The code requires a total of 241 parking spaces for the complex and the plan has provided a total number of 242 parking spaces . 10 . Private patio area. All units except those units fronting onto Pearce Street have been provided with two separate patio areas which exceed the minimum area and dimension as required by code . It should be noted, however that the 3A type units on Pearce Street only have one patio area of approximately 130 sq. ft . each. These six units will have to be replaced with another type unit or additiona.' patio areas provided to conform with the minimum 300 sq. ft . with a minimum dimension of 13 ft . for this three bedroom type unit . 11 . Attached herewith is the Environmental Review Board' s recommendations'. *Revenue/Expenditure Analysis of Residential Developments , City of Huntington Beach , dated January 1973. �COAiMENDA'f I0N In view of the above information , and if the Planning Commission keels that the proposed developments meets the intent of Article 931. (Planned Residential Development) with those revisions as recommedded by this report , the Subdivision Committee offers the following conditions of approval for your consideration. 1 . A revised tentative tract map and plot plan shall be submitted prior to the issuance of building permits of any construction on said property. Said revised plot plan shall provide a minimum of a 2 ft . landscape area along the side of each structure that abuts a driveway. All main structures shall be separated by a minimum distance of 25 ft . All driveways shall have a minimum width . 2 . The undersigned does hereby appeal to the City Council of the city of Huntington Beach for action of the Planning Committee of the city of Huntington Beach taiten o' . Julyj , 1973 on the above described use permit, at their regular meetl.ng; said action consisting of granting said use permit imposed "conditions of approval" , a copy of which is attached hereto and made a part hereof. Appeal is herewith made to remove said conditions of approval and said restrictions for the following reasons : 1 LATIDSCAPING REQUIREMENTS. � Said condition is an arbitrary exercise of the powers and peregatives of the Planning Committee and of the City Council. It does iAat involve the exercise of any health or safety power granted to the City by the State or the Federal government nor ils it embodied in any code or ordinance. The environmental Protective law authorizes the enactment of supplemental regjilatlons by cities to prevent a detrimental impact on the environment. REQUIREMENTS OF CC & Res AND ASSOCIATION RUBS CLAUSE This is an arbitrary exercise of powers not granted to the state or city and constitute usurpation of powers of the city which they Simply do not have and hence does not have a right to impose such a condition. 4. THIRTY FIVE FOOT OFF SET . See objections under Vo. 1, In addition, this is an arbitrary exercise of power. Also it is vague and ambiguous , speculative and a:^gumentative. S. FORCED AIR VENTS : This is a complete arb�trery usurpation of powers not granted to the city. The only reason given for this condition by any member of the Planning Committee was that " it would make for better living at the residence. " The city has no power or right to impose this condition. It is tantamount to requiring any developer to make gold bath tub .fixtures, have platinum doer knobs air conditioning, inter- room communication, built in television in each room built in stereos, closedtcircuit television, movit projection room, and screen, and overseas telephone service , under the J guise that it would be for "better living. ' This is tanta- mount to the Planning Commission arbitrarily taking over and drawing plena and specifications of each developer. 6 . FULL IM.MLATION OF ALL EXTERIOR WALLS AND CEILINGS. This is given under the guise that it will help reduce the burden on heating and cooling systems as well as decrease the noise levels according to the Environmental Protective lax, The burden of proof is an the city to show that there is or would be a burden in the heating and cool- ing systems or Mat t e noise level would be substantially 'increased. On the contrary, the Environmental Impact heport shows the exact opposite. Thus this requirement is a direct violation by the city of the Environmental lmpa ct law. 9. T�iE TREES:EUCALYPTUS `Tfi Two pages of the Environmental Impact Report offer definite evidence showing that the present grove is a health hazard. Technically, the developer would be required to remove these or be prosecuted for failure to do so. Not only does the city foist upon the developer a health hazard but requires him to maintain same or to replace two for one, at his expense. Again an arbitrary exercise of p ioaer not possessed by the city. It is the city 's power and function to maintain the health and safety Moreover requir:Lng the replacement of tvo for one is the arbitrary exercise of the eminent domain power of the city without due process of law in violation of the ll+th Amendment of the United States Constition. 10. RESTRAINING BOATS, TRA1LEHS AND ..SIMILAR VEHICLES. There is no zonin ordinance or code section. or. any other type of legal city enactment proving such statements or preventing such storage. Here the city is attempting to, by indirect means , do what it has not done and cannot do by direct means. This is an illegal requirement. 