As we previously advised in our attached memo dated May 6, 19880 courts have found such limits unconstitutional. In a legal challenge, the city could be required to pay attorney fees. It is recommended ghat we delete the postinq limit, but still require removal after elections as a clean--up measure. It is a misdemc:•nor for any person to place, maintain, or cause to be placed or maintained, any sign or picture for the purpose of advertising on any property• of the state, county or city without lawful permission from � the public agency having Jurisdiction thereover. California Penal Code Section 556. This includes political signs or posters -on public rights of-way. Utility .poles t�►r�pe located th public rights of way. The state has jurisdiction over Beach Boulevard and Pacific Coast Highway and it is the policy of the state not. to give permission for political signs. .... The city has Jurisdiction over all other streets and rights of way in Huntington Beach. 2. Hunt g on Beach Ordinance Code Section 9762.6 specifically prohibits any sign on or over any public property or any public right of way with respect to which the city has jurisdiction. This includes all utility polee in rights j of way -involving city streets . it violation of the city ordinance is a misdemeanor. 3. Permits: (1) Political signs of 'less than six square feet. do not f require a permit. However, such signs are subject to the above prohibitions . In practical effect such E political• signs are permitted only on privite ' property with the permission of the property owner. (HBOC Section 9761.3(1) . ) offsite signs requiring no permit require a bond of One Hundred Dollars ($100.00) . HBOC Section 9764.7. ; • (II) Political signs of more than six square feet require one sign permit for all such signs. Said permit shall be obtained from the Department of Building, and Safety. HBOC Section 9761.1. Such signs are not permitted on public property or rights or way . It also provides that political signs may not pose a traffic hazard. You should be aware that a 60-;day restriction allowing political signs prior to an. election was held unconstitutional in City of &ntioch v. Candidates ' Outdoor Graphic Service (N.D. California (1982 ) 557 Fed. Supp. 52). The crdinance was held an improper restriction on freedom of speech and a violation of equal protection . The court noted that while the government has a legitimate interest in aesthetics, a ban . is not sufficiently narrowly drawn. The court emphasized that signs are a relatively inexpensive means of campaigning and an important means to place a name or issue before the public. Instead of a general ban, the court noted that the government may permissibly regulate the size, design, and construction of signs, provide more stringent regulations for areas in need of greater protection, prohibit signs that obscure hydrants, traffic signs and signals, or block motorists ' line of sight.. Also, the court suggested that a city might prohibit posting of signs on trees or shrubs. Thus , it is our opinion that the 45-day ban is unenforceable, although the balance of the ordinance is legal . We can still ask candidates for cooperation in--voluntarily complying with the restriction. ANALYSIS: The attached ordinance prohibits erecting political signs more than 60 days before an election , requires the removal of such signs within �.. ten days after an election , provides for a ten-day grace period following notice to remove signs, and allows the City to assess candidates or their campaign chairman for the costs of removal by the City. The Huntington Beach Ordinance Code is hereby amended by adding thereto Section 9760.51, entitled, "Politin.al Signs ," to read as follows : 9760. 51. POLITICAL SIGNS. Yotwithstanding Section 8760. 28(d) of this code, political signs may be erected in public rights-of way subject to the following limitations and restrictions: (a) No candidate shall place or allow, permit, or cruse to be placed a sign bearing his name in any public right-of-way 1 more than sixty (60) days prior to an election in -)hick he is a i candidate. (b) Ito person or chairman of any committee in support of an issue, cause, or proposition shall place or allow, permit or cause to be placed a sign in support of said issue, cause, or proposition: in any public right-of-way more than sixty (60) days prior to an election in which such issue, cause, or prop- ;. oeition appeare on the ballot. (e) All political signs, whether in support of an individual candidate or an issue, cause, or proposition, shall be removed from the public right-of-way within ten (ZO) days from the date of the election in which such candidate 's name or such issue, cause, or proposition appeared on the ballot. (d) If, after expiration of the ten (10) day period speci- fied in subsection (c) of this section, political signs have not been removed from the public rights-of-way, the Director of Public Works shall, by registered mail, return receipt requested, give written notice to the person, candidate, or chairman of any committee responeihZe for the placement of political signs that an additional ten (to) day period, from and after the date of such notice, has been granted in which to remove such ,political MT:ahb 1. i I t i signs. AN The present system for enforcement by the Building Department calls for them to. send a letter to the. candidate responsible for the violation informing him of the requirements of the H. B. Ordinance Code and requesting his compliance therewith. Within a reasonable time (not established) , if the candidate has not made an effort to comply:. he is sent another letter informing him again I of the requirements and stating that the signs will be removed. In some cases, even a third letter is sometimes sent, and since ; this contact may require a full week between letters, there is a considerable lapse of time. 'I I have discussed the matter with Mr. I4evis in the Legal. Department, and he agrees that the Ordinance Code is not specific in its re-- 1 quirements in this regard. j ) May I suggest that you consider giving the Building Department a directive regarding this matter, as follows: (a) When the department finds a sign or signs (or posters) adver- tising any particular candidate, for which no permits have been appliod for, or no bonds for removal have been posted, that they notify the candidate by registered mail, return receipt requested, it of his violation and the city's requirements in regard thereto. (b) That the Building Department, in this original notification, i ( give the candidate five days from the receipt: of said notifica- tion to comply with the City's requirements. j1 (c) That, in the event of non-compliance by the candidate, the ' Building Department be directed, either to remove said illegal signs and posters, or that the candidate be cited for violation of the H. B. Ordinance Code. This suggestion is made with the idea of reducing the time for en- forcement of the provisions of the code, and the reduction of dup- lication of correspondence in regard thereto. ! : I HOME OWN ERS olden eat ASSO,,ATION HUNTINGTON BEACH CALIFORNIA p. b. BOX 1086, HUNTINGTON BEACH, CALIFORNIA 92647 May 22, 1972 In a editorial last week, the Los Angeles Times complimented the City of 31untington Beach for their new ordinance bringing control over the posting of political sighs. You might be interested to kuow that it is easier to write such a ordinance than it is to enforceit. Por the Juice 6th election , some candidates have already posted signs and more are goijig up daily. Of those going up only Leacom, candidate for Wunicipal court judge, has posted the required 000.00 cieau up bond. A out-of-district candidate irally Davis, who has large signs posted on the southwest corner of liolsa J: Goldenwest, has ignored the letter inform- ing him of the need to post the cleanup bond. Other candidates are foliowing his lead. City officials explain that the enforcement pro- blem comes about because they, if they find signs posted, have to first send the candidates a latter officially informing them of the bond requirement. If no response in received in a reasonable time, ' a second letter roust be sent informing the candi- dates that if the band is not posted by a certain date, the signs will be removed. It is obvious that by following the above procedure the election day will have paase(i before the city work crews can legally act to remove the "illegally" posted political signs. A mockery is being made out of a well intended sign, control ordinance by those persona campaigning to represent us. f Public_ comment by you would help apply enough heat to get candidates to comply with the posting of the clean up bond.
