MMll�.a�;fi,N i.CAC�I.CAl i� September 18, 1975 TO: The City Council I am appealing to the City Council the action taken by the Planning Commission at the September 160 1975 meeting. A hardship condition truly does exist for if the single family residence in question was conforming to zoning as the master plan shows Ml-CD, I would not be appealing the Commission' s decision. As Mr. Ed Kerins pointed out that no hardsr.ip exists because -the property zoning was adequate for other types of industrial use other than mine and the residence would have no effect upon. My feelings on that statement are as a comparison to tell a person who has studied to be a doctor can not practice as a doctor on . a plot of ground zoned for a doctor's practice because of a residence completely surrounded by the same type of zoning and that because a new ordinance passed by the Commission less than one year ago, the doctor's practice must be no closer than 660 feet fr,:= a developed or zoned residential but that he may become a lawyer or a plumber or some other type of business he knows nothing about even though there is a business similar to his located across the street 200-300 , away from the same residence in question, which is non-conforming to the Ml-CD. I realize that Steverson is not in fully compliance with this new ordinance but is still able to continue his business . I do not feel I am asking for anything beyond normal justice. I want to perform wy business as depicted on Conditional Use Permit No. 75-10 and have the full desire to follow up on all the Commission ' s conditions. If I am still riot found to be under hardship circumstances, I shall step down but will never take it as truth. Thank you, Frank Standard P.S. SU14W.RY OF STAFF REPORT: Conditional Use Permit No. 75-10 is a request to permit the establish- ment of an automobile dismantling yard on an existing develcped in- dustrial site. The proposed use will include a screened cu4door storage area, warehouse for storage of parts, office area, and off-street parking facilities. Conditional Exception No. 75-36 is a request to allow the storage yard to be located closer than 660 feet from a developed residential use as required by Section 9534 (a) of the Huntington Beach Ordinance Code . The applicant has proposed considerable improvements to the existing facilities and is in conformance with the screening, parking , and landscaping requirement for this type of development. The Conditional Exception was necessitated by the existence of a nonconforming single family residence located on the parcel directly east of the subject site. Because this property is zoned M1 (Light Industrial) and the existing residence is nonconforming , the staff felt there were circum- stances which lend themselves to a consideration of the request. The staff also recommended conditional approval of the storage yard subject to conditions that would ensure compatibility with the surrounding uses. ENVIRONMENTAL STATUS : The proposed industrial use is a Class I Categorical Exemption , California Environmental Quality Act, 1970. The class includes the reoperation cf existing facilities . The existing facilities had originally been used as a contractor ' s and " plumbing storage yard. The proposed use will include a c,-creered outdoor storage arer., warehouse for storage of parts, office area, and off -street parking facilities. Conditional Exception No. 75-36 is a request to allow the storage yard to e ocated closer than six FuRred and sixty (660) feeet from a developed 4tr►t• :residential use as required by Section 9534 (a) of the Huntington Beach y ;Qtdinance Code. 3.0 PRESENT LAND USE, ZONING, GENERAL PLAN DESIGNATION: The subject property is zoned M1-•CD (Light Industrial in the Civic District) and is designated on the General Plan as an industrial land use. The property is developed with outdoor storage facilities and office areas. Property to the north and northwest is zoned M1-CD and developed with industrial uses . To the west is property zoned CF-R (Community Facilities -- Recreatios:al) and developed with the "Adventureland Playground" . Directly south of the subject property is Ml• •CD zoning which is developed with an automobile dismantling yard. All of the surrounding properties with the exception of the City recreational uses, are designated for industrial land uses on the Genera% Plan . 4 . 0 ANALYSIS: :�w•y The applicant has proposed considerable improvements to the existing fici�lities. A new decorative masonry screening wall is proposed to rPolace the existing wood fence that fronts on Gothard and Talbert Streets. The off--street parking area will be completely paved and landscaped with the only access bear:g from Harriman Street. Landscaping of the entire site will be provided and will be accomplished in a manner in keeping with the site' s close proximity to the Central Park. Under provisions of the Ml- District, 975 square feet of landscaping would be required, . the applicant is providing in excess of 2500 square f•aet. Four (4) off-street parking spaces are required, the site plan indicates seven (7) . Conditional Exception No. 75-36 was deemed necessary as the result of a field inspection which showed tnat an existing single Family residence was located on the parcel of land directly east of the proposed site. This residence is an older, single story, wood frame structure which is nonconforming because of existing zoning. The zoning surrounding this residence is also 61.1 (Light Industrial) and developed with industrial uses. Should the Planning Commission approve Conditional Exception No. 75-29, the staff recommends approval of Conditional Use Permit No. 75-10 based on the following findings and subject to the following conditions. b. Should the Planning Commission deny Conditional Exception No. 75--29 , the staff recommends that Conditional Use Permit No. 75-10 be denied based on nonco*npliance with the applicable provisions of the Huntington Beach Ordinance Code FINDINGS : I. The proposed use is in substantial conformance with applicable Provisions of the Huntington Beach Ordinance Ccde. 2. The proposed site is adequate for the function as d, jicted on the conceptual site plan. 3. The proposed use is compatible with existing surrounding uses. CONDITIONS : 1. The conceptual site plan received ved August 9 t 2Q, 1475 shall be the approved layout.