11. APPLICABLE CONDITIONS OF `.I'HE "STANDARD CONDITIONS. " This is arbitrary, argumentative and specula- tive. Whe,i certain conditions came up for discussion at the Planning Committe9 meeting, Mr. Patin was asked by the Planning Committee the reason for imposing that particular condition. His reply vas "Well that is a sti ndard requirement. " Upon further questioning it { appeared that Mr. Palin considered the action to be a "standard" action because it has been imposed merely once before on another and previous occasion. Respondent requests that the Honorable City Council of the city of Huntington Beach grant the use permit without the said conditions or that the matter be set down for further hearing on this appeal. Full insulation of all exterior walls and ceilings of the dwellings shall be required to lielp minimize the b,1rden on beating and cooling systems and to help reduce noise levels . 7. Disposal of building spoil : unusable lumber, tar paper , wire, ripe and other excess and unusable waste shall be disposed of at an off-site facility equipped to handle them. S . The additional mitigating measures as proposed within the final Environmental Impact Report should also be a require- ment of the developer, with the exceptions noted below : a . Paragraph 7 , page 55 : reference to portabl-e/temporary traffic control signals should be deleted . Pu`:•lic Works has found that these controls do not work o,-t satisfactorily. b . Third mitigating measure , page 54 : Foard recommends rewording of this measure to read " . . . organically rich soil will be stripped , stocl:i. ' led , and re-used within the landscaped areas of the project . " 9. Board recommends that the developer he offered the alternatives of leaving the existing eticalyptus grove within the proposed project by cleaning tip and pruning of the healthy trees and/or of •removal and replacement, based upon a ratio of two trees to • be replaced for each Cree removed . Replacement trees are to be a minimum size of 30" boxed specimen material. ; this replace- ment planting is to be in addition to the standard tree panting required for a planned development , which is equivalent of one 30" boxed tree per unit . The Board further recommends that if any trees are removed the replacement trees be equally distributed throughout the landscaped areas , with emphasis on the landscaped area Tong Bolsa Chica and Pearce Streets . 10. CC&R' s shall state that nu boats , trailers and similar vehicles may be stored in this project . 11 . Margaret Carlberg, Secretary to the Environmental Council stated that it is required by State law to justi.fy removal of trees and replacem-,n't thereof. In response to a question of Commissioner Wallin, the applicant stated that he would be agreeable to putting in 98 units . Minority Report : Commissioner Wallin stated that Article 931 of the Huntington Beach Ordinance Code does allow discretionary action on conditions of approval and that in her opinion some of the conditions of approval that would make for a better quality of life fo: those residents have been removed by the majority vote . Chairman Kerins requested that the minority report be recorded in the Minutes . The following written minority report was submitted by Commissioner Porter and Wallin: Other than personal preference , the applicant � has not demonstrated any extenuating circumstances to the deletion ) of the following conditions heretofore required on all residential developments reviewed by the Environmental Review Board: 1. Requirements for forced air ventilation (ERB #2) 2 _ Requirement for balanced power usage to avoid singular burden on utility resources . The applicant has proposed to build an all-electric development which is , in the opinion of the minority members , an unnecessary burden on an already overtaxed utility resource . Additionally, the requirement for forced ventilation is reasonable in view of the .lesser number of openings provided in common wall residential units as I posed to standard detached residential dwellings even thoughoth units may '.lave the same floor area (1200• I30D sq . ft. ) . It was the consensus of the Committee that the developer should coordi- nate the main access point from Bolsa Chica with a break in the future raised median on Bolsa Chica . The Committee also recommended that the points of access from Bolsa Chica be limited to a maximum of two, that a revised plan should be coordinated through the Department of Public Works on these access points . On site circulation was discussed and it was the consensus that the north-south street on the easterly side of the project be tied with the northerly east-west street to provide inner circulation for the development . It should also be noted that the March 8 precise plan did not provide sufficient private patio for all units and the Committee suggested revisions to include front patio areas and offered suggestions for a combination of wall and landscaping separation for these private patio areas from other open space areas . The committee also discussed separation between main building along the north property line t which point a 17 ft . • separation has been provided.
