Due to concerns relating to plot plan inadequacies and the need for additional information regard- ing traffic generated, the applicant requested a continuance on C. U . P . 73--22 to January 20 , 1976 . The applicant has since provided additional information concerning factors related to traffic estimates and has revised the plot plan to substantially conform with all. City code requiremp-Ls. 3. 0 ADDITIONAL INFORMATION : The Planning Department has received two petitions ; otie from parents who are willing to car pool their children to qet to and from the proposed pre-school facility and one from local residents who are opposed to the proposed facility being located on Glencoe Street . Both petitions are attached to this staff _9po.rt for your reference . 4 . 0 PRESENT LAND USE, ZONING AND GENERAL FLAN DESIGNATION: The subject property contains a dilapidated single--family structure that is presently unoccupied . It is intendLd that this structure be used as part of the new facility. The site is designated on the City ' s General Plan for medium density residential use of 8 to 15 dwelling units per gross acre. The parcel ' s zoning of R2 (Medium Density Residential District ) is consistent with the City ' s General Plan , Directly north of the subject property is the Sunview Elementary School site. Directly east of the site is a smell apartment complex . South and across the street from the subject site are parcels containing a four-plea residential unit, a single-family home , and an apartment building . An older single--family home Is located directly west of the subject parcel . At the northwest corner of Silver Lane and Glencoe Avenue is an existing church structure. Excl»ding the elementary school site , all parcels Sur- rounding the subject property are presently zoned A2 and all parcels except the school and church sites are designated for medium density resi- dential use on the City ' s General Plan. 5. 0 ANALYSIS As required by the Planning Staff , the applicant has submitted revised plans. The Staff has reviewed the plans and finds that , excluding -quare foote:ge requirements of the outdoor play area , the revised plans Conform or exceed all planning requirements and development standards . 5. 1 PLOT PLAN REQUIREMENTS A total of 8, 400 square feet of outdoor play space is required by Code ( 175 square feet per child times 48 maximum children) . The project. Plan provides a total of 7 , 000 square feet . A total of 1 , 680 square feet of play area is required within the pt-t)pos.oti building ( 35 square feet per child) . The project prr>posod a total of 2 . 000 square feet of classroom spaccc . CONDITIONAL USE PERMIT NO. 75-22 Page 3 Relative to nursery schools, the facility shall be enclosed with a minimum of a six-foot high fence. The applicant proposes to enclose the facility with a six-foot high chain link fence . All other requirements - including setbacks , height restrictions , land- scaping, etc. - comply with the provisions of the Ci_t;y ' s ordinance code. 5. 2 CONSISTENCY WITH THE CITY ' S GENERAL PLAN: In that the project is proposed to be located in a residential neighborhood, ati issue is that of the project ' s compatibility with existing and future land uses. As stated in Section 2. 0 , the subject parcel. is located .in an area desig- nated for medium density residential use . As is the case throughout the City, the majority of residential quarter-sections are typically planned to i.^.elude an elementary school site and neighborhood park facility . In addition , quasi-public uses such as churches any' ether .institutional uses are generally regarded as compatible uses that may be permitted within residential neighborhoods . The concept of planning community facilities and allowing certain quasi - public institutional uses within residential neighborhoods creates certain advantages and disadvantages to local residents . The cultural, educational , and recreational benefits derived from the services and activities rendered by these public and quasi-public uses are generally recognized. Ec: . r access and locational convenience are physical factors considered in determining the proper location of community facili- ties within residential- districts . ':'he unfavorable factors are quantifiable in terms of traffic generated and, in the case of a pre-school facility , the noise generated from recreational activities that matr create a nuisance to local residents. Considering the hours of operation (9 : 00 a . m. to 1 : 00 p .m. ) and the scope of the project, coupled with the willingness of parents to carpool their children to and from the proposed facility , all indications are that the traffic generated would not create a major prolelem to local. residents. This postulation is based on a traffic analysis conducted by the City ' s Department of Public Works . Furthermore, in that the City ' s Environmental Review Board has h,:d the opportunity to review the proposed project , it. has assessed all environ- mental impacts , including the impact of the not so generated `rom the project.. The findings of the Environmental Review Board conclude that tho proposed project will not: have a significant adverse effect upon the physical environment . Regarding the site location , the Staff feels that , while the proposed facility will cater to pre--school children otit: -- ide Lhe neighborhood , t:ho potentiality of accommodating pre-school children wit.hitt the ittim_diat o area is apparent . As stated in Section 4 . 