The City Council of the City of Huntington Beach approved Entitlement Plan Amendment No. 00-22 and Coastal Development Permit No. 00-22 with the suggested findings and conditions of approval as amended to delete the water feature in the design of the monument. The action agenda pages 8-9 and the approved as-amended Suggested Findings & Conditions of Approval are enclosed. The February 20, 2001 minutes will be mailed to you following Council approval of the minutes. This is a final decision. SUGGESTED FINDINGS FOR APPROVAL—ENTITLEMENT PLAN AMENDMENT NO. 00- 12: 1. Entitlement Plan Amendment No. 00-12 for the establishment, maintenance and operation of the Surfer's Hall of Fame at the Pierside Pavilion plaza at the corner of Main Street and P.C.H., will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. Based upon the conditions imposed, the improvements will not impact pedestrian circulation, nor will the operation impact the surrounding businesses. 2. The entitlement plan amendment will be compatible with surrounding uses. The proposed improvements are consistent with the zoning designation and does not represent a significant change from the existing commercial uses and passive open plaza area. 3. Entitlement Plan Amendment No. 00-12 will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located. The proposed improvements comply with the Downtown Specific Plan open space requirements. 4. The granting of the entitlement plan amendment will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Mixed Use on the subject property. In addition, it is consistent with the following goals and policies of the General Plan: a. Require the inclusion of uses and elements that contribute amenities for visitors, such as public activity areas and on-site recreational facilities. (LU 10.1.7) b. Revitalize, renovate and expand the existing Huntington Beach commercial facilities while attracting new commercial uses. (ED 2.4) c. Encourage the attraction of coastal and inland and visitor serving uses to offer a wider spectrum of visitor opportunities. (ED 2.6.1) 1 The proposed Surfer's Hall of Fame will compliment the visitor serving commercial facility while minimizing impacts to adjacent businesses and properties. SUGGESTED FINDINGS FOR APPROVAL-COASTAL DEVELOPMENT PERMIT NO. 00-22: 1. Coastal Development Permit No. 00-22 for the development project, as modified by conditions of approval, conforms with the General Plan, including the Local Coastal Program. The subject site is designated in the General Plan Land Use Element as Mixed Use and has a zoning designation of Downtown Specific Plan-District#3 (Visitor Serving Commercial)which permit visitor serving uses. The project will not impact public views or access to coastal resources and.will maintain access throughout the existing plaza. It is consistent with the following goals,policies, and objectives in the General Plan: a. Require the inclusion of uses and elements that contribute amenities for visitors, such as public activity areas and on-site recreational facilities. (LU 10.1.7) b. Revitalize,renovate and expand the existing Huntington Beach commercial facilities while attracting new commercial uses. (ED 2.4) c. Encourage the attraction of coastal and inland and visitor serving uses to offer a wider spectrum of visitor opportunities. (ED 2.6.1) 2. The project is consistent with the requirements of the CZ Overlay District,the base zoning district, as well as other applicable provisions of the Municipal Code. The project complies with all.development standards including minimum open space area for the development. 3. At the time of occupancy the proposed development can be provided with infrastructure in a manner that is consistent with the Local Coastal Program. All infrastructure currently exist to the site. 4. The development conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. The project will enhance visitor serving commercial opportunities by providing a visual art element on the open plaza area. No impacts to public views or access will occur. SUGGESTED CONDITIONS OF APPROVAL—ENTITLEMENT PLAN AMENDMENT NO. 00- 12/COASTAL DEVELOPMENT PERMIT NO. 00-22: 1. The site plan, floor plans, and elevations received and dated September 1, 2000 shall be the conceptually approved layout with the following modifications: a. The proposed plaque shall be mounted on an approximate three ft. high base and shall be enlarged proportionately. The monument shall be designed with a lighting element (i.e. uplighting). Mn p2-20—01 b. All flags shall be eliminated. Ca�^N�11' �0 laN C6-o_� c. Public seating shall be provided within the plaza area adjacent to the store entrance. d. The existing palm plantings and irrigation shall remain. If either is damaged they shall be repaired or replaced to the satisfaction of the Public Works Department,Park, Tree, and Landscape Division. 