No. 89-65 and Negative Declaration No. 90-3 is a request for the =
subdivision of a 110 foot by 135 foot parcel into two parcels, one
with 60 feet of frontage and one with 50 feet of frontage. The

latter parcel requires a variance to the~minimum_ lot width of 60
feet required pursuant to Section 9120 . 2 of the Huntington Beach
Ordinance Code. The intent of the applicant is to construct a
four-plex on the larger lot and a tri-plea on the smaller lot for a
total of seven units.
ENVIRONMENTAL STATUS:
Pursuant to the environmental regulations in effect at this time,
the Department of Community Development advertised draft Negative
Declaration No . 90-3 for twenty-one (21) days, and no comments,
either verbal or written were received. The staff, in its initial
study of the project, has recommended that a negative declaration be
issued.
STAFF RECOMMENDATION:
Approve Negative Declaration No. 90-3, Tentative Parcel Map No.
89-443 and Conditional Exception (Variance) No. 89-64 with findings
and conditions of approval .
THE PUBLIC HEARING WAS OPENED
There was no one present to speak for or against the project and the
public hearing was closed.
A discussion ensued regarding the condition of public improvements
along Glencoe Street and the Commission' s desire to find a mechanism
to improve the uniformity on the public improvements (streets,
sidewalks, curbs, etc. ) with existing improved properties . It was
felt by some Commissioners that since this is already a problem area
because of the undesirable state of the street and that the
applicant is subdividing the parcel to gain one (1) unit, they could
not allow a developer to create two lots to gain an additional
unit. In addition, the Commissioners noted that they could not make
the necessary findings of fact regarding a land - related hardship for
the proposed exception to lot width for the one (1) parcel of land.

would be one and one-half parking spaces per unit on site which he .
felt was a sufficient amount and would also benefit the area by

1. The proposed subdivision of this . 34 acre lot into two (2)

development .

land use at the time the land use designation for medium
density residential was placed on the subject property.

FINDINGS FOR DENIAL - CONDITIONAL EXCEPTION (VARIANCE) NO. 89-64 :
1. Granting of the conditional exception (variance) for a 50 foot
wide lot will be detrimental to the health, safety, or welfare
of residents of neighboring .properties or injurious to
improvement of property in the vicinity due to the narrow width
of the lot .
2 . Granting of the conditional exception (variance) for a 50 foot
wide lot will adversely affect the General Plan of the City of
Huntington Beach.
3 . Granting of the conditional exception (variance) for a 50 foot
wide lot does constitute a grant of special privilege from
other properties in the vicinity.
4 . There are no special circumstances .applicable to the subject
property, location, or surroundings, by which the strict
application of the zoning ordinance would deprive the subject

Conditional Exception (Variance) No. 89-64 has been filed to allow a
reduction in lot width for one of the proposed parcels from the
required 60 feet to 50 feet. Tentative Parcel Map No. 89-443 will
create one parcel of 50 feet by 135 feet (6, 750 square feet) , and
another parcel of 60 feet by 135 feet (8, 100 square feet) .
According to Article 912 of the Huntington Beach Ordinance Code, the
two proposed R2 lots would yield a total of seven units; four units
on the larger parcel and three on the other. If the subject
property is not divided into two parcels, or if it is divided into
two equal 57 . 5-foot parcels, then a total of six units would be
permitted.
It should be noted that there are at least nine (9) other parcels
that have been divided this way to accommodate seven units on
Glencoe Avenue and on Alhambra Avenue to the south. The most recent
variance was approved by the Planning Commission on July 18, 1989 .

Staff Recommendation:
Planning Staff recommends that the City Council overturn the action
taken by the Planning Commission on February 21, 1990, by approving
the appeal with findings and conditions of approval as outlined in
the Planning Commission' s Staff report dated February 21, 1990 .
ANALYSIS OF PROPOSAL:
The applicant ' s request is for the subdivision of a 110 foot by 135
foot lot into two parcels, one with 60 feet of frontage and one with
50 feet of frontage. The latter parcel requires a variance to the
minimum lot width of 60 feet pursuant to Section 9120 .2 of the
Huntington Beach Ordinance code. The intent of the applicant is to
construct a four-plex on the larger lot (60 'X 135 ' ) and a tri-plex
on the smaller lot (50 'x 135 ' ) for a total of seven units .

