Academy, advised staff that a fifth modular unit for the caretaker had not been purchased due to budget
reasons and that he did not know when the Academy would be able to purchase the additional unit.

At the August 15, 1989 Planning Commission meeting, Cinda Russell, Principal of the Hebrew Academy
addressed the Planning Commission and reported that the site improvements had been completed and
other improvements were planned to be completed. Planning Staff advised the Commission that it would
monitor the site and report back if further improvements were not completed. Condition 9e of Conditional
Use Permit No. 88-29 states that when the new fifth modular building is moved on the premises,the
caretaker's unit shall be removed. Since the fifth modular unit was never purchased,the caretaker's unit
was allowed to remain.
Parking
With the addition of two (2)kindergarten classrooms, three (3) additional parking spaces are required for
the site. The Hebrew Academy is increasing the north parking lot from 56 to 74 spaces (an increase of 18
spaces)bringing the total on-site spaces to 85. The following table represents the parking requirement for

Additional Correspondence
The conditions of approval for Conditional Use Permit No. 98-90 have been revised to reflect Fire
Department recommendations and carry-over of three (3)conditions from the 1988 conditional use
permit. Additionally, staff has received a letter(Attachment No. 2) from Steve VanderSchaaf(the son of
the property owner living across Willow Lane from the subject site),who opposed the project at the June
22, 1999 Planning Commission meeting. The letter states that his previous concerns have been addressed
and that he no longer opposes the project.
Staff has also received a letter from the City of Westminster(Attachment No. 3) requesting staff to
prepare a mitigated negative declaration or focused environmental impact report concerning the subject
property. Staff has determined that the subject site is exempt from environmental review for reasons
outlined in the June 22, 1999 staff report. These reasons include the fact that this is considered a minor
expansion to existing facilities. The site improvements are improving circulation on-site, and the
maximum enrollment of 400 students, conditioned in the 1988 approval, remains the same.

Dear Mr. Thompson,
• I am writing to you today in support of the conditional use permit
(number 98-90) sought by the Hebrew Academy at 14401 Willow Lane.-
As you may recall , my Mother (Lois Teeslink) owns the property at
6302 Maple Avenue. This is the old farm directly across the extension
of Willow Lane from the Academy. I appeared on her behalf at the
planning commission meeting on the evening of 22 June 1999.
I went to the planning commission meeting seeking only additional
details on the bus drop-off modifications. The drawings available
at the time were insufficient to put some of my concerns to rest,
so I filled out a card to speak before the commission.:
My comments were unrehearsed, and given the four-minutes-of-deer-
in-the-headlights nature of my presentaton, I feel that I was
unsuccessful in getting accross my TWO concerns. Furthermore,
in the days since the meeting, I have had those two concerns
addressed to my satisfaction:
Concern 1: The redesign of the student drop-off area is truly
sufficient to allow buses to exit without needing any part of
my mother's property to exit safely without backing up. In
other words, that the changes get done right the FIRST TIME, so
that the Academy need not spend more time and money at a later
date to redo anything if [and when] my mother's property should -
be developed.
Since the meeting, Brion S. Jeannette a Associates were kind enough _
to provide me a NON-reduced copy of the drop-off portion of the
plans. My inspection of the plans puts to rest my reservations
in this area. It is unfortunate that there was insufficient
time prior to the meeting (I received notice on Friday, 18 June)
for me to reach this conclusion without even attending the meeting
or offerring comments.

Concern 2: The phrase in the staff report stating "the operation
of the Hebrew school is similar to an elementary school for which
the site was previously used" would somehow give the Hebrew Academy
'carte blanche' to expand in whatever fashion they chose as long
.as it remained a 'school ' .
This concern has been removed on many fronts since last Tuesday's
meeting. Right off, it was a gross oversimplification that' HB
staff members would continue to use the "a school 's a school" line,
no matter the expansion plans. Also, the specifics of the permit
address general site improvements, rather than seeking a substantial
increase in student capacity (and are a step in the right direction
for improving parking and traffic around the Academy) . Finally,
in a phone conversation, Rabbi Newman makes a valid point when
observing that even an .elementary school .in the 1990 's would have
a higher level of traffic than the 1960's 'neighborhood' elementary
school against which I would compare the Academy.
I wish there were a way to unring the bell , but there isn't. Had I
have known then what I know now, there would have been no comments
from me at the 26 June meeting. I understand that UNbuilding the
Hebrew Academy is not an agenda item. I seek to distance myself from
those who might think otherwise. The components of conditional use
permit number 98-90 would be beneficial to my mother's property.
I am not familiar of the intricasies of the city planning commission
process . If there is still time to gather public comment on the
issue, I would like the contents of. this letter. to be presented
to. the members of the commission. If it is past .the deadline for
additional comments, I would request that although I am not the
police chief (who seems to be exempt from any deadline for the
close of public comments) , perhaps some consideration could be
given to just how late notice of this issue was provided to my
mother and me.

