SUBJECT: Negative Declaration No. 75-14 (C.U.P . 75-4)
The Environmental Review Board at its meeting of Marr;h 19 , 1975 ,
granted the above negative declaration, having found that the
proposed project %.*.11 not have a significant adverse effect upon
the physical environment.
No enviroiunental impact report has been prepared for this pro-
ject, and the Negative Declaration issued for the project has
been properly posted in the office of the City Clerk. Findings
are based upon information contained in the negative declaration
request, discussion at meetings of this Board, and the following
recowmendations :
1. If the laveloper pro;,oses to provide air conditioning, the
insulation in ceilings and exterior walls shall be a minimum
of R-19 and R-111 respectively. If no air conditioning is to
be provided, the inaulation in ceilings and exterior walls
shall be a minimum of R•-13 and R-7 , respectively.
2 . All building spoils , such as unusable lumber , wire , pipe , and
other surplus or unusable material , shall be disposed of at
an offsite facility equipped to handle them.
3. All structures proposed for construction within this subdivi-
sion shall be constructed in compliance with the g-factors
as indicated by the geologist ' s report.
4 . Calculations for Eootings and structural members to withstand
anticipated g--factors shall be submitted to the City for
review.
S. Circulation easements required of the property to the north of
this proposed project shall be recorded concurrently with the
sale of the property or upon issuance of permits or entitle-
ments for the pv jposed project.
6. The driveway shvkgn on the property to the north should be loc-
ated as close as possible to that property' s south property
line, and the northerly driveway on the subject property should
be located as close to the first drive as possible, to take ad-
vantage of the break .in the street median on Goldenwest.

Conditional Use Permit #75-4 at their recent meeting held on May 6, 1975.
At that time, the Planning Cooc!" lion, with total disregard for the recommendation
of the planning staff and the four page staff report, denied our application for
a Conditional Use permit with findings totally inconsistent with the facts.

The applicant is .proposing to construct a Montessori Sc:hoc . •.ith an
enrollment capacity of 120 children ranging in age from 5 i.o 12 years.
The facility will contain five classrooms, an administrative office,
off-street parking, and outdoor play areas.
The subject site is zoned R1 and surrounded by single family homes to
the north, west, and south. The property to the east is Goldenwest
College.
After an analysis of operational aspects , relationships of abutting
uses, and suitability of the site for the proposed use, the staff
recommended conditional approval of the school.
ADDITIONAL INFORMATION:
During the public hearing before the Planning Commission on the
matter, there were a number of residents from the adjacent neighbor--
hood who indicated their opposition to the proposed project.

2.1 3.0 ANALYSIS OF OPERATIONS:
The hours of operation are proposed as follows :
Arrival Time -- 7 a.m. - 9 a.m.
Classroom Time = 8 a.m. - 4 p.m.
Departure Time -- 4 p.m. -- 6 p.m.
A two hour time period for arrival or departure is provide.3 to allow
flexibility to parents ' varied schedules . The applicant indicates
that the proposed arrival and departure times usually will alleviate

enrolled. Children' s activities will take place both indoors and
outdoors during operation.
4 .0 -ANALYSIS OF CONCEPTUAL PLAN:
The proposed site is 117 ft. x 312 fit. deep with a lot area :,f

61260 sq. ft. (17% lot coverage) .

The proposed northerly drive on the subject property aligns with
the Department of Public Works plan for a left turn pocket from
the northbound travel lane on Goldenwest Street. On-site circulation
has been reviewedl and approved by the Traffic Engineer. Functionally,
the proposed loading/unloading Zane, coupled with a primary
; . circulation drive next to it for access to parking stalls and
egress will be :sufficient for thiF operation,

No indoor/outdoor . or outdoor play area is required by the Huntington
Beach Ordinance Coder for private ,schools although the applicant must
• meat minimum State of California Standards .

The plan proposed will concentrate outdoor activity primarily to
the rear half of the lot . After observation of other Montessori
School sites, the Staff believos that the noise generated by
children's activities outdoors will not be objectionable to
residents which abut the subject property to the south and west.
4 . 5 (Revenue Expenditure)
Generally, the proposed use would result in a net loss of income
to the City as services would not be outweighed by revenue generation.
Similarly, if low density residential were to be built, a net loss
of approximately $408. 00 per year would occur.
5. 0 FINDINGS:
1. The proposed plan is in substantial conformance with applicable
provisions of the Huntington Beach Ordinance Code.
2. Th-- location of the proposed use is compatible to the surrounding
residential uses .
j 3. The proposed site is adequate for the function depicted on the
conceptual site plan.
5 .0 RECOMMENDATION:
Based on the above findings, Staff recommends approval of Conditional
Use Permit No. 75-4 subject to the following conditions.
SUGGESTED CONDITIONS OF APPROVAL :
1. The conceptual plot plan received May 1, 1975 shall be the
approvee. layout.
In its approval action the Planning CoCommissionconsidered the
following issues relating to the conceptual plan:
Traffic Circulation and drives �
Parking layout
Lot area, width and depth
. Typ;: of use and its relation to property and improvements
in the immediate vicinity.
The conceptual plan is reviewed as a basic request for entitlement
of the use applied for in relation to the vicinity in which it
is proposed. The conceptual plan should not be construed as a
precise plan reflecting conforman.-e to all ordinance code re-
quirements.
2. Soil reports as required by the Department of Building and
Community Development and the Department of Public Works shall be
submitted to such departments prior to the ,issuance of Building
Permits.

3. Dedication and improvements of Goldenwest Street as required
by the Department of Public Wor.%s shall be complied with,
prior to the final inspection.
4. Prior to the final inspection, a landscape plan depicting plant
type, size, location, plan for irrigation, and screening wall:
for the parking areas shall be ;submitted to the Planning
Department for approval.
5. The maximum occupancy fcr the school facility shall not exceed
125 persons, unless determined to be less by the Fire Department.
6 . The water, sewer, and fire hydrant system shall be subject to
approval by the V-!partment of Public Works and the Fire Department.
7. No structures , other than those shown on the approved plot plan
shall be constructed.

We , the undersigned Home Owners surrounding the site of
the request for Conditional Use Permit 75-4 , wish to go
on record as being opposed to the granting of subject
Permit by the City Council of Huntington Beach on an ap-
peal to the denial by the City Planning Commission. ile
feel the reasons for the denial were overwhelming and
justiciable .
The proposed usage of the property described would only
add to trafFic and narking problems already extremely dif-
ficult in our ingress and egress to our homes both on local
streets and Golden tlest Avenue .
c*urthermore , oropased usage would treat on overly high
density area in what is now a "choice" low density resi-
dential neighborhood . The plot in question is insufficient
in size for an adequate school For children , play area ,
parking spaces and the bufFer zones For the home owners
backing there to . .Uith the parcel split , the question
arises as to the proper usage for the remaining land .
Qe thererore , feel tt,e best interests of the City and
the surrounding Home 0-mners would be oetter served by
holding and develvainca the entire piece of property as
residential housing_ in the same manner as all the homes
abutting it .