2. During construction, the work area shall be fenced to prevent unauthorized entry and provide clear pedestrian access along the sidewalk. 3. Prior to commencement of the use of the Surfer's Hall of Fame,the following shall be completed: a. All improvements to the property shall be completed in accordance with the approved plans and conditions of approval specified herein,including landscaping. b. Compliance with all conditions of approval specified herein shall be accomplished and verified by the Planning Department. c. All building spoils, such as unusable lumber,wire,pipe,and other surplus or unusable material, shall be disposed of at an off-site facility equipped to handle them. 4. The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan, elevations and floor plans are proposed as a result of the plan check process. Building permits shall not be issued until the Planning Director has reviewed and approved the proposed changes for conformance with the intent of the City Council's.action and the conditions herein. If the proposed changes are of a substantial nature, An amendment to the original entitlement reviewed by the City Council may be required pursuant to the HBZSO. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. Entitlement Plan Amendment No. 00-1 2/Coastal Development Permit No. 00-22 shall not become effective until the ten working day appeal period has elapsed. 2. Entitlement Plan Amendment No. 00-1 2/Coastal Development Permit No. 00-22 shall become null and void unless exercised within one year of the date of final approval which is November 28, 2001 or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 3. The City Council reserves the right to revoke Entitlement Plan Amendment No. 00-12/Coastal Development Permit No. 00-22, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. All applicable fees from the Building, Public Works, and Fire Departments shall be paid prior to the issuance of Building Permits. 3 5. The development shall comply with all applicable provisions of the Municipal Code,Building and Safety Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. 6. Construction shall be limited to Monday- Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 7. The applicant shall submit a check in the amount of$43.00 for the posting of the Notice of Exemption at the County of Orange Clerk's Office. The check shall be made out to the Co=of Oranee and submitted to the Planning Department within two (2) days of the City Council's action. 8. All landscaping shall be maintained in a neat and clean manner, and in conformance with the HBZSO. Prior to removing or replacing any landscaped areas,check with the Departments of Planning and Public Works for Code requirements. Substantial changes may require approval by the City Council. 5 9. All permanent, temporary, or promotional signs shall conform to Chapter 233 of the HBZSO. Prior to installing any new signs, changing sign faces, or installing promotional signs, applicable permit(s) shall be obtained from the Planning Department. Violations of this ordinance requirement may result in permit revocation,recovery of code enforcement costs,and removal of installed signs. 10. This item was continued from the January 16, 2001 City Council meeting at the applicant's request in order to allow the applicant to be present at the public hearing. The applications represent a request by Bob Thornton to remove the existing water fountain located at the corner of Pacific Coast Highway and Main Street (Pierside Pavilion) and construct a Surfer's Hall of Fame. The improvements include the installation of colored concrete castings of surf heroes hand and foot impressions throughout the plaza area, and a centrally located monument. The appeal was filed to give the City Council the opportunity to review the proposed modification to this prominent corner by reviewing its consistency with the Urban Design Guidelines, and determine whether commemorating surfers is the art element the City endorses when another similar feature (Surfer's Walk of Fame) is located across the street in front of Jack's Surfboards. The Planning Commission approved the request and is recommending approval (Recommended Action) because the proposed improvements would compliment the Pierside Pavilion commercial facility and would not impact retail businesses or pedestrian circulation at the corner. Staff is also recommending approval of the request for the same reasons. CODE OF CIVIL PROCEDURE § 1094.6 § 1094.6. The improvements include placing colored concrete castings of surf heroes hand and foot impressions throughout the plaza area, and to allow for future castings to be placed within the plaza following ceremonies. These ceremonies would typically take place during local surf events and would allow for future surf heroes to be inducted into the Surfer's Hall of Fame. The proposed improvements also include a 5'-8" ft. high monument centrally located