In the y ' 9 . j . q_.. interim, Mr. Shelton had made inquiries to the deppartment, on procedures : to modify said condition, therefore, on June 8, 1976 , a letter was sent '. ,.tto t�tr. Shelton from the Planning De' part5heiit outlining a procedure' to `modfy� t�ie original condition of approval. On- June 17, 1976, Mr. Mitchell submitted to the Board of Zoning Adjustments a request for c'arification on the condition on roofing materials and after discussion with the Attorney' s Office, it was determined that, if in fact the original minutes and conditions were in error and were not as-discussed by Board members presiding at the meeting at time of original approval that the condition could be clarified to reflect that wording which had 'beLiz discussed. On July 6, 1976 , a letter was sent to Mr. Mitchell outlining the June 23, 1976 Board of Zoning Adjustments action on the clarification of the roofing material. Clarified Condition: "Roofing materials, shake, ceadar, or composition shingles. " (June 23 , 1976 Board of Zoning Adjustments' Minutes attached herewith) Oft July 15, 1976, a new Use Permit No. 76-42 was filed to allow the modification of the prior conditions of approval and to substitute non-glare materials for the original condition. The Board of Zoning Adjustments denied Use Permit 76-42 'at the July 28, 1976 meeting having found that the proposal was-not within the original intent of the approval. (July 28 , 1�76 BZA Minutes attached herewith) At the August 18 , 1976 Board of Zoning Adjustments meeting, as a miscellaneous agenda item, the Department of Building and Community Development. representativ_e brought to the Board some sample materials which had been submitted to them for review to .satisfy the roofing materials for the accessory structures proposed within the complex. The materials reviewed were of a granular type . Of composition ma';erial adhered to aluminum panels and were to satisfy the portion of the condition which allowed the composition shingles. At that time, the Board of Zoning Adjustments approved the samples submitted whi::h is the action of this appeal adding specific conditions Jf approval outlined previously in thin staff report. ADDITIONAL INFORMATION: it should be noted that the attached minutes do not reflect the emotions on both sides of the issue and the comments and discussion at the Board w` page. Four. USE PERMIT NO. 76--17 of.- Zoning Adjustments meetings (many .of which cannot be reproduced in,:'prin'ted . form) nor do they truly reflect the time spent by the Board and the staff in attempting to word out a compromise for a suitable type of material to satisfy the original conditions of approval. However, it is . hoped that these minutes will give the Commission some insight into this matter. ENVIRONMENTAL STATUS: The Environmental Review Board, at its meeting of February 20, 1975, adopted Environmental Impact Report 75-11, and it was subsequently approved and rdopted by the City Council on March 17, 1975, having found the project would not have a significant adverse effect upon the physical environment with the mitigating measures contained therein. The Chairman informed the Board that this project is covered by EIR 74--11. The Chairman opened the public nearing . Tom Shelton was present at the meeting and addressed the Hoard to explain the prcblems encountered under a strict interpretation of the term "composition shingles , " citing the heavier and costlier construction needed to support the asphalt-based shingles. Ile presented samples of an aluminum-based shingle with textured , non-glare coating for the Board' s consideration. It was his belief that the samples -were basically the same materials and finish as the asphalt composition shingles except that they meet the weight * requirements of Title 25 of the State Mobilehome Code. Various people in the audience addressed the Board both in support of the ehanne in the condition and in opposition. Those in support of the lighter material cited the economic hardship to which they will be subjected; those in opposition were mainly residents of the homes on the bluff overlookii:g the mobilehome project and spoke against any relaxation of the original conditions on aesthetic grounds. Secretary Palin reviewed the administrative history of this project., followed by extensive further discussion. The Chairman closed the public hearing. 01 UN MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT No. 76-42 WAS DENIED ,BY THE FOLLOWING VOTE FOR THE FOLLOWING REASONS: REASONS FOR DENIAL: 1. The original intent of Condition No. C--1 was to establish a .-» residential appearance, from both within as well as when viewed from above, to the mobile home units; therefore, to allow only non-glare roofing material would have a detrimental effect upon + i persons residing in the area. The proponen" has not submitted sufficient justification on the cost differential between freestanding (if that is what is necersary for support of the original roofing materials) _ and those costs incurred through the use of aluminum with granular composition shingles to allow approval of a number of varying types of non--glare materials only. Mr. Amerman was present at the meeting; he explained that he had rc eived incorrect information on the zoning of the abutti.