rt Mark Downing , as sole owner, constituting
the only person , purtxer, having any interest in the real property
described as follows :
Lot 7 , Block H of Tract No. 7
which property is 'located and known as Mark Do—fiing Ford, Inc
at 16651 Beach Boulevard, Huntington Beach , California, does
hereby covenant, promise and agree to and with the City of
Huntington Beach , State of California, a municipal corporation. ,
that:
In consideration of the granting to Mark Downing of Use Permit
No. 65-9 by the City , they will perform the following conditions,
improvements , and etc. , prior to January 1, 1966:
1, Beach Boulevard shall be fully improved to State
Standards . Improvements shall include street trees
and street lights ,
2. gain Street shall be fully improved to City Standards
along all that portion of Lot 3 , Block H , Tract 7,
abutting said street. Improvements shall include
street trees and street lights. Work shall be done
at the saute time and in conjunction with improvement
of Main Street by the City.
3. Drainage of the property shall be approved by the
Department of Public Works .
4. A six (6) foot high block wall shall be constructed
along that portion of lots 3 , 41 50 e , and 7 of Block
H, Tract No. 7, abutting "R" zoned property. The height
of said wall shall conform to the provisions of Section
9732.i of the Huntington Beach Ordinance Code.
5. Off-street parking facilities including landscaping,
number, arrangement, eccess , paving and striping of all
parking spaces shall meet all. adopted ordinances and
the latest adopted Planning Commission Standards .
6 . No structures , other than those shown on the approved
plot plan, shall be constructed within the project.

This office represents Mark Downin
g Ford, Inc . who
protested, on May 19, 1964 , the granting by t!ie
Huntington Beach Planning Commission of the Use
Permit referred to above to the applicant, Paul C .
Jones , 17171 Beach Boulevard, Huntington Beach ,
California . The application requested permission
by Mr. Jones to allow the sale and/or exchange of
new and used cars In the C-4 Highway Commercial District .
The Planning Commission granted the Ilse Permit with
certain restrictions attached thereto .
On behalf of my client above: noted, appeal from that
decision and your conditions attached, is made . it
should be noted that our appeal is in two separate respects ;
1 . ) Appeal from the granting of the Use Permit itself ; and
2, ) Appeal from the conditions and restrictions set down whist:
we do not believe are strict enough in the event such
permit is approved.

have in mind when he purchased property around it, certainly he I'Mew
it would not stay vacant for ever.
I am glad to iipar Mr. Dooming, I,as spent as much money with the
city ac he has. But on the other hams 1 certainly hope the rights
of our citizens won't be judgod by the amuunt of tales we ray. This
surely can' t be a „ound reason for the small property o.,mer to tceke
a back seat to ;people who buy and build around him.
This issue reminds me of neople who buy hones around cattle
dairies, and then. com-plain abotit flies and ask the dairy to move :Then
the situation ryas there at the time they purchased the property.
I am in favor of i-:r . Paul. Jones , and if there is free enterprioe
and democracy it cortainly has a chance to be stio:..i by each of ,you
thin evening.

City of Huntington Beach, State of California, a municipal

?Sark Downing to perform all provisions of an agreement
dated June 209 , 1965 , as said agreement pertains to Lot 7
referred to in said agreement which agreement is hereby
referred to and incorporated by reference in this agree-
ment, Said Mark Downing does hereby agree to install the
following improvements on or before March 1, 1968:
1. A six (6 ) foot high block wall shall be
constructed along that portion of Lot 7
of Block H, Tract Ito. 7, abutting property
Zoned for residential purposes. Said wall
shall conform to provisions of Section
9730. 17 of the Huntington Beach Ordinance
Code.
2. All off—street parking facilities shall
conform to Article 975' of the Huntington
Beach Ordinance Code,