within the Surfer's Hall of Fame (ATTACHMENT NO. 3). The monument is composed of a bronze plaque identifying "Surfer's Hall of Fame" mounted on a diamond-shaped granite face perched on a 2'-9" high granite base. The applicant indicates that the reason for the request is to honor and pay tribute to surf pioneers and legends, while reducing the safety and liability risks created by the existing six foot high water fountain (ATTACHMENT NO. 4). Currently, there are several castings located within the Huntington Surf& Sport surf shop. By approving this request, the general public would be able to view and walk among the surf heroes hand and foot impressions. The applicant further indicates that the existing water feature does not provide the visual art element that is as complimentary to the open plaza as the proposed Surfer's Hall of Fame. The proposed improvements will be constructed in compliance with Section 4.5.10 Open Space of the Downtown Specific Plan by providing textured paving, a visual feature, and public seating. B. BACKGROUND In May of 1993, a similar request was reviewed and approved by the Planning Commission which permitted the replacement of the existing water feature with a "Surfer's Field of Impressions." Site Plan Amendment No. 93-1 was approved authorizing the removal of the water fountain and construction of a similar project with surfer's impressions. This design change was never implemented, and the entitlement expired in May of 1994. C. PLANNING COMMISSION MEETING: On November 28, 2000 the Planning Commission held a public hearing to discuss the proposed project. There were four persons who testified during the public hearing, all of whom supported the project (ATTACHMENT NO. 5). Following the public hearing and discussion, the Planning Commission unanimously approved the request based on findings that the proposed Surfer's Hall of Fame was consistent with the goals and policies of the General Plan and Urban Design Guidelines, and was compatible with the Downtown Specific Plan and surrounding uses by retaining a pedestrian-oriented attraction that ties in with the adopted "Surf City" theme. APPEAL: On December 1, 2000, Council member Ralph Bauer appealed the Planning Commission's action (ATTACHMENT NO. 2) citing the following reasons: The Council was not consulted on this action, yet since the area is a gateway to the city, the Council should get involved. Proposal needs to be reviewed for its consistency with the Urban Design Ordinance. It should be determined whether commemorating surfers is the art element we wish promulgated in the face of such a project already in place. Some indication of the cost of any project and who is financially responsible need to the determined. By virtue of this appeal, the Council must approve a coastal development. E. STAFF ANALYSIS AND RECOMMENDATION: The primary issues involved with the proposed improvements are compliance with the open space/visual feature requirements of the Downtown Specific Plan, the Urban Design Guidelines, public safety, design compatibility, and pedestrian access. The Downtown Specific Plan stipulates the design of public plazas at the corners of full block developments. The plazas are required to consist of a visual feature in the form of a sculpture, fountain, or similar visual amenity. The proposed modification to the plaza does not constitute a major change to the plaza as it will continue to provide a visual feature and art element for visitors. Staff believes that the design of the plaza meets the intent of the zoning designation and design guidelines by facilitating and encouraging pedestrian activity, and providing a focal point at one of the most prominent corners in the City. The replacement of the fountain with a "Surfer's Hall of Fame" is a concept similar to that of the impressions of movie stars' footprints and hand prints at Mann's Chinese Theatre. The concrete castings would be colored and textured to be compatible with the existing pavers at Pierside Pavilion. All improvements would be installed on private property. The Pierside Pavilion management would be responsible for the maintenance of the plaza, including the Surfer's Hall of Fame. The design concept is compatible with the area and will compliment the open plaza. Staff believes that these improvements will draw interest while providing a large passive open plaza area for visitors. This area will continue to provide adequate space for pedestrian use, especially during the summer months. With the new design and removal of the large water fountain, pedestrian access will be improved. With the recommended conditions, the project will provide public seating adjacent to the retail storefront for Huntington Surf& Sport, and will retain a pedestrian-oriented attraction that ties in with the adopted "Surf City" theme. The central monument and informational display will further contribute to