-ig property, having been notified last week that it is residential rather than commercial and will require the ten (10) foot side }yard setback. This set- back on his plans will not leave sufficient room to satisfy the parking requirements and ths.. plans are to the puint of beginning construction. Marc Porter, representing the owners of the abutting property, addressed the board in opposition to the request, pointing out that the zero lot line would place severe building restraints on that property and limit the options for later development. AYES: Parkinson, Finley, Gibson, Boyle NOES : Slates, Shea , Newman ABSENT: None PLANNING COMMISSION RECOMMENDATION: The Planning Conunission recommends that the City Council deny the appeal and sustain the Commission' s decision to allow the substitute materials to satisfy the original condit�an. .,F'�ge Two SUMMARY ANALYSIS: Use Pe'r'mit No. 74-17 was originally filed on April 10, 1974 and was a request for the development of a 145 sp, ce mobilehome park. This request was conditionally .appiroved on April 30, 1975 following completion of the eAvironmental. ;-eview process. A condition of approval which is the subject of ;:;:.ems appeal, was imposed which regulated the type of roofing materials permitted. This condition, read as follows: "The mobilehome units and attached structures, including carports and patio covers, shall only have roofing materials consisting of shake, cedar, or composition. " This -zondition was agreeable to both the developer and adjacent property owners at the time of its imposition. However. as the mobilehome park reared its completion a raimber of technical problems surfaced in regards to the installation of these required roofing materials on the carports and patio cowers. Specifizally, the weight load factors were such, that the normal structural members of these covers would nW. support the ad- ditional weight of the shingle roofing materials. Therefore, the Board of Zoning Adjustments, at its meeting of August 18 , 1976 , clarified the condition to allow a granular textured type of composition material adhered to aluminum panels to satisfy this condition on the patio covers and carport roofs. Additionally , the Board imposed the following con- ditions for these spacific structures: i a. The material shall be of a similar color to chat which is being used on the coach roofs to assure continuity in design and appearance. b. The materials shall be a granular mixture adhered to an aluminum interlocking panel, c. The Department of Building and Community Development shall assure that the materials carry the same guarantee as the roofing material on the coaches . It was this clarification approval to allow the granular textured inter- locking aluminum panel for the roofs of patio covers and carports that was appealed to the Planning Commission. i ADDITIONAL INFORMATION: i The Planning Commission held a public hearing on this request at its meeting of September 21, 1976. During this hearing, Mr. Steve Calvillo, representing Huntington Viewpoint, Seabreeze and Harper Estates, addressed the Commission and spoke in opposition to a clarification of the previous condition. Mr. Louis Graziadio addressed the Commission and stated that the permanency of today' s mobilehome parks should be considered in any clarification of the condition . Ms. Bessie Levy, a resident of the bluff area, Ms. Vicky Derieg repre- senting the Mobilehome Manufacturer ' a Association, Mr. Tom Shelton, Project O*jordinator, all addressed the Conanission and spoke in favor of the pcioposed clarification. i . i Page Three Mr. . Dennia Olson, representing the City of Fountain Valley addressed the Commission and requested a continuance to the next regular meeting tb give the -Fountain Valley Planning Commission an opnortunity. t-o more fully : review the proposed clarification . The Commission discussed this request at length and fully considered a continuance on the matter. However, ' it was decided to proceed with a decision on the appeal primarily because of delays already incurred on the project: and the inconvenience and hardships that would result to a large number of Huntington Beach residents waiting to move into the nearly completed park. Also, the Commission stated that a further appeal to the City Council could be anticipated and that the City of Fountain Valley could present their input at that time. The chairman did request that a member of the Huntington Beach Planning Department attend the Fountain Valley Commission meeting on September 22 , 1976 in order to explain the proposed clarifi- cation. Mr. John Cope of the Planning Staff attended this meeting and discussed the matter in detail with the Fountain Valley Commissioners. ':'he Commission indicated that they did not have any additional input on the proposed clarification . SUMMARY ANALYSIS: There were a number of events which lead up to the August 18 , 1976 determination of the Board of Zoning Adjustments. To outline in detail all discussion and comments that took place concurrently with each of these events would tend to confuse this appeal pending before the Commission. However. , the staff felt that it was important that the Planning Commission have a brief history in chronological order of these events leading up to the Board' s