Gilbert Drive and Somerset Lane GENERAL I NFOR'MAT'I ON : On April 4 , 1973 the Board of Zon:.ng Adjustments a-. proved Use Permit No . 73- 28 , The reasons given were as follows : 1 . The dwelling will not have a detrimental effect on the general health , welfare , and }privacy of persons residing in the neighborhood . 2 . Location , site layout , and design is harmonious and cormpn 4ib 1 c with the street and ad j acon t dke ll i gas in the neighborhood . It was noted several days after the approval of the use permit that an error in plan cFeck - occurred and that the minimum interior side yard setback for a three story dwelling must be 10 ft . The approved plan indicated S ft . Pursuant to the error noted , the staff conta�ted thi: applicant and indicated that he would have to revise the plans for the three story dwelling; to indicate a 10 ft . interior side yard setback on each side of the f olise or that he would have to submit a conditional exception requesting variance to allow the S ft . interior side yard setback . At the April 11 , 1973 Board of Zoning Adjustments meeting, the Board noted by minute action that a mistake had occurred regarding the requirement for a 10 ft . interior side yard setback for 3 story building and noted. that the applicant will ;rave to submit a conditional exception or revise his plans . PRESENT LAND USE AND ZONING: The subject site is presently vacant land fronting on a channel within Huntington Harbour and is among single family residences in a R1 Low Density residential District . PROPOSAL AND ANALYSIS : The applicant is proposing to construct a three story residence . The first floor , except for a three car garage , entry way and elevator , is almost entirely open . The majority of the ground floor is covered with docking , pool area and a barbeque area . The second and third stories are supported by wood pylons throughout the structure . ,_ The total living area for the second and third floors is 5435 sq . ft . The overall height of the structure is 30 ft . Section 9102 . 6 of the Ordinance Code states that a martimum building, ehight shall riot exceed thirty feet and shall not exceed two stories , however , a maximum building height of three stories may be permitted if a use permit is approved by the Board of Zoning Adjustments . The following criteria serves as guidelines for the Board of Zoning Adjustments for approving , conditionally approving or denying use permit application , for three story development : 1 . The proposed dwelling shall riot have a detrimental of.Lect on the general health , welfare , safety and privacy of persons residing in the neighborhood , or the value of property in such ncighborhood . 2 . The location , site layout and design of the proposed dwelling shall be harmonious and compatible with the streets , drive - ways , property lines and adjacent dwellings in the neighbor- hood . 3. The age and anticipated permanence of the existing dwellings on adjacent properties . 4 . Any other criteria the Board deems necessary to preserve the health , welfare and convenience of the neighborhood. BOARD OF ZONING ADJUSTMENTS ACTION : At the public hearing for Use Permit No . 73- 28 , the Board considered opposition to the application . Mr . John Wolf was r®presentative for opposition to the application . Mr . Wolf submitted petitions containing 66 sign cures in opposition to the project . fir. The following points werc discussed by the board of Zoning Adjust- ments regarding the petition : 1 . The petition stated that the declaration of restrictions for Huntington Harbour stated that only one and two story buildings may be erected . The lio«rd indicated that they did not believe it was within the City ' s jurisdiction to enforce conditions , covenants and agreements and that this was more of a problem between Huntington harbour and the applicant . 2 . The petition stated that a three story building would be detrimental to the general welfare to the persons residing in the vicinity . The Board indicated that they did not believe the proposed project would be detrimental to the general welfare of the persons residing in the vicinity . The petition stated that not one three story building had . ever been built on Admiraldty or Gilbert Island and this would not in any way be harmonious or compatible with other properties in the neighborhood , The Boarci of Zoning; Adjustments contended that the proposed 30 ft . hldg , would be harmonious Sri compatible with the adjacent properties . The petition stated that a three story building would restrict sua- 'light and free airflow to the adjacent property and would infringe on their privacy , The Board indicated that this three story building would not restrict sunlight and free air- flow to the adjoining properties and would not infringe upon their privacy any more than a two story building :could . 3 . The petition stated that this would be a one - of- a•kind building and would substantially reduce the values of all properties within site of the structure . The Board noted that many of the houses in this area are custom made and , in fact , the architectural variability i n the area would actually enhance economics . d . (6) months on the expiration date of 6-18--74 for the above Use Permit The Use Permit is to permit the construction of a three story residence in the R1 district. General Information: On April 4 , 1973 the Board of zoning Adjustments approved Use Permit No. 73-28. This was appealed by Planning Commissioner Marcus Porter on April 12, 1973 , based on the understanding that the Board of Zoning Adjustments did not reconsider approval of the application when it was discovered that a mistake had o--curred regarding the requirement for a 10 f t. interior side yard setback for three story buildings. The Planning Commission at its meet_ng of May 15, 1973 approved Use Permit No. 73--28 subject to the applicant complying with the side yard setback required by Ordinance at the time of issuance of building permits. The Planning Commission approval was appealed by Councilman Henry H. Duke on May 25, 1973 based on the contention that the structure will only set back five feet from the side property line, and that a three story building in the area would be contrary to the CC & R' s of the development. The appeal was denied by the Council on June 18, 1973 . The applicant has stated that plans have been submitted to the building department for plan check and issuance of building permits , but, since the California Coastal .Commission will not be able to act upon this application until July, the permits and subsequent construction will not commence prior, to the Use permit expiring. Page 2 Additional Information: Although the Huntington Beach Ortlinarce Code does not specifically provide authority for the granting of extensions of time on . Use Permit applications, the City Council has granted extensions in the pact. These past actions were indicated to the applicant through discussions with membi,rs of the building and planning departments.