visual interest at this prominent corner. Staff agrees that the project will increase safety for the public, and will reduce liability to the City and property owner. Because of the prominent location, staff reviewed the proposed modification to the plaza for consistency with the General Plan and the Downtown/Main Street Commercial area chapter in the Urban Design Guidelines. The intersection is identified in the General Plan as an internal node which functions as a focal point of high activity within the community. In its entirety, the project provides an art element accessible to all visiting downtown Huntington Beach. Staff believes that the Surfer's Hall of Fame is compatible with the existing colors and materials at Pierside Pavilion, is consistent with the "Surf City" theme, and is consistent with the Urban Design Guidelines and General Plan. Staff further believes that the proposed improvements provide more interest to the corner than the existing water feature. Much like the Hollywood Walk of Fame co-exists with Mann's Chinese Theatre, both the Surfer's Walk of Fame located in front of Jack Surfboards (Oceanview Promenade) and the proposed Surfer's Hall of Fame could co-exist. The Surfer's Walk of Fame consists of plaques with surfers names intermingled within the pavers, while the Surfer's Hall of Fame is presented with the concrete castings of hand and foot impressions. Both features together would add interest to the intersection without detracting from each other. The costs for the construction, operation and maintenance of the Surfer's Hall of Fame will be the sole responsibility of the applicant and property owner. No funding would be provided by the City. Design Review Board On October 15, 2000, the Design Review Board (DRB) reviewed the design, colors and materials proposed for the Surfer's Hall of Fame and recommended approval of the components with the following conditions: • The monument located in the center of the Surfer's Hall of Fame shall be designed with a 3 to 4 ft. high base and shall be enlarged proportionately. The Surfer's Hall of Fame shall be designed with uplighting to the monument. Elimination of the proposed flags within the Surfer's Hall of Fame. Staff agrees with the recommendations of the DRB and has incorporated the conditions into the suggested conditions of approval (ATTACHMENT NO. 1). The development conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. The project will enhance visitor serving commercial opportunities by providing a visual.art element on the open plaza area. No impacts to public views or access will occur. SUGGESTED CONDITIONS OF APPROVAL—ENTITLEMENT PLAN AMENDMENT NO. 00- 12/COASTAL DEVELOPMENT PERMIT NO. 00-22: 1. The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan, elevations and floor plans are proposed as a result of the plan check process. Building permits shall not be issued until the Planning Director has reviewed and approved the proposed changes for conformance with the intent of the City Council's action and the conditions herein. If the proposed changes are of a substantial nature, an amendment to the original entitlement reviewed by the City Council may be required pursuant to the HBZSO. The applicant indicates that the reason for the request is to pay tribute and honor surf pioneers and legends,while reducing the safety and liability risks created by the six foot high water fountain (Attachment No. 3). Currently,there are several castings located in the Huntington Surf& Sport surf shop. By approving this request,the general public would be able to view and walk among the surf heroes hand and foot impressions. The applicant further indicates that the existing water feature does not provide the visual art element that is as complimentary to the open plaza as the proposed Surfer's Hall of Fame. The proposed project complies with the zoning code and Coastal Zone. requirements, and will implement the following policies of the Coastal Element of the General Plan: • Protect, encourage and, where feasible,provide visitor-serving facilities in the Coastal Zone that are varied in type and price. • Provide a variety of recreational and visitor commercial serving uses for a range of cost and market preferences. • Encourage,where feasible, facilities,programs and services that increase and enhance public recreational opportunities in the Coastal Zone. Redevelopment Status: The project is located in the Huntington Beach Redevelopment Project, Main-Pier subarea. The I Economic Development Department has reviewed and supports the request to enhance the plaza by . installing the proposed improvements. Design Review Board: On October 15, 2000,the Design Review Board reviewed the design, colors and materials proposed for the Surfer's Hall of Fame and recommended approval of the components with the following conditions: • The monument located in the center of the Surfer's Hall