A suimns:ry of our reasons for your prior consideration is listed below: . 1. The use was. previously denied on a separate vote and we are unaware of any Valid reasons Which suggest reconsideration. 2. Handyman desires 2/3 of the Brookhurst Street frontage but is buying only 1/3 of" the land. The remaining 2/3 of the property would not be ccramercially desirable with Handyman taking the prime frontage location.. Handyman has stated to Councilman Matney that they would not grant to locate in the back parcel. 3. As councilmen you may state that you will not alloys apartments or detrimental commercial development in the back parcel. However, history has proved that the alternatives presented at a future time force the City Council to make decisions that they did not intend to make in the east. 4. Asstming Handyman generates $2.5 million in sales , the sales . tax revenue of $259000 would be offset by decreased sales from National Lumber, American Building Center, and the other 5 building supply firms in the area. The sales tax revenue that could be generated from total planned development should be over $100,000 per year. . 5. The results of partial development and frontage development can be seen at Magnolia and Adams Where 1/4 of the property has been unproductive for five years. 6. The City Attorney's opinion 70-5 states the City may l, eilally d. n requests for use permits Where the trial development of the sub4ect property, would prevent the highest and best development use of the remaining undeveloped parcel, vherQ aarrtial development 'Would prevent the highest and beat develop- ment use of.-the properly as a complete:entity, and where the wean can be da:trimental to or prevent the future and beat development use of adjoining properties. tr Mayor. and .City Council ma 1470 Page`2 T. The rezoning last year from R1 to C4 for the Two GVs shopping center across Brookhurst created more commercially zoned land at this intersection than any other intersection in the City. We believe this fact alone high- lights the need for totally planned development of this corner. As one can see from the history relating to Handyman ' s locating at this site, during the fall of 1969 their original plot plan had been approved by the Board of Zoning Adjustments, and at that time City Council took action to place a moratorium on the property to rezone it to C-•4. In view of the above stated action, we were advised that our next step was to obtain a Use Permit applicable to the zoning requirements, which we did. That plan was"then appealed by the Planning Commission and we re-plotted the" Handyman property according to their suggestions. .such later, at the request of the Planning Commission, we hired an architectural firm to oversee the proper comnat:ability of our project with the City of Newport Beach development. This plan was subsequently approved by the Planning Commission, with conditions agreed to by all parties. lnagmuch as we have complied with all requirements imposed upon our development, we have no alternative but to feel that denial of our Use Permit was based mainly upon our association with the City of Newport Beach. Consequer.tly, if we are g' ,en another opportunity to appear before City Council , we can show adequate and juLc reason for approval of Handyman's development on its own merits. Additional Information: The Planning Commission considered the a ove applications- concurrently with two other items : 1) Use Permit No. 70-3, Beacon Bay Enterprises, requesting a full ser- vice car wash and dispensing of gasoline, located south of Adams Avenue, 150 ft. east of Brookr.ur.st Street; and, Z) Use Permit .. o No, 70 4, Atlantic Richfield Co. , requesting a service station at the southeast corner of Brookhurst St. and Adams Ave . At that time, Division of Land No. 69-43, Division of Land No . 70-1 and Use Permit No. 69--70 were conditionally approved. Use Permit No. 70-3 and Use Permit No. 70-4 were automatically con- tinued to the March 3, 1370: meeting because the motion did not carry either for approval or denial . At the March 3, 1970, meeting Use Permit No. 70-3 wa; conditionally approved and Use Permit No . 70-4, Atlantic Richfield Co. , waas denied. Following the Commission action, Use Peruti4 No. 70-33, Beacon Bay Enterprises, was appealed by Councilman Matney. It is our understanding that Atlantic Richfield intends to appeal the 'denial of their use permit. James DeChaine, Assistant City Manager, Newport Beach, stated that he was in favor of having architectural control as a condi- tion of approval to insure continuity on the proposed and future .. developments. Owen Kupfer, attorney, representing Mr. Sr-kiok.9, stated that he agreed with reasonable architectural control as a condition of approval for Division of Land No. 49-43. Jerry 1 Pollock, representing Handyman Co. , stated that a revised plan showing curb cuts, ingress and egress will be submitted to the Planning Commission for their approval . Jack Selman, architect, stated that his firm is responsible for coordination of the pro- posed car wash and that the car wash will be compatible with i _5- i f. III other _rievel opments Dean . Royce, "realtor, re resenting, fir. Sak oka,.. presented .p1ian's showing, a possible building lay- out for :Par' cel No . 29 stating that his client '. is.. lol6kiiig for compatible uses. Mr. Royce stated that this plan depicted one of many possibilities for development. Owen Kupfer informed the Commission that his client does not have plans for Parcel `No . 2 at this time. Persons speaking in opposition to Us- Permit- No . 69.-70, Divi-, sion ,of Land No . 69-43, Use Permit No. 70-3, Division of Land .. No. 70-1 and Use Permit No . 70-/+ were as follows : Edward Kerins, representing Meredith Gardens Homeowners Assoc. He stated that: the proposed use would be detrimental to the surrounding area and to the City as a whole. He discussed commercial development in the area and pointed out situations that have developed when property is divided without regard to future use of the vacant parcels . Mr. Kerins suggested that the Commission take their time so as to have the City- develop in a proper manner. Ile stated that the Commission has threL alternatives with regard to develop- ment of this corner: 1 . The Commission can deny all applications before them. 2. The Commission can inform Mr. Sakioka that they will not accept any development on this property less than total. development, so as to provide a totally coordinated development . 3. The Commission may, by resolution of intent, re- zone this property R1 because the master plan of land use only calls for commercial development on three corners of this intersection and the City recently rezoned the southwest corner C4 causing a surplus of commercial zoning. Ben Lawnderey, representing the Huntington Bay Homeowners Assoc. , stated that he was concerned with traffic problems . He felt that there were too many curb cuts and that a better traffic circulation plan should be established . Dave Shulte, past president of Mere- dith Gardens Homeowners Assoc. , stated that if this project is approved it will. cause a f odge-podge development and potential blight.
