tract 14296.
a) With an addition of a new street (across from 6722 and 6732
Lawn Haven) , our cul-de-sac will be virtually eliminated,
thus decreasing the value of our homes.
b) As designed, there will be a major circulation problem
with turning hazards, plus the nuisance and danger of the
street outlet directly opposite 6722 and 6732 Lawn Haven.
5. Complete soil studies shall be performed at varying depths to
assure waste from former oil production areas poses no threat
to new and existing tracts.
6. Lawn Haven Drive residents opposite and adjacent have requested
walls and visual buffers before approval of the tentative map.
Homeowners Association stated requests would be presented
and considered.
7. Parking onstreet is inadequate and will be reduced more
greatly.
a) Existing 21 of 42 homes on Lawn Haven Drive have
insufficient driveway depth to park a vehicle.
Therefore, it is necessary for homeowners and their
guests to park on street.
b) The access to 14296 as approved by planning commission
will eliminate street parking which as existing was
already insufficient.
c) The proposed tract 14296 will only provide onstreet
parking for 6 of 10 residences. As a result, their
overflow parking will be on Lawn Haven Dr. and will
compound an existing parking problem in neighborhood.
8. Hazardous ingress and egress:
Vehicular exit of proposed tract 14296 will require drivers to
look behind them as they are turning left and while in this
turn, vehicles traveling north on Evening Hill will be turning
into their lane. Recommendation: Stop Sign at Evening Hill.
Regarding map approved by planning: This dangerous "traffic
pattern is not accepted by California Department of
Transportating (CALTRANS) on our highways. A 4-way
intersection has superior visability because traffic can
be viewed in all 4 directions at 1 time. Ingress and egress
to tract requires 4 turns, all 1/2 block in length, which
increases potential for accidents.
9. By bisecting existing cul-de-sac, existing homeowners will
suffer a 5% - 10% loss in property values.. . one cul-de-sac off
another cul-de-sac is poor planning. The planning department
alternative for access is better planning.
Existing 9 ' high wall to street grade in not objectionable to
the 6 homes most impacted on this street. A 6' or 8 ' wall
will not after 19 years create a negative impact on
marketability on the street aesthetics. We recommend a 8' high
wall for visual buffer from the new 2 story homes and 2:1
replacement of street trees in rear yards of these homes.

Following are the problems that continue to exist with the
revised tentative tract:
1 . With an addition of a new street (across - from 6722 and
6732 -Lown Haven ), our cul-de-sac will be virtually
eliminated, thus decreasing the value of our homes.
2. As designed, there will be a maJor circulation problem
with turning hazards, plus the nuisance and' donger of
the street outlet directly opposite 6722 and 6732 Lawn
Haven.
3. With the elimination of the possibility of access from
Clay into the new tract, the parking situation will
become a large problem for the 6700 block of Lawn Haven
as well as the new homes.
I. Perhaps the largest problem will be in regards to the
drainage and water pressure. This is already a problem
as the street currently exists. (See attached picture
of the rainstorm this date. ) The addition of a new
street in this area would compound the existing problem.
The new proposed set-up is an improvement of the initial
Proposed tract, "• but we feel that if the most desirable layout
(access from Cloy) can not be realized, the second choice
to alleviate or eliminate all of the problems, would be the
extension of Evening Hill into the new tract.

Drainage update: Mild rainfall 1/7 resulted in 3' wide channel centered
in swale on Lawn Haven at Evening Hill . See pictures. Water was at top
of curb, on base of driveway of corner residence. At 6PM 1/9, still a
1' wide -channel in swale, a 6" wide channel in swale .continuing southward
at the 2 street intersections before water empties into drain at Gate Hill
3 blocks south on Evening Hill . No water still evident along east side of
Evening Hill which drains the south side of Lawn Haven and east side of
Evening Hill from Beacon Hill to Gate Hill . The two drains at Gate Hill
.currently appear to be exceeding. their capacity during rainfall -with the
existing homes served by these drains. Recommendation: install new flood
drain to serve Lawn Haven at Evening Hill , -unless all drainage for new
10 home tract can be directed to Clay which originally was where this- land
drained to since Lawn Haven Dr. was 8' above the northeast edge of this
parcel before any regrading was done.

