PUBLIC HEARING - APPEAL TO PC CONDITIONS TO APPROVAL OF ONE YEAR EXTENSION OF
TIME F - OVERRULED PC - DELETED CONDITION #2 - CURRENT FM TO BE
PAID - MANSION HILL CO
The Mayor announced that this was the day and hour set for the continuance of
a public hearing opened August 19, 1985 and continued open from September lb,
1985 for the purpose of considering an appeal filed by Stephen Gunther, Man-
sion Hill Co. , to the Planning Commission's conditions of approval of a one-
year extension of time with conditions for Tentative Tract No. 11417 pursuant
to Section 9941 of the Huntington Beach Ordinance Code within the R2-0-PD-CD
(Medium Density-Oil Production-Planned Development-Civic District), R2-0-PD,
and R2-0 Districts. Mansion Hill is appealing the Planning Commission's
imposition of conditions on the granting of an extension of time. The subject
property is located at the northeast corner of Yorktown Avenue and Main Street.
Jim Palin, Development Services Director, stated that Council had been
provided with a communication from the City Attorney's Office dated October
14, 1985 recommending that Council delete the condition relative to park and
recreation fees.
Art DeLaLoza, Deputy City Attorney, stated for the -record: "The recommenda-
tion from the City Attorney's Office was that in effect even though you don't
call it a condition the City may impose and receive the higher and 1983 fees
for the granting of this particular request; so even though you don't call it
a condition those fees are in effect as of 1983 and therefore would apply to
this particular application."
Roger Work, representing Mansion Properties, requested Council approval of the
extension of Tentative Tract No. 11417 with removal of the condition that the
project shall be subject to current park and recreation fees.
There being no one present to speak on the matter and there being no protests
filed, either oral or written, the hearing was closed by the Mayor.
Following discussion, a motion was made by MacAllister, seconded by Mandic, to
continue to October 21, 1985 a decision on the appeal filed by Stephen
Gunther, Mansion Hill Company, to the Planning Commission's imposition of con-
ditions on the granting of an extension of time for Tentative Tract No. 11417;
the purpose of the continuance to give Councilmembers time to review a commun-
ication received October 14, 1985 from the City Attorney's Office. The motion
failed by the following roll call vote:
AYES: MacAllister, Mandic, Green
NOES: Kelly, Bailey, Finley
NOT VOTING: Thomas _

A motion was made by Finley, seconded by Kelly, to overrule the Planning Com-
mission's approval of the one-year extension With conditions for Tentative
Tract i11417 - (Revised) by deleting the condition of the requirement to pay
the current fees, with the full understanding that the City shall collect .the
current park and recreation fees. The motion carried by the following roll
call vote:
AYES: Kelly, Mandic, Bailey, Finley

Beach Or ace Code covering the make-up, public notice requirements, and

The Mayor announced that this was th ay and hour set for a public hearing to
consider a request to redesignate .51 re service station site from C4. (High-
way Commercial) to C4-SS (Highway Comm ial - Service Station) for the pur-
pose of remodeling and establishing a con ence market. The subject site is
located on the northeast corner of Beach Bo vard and Garfield Avenue.
The Mayor stated that City Council would al consider Negative Declaration
i No. 85-39 assessing the environmental effects o one Change No. 8 5-11.
The City Clerk announced that all legal requireme s for notification, publi-
cation and posting had been met, and that she had ceived no communications
or written protests to the matter.

Jim Palin, Director of Development Services presente a staff report. he
stated that a communication dated September 10, 1985 ha been received from
George Buccola, property owner of the vacant parcel front on Garfield Ave-
nue, east of the subject site, stating his concern that t parking may be
inadequate and that the setback requirements could adversely ect his devel-
opment options. Mr. Buccola suggested that a "Q" Qualified Zo be placed on
the property so the owner would be required to do the following 1) provide
parking based on parking requirements for other retail establishm s, and 2)
prohibit placement of signs, outdoor storage, pump islands, etc. , such a
way as to block the view of Mr. Buccola's site.

SUBDIVISION IMPROVEMENT SECURITY AGREEMENT BETWEEN THE
CITY OF HUNTINGTON BEACH AND MANSION PROPERTIES, INC.
AND U.W.C. -- HUNTINGTON BEACH, LTD.
THIS A REEMENT is entered into this 3n day
of ���, 19 86 , by and between the CITY OF HUNTINGTON
BEACH, a municipal corporation of the State of California, herein-
after referred to as "CITY, " and Mansion Properties,` Inc. , a
California corporation, and U.W.C. -- Huntington Beach, Ltd. , a
California limited partnership, collectively hereinafter referred
to as "SUBDIVIDER. "
WITNESSETH:
WHEREAS, SUBDIVIDER is subdividing that certain parcel of
land shown within the subdivision boundaries of Tentative Tract
Map 12141 (herein as "map" ) ; and,
CITY _has imposed certain on-site and off-site development
improvement requirements (herein as "improvements" ) upon
SUBDIVIDER, which conditions must be fulfilled prior to recorda-
tion of a final map; and,
Exigent circumstances have made it impossible for
SUBDIVIDER to construct such improvements prior to the filing of
said final map; and,
SUBDIVIDER desires to post security with CITY to insure
that all improvements will be completed after such recordation,
and CITY is willing to accept such security in lieu of present
compliance with the conditions of the maps .
NOW, THEREFORE, the parties hereto covenant and agree as
follows:
1. WORK STATEMENT - SUBDIVIDER TO CONSTRUCT IMPROVEMENTS
SUBDIVIDER agrees that it will, within ninety (90)
days of written notice to proceed from City' s Director of Public