The applicant ' s intention is to develop the- two parcels with a
shared reciprocal driveway easement. One of the reasons for the 60
foot wide lot requirement is to allow adequate building area after
providing a 25 foot driveway. Since the two parcels are to be
developed with a reciprocal drive, the need for the 60 foot minimum
is reduced. The proposed 50 foot wide parcel should not pose any
design problems because use of the reciprocal drive will preserve
adequate building area.
Conditional Exception (Variance) No. 89-64 has been filed to allow a
reduction in lot width for one of the proposed parcels . Tentative
Parcel Map No. 89-443 will create one parcel of 50 feet by 135 feet
(6, 750 square feet) , and another parcel of 60 feet by 135 feet
(8, 100 square feet) . According to Article 912 of the Huntington

seven units on Glencoe Avenue and on Alhambra Avenue to the south.
The most recent variance was approved by the Planning Commission on
July 18, 1989 . This type of subdivision, as noted, has occurred
only in this general area .
ANALYSIS OF APPEAL:
The appellant, Robert Stellrecht Jr. cites that the Planning
Commission did not make the necessary findings of fact for denial of
the tentative parcel map and conditional exception (variance) and
also noted that precedent has taken place along Glencoe and Alhambra
Avenues for such a subdivision of land. A discussion of the
appelcant ' s concerns is discussed below.
TENTATIVE PARCEL MAP:
The Planning Commission in making the findings of denial for the
tentative parcel map noted that, 1) the proposed subdivision is not
in compliance with the size and shape of property necessary for
Medium Density residential development, 2) the property was not
studied for this intensity of land use and, 3) that the lot width
and street frontage of the subdivision is not in compliance with
standards and specifications on file with the City.
In staff ' s analysis of the subdivision, the overall 110 foot lot
frontage with one (1) reciprocal drive for access to both properties
would provide adequate access and building area for both
developments. In addition, the applicant will provide additional
open space for the area gained as a result of the reciprocal access
which will lessen the potential impacts of the proposed seven unit
development. The reciprocal driveway will add 12 1/2 feet to the
buildable area of the 50 foot wide lot (see Attachment No. 4) . This
will allow the lot to be developed in a manner consistent with the
R2 standards .

Also, it should be noted that the overall seven (7) unit development
will be given further review through a use permit application to the
Zoning Administrator for compliance with all development and design
standards.
CONDITIONAL EXCEPTION (VARIANCE) :
The Planning Commission in making the findings of denial for the
conditional exception (variance) noted that, 1) the variance to
minimum lot width would be detrimental to the health, safety and
welfare of residents of neighboring properties or injurious to
improvements due to the narrow width of the lot, 2) the variance
will adversely affect the General Plan, 3) constitute a special
privilege and, 4) that no special circumstances exist which would
deprive the property of privileges enjoyed by other properties in
the vicinity under identical zone classifications .
The applicant contends that the proposed conditional exception
(variance) to the minimum lot width requirement will be consistent
with previously approved lot width exceptions . The general area has
consisted of one (1) lot subdivisions. These subdivisions consisted
of minimum lot widths of 60 ft. , 57. 5 ft. (variance) , and 55 ft.
(variance) with reciprocal drive easements. The applicant maintains
that the proposed one (1) lot subdivision consisting of one 60 ft.
and one 50 ft. wide lot with a reciprocal drive easement is
consistent with the previously approved subdivisions in the general
area. As noted earlier, the most recent variance was approved by
the Planning Commission on July 18, 1989 .
In response to the letter of appeal, the Planning staff believes
that the findings of approval for the subject tentative parcel map
and conditional exception (variance) can be made and supported and
therefore is recommending approval of the appeal .
FUNDING SOURCE:
Not applicable.
ALTERNATIVE ACTION:
The City Council may deny the appeal and reaffirm the Planning
Commission' s action on February 21, 1990 .