On February 19, 1992, the Planning Commission approved Tentative
Tract No. 14296 which is a request by Pacific Coast Homes to
subdivide a 2 .31 acre parcel into ten (10) lots . Tentative Tract
No. 14296 is located on the north side of Lawn Haven Drive
approximately 100 feet west of Evening Hill Drive.

On February 28, 1992, Paul and Karen Jackle, Seacliff residents who
reside at 6702 Lawn Haven Drive, submitted an appeal to the Planning
Commission' s approval of Tentative Tract No. 14296 . The appeal is
based on 1) improper notification of the February 19, 1992 Planning
Commission meeting 2) circulation impacts 3) inadequate on-street
parking and 4) decrease in property values . The following is a
discussion of the concerns :
1) Improper notification of continued Planning Commission
meeting date:
The appellant spoke at the first public hearing for
Tentative Tract No. 14296 on January 29 , 1992. The
Planning Commission continued Tentative Tract No. 14296
with direction to reschedule within 30 days . The February
19, 1992 Planning Commission meeting date was selected
because a meeting date is March would have been scheduled
beyond 30 days .
All interested parties were notified of the February 19,
1992 Planning Commission meeting. In fact, the appellant' s
husband and daughter were present and spoke at the
rescheduled February 19, 1992 Planning Commission meeting.
Contrary to the concern in the appeal regarding improper
notification, all interested parties were informed of the
February 19 , 1992 Planning Commission meeting where the
appellant and other interested parties spoke.
2) Circulation Impacts
The appellants claim that Tentative Tract No. 14296 will
create circulation impacts . This concern was fully
addressed at staff meetings, Subdivision Committee
meetings, and at the Planning Commission meetings . The
Subdivision Committee and Planning Commission have analyzed
Tentative Tract No. 14296 and have decided that the
proposal layout will not create circulation problems .
Staff has listened to the Subdivision Committee and
Planning Commission analysis and agrees with their
conclusions . The mid-block access will serve to slow
vehicles and promote distinct turning decisions . The
alternative alignment to oppose Evening Hill Drive may
cause quick turns and a hazardous situation.
Staff does not agree with the appellant' s position that
Tentative Tract No. 14296 will create circulation
problems . Staff supports the Subdivision Committee and the
Planning Commission.

3) Inadequate On-street Parking
The appellants claim that Tentative Tract No. 14296 will
result in inadequate on-street parking. Within the
tentative tract boundaries, twelve (12) on-street parking
will be provided. In addition, the four (4) lots with
reduced frontages will be required to provide extra guest
parking spaces on-site. This will reduce on-street parking
demand.
The existing Lawn Haven Drive terminus (cul-de-sac) will
lose three (3) on-street parking spaces due to the location
of the new street for the proposed subdivision. The loss
of parking spaces will be off-set by the additional twelve
(12) on-street parking spaces provided in the new
subdivision. Staff recognizes the loss of three (3)
on-street parking spaces and feels that the loss will not
be significant with the additional 12 on-street parking
spaces provided in the subdivision.
4) Decrease in Property Values:
The appellants claim that the mid-block access for
Tentative Tract No. 14296 will result in a 5 to 10% doss in
property values . Staff can only state that, as with the
general consensus in the Seacliff area, the new
subdivisions will generally increase property values .
Staff has noticed that sales of new construction generally
increase the value of existing housing stock.
The proposed access for Tentative Tract No. 14.296 is very
similar to Tentative Tract No. 14044 which is located on
Garden Circle in the Upper Seacliff area. Existing
residents on Garden Circle were concerned about the
compatibility of the new construction. Once assured that
the new homes would be a benefit to their neighborhood,
concerned residents all stated that the abandonment of oil
operations and the construction of single family homes
would increase property values .
Staff does not agree that proposed access for Tentative
Tract No. 14296 will result in a decrease in property
values .
Summary:
In summary, staff feels that the thorough review by the Subdivision
Committee and the Planning Commission and warrants approval of
Tentative Tract No. 14296 . Staff does not agree with the concerns
expressed in the appeal submitted by Paul and Karen Jackle. Staff
recommends that the City Council deny the appeal and sustain the
Planning Commission' s approval of Tentative Tract No. 14296 .

Environmental Status :
Tentative Tract No. 14296 is covered by Negative Declaration No.
90-28 which was approved by the City Council on May 6, 1991. No
further environmental action is necessary.

Not applicable.
ALTERNATIVE ACTION:
The City Council may approve the appeal and deny Tentative Tract Map
No. 14296 .

Dear Connie:
I would like to appeal the approval of tract # 14296 2-19-92. An
appeal has already been received which will cover public noticing
costs.
The most directly impacted six residences already paid $180. 00 for
3 alternative renderings to prepare staff alternative for access
to 14296. Prior to the preparing of above drawings, homeowners
association covered cost of 5 drawings.
The developer has refused to consider revision of staff alternative
and all drawings meet the standards of the Map Act. The .3
alternative renderings including one showing 5 golf course lots are
attached. The neighborhood prefers access at Evening Hill to map
approved by planning.
1. Improper notification of public of date of planning commission
meeting. No specific date announced when action was continued,
only reschedule to be within 30 days. February 17 holiday
offset regular scheduled time of planning commission meeting.
.No subcommittee meeting subsequent to January 7 meeting
reviewed data.
2 . A 4 way intersection with a minor offset. is preferred by block
to a cul-de-sac at midpoint on existing cul-de-sac.
3 . Since staff alternative rendering was engineered based on 1990
map received May, 1991, from planning, the northerly boundary
was moved northward, adding land (a part of Holly Seacliff. )
Therefore, there is sufficient north to south,. westerly
frontage to design 5 golf course lots using staff alternative
access.

Fire Department - Michael Dolder
On September 27, I visited the fire department and spoke to Mr. Dolder,
the fire chief. He explained the city standards of 100 parts .per million
for hydrocarbons was initiated 11/90 in response to the oil spill then and
it is being reviewed -now to see if it is appropriate for soils in Holly
Seacliff (instead of beach sand).
He reported that 9/24 at 8AM he met Gene Hines from SQAQMD at the oil island
by Lawn Haven Dr. and they found over 100 parts per million and when .they
came back three hours later to retest, all the soil had been removed and
soil of a different color was now on top. (soil 1st tested was covered or
removed). As a result of this testing, he is recommending on the October 7
consent calendar (this precedes public input at council meeting) that
$45,000 be budgeted for independent soil study because of the extensive
development in Seacliff and Holly Seacliff. Public works said 9/30 that
the fire department monitors and directs all soil moved and treated in
the city and public works is responsible for granting the permits to
stockpile soil to be used in development.' I spoke to John; he will ask
Bruce Crosby to call me back to answer any additional questions about the
permits and testing required by the city for the monitoring process now.
The planner handling the development of Seacliff is on vacation until 10/2/91.
Additional questions regarding the status of when the planning commission
will schedule a meeting for reviewing the recommendations of the subcommittee
and what happened to the petition dated April 12, 1991 signed by residents
of 20 homes in upper Seacliff will be addressed upon his return. The petition
should be added to the planning commission staff report (last one.dated 3/19
was prior to approval of the negative deV aration 90-28 which was appro ved
by city council 5/6/91.) There should be more information by October 4.
The subcommittee, which consists of 3 Seacliff residents (includes Nick, the
HOA President) plus- city staff from planning, public works, fire add 3 of the
6 planning commissioners has over the last few months reviewed each map for
Seacliff and the last 3 reviewed were 14396 and Island Q (the one requiring a
road through the golfcourse, 14277 and 14244, which requires and extension of
Island Bay- and has some-view and blockage problems on golfcourse lots. That
meeting was September 6 and the mitigating measures recommended 4 items related
to street width, sprinklers for 5000 sq.ft. homes if larger, & fire hydrants: The
association submitted map was reviewed & committee recommended access be moved
closer to Evening Hill Dr. Developer wants 5 golfcourse lots.

RE: Tentative Tract Map 14296
Attached is -petition signed by 20 homes near this proposed site and
original was delivered to Mike Adams April 22, 1991. To summarize
our preferences:
Access to the new tract should be from Clay. If tract 14043. to
Goldenwest is accepted as proposed, and/or tract 14243, which is
a 10 home subdivision with access from Palm, the need for access
from Lawn Haven to avoid cul-de-sac access from feeder street should
also be permitted for tract map 14296 since the natural drainage is
to Clay as Lawn Haven is above Clay. Also, there is a street vacation
needed if no street is tied in where Clay now ends so it would be
logical for access to be 'from this point, or as a second choice, simply
reversing the cul-de-sac to outlet on the extension of Clay to north.
Our second choice would be access from Lawn Haven by extending Evening
Hill adjacent to Lot 7,- the Salomeda residence at 6751 Lawn Haven which
would then become a corner lot. There is a downgrade from the westerly
lot line of Lot 7 to Tract 14296 currently and the retaining wall must
remain in place. As designed, all parking onstreet for the 5 existing
homes would be reduced to 2 onstreet guest spaces and there is no onsite
parking for Lot 8 due to short driveway so the cul-de-sac must be moved
eastward to be acceptable to the existing residents. There is also a
problem with headlights turning from the cul-de-sac onto Lawn Haven
for the 2 homes on south side of Lawn Haven unless the location of the
inlet is moved eastward.
We have no objection to having .10 homes built on site 14296, provided
the street width, drainage, privacy, grading tie-in to existing street
and compatability of the lot size, shape and onstreet parking is
addressed to be equal or superior to the existing tract, and when
the desi.gn phase is reached, the home design is compatible with our
community. If some homes face Lawn Haven, that will also be acceptable.
There is sufficient.land that minimum 6000 sq.ft. lots, preferably at
least 7500 sq.ft. lots should be no problem on this site.
Thank you for your willingness to respect our wishes. We are pleased
to report that the 20 homes who signed this petition were unanimous
on all of the above requests and if you would like additional petitions
for the balance of Lawn Haven and Evening Hill , we are willing to

Tentative Tract Map No . 14296 is a 10 lot-subdivision for
residential development purposes . The 2 . 31 gross acre parcel is
located at the northwest intersection of Lawn and Evening Hill
Drive. The vacant oil island property is zoned R4-01 .
Robert Franklin, Staff Planner, presented the tract and reported
that the project was previously reviewed by the Subdivision
Committee at their meeting of Wednesday, September 11, 1991 . At the
original time of hearing, the project was continued to allow the
applicant sufficient time to revise the map based on Subdivision
Committee findings and recommendations .
Staff stated that the map was revised and meets the recommendations
of the Committee and Departments of Fire and Public Works .
Discussion about the map ' s modifications ensued.
Staff reported that the Departments of Fire and Public Works had
reviewed the revised map and support the amended request with the
following findings and conditions of approval :

Works . These are based on the understanding that other comments in
the memorandum dated November 7, 1991 are addressed prior to
Planning Commission approval .
1 . The water and sewer system and appurtenances, shall be
dedicated to the City of Huntington Beach.
2 . Remove and reconstruct street improvements on Clay Avenue,
adjacent to Tract boundary, to new alignment .
3 . Damaged and deteriorated public improvements on Lawn haven
Drive, adjacent to Tract boundary, shall be reconstructed per
Public Works standards and requirements .
There being no further comments, the Subdivision Committee made a
motion to recommend approval of Tract 14296 to the Planning
Commission with findings and conditions of approval . The motion
passed with a vote of 4 to 1 . Planning voted against the request
because staff ' s recommendation is to align the access with Evening
Hill Drive.

I would .like to appeal the approval of tract # 14296 2-19-92 . An .
appeal has already been received which will cover public noticing
costs.

The most directly impacted six residences already paid $180. 00 for
3 alternative renderings to prepare staff alternative for access
to 14296. Prior to the preparing of above drawings, homeowners
association covered cost of 5- drawings.
- The developer has refused to consider revision of staff alternative
and all drawings meet the standards of the Map . Act. The 3
alternative renderings including one showing 5 golf course lots are
attached. The neighborhood prefers access at Evening Hill to map
approved by planning.
1. Improper notification of public of date of planning commission
meeting. No specific date announced when action was continued,
only reschedule to be within 30 days. February 17 holiday
offset regular scheduled time of planning commission meeting. '
No subcommittee meeting subsequent to January 7 meeting
reviewed data.
2 . A 4 way intersection with a minor offset is preferred by block
to a cul-de-sac at midpoint on existing cul-de-sac.
3 . Since staff alternative rendering was engineered based on 1990
map received May, 1991, from planning, the northerly boundary
was moved northward, adding land (a part of Holly Seacliff. )
Therefore, there is sufficient north to south, westerly
frontage to design 5 golf course lots using staff alternative
access.
4 . The following two items are taken from 1-7-92 letter (Exhibit
#1 ) prepared by residents of 6700 block of Lawn Haven, the