Re: Proposed High School at Willow and Maple
Dear City Council Members,
In regards to the proposed high school to be located near the current
location of the Hebrew Academy Lubavich, on Willow Lane at Maple Ave.
We respectfully request the Council consider the following factors
before approving the project.
Access to the location is prohibitively limited. Traffic has access
from Springdale St. through a residential neighborhood via Mahogany Ave,
or Chinook Ave through the housing tract to Willow Ln. Access from
Edwards St is limited solely to a very narrow Edwards Ave. frontage road
to Maple Ave. The streets and neighborhoods affected could not support
the heavy traffic that a high school would generate.
Traffic flow in the early morning and afternoon can be dangerous.
Anyone traveling down Maple to get to the Hebrew Academy or the
residences west of Willow travel at an excessive speed consistently.
Police monitoring and verbal warnings to the motorists have been
ineffective. This problem would only increase if a high school was
located there.
Every weekday both sides of Maple has vehicles parked the entire
length, except the east end of Maple, on the south side, where there Is
no curb or sidewalk is posted No Parking. However, drivers making
deliveries to the business located on the southwest corner of Maple and
Edwards frontage (a blind V intersection) routinely park in the
eastbound lane of Maple within several feet of the corner to make their
deliveries. This forces vehicles to cross onto the westbound side to
get around them. The Hebrew Academy's parking lot is currently too

small. Vehicles overflow into the surrounding streets for parking.
Carr Towing, which contains a police impound yard, and Cable Crafters
both have large vehicles that must be able to access their facilities at
any time.
This particular section of Maple Ave. is in a state of disrepair that
has gone unnoticed by the City of Westminster, although the problems
have been reported repeatedly. The drainage problem on the south side
is severe. Even after a brief rain, the water literally has nowhere to
go and will gather in front of some of the businesses along Maple, and
depending on the amount of rain, can and does flood to the middle of the
street and over the sidewalk. Anyone wanting to park in these areas can
not exit their vehicle without stepping into calf-deep water. The
ONLY way to remove the water is to pump it out, or wait for it to dry up
on it's own.
A high school located entirely within an area that is accessible only
through a residential neighborhood on one side and a single two lane
street zoned for heavy industrial on the other would only add tenfold to
the problems that already exist in the area. If a high school is
placed there, the cities of Westminster and Huntington Beach can look
forward to constant complaints from the businesses and residents;
traffic congestion so severe that emergency vehicles needing to access
the area to respond to accidents and other calls for assistance (which in
themselves will increase) will not be able to get through without delay.
I invite the city council members to visit the area in the morning at 8:00
am to 8:30 am and again in the afternoon to see the true effect that the
proposed high school will have on the surrounding areas.

BEFORE THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH
NOTICE IS HEREBY GIVEN that on Monday, October 4, 1999, at 7:00 PM in the City Council
Chambers, 2000 Main Street, Huntington Beach, the City Council will hold a public hearing on the
following item:
❑ CONDITIONAL USE PERMIT NO. 99-90 (HEBREW ACADEMY IMPROVEMENTS)
(APPEAL): Applicant: Brion S. Jeanette& Associates, Inc. Annellant: City of Westminster
Request: Appeal of the Planning Commission's approval for the construction of a 4,043 square
foot classroom building, a 4,260 square foot modular administration building, expansion of the
existing parking lot from 56 to 74 spaces, and redesign of the existing student drop-off area to
accommodate a wider bus turning radius and five (5) parking spaces. The aforementioned
improvements are proposed for the existing Hebrew Academy, which is utilizing a former public
school site. Location: 14401 Willow Lane (formerly Clara Cook School). Project Planner: Joe
Thompson
NOTICE IS HEREBY GIVEN that the above item is categorically exempt from the provisions of the
California Environmental Quality Act.
ON FILE: A copy of the proposed request is on file in the Planning Department, 2000 Main Street,
Huntington Beach, California 92648, for inspection by the public. A copy of the staff report will be
available to interested parties at City Hall or the Main City Library (7111 Talbert Avenue) after
September 30, 1999.
ALL INTERESTED PERSONS are invited to attend said hearing and express opinions or submit
evidence for or against the application as outlined above. If you challenge the City Council's action
in court, you may be limited to raising only those issues you or someone else raised at the public
hearing described in this notice, or in written correspondence delivered to the City at, or prior to, the