Honorable City Council,
Please accept this as a formal request for appeal of the
above mentioned items.
I find it hard to begin to describe this appeal in that
I never believed a denial was possible given the
circumstances involved.
As to the findings for denial, there is not one which
has either merit or substance. They are merely the findings
for approval reversed. Furthermore, they are grossly
inconsistent with the existing area and past planning
policies and actions.
In the past, nine requests have been made similar if not
identical to mine. All of these past request were granted,
the most recent July 18, 1989, barely seven months ago and
approved by some planning commission whom denied my request.
Especially for this reason I cannot understand why I should
be denied the same right of use and enjoyment of my property
as my surrounding property owners.

I cannot seem to make any better case for my request
than that of the planning staff. I myself met with on two
occasions staff members which included, Scott Hess, Bob
Franklin, Hal Simmons and Jeff Abramowitz as well as Herb
Fauland in regards to Environmental Assessment. I applaud
the staff members for their guidance in assuring that my
project be consistent with the immediate area. I have much
respect in a staff decision, especially when it concerns a
recommendation to the Planning Commission. It is very hard
to accept when the Planning Commission fails to examine
the real findings for a request and wanders off on other
tangents. Furthermore, it appalls me when planning
commissioners publicly insinuate fraud or wilful deceit as to
the applicants motive for his request. Unfortunately I was
unable to attend the hearing, I would have enjoyed rebutting
to this commissioner's allegations, needless to say my
representative was flabbergasted. Possibly it was the mood
of the evening, the previous or subsequent items on the
agenda or late evening which prompted such as ignorant
allegation.
As you may be able to surmise from the tone of my appeal
I am not very happy to be having to go thru it. Nor am I
happy having to ask Council to utilize it' s precious time on
such an item, however I have no choice. As I pointed out
earlier all I would like is to be able to utilize my property
in a manner consistent with and equivalent to the adjacent
and surrounding properties.
I would appreciate the Councils consideration of my
appeal and look forward to a hearing.

The applicant ' s intention is to develop the two parcels with a
shared reciprocal driveway easement. One of the reasons for the 60
foot wide lot requirement is to allow adequate building room after
the provision of a minimum 25 foot wide driveway. Since the two
lots are to be developed with a reciprocal drive, the need for the
60 foot minimum is reduced. The 50 foot wide lot should not pose
any design problems . This type of subdivision, as noted earlier,
has occurred only in this general area . The existing lot frontage
is conducive to this type of subdivision for medium density
development .
Conditions of approval on the conditional exception (variance)
include a requirement that a use permit for the overall seven unit
project be processed before the Zoning Administrator. The Planning
Commission may recommend to the Zoning Administrator that the
additional unit proposed on the subject property be made an
affordable unit . This will enable further review of the
architecture and site plan and would be required for a seven unit
project if it was on one lot . Also, a recommended condition is that
additional open space be provided to equal the area gained on each
lot through the use of the shared driveway. This requirement has
been applied by policy in the past .
10 . 0 RECOMMENDATION:
Staff recommends that the Planning Commission approve Negative
Declaration No . 90-3 , Tentative Parcel Map No. 89-443 and
Conditional Exception (Variance) No. 89-64 , with the following
findings and conditions of approval :
FINDINGS FOR APPROVAL - TENTATIVE PARCEL MAP NO, 89-443 :
1 . The proposed subdivision of this .34 acre lot into two (2)
parcels for purposes of residential use is in compliance with
the size and shape of property necessary for that type of
development . The reciprocal drive for the two lots shall
provide the subdivision with adequate building area for
development.
2 . The General Plan has set forth provisions for this type of land
use as well as setting forth objectives for implementation of
this type of use. The proposed development of the 7 unit
apartment building shall be in conformance with R2 development
standards .
3 . The property was previously studied for this intensity of land
use at the time the land use designation for medium density
residential was placed on the subject property. The
development of the site with a reciprocal driveway will be in
conformance with the Medium Density Residential Land Use
Designation.