actions. On April 10 , 1974 , the applicant filed a request, Use Permit No. 74-17 to permit the construction of a 145 E ace mobilehome park. On .august 13 , 1974 , the environmental assessment and request for Exemption Declaration 74-123 , was rejected by the Environmental Review Board and they called for the preparation of an Environmental Impact Report. The August 13 , 1974 Environmental Review Board transmittal is attached herewith. Environmental impact Report 74--11 was prepared by a consultant of the City disseminated for review and ultimately adopted by the Environmental Review Board on February 1.3, 1975 . The City Council and Planning Commission of the City of Fountain Valley voiced much concern over the environmental impact report and zoning on the property, therefore, Councilman Matney appealed the decision of the Environmental Review Board to the City Council and at their March 17, 1975 meeting, the City Council rejected the appeal and sustained the Environmental Review Board in their actions and adopted Environmental Impact Report 74-11 with the findings contained therein . On April 30, 1975, the Board of zoning Adjustments conditionally approved Use Permit 74-17 and placed on the project the condition which is the subject of this pending appeal. On a present worth basis , these early dollars are more valuable than the ones ten or fifteen years down the road. Another point to bring out is that although the project will have an apparent small negative affect on City costs and Community College District costs, the overall revenue and cost relationship is strongly positive. Looking at the combined impact on the County, City, '- hd School Districts , the project has an average overall revenue/cost ratio, Page Of 1 .36, with an average yearly surplus of $23, 180 over costs (total 120 revenue of Z83,103 versus costs of $61 , 130. Thus , the small loss to the City represents imbalances in the law, rather than the mistaken belief that mobile homy owners do not pay their share of taxes . The Western F'obile home Association lobbied in 1972 for passage of a bill to peace mobile homes on local tax roles, just as single-family homes are. The measure failed.* Since the City, County, and School Districts all impose property taxes , the overall positive revenues of the project will permit overall property taxes to be "lowered." In other wards, the decreaseF in County and school taxes will outweigh increases in City taxis , thus benefiting the taxpayers of the conrmuni ty. In actuality, these eFfects will not be visible in these buagets, but they are real nonetheless. 4.8 Aesthetics Views Homeowners in Seab►•eeze Condominiums overlooking the project site (Figures 5, ra, and 7) may prefer not to look down and across a mobile home t" park.. Ground-level views in the page 135 condominiums would look out onto a vista broken up by the hedgerow. Likewise, westerly views from the mobile home park would be directed � into a greenbelt of trees rather than upward and into the condominiums. i The proposed "fence" would extend along the entire length of the western boundary of the site (Figure 7) as high on the slope as possible. Trees or bushes should be selected for rapid dense horizontal growth and limited height in order to preclude obstructing views beyord that desired. In order to present as pleasing a view as would any quaility single-family residential development, it is recommended that the use permit be conditioned upon utilization of shake roofs for all structures on the site. Louis Graziadio stated that mobile home parks are tending more and more to become permanent type structures because of the cost of housing, and that the permanency of the coaches should be considered. John Cope stated that a number of technical problemms had occurred and with new information received from the State Mobilehome Code con- cerning the weight of attached structures a modification was in order. Robert Drechsler, tenant of Space 26 in the mobi.lehome part, was present at the meeting. Secretary Palin reported to the Board that the prior approval of these modifications (granted on September 29 , 1976) had been based upon misinformation as to the effects such modifications would have on adjacent spaces within the park. He also noted that some coaches had, in fart, already been moved in on some of the lots upon which the Board had acted. Walt Lipps noted that some of the people whose coaches were already in place now find that their units are too close to the space lines and are subject to reloca- tion. Mr. Drechsler, ane of the tenants so affected, has filed an appeal to the Board ' s actions of September 29 . ON MOTION BY PALIN AND SECOND BY LIPPS THE BOARD DETEP14INED TO RECONSIDER ITS PRIOR ACTION OF SEPTEMBER 29 , 1976, BY THE FOLLOW- ING VOTE: AYES : PALIN, CRQSBY, LIPPS NOES: NONE ABSENT: NONE The Board discussed the project. It was the consensus of the Board that the prior action should be rescinded and the applica- tion for mcdi.ficatioa of lot lines denied. Applicant will be required to provide written proof that any future request for a lot line adjustment for a specific lot will not affect any space already occupied by a coach or any space with currently existing lawful setbacks which in leased or under ,agreement to lease to a specific tenant.