0 , the subject parcel is located botween two exist::- ing residential uses . While it also borders the elementary school site , the proposed facility would front on Glencoe Avenue and consequently have a greater relationship to those residential uses along Glencoe Avenue than the school site. Thus it could be aryued that the pre-school facility may disrupt the character of existing and future residential uses along Glencoe Avenue and may adversely affect property values . The applicant has expressl?d the desire to architecturally design the facility to create a residential-like -appearance of the structure . An exterior elevation .lrawing of the proposed structure Has been submitted and, as illustrated on the drawing , the sLr ,:cture is oriented towards a residential building appearance, includi.nq a roof dc!s.ign similar to the abutting P complex.apartment It is the Stet f f ' s contention that throuc h t appropriate architectural design and proper site p l anning the facility would harmonize wi.ch existing and futrurc, residential uses along Glencoe Avenue . 6 . 0 FINDINGS : i The Staff offers the following findings : i 1 • The proposed plan substantially complies with all annlicahln provisions of the liunti:,aton Beach Ordinance Code . 2 . The proposed use as a quasi--public or institutional use is compatible with the adopted land use designations of t:hc- City ' s General Flan . 3 . The proposed use is consistent with the City ' s CommuNLty FnCi.iiti(�s objective of "Satisfying the quasi-public n^eds of th(.! coo munit:•; by encouraging the proper location and planninca of such a facility. " • 4b Page Two Conditional Use Permit No. 75-r22 PLANNING COMMISSION RECOMMENDATION: i The Planning Commission recommends approval of Conditional Use Permit No. 75-22 for the reasons enumerated above. SUMMARY REPORT Conditional Use Permit No. 75-22 is a request to allow the development of a private pre-school facility on a 13 , 500 square foot panel zoned for residential use. The proposed project consists of remodeling an existing structure and constructing additional floor area to provide a 2400 square foot building . The building is planned to contain four (4) classrooms and two (2) administrative offices. The proposed facility will accommodate a maximum pre-school enrollment of 48 children. The proposed facility is in substantial conformance with the develop- ment standards of the Huntington Beach Ordinance Code. The issue of the project' s compatibility with existing and future land uses and the concept of planning such a quasi-public institutional use within a residential neighborhood were discussed in the staff report to the Planning Commissicn. i This analysis indicated the advantages: locational convenieace and easy access to the immediate residents; and the disadvantages : traffic and noise generated from the use. The staff conclusions and recom- mendation for approval were based on the mitigating effects that the hours of operation (9 : 00 a .m. to 3 : 00 p.m. ) would accomplish, the willingness of the parents to car pool the children to and from the facility and the commitment the applicant made in the design of the structure to create a residential-like appearance. A detailed discussion of these issues and concerns is contained in the original attached staff report. ADDITIONAL INFORMATION: The applicant, Airs. Barbara Smith, and La Dorna Lysor addressed the Planning Commission during the public hearing and spoke in favor. Mr. PDger Coulter , Claude Sarrat, Reginald De La Cuesta , Gene E.:win, and Margaret De La Cuesta spoke in opposition citing the smallness of the lot and noise and traffic effects on adjacent residential uses. ENVIRONMENTAL STATUS : The Environmental Review Board, at its meeting of December 30, 1975 , granted Negative Declaration No. 75-80, having found that the pro- posed project will not have u significant adverse effect upon the physical environment. Lunch 12 :00 48 0 48 48 0 3 :00 The applicant stated that some car pooling is being practiced, and that most of the trips would origi�1ate in the western part of the City all the way to Huntington Harbour. it is estimated that an occu- pancy of 1. 6 students per vehicle and a 2 mile average trip length wouli be used to estimate the impact by the tra:..'ic. About 70% of these trips would probably pass through the intersection of Heil Ave. and Silver bane. This particular interx:iection has a sight distance problem because of the embankment en the r.orthaast corner of the inter-- section . Although there is an A ,H.F.P . project to correct this situation, the actual construction will be delayed because of enviroiunental matters. Mitigating Measures.- The number of vehicles arriving at one ti-ne can be reduced by staggering the hours of operation by 30 minutes .