4 . The size, depth, frontage, street width and other design and
improvement features of the proposed subdivision are proposed
to be constructed in compliance with standards, plans and
specifications on file with the City as well as in compliance
with the State Map Act and supplemental City Subdivision
Ordinance.
FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO. 89-64 :
1 . Granting of the conditional exception (variance) for a 50 foot
wide lot will not be detrimental to the health, safety, or
welfare of residents of neighboring properties or injurious to
improvement of property in the vicinity due to the proposed
reciprocal driveway easement .
2 . Granting of the conditional exception (variance) for a 50 foot
wide lot will not adversely affect the General Plan of the City
of Huntington Beach.
3 . Granting of the conditional exception (variance) for a 50 foot
wide lot does not constitute a grant of special privilege from
other properties in the vicinity.
4 . Because of special circumstances applicable to the subject
property, location, or surroundings, the strict application of
the zoning ordinance is found to deprive the subject property
of privileges enjoyed by other properties in the vicinity under
identical R2 zone classifications .
CONDITIONS OF APPROVL - TENTATIVE PARCEL MAP NO, 89-443 :
1 . The Tentative Parcel Map received by the Department of
Community Development on December 7, 1989 , shall be the
approved layout .
2 . A parcel map shall be filed with and approved by the Department
of Public Works prior to issuance of any building permits, and
recorded with the Orange County Recorder.
3 . Water supply shall be through the City of Huntington Beach' s
water system at the time said parcel is developed.
4 . Sewage disposal shall be through the City of Huntington Beach' s
sewage system at the time said parcel is developed.
5 . All utilities shall be installed underground at the time said
parcel is developed.
6 . The tentative parcel map shall comply with all applicable City
Ordinances .

7 . A copy of the recorded parcel map shall be filed with the
Department of Community Development .
8 . All Public Works improvements shall be constructed to City
standards .
9 . Drainage flow/direction shall be approved by the Department of
Public Works .
10 . A grading plan shall be submitted to the Department of Public
Works for review and it must be approved (by issuance of a
grading permit) . A plan for silt control for all water runoff
from the property during construction and initial operation of
the project may be required if deemed necessary by the Director
of Public Works .
11 . A detailed soils analysis shall be prepared by a registered
Soils Engineer. This analysis shall include on-site soil
sampling and laboratory testing of materials to provide
detailed recommendations regarding grading, chemical and fill
properties, foundations, retaining walls, streets, and
utilities .
CONDITIONS OF APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO. 89-64 :
1 . Prior to construction of any residential units on the subject
property, a use permit application for the seven unit project
shall be reviewed and approved by the Zoning Administrator .
2 . Additional open space over and above the minimum required by
code shall be provided on each lot in an amount equal to the
area gained by not having to provide two full 25 foot wide
driveways .
11 . 0 ALTERNATIVE ACTION:
The Planning Commission may deny Negative Declaration No. 90-3,
Tentative Parcel Map No. 89-443 and Conditional Exception (Variance)
No . 89-64 with findings .

Parcel Map 89-443
7841 Glencoe Avenue
The intent of our request is to effect a lot split through a
parcel map for subject property.
The subject parcel is located on the north side of Glencoe
Avenue, west of Beach Boulevard. It has a frontage width on
Glencoe of 110 feet and a depth of 135 feet. This was a
typical lot size of original subdivision performed some years
ago. Of 20 original lots on Glencoe Avenue 14 have in recent
years been split in the same fashion as we are proposing in
this request. The effect of this map would be in conformance
with all previous actions taken on surrounding parcels .
Furthermore, this pattern is present on both sides of
Alhambra Avenue which parallels Glencoe Avenue to the south.
The request if provided would create two lots, one of
conforming dimensions (60x135) and one nonconforming
(50x135) . This is our reason for the request of a variance
in conjuction with the parcel map.
The proposed development on the site would consist of a new 3
unit building on the smaller lot and a new 4 unit building on
the larger lot.
We feel that our request for a variance from minimum lot
width and subsequent parcel map and development is completely
consistent with the surrounding properties and the City' s
planning in this area.