and considered.
7. Parking onstreet is inadequate and will be reduced more
greatly.
a) Existing 21 of 42 homes on Lawn Haven Drive have
insufficient driveway depth ` to park a vehicle`.
Therefore, it is necessary for homeowners and their
guests to park on street.
b) The access to 14296 as approved by planning commission
will eliminate street parking which as existing was
already insufficient.
c) The proposed tract 14296 will only provide onstreet
parking for 6 of 10 residences. As a result, their
overflow parking will be on Lawn Haven Dr. and will
compound an existing parking problem in neighborhood.

8. Hazardous ingress and egress:
Vehicular exit of proposed tract 14296 will require drivers to
look behind them as they are turning left and while in this
turn, vehicles traveling north on Evening Hill will be turning
into their lane. Recommendation: Stop Sign at Evening Hill.
Regarding map approved by planning: This dangerous traffic
pattern is not accepted by California Department of
Transportating (CALTRANS) on our highways. A 4-way
intersection has superior visability because traffic can
be viewed in all 4 directions at 1 time. Ingress and egress
to tract requires 4 turns, all 1/2 block in length, which
increases potential for accidents.

9. By bisecting existing cul-de-sac, existing homeowners will
suffer a 5% - 10% loss in property values.. One cul-de-sac off
another cul-de-sac is poor planning. The planning department
alternative for access is better planning.
Existing 9 ' high wall to street grade in not objectionable to
the 6 homes most impacted on this street. A 6 ' or 8 ' wall
will not after 19 years create a negative impact on i
marketability on the street aesthetics. We recommend a 8 ' high
wall for visual buffer from the new 2 story homes and 2: 1
replacement of street trees in rear yards of these homes.

Following are the problems that continue to exist with the
revised tentative tract:
1 . With an addition of a new street (across from 6722 and
6732 Lawn Haven ), our cul—de—sac will be virtually
eliminated, thus decreasing the value of our homes.
2• As designed, there will be a maJor circulation problem
with turning hazards, plus the nuisance and danger of
the street outlet directly opposite 6722 and 6732 Lawn
Haven. -
3. With the elimination of the possibility of access from
Clay into the new tract, the parking situation will
become a large problem for the 6700 block of Lawn Haven
as well as the new homes.
4. Perhaps the largest problem will be in regards to the
drainage and water pressure. This is already a problem
as the street currently exists. (See attached picture
of the rainstorm this date. ) The addition of a new
street in this area would compound the existing problem.
The new proposed set—up is on improvement of the initial
proposed tract, but we feel that if the most desirable layout
(access from Clay) can not be realized, the second choice
to alleviate or eliminate all of the problems, would be the
extension of Evening Hill into the new tract.

Drainage update: Mild rainfall 1/7 resulted in 3' wide channel centered
in swale on Lawn Haven at Evening Hill . See pictures. Water was at top
of curb, on base of driveway of corner residence. At 6PM 1/9, still a
l' wide channel in swale, a 6" wide channel in swale .continuing southward
at the 2 street intersections before water empties into drain at Gate Hill
3 blocks south on Evening Hill . No water still evident along east side of
Evening Hill which drains the south side of Lawn Haven and east side of
Evening Hill from Beacon Hill to Gate Hill . The two drains at Gate Hill
.currently appear to be exceeding their capacity during rainfall with the
existing homes served by these drains. Recommendation: install new flood
drain to serve Lawn Haven at Evening Hil-1 , unless all drainage for new
10 home tract can be directed to Clay which originally was where this- land
drained to since Lawn Haven Dr. was 8' above the northeast edge of this
parcel before any regrading was done.

