City of Huntington Beach to order at 7:00 P.M. MAP '7950 - APPROVED Mayor Ma�ney' a' noutic ' that this was the day and hour set for a public hearing on an appeal' f iled.b�, Daniel/Webb Construction, Inc. , Placentia, California, to the denial by the Planning Comission of Conditional Use Permit No. 73-036 and Tentative Tract Map No'. 7950 to allow the construction of a 24 unit planned residential development on a 3.86 acre parcel of land in the R1-Pb Low Density Residential District - Planned Residential. The subject property is located on the south side of Holland Drive and 265.5 feet east of Beach Boulevard. The City Clerk informed Council that all legal requirements for notification, puLlicat{on and posting had been met, and that: other than the letter of appeal she hed received no communi,,ations or written protests to Conditional Use Permit No. 73-036 and Tentative Tract Map No. 7950. The Planning Director presented a resume' of the Planning Commission's reasons for recommending denial of Conditional Use Permit No. 73-�036 and Tentative Tract No. 79:50. Discussion was held between the Planning Director and Council regarding the provisions of the Planned Residential Development section of the ordinance code. In response to a question by Councilman Duke regarding procedure, the City Attorney spoke regarding the legal aspects of the matter. Mayor Matney declared the hearing open. Mr. Ira E. Sheldon, 8047 Slater Avenge, City, addressed Council and informed them that he owned property directly south of the proposed development, and spoke regarding the status of the easement on the property. Mr. Lamar Stewart, Engineering Representative, representing Daniel/Webb Construction, Iri. , addressed Council regarding the proposed development and spoke regarding the density factors involved. He stated that he believed their company had met the intent of the Planned Residential Development section of the ordinance code and requested Council approval of the matter. Discussion was held between the Council and City Attorney. Mr. Edward Kerins, Planning Commission Chairman, addressed Council regarding the proposed development. Mayor Matney suggested that staff study the possibility of modifying the Planned Residential Development .section of tilt: Ordinance Code so that a distance separation other than 25 feet could be allowed between single detached units. Mr. Robert L. Rr:dman, 17421 Marken Lane, City, Vice-President of the Dutch Haven Homeowners Association, addressed Council and stated that their organization favored the proposed development. Mr. Ed Webb, Daniel/Webb Construction, Inc. , developer, addressed Council regarding the proposed development and stated that he believed it was a desirable project for the City. At *he time Zone Case No . 7' - 48 was before the City Council the R1 homeowners to the east submitted a five point recommendation which was taken into consideration by the Council in their approval action . (See attachment . ) PRESENT LAIND USE AND 2-70"I I.NG : Subject property is zoned RI -PD Low Density Residential District and is vacant at this time . The property to the east is zoned R1 and developed with singl family homes . The property to the north across Rolland Drive• is zoned R3 Medium high Residential and developed with an apartment complex . Property to the Crest is zoned C4 and developed commercially . Proporties to the south 40 are zoned R5 and are vacant except for a single family home upon one of the parcels . (See attached map . ) MASTER PLAN : The blaster Plan of. Land Use has this property shown for low density residential development by Asisrer Plan Amendment No . 73- 1 •• Staff Report Tentative Map 7950 Use permit No . 73-036 Page Z SUBDIVISION CONWITTEE REVIEW: ;he Subdivision Committee reviewed Tentative 1%fap 795C at the June 8 Subdivision meeting . Following are a number of items li discussed with the developer at that meeting : site plan , density , diversification of unit types , minimum floor area , private patio areas , coverage , setbacks from interior property lines and public streets , distance between main structures , widtlis of private drives , parking ast-ignment and facilities , recreation and leisure space , signing , roof materials , association fees , and the number of school age children generated , It was the consensus of the Subdivision Committee after a lengthy discussion on the separation between the ruin structures which is shown on the play, at 10 ft . would have to be pursued by a conditional exception . It should be noted that this setback occurs at six locations within the proposed development where said separation of 10 ft . is between a garage to the side of a dwelling unit and at 8 locations where said separation is between main structures . However , the Committee discussed this detached type of construction and were informed by the developer that in no case were there windows existing in opposite walls across this ter, fo,%t separation closer than 26 ft . The Committee also discussed the private driveway width and it was the consensus that the developer should revise the plan to provide parkin bays wl .hin the driveway section of the north - south drive an to re-iuce the driveway section of bc,th east-west drives from 30 ft . in width to 28 ft . width to restrict parallel parking at those locations . The Subdivision Committee also informed the develouer that he should be prepared %o discuss with th - Planning Commission a possible future permanent access for the develcpment from Slater to the south across the R5 property , tie informed the committee that he is only proposing a walkway easement cor school access at this tire . The developer also stated tkat he was proposing wood roof material on all sloped roofs , either wood shake and/or shingles . However , there is a flat roof portion of one of the units upon which the developer has proposed rock . All of these units have conformed to the livable open space: per unit . 9 . Parking Each unit has been provided with two covered parking spaces immediately adjacent and attached to the unit . The total parking provided within this complex is Ill parking spares , required by ordinance code - 108 spaces . 10 . Private pa- io areas Each unit has been provided with a private patio area . Unit type one , a single story two bedroom unit has been provided with the private patio area of 306 square feet . Unit type two a one story three bedruom unit type has been provided with a private patio area of 504 square feet . The two story four bedroom type unit has only bean provided with a minimum 270 square foot private patio area whereas the ordinance '� code requires 400 square feet . The developer has been informed of this discrepancy upon the revised plot and has indicated that he will have no difficulty in providing the full 400 square feet and will have a revised plan for the Planning Commission ' s review.