Resources Section of the City of Huntington Beach that the following Draft Negative
Declaration request has been prepared and will be submitted to the City Planning
Commission for their consideration on February 21, 1990. The draft Negative
Declarations will be available for public review and comment for twenty-one (21) days
commencing Thursday, January 25, 1990.
Draft Negative Declaration No. 90-3 in conjunction with Conditional Exception (Variance)
No. 89-64 and Tentative Parcel Map No. 89-443 is a request to subdivide one (1) 110 ft. x
135 foot parcel of land into two (2) lots. The subject property is located on the north side
of Glencoe Avenue approximately 715 feet west of the centerline of Beach Boulevard.
Parcel one (1) shall have a minimum lot width of 60 feet and Parcel two (2) shall have a
minimum lot width of 50 feet. The conditional exception (variance) is to permit Parcel
two (2) to have a minimum lot width of 50 feet in lieu of the minimum required lot width
of 60 feet pursuant to Section 9120.2 of the Huntington Beach Ordinance Code. The
subject property is zoned R2-FP2 (Medium Density Residential-Flood Plain) and is
designated as Medium Density Residential in the City's General Plan. The applicant

III. Discussion of Environmental Evaluation

there will not be a significant effect in this case because the mitigation
measures described on an attached sheet have been added to the project.
A NEGATIVE DECLARATION WILL BE PREPARED.

STANDARD MITIGATING MEASURES
FOR NEGATIVE DECLARATION NO. 89-58
X 1 . Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers.
X 2. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central
heating units.
X 3. Low volume heads shall be used on all showers.
X 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material,
shall be disposed of at an offsite facility equipped to handle them.
X 5. The structures on the subject property, whether attached or detached, shall be constructed in
compliance with the state acoustical standards set forth for units that lie within the 60 CNEL
contours of the property. The interior noise levels of all dwelling units shall not exceed the
California insulation standards of 45 dba CNEL. Evidence of compliance shall consist of submittal of
an acoustical analysis report, prepared under the supervision of a person experienced in the field of
acoustical engineering, with the application for building permit(s). All measures recommended to
mitigate noise to acceptable levels shall be incorporated into the design of the project.
X 6. If lighting is included in the parking lot and/or recreation area energy efficient lamps shall be
used (e.g., high pressure sodium vapor, metal halide). All outside lighting shall be directed to
prevent "spillage"onto adjacent properties.
7. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall
include on—site soil sampling and laboratory testing of materials to provide detailed recommendations
regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities.
8. Existing mature trees on site shall be retained and incorporated into the site plan if feasible. Any
existing mature tree that must be removed shall be replaced at a 2:1 ratio with 36" box trees which
shall be incorporated into the project's landscape plan.
X 9. If foil—type insulation is to be used, a fire retardant type shall be installed as approved by the
Building Department.

STANDARD MITIGATING MEASURES
FOR NEGATIVE DECLARATION NO. 90-3
X 1 . Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers.
X 2. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central
heating units.
X 3. Low volume heads shall be used on all showers.
X 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material,
shall be disposed of at an offsite facility equipped to handle them.
X 5. The structures on the subject property, whether attached or detached, shall be constructed in .
compliance with the state acoustical standards set forth for units that lie within the 60 CNEL
contours of the property. The interior noise levels of all dwelling units shall not exceed the
California insulation standards of 45 dba CNEL. Evidence of compliance shall consist of submittal of
an acoustical analysis report, prepared under the supervision of a person experienced in the field of
acoustical engineering, with the application for building permit(s) . All measures recommended to
mitigate noise to acceptable levels shall be incorporated into the design of the project.
X 6. If lighting is included in the parking lot and/or recreation area energy efficient lamps shall be
used (e.g., high pressure sodium vapor, metal halide). All outside lighting shall be directed to
prevent "spillage"onto adjacent properties.
7. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall
include on—site soil sampling and laboratory testing of materials to provide detailed recommendations
regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities.
8. Existing mature trees on site shall be retained and incorporated into the site plan if feasible. Any
existing mature tree that must be removed shall be replaced at a 2:1 _ratio with 36" box trees which
shall be incorporated into the project's landscape plan.
X 9. If foil—type insulation is to be used, a fire retardant type shall .be installed as approved by the
Building Department.