Fire Department - Michael Dolder
On September 27, I visited the fire department and spoke to Mr. Dolder,
the fire chief. He explained the city standards of 100 parts per million
for hydrocarbons was initiated 11/90 in response to the oil spill then and
it is being reviewed now to see if it is appropriate for soils in Holly
Seacliff (instead of beach sand).
He reported that 9/24 at 8AM he met Gene Hines from SQAQMD at the oil island
by Lawn Haven Dr. and they found over 100 parts per million and when they
came back three hours later to retest, all the soil had been removed and
soil of a different color was now on top. (soil 1st tested was covered or
removed). As a result of this testing, he is recommending on the October 7
consent calendar (this precedes public input at council meeting) that
$45,000 be budgeted for independent soil study because of the extensive
development in Seacliff and Holly Seacliff. Public works said 9/30 that
the fire department monitors and directs all soil moved and treated in
the city and public works is responsible for granting the permits to
stockpile soil to be used in development. I spoke to John; he will ask
Bruce Crosby to call me back to answer any additional questions about the
permits and testing required by the city for the monitoring process now.
The planner handling the development of Seacliff is on vacation until 10/2/91.
Additional questions regarding the status of when the planning commission
will schedule a meeting for reviewing the recommendations of the subcommittee
and what happened to the petition dated April 12, 1991 signed by residents
of 20 homes in upper Seacliff will be addressed upon his return. The petition
should be added to the planning commission staff report (last one dated 3/19
was prior to approval of the negative declaration 90-28 which was appro\ed
- by city council 5/6/91.) There should be more information by October 4.
The subcommittee, which consists of 3 Seacliff residents (includes Nick, the
HOA President) plus city staff from planning, public works, fire add 3 of the
6 planning commissioners has over the last few months reviewed each map for
Seacliff and the last 3 reviewed were 14396 and Island Q (the one requir6ng a
road through the golfcourse, 14277 and 14244, which requires and extension of
Island Bay and has some view and blockage problems on golfcourse lots. That
meeting was September 6 and the mitigating measures recommended 4 items related
to street width, sprinklers for 5000 sq.ft. homes if larger, & fire hydrants: The
.association submitted map was reviewed & committee recommended access be moved
closer to Evening Hill Dr. Developer wants 5 golfcourse lots.

RE: Tentative Tract Map 14296
Attached is petition signed by 20 homes near this proposed site and
original was delivered to Mike Adams April 22, 1991. To summarize
our preferences:
Access to the new tract should be from Clay. If tract 14043 to
Goldenwest is accepted as proposed, and/or tract 14243, which is
a 10 home subdivision with access from Palm, the need for access
from Lawn Haven to avoid cul-de-sac access from feeder street should
also be permitted for tract map 14296 since the natural drainage is
to Clay as Lawn Haven is above Clay. Also, there is a street vacation
needed if no street is -tied in where Clay now ends so it would be
logical for access to be-'from this point, or as a second choice, simply
reversing the cul-de-sac to outlet on the extension of Clay to north.
Our second choice would be access from Lawn Haven by extending Evening
Hill adjacent to Lot 7, the Salomeda residence at 6751 Lawn Haven which
would then become a corner lot. There is a downgrade from the westerly
lot line of Lot 7 to Tract 14296 currently and the retaining wall must
remain in place. As designed, all parking onstreet for the 5 existing
homes would be reduced to 2 onstreet guest spaces and there is no onsite
parking for Lot 8 due to short driveway so the cul-de-sac must be moved
eastward to be acceptable to the existing residents. There is also a
Problem with headlights turning from the cul-de-sac onto Lawn Haven
for the 2 homes on south side of Lawn Haven unless the location of the
inlet is moved eastward.
We have no objection to having 10 homes built on site 14296, provided
the street width, drainage, privacy, grading tie-in to existing street
and compatability of the lot size, shape and onstreet parking is
addressed to be equal or superior to the existing tract, and when
the design phase is reached, the home design is compatible with our
community. If some homes face Lawn Haven, that will also be acceptable.
There is sufficient.land that minimum 6000 sq.ft. lots, preferably at
least 7500 sq.ft. lots should be no problem on this site.
Thank you for your willingness to respect our wishes. We are pleased
to report that the 20 homes who signed this petition were unanimous
on all of the above requests and if you would like additional petitions
for the balance of Lawn Haven and Evening Hill , we are willing to
o,,'.•Sso provide them for you. Please work with our Seacliff subcommittee.
