Gentlemen:
American Mobilehome Corporation, herein "Applicant" has been
notified by the acting secretary of the Planning Department of
the City of Huntington Beach, California that its application
for the captioned Use Permit was acted upon by the Huntington
Beach Planning Commission on February 3, 1970 and the request
was "Disapproved. "
In the notice of ruling the reasons stated for denial were as
follows:
1 . The Planning Commission had �.)riginally suggested
continuance of the matter until May 19 , 1970; however,
the applicant has suggestea that a decision be made at this
time.
2 . Additional time was necessary, so as to review the data
to be supplied by Economic Research Associates, as to
the economic potential of the area, and inasmuch as a
decision has been requested, the Planning Commission has
insufficient data upon which to base their decision.
3 . A Mobilehome Park is inconsistent with the "Top-of--the-Pier"
Development Platt because mobilehome parks have not been
included as proposed uses within such area.

NOTICE IS HEREBY GIVEN that Applicant appeals said decision
to the City Council of the City of Huntington Beach on the
following grounds:
1. The Use Permit applied for is for a use consistent with
the existing zoning of the property.
2 . Adjacent properties are presently being used for mobilehome
parks , and a large, new mobilehome park is currently
under construction on nearby property; the denial of the
Use Perinit is arbitrary and discriminatory to Applicant
and deprives Applicant of a use available to other adjacent
property owners ,
3. Justification for the use applied for was fully shown by
Applicant.
4 . The economic survey of Economic Research Associates is
based upon highly speculative and presently uneconomic and
unrealistic uses for the property which may never become
realities . Precluding Applicant from economically and
realistically developing its property for an extended
period of time is unjustifiable and illegal.
5 . The proposed development of the property into a top quality,
first class mobilehome park will be financially bene-
ficial to the community as a whole and will upgrade the
immediate vicinity oi: the property, both o;.--site and off-
site . When a "higher" use for the property becomes
economically f-aasible, Applicant will be eager to develop
its property consistent therewith .

The Staff has reviewed Use Permit No. +69-69 and offers the follow-
ing information for your consideration.
1. This application was referred to the Planning Coisaission
by the Board of Zoning Adjustments at the request of the
Chairman of the Planning Commission.
2 The applicant has re(piested permission for construction
of a 255 space mobilehowe park situateu on approximately
31.34 acres of land.
3. The property is located a�: the -southwest corner of
Atlanta Ave. and Beach Blvd. and is zoned R5. The R5
zone permits construction of a mobilehome park subject:
to approval of a use permit.
4. The property is situated within the area covered by the
"Tip-of-Fier" Development Plan. The plan was adopted by
the CityCouncil on November 1? 1969 and desi atee

#he uses in this area as offices, hotel complex, restwarants,
specialty shops, recreation and golf. The Planning Com-
mission, at their January 20, 1970, meeting adopted an
amendment to the Master Plan of Land Use, which essen-
tially conforms to the development plan. The City Council
will be holding their public hearing on the master plan
amendment on February 2, 1970.
5. The "Top-of-Pier" Development Plan indicaz that this
parcel will be bounded on all fcrar sides by streets.
At the January 20, 1970, Planning Commission meeting,
the Commission adopted a resolution to amend the Master
Plan of Arterial Highways to establish Atlanta Ave. as
a major highway and to establish a secondary highway
along the easterly portion of the subject property. The
secondary highway will be in addition to the freeway,
which is proposed by the State Division of Highways.

6. The City Council, at their November 17, 1969, meeting

any building permits or other permits,, in the area
included within the "Top-of-Pier" Development Plan,
for uses that are or will be inconsistent with the
"Top-of-�Pier" Development Plan. The resolution Will
be effective for a period of six months.
7. The City is presently Putting,* the final touches on
their agreement with Economics Re,- larch Associates
to have a detailed econonte study of this area. With
regard to the hotel and recreation area, the study
will include:
a) Number of rooms and phasing
b) amount and type of recreation apace
e) Types of typical land lease or lend and building
leases
d) Financial fu�sibilit~y and residual land value
analysis;
With respect to offices and apartm Ls, the study will
include:
a) Type of buildings including high, medium or
low rise
b) Probable phaziog of demand and construction
e) Recommended density and rental rascal
d) Finlen III 'f"vibility & roiiaia7: land value analysis
8. it is the consensus of the Staff t1rit the proposed mobil*-
gams park is inconsistent with the "Top-of-Pier" Develop- f.

as proposed uses within such area.