13. If any hazardous materials are to be used on site, the business must comply with Chapter 1758 of the
City's Municipal Code which requires any business that handles or stores hazardous materials,
including waste, to inventory the hazardous materials on site and prepare a business emergency plan in
case of an accidental release of toxic material . Additionally, all hazardous materials, including
waste, must be handled and stored in accordance with the Uniform Fire Code. Waste oil is considered a
hazardous waste.
14. Should any abandoned oil wells or tanks be encountered, the Fire Department shall be notified and
current standards met as required by Article 15 of the Huntington Beach Ordinance Code. Any
abandonment of existing wells must be to current standards as well .
X 15. An on—site qualified archaeologist should monitor all initial grading and excavation activities.
X 16. Should any cultural materials be encountered during the initial site survey or during grading and
excavation activities, all activity shall cease and the archaeologist shall determine the appropriate
course of action.
X 17. Should any human bone be encountered during any construction activities on the site, the archaeologist
shall contact the coroner pursuant to Section 5097.98 and 5097.99 of the Public Resources Code
relative to Native American Remains. Should the coroner determine the human remains to be Native
American, the Native American Heritage Commission shall be contacted pursuant to State Law SB 297.
X 18. During cleaning, grading, earth moving or excavation, the applicant shall:
a. Control fugitive dust by regular watering, paving construction roads, or other dust preventive
measures.
b. Maintain equipment engines in proper tune.
X 19. During construction, the applicant shall :
a. Use water trucks or sprinkler systems to keep all areas where vehicles move damp enough to prevent
dust raised when leaving the site,
b. Wet down areas in the late morning and after work is completed for the day,
c. Use low sulfur fuel (.05% by weight) for construction equipment,
d. Phase and schedule construction activities to avoid high ozone days (first stage smog alerts),
e. Discontinue construction during second stage smog alerts.
X 20. Construction shall be limited to Monday — Saturday 7:00 AM to 8:00 PM. Construction shall be
prohibited Sundays and Federal holidays.
21. Prior to initiation of construction, police and fire departments shall be notified and the departments
shall be kept informed about duration and extent of construction throughout the process.
22. Public Works Department shall provide alternate routes for traffic during the construction phase, if
necessary. Adequate signage shall be provided to warn motor vehicles, bicyclists and pedestrians of
construction.

23. All oil facilities within the boundaries of the development which are to be removed and abandoned,
reabandoned or to remain must meet all existing requirements of the City of Huntington Beach and the
State Division of Oil and Gas. Further protective measures may be required, depending upon the
conditions and quality of the abandonments and reabandonments. Additionally, any mobile homes which
are placed over abandoned oil wells must be equipped with a household "methane detector."
24. The area must be sampled and monitored for methane on a "grid system" of one hundred (100) foot
lengths. Each one hundred (100) feet, the soil must be probed to a depth of two (2) to three (3)
feet. Each TENTH site must be an augered or drilled hole of a minimum three (3) inch diameter sunk to
a depth of ten (10) feet. Each probe site and auger or drill site must be tested for the presence of
methane, and all readings must be recorded for each site in PERCENT OF LOWER EXPLOSIVE LIMIT (LEL) of
methane.
The results of the tests must be submitted to the Fire Department for evaluation. Any anomalously
high readings (as defined in the Roberti Methane Study for the State of California) must be addressed
and mitigated prior to mobile homes being placed in the area of the high reading. If no anomalously
high amounts of methane are encountered, development may proceed. The Fire Department will perform
further monitoring activities at surface levels as is deemed necessary.