of Fame shall be designed with a 3 to 4 ft. high base and shall be enlarged proportionately. • The Surfer's Hall of Fame shall be designed with uplighting to the monument. • Elimination of the proposed flags within the Surfer's Hall of Fame. Staff agrees with the recommendations of the DRB and has incorporated the conditions into the suggested . conditions of approval (Attachment No: 1). . Subdivision Committee: Not applicable. Other Departments Concerns: The Departments of Public Works,Fire, Community Services and Building and Safety have recommended conditions which are incorporated into the conditions of approval. (and tenants within a 100 ft) radius of the subject property, individuals/organizations requesting notification(Planning Department's Notification Matrix),tenants at the commercial center, applicant, and interested parties. As of November 21,2000, no communication supporting or opposing the request has been received. Application Processing Dates: DATE OF COMPLETE APPLICATION: MANDATORY PROCESSING DATE(S): October 12,2000 January 12, 2001 (90 days) ANALYSIS: The primary issues involved with the proposed improvements are compliance with the open space/visual feature requirements of the Downtown Specific Plan, safety, design compatibility, and pedestrian access. The Downtown Specific Plan requires the design of public plazas at corner of full block developments. The plazas are required to consist of a visual feature in the form of a sculpture,fountain, or similar visual amenity. The proposed modification to the plaza does not constitute a major change as the plaza will continue to provide a visual feature and art element to visitors. Staff feels that the design of the plaza meets the intent of the zoning designation and design guidelines by providing a focal point at one of the most prominent corners in the City. The proposed improvements have been requested for a number of reasons. The existing six foot high water fountain stair steps down to the seating area along the front of the fountain. Children often climb the fountain and have occasionally fallen to the concrete plaza below. This poses a safety hazard to the public and a liability risk to the property owner. In addition,there has been a continuing loitering problem in the plaza. The height of the fountain wall also tends to hide any foul play that may occur along the retail shops facing the plaza. For these reasons,the applicant proposes the revised plaza design that will increase both safety and the pedestrian amenities in the plaza. The replacement of the fountain with a"Surfer's Hall of Fame" is a concept similar to the Hollywood Walk of Fame or the impressions of movie stars' footprints at Mann's Chinese Theatre. The concrete castings would be colored and textured to be compatible with the existing pavers at Pierside Pavilion. All improvements would be installed on private property. The Pierside Pavilion management would be responsible for the maintenance of the plaza, including the Surfer's Hall of Fame. The design concept is compatible with the area and will compliment the open plaza. Staff feels that these improvements will draw interest while providing a large passive open plaza area for visitors. This area will continue to provide an adequate area for heavy pedestrian use, especially during the summer months. With the new design and removal of the large water fountain,pedestrian access will be improved. Staff Report-11/28/00 6 (OOSR71) The proposed modification of the plaza area complies with the intent of the Downtown Specific Plan. The plaza serves as a focal point for the downtown/pier area. With the recommended conditions,the project will provide public seating adjacent to the retail storefront for Huntington Surf& Sport, and will retain a pedestrian-oriented attraction that ties in with the adopted"Surf City"theme. The central monument and informational display will further contribute to visual interest at this prominent corner. Staff recommends that a water element be incorporated into the monument to add interest to the centralized art piece, and that the proposed flags be eliminated to avoid a weathered look caused from the salt air which would detract from the Surfer's Hall of Fame. The applicant agrees to remove the flags from the project, and also requests that the water element be eliminated. The reasons are as follows: 1. The Council was not consulted on this action, yet since the area is a gateway to the city, the Council should get involved. 2. Proposal needs to be reviewed for its consistency with the Urban Design Ordinance. 3. It should be determined whether commemorating surfers is the art element we wish promulgated in the face of such a project already in place. 4. Some indication of the cost of any project and who is financially responsible needs to be determined. 5. By virtue of this appeal, the Council must approve a coastal development.