Works and, in any case, within two (2) years from the date above
first written, complete to CITY' S specifications and to the
satisfaction of its inspectors all unfulfilled conditions of the
map and that all works of construction and improvement shall be
finally offered to and accepted by the CITY.
2 . IMPROVEMENT SECURITY
In accordance with Huntington Beach Ordinance Code
(HBOC) , Article 997 , upon execution hereof SUBDIVIDER shall
deposit with the City Treasurer the sum of $10, 750.00, as
prescribed by HBOC Section 9970, which security is given to CITY
to insure faithful performance of this Agreement. The deposit may
be by corporate surety bond, cash or other approved form of
improvement security. At any time, CITY, at its sole option, may
require any surety to enter upon the job site and complete the
improvements, or the CITY may, at its sole option, invade any
deposit given it or utilize any other form of security deposited
or made available to it to commence and/or complete the
improvements . All bonds and other forms of deposit shall be
approved by the City Attorney prior to their acceptance by CITY.
SUBDIVIDER may, during the term of this Agreement, substitute
improvement security provided that the substituted security is
acceptable to the City Attorney.
3 . GENERAL STREET CONSTRUCTION
SUBDIVIDER agrees to perform the following works of
improvement: Construction of streets ( including excavation,
paving, curbs, gutters, sidewalks, trees and landscaping) , sewers
(including construction of main lines and lot laterals and
structures, ) street lights, street signs, domestic water systems,
water mains , lot laterals and installation of meter; engineering
costs; and any miscellaneous requirements as may be set forth in
HBOC Chapter 99. Such work shall be done and performed in
accordance with plans, specifications and profiles which have been
approved by the City Engineer and filed in the office of the City
Engineer according to HBOC provisions and which are in effect when

the work is to be performed; all of said work shall be done at
the sole cost and expense of SUBDIVIDER, and all labor and
material bills shall be paid by it in a good and timely manner.
SUBDIVIDER agrees to complete all public street
improvements, including perimeter walls and landscaping, prior to
release or connection of utilities for occupancy for any lot in
the Tract.
4. ACCEPTANCE OF IMPROVEMENTS - RETURN OF CASH DEPOSIT
If SUBDIVIDER has made cash deposit with the City
Treasurer under Section 2 hereof, upon CITY' s acceptance of the
improvements the SUBDIVIDER may demand return of said deposit
which shall be returned, with legal interest, within 30 days of
said demand.
5 . SUBDIVIDER BREACH OF COVENANT TO CONSTRUCT
In the event that SUBDIVIDER fails to satisfactorily
complete construction of the improvements within ninety days after
CITY' s notice to proceed, CITY, at its sole option, may invade and
use the deposit in order to complete the construction of
improvements hereunder. Any monies remaining unspent upon
completion of improvements shall be returned to SUBDIVIDER as
provided in Section 4 hereof.
6 . PLANS, SPECIFICATIONS, REQUIREMENTS OF CITY: All
improvements will be constructed in accordance with the CITY's
plans, specifications and requirements applicable to similar work
usually performed under contract to CITY and which are in effect
at the time of their construction.
7 . INSPECTION: CITY shall control work in all public
job sites and dedicated areas . CITY may inspect the construc-
tion of improvements at all reasonable times . CITY will cooperate
with SUBDIVIDER to provide access to CITY-owned utilities and
allow all necessary encroachments to public or CITY-owned

Mansion Hill has completed all street improvements for Tract 12141 and is requesting
release by the City, as required by Section 66499.7 of the Subdivision Map Act.
RECOMMENDATION:
1. Accept the improvements dedicated for public use.
2. Release the Faithful Performance Bond.
3. Release the Monument Bond
4. Instruct the City Clerk to notify the developer and the City Treasurer to notify the

STATEMENT OF ISSUE:
The final map of Tract No . 12141 being a portion of Tentative Tract
No. 11417 has been submitted to the City Council for approval. Also
Section 66499 of the Subdivision Map Act requires the local agency to
approve bonds and agreements for new subdivisions . Tentative Tract
No. 11..417 will expire on October 14 , 1986.
RECOMMENDATION:
1 . Approve the map pursuant to the required findings set forth in
Section 66458 of the Government Code.
2. Approve the map subject to. the finding that the map is in
substantial compliance with the previously approved tentative map
pursuant to the mandatory findings established by the Planning
Commission as set forth by Section 66474 of .the Government Code.
3 . Accept the offer of dedication and improvements subject to
completion of requirements shown.
4 . Instruct the City Clerk to not affix her signature to the map nor
release it for preliminary processing by the. County of Orange or
for recordation until the following conditions have been complied
with:
a. A deposit of fees for water, sewer, drainage, engineering and
inspections shall be provided;
b. A Certificate of Insurance shall be submitted;
C. Subdivision Agreement;
d. Drainage for the subdivision shall be approved by the
Department of Public Works prior to recordation of the final
map.

e. The Declaration of Covenants, Conditions, and Restrictions
shall be reviewed and approved by the Department of
Development Services and "approved as to form" by the City
Attorney prior to recordation of the final map.
5 . Park and Recreation Fees shall be paid or a surety posted in an
amount equal to the in lieu fees and "approved as to form" by the
City Attorney prior to recordation of the final map.
6. It is also recommended that the City Council accept the following
bonds and two copies of the Subdivision Agreement,
a. Faithful Performance Bond No. 7129830
b. Guaranty and Warranty Bond No. 7129831
c . Labor and Material Bond No. 7129830
d . Monument Bond No. 7129829
and instruct the City Clerk to file them with the City
Treasurer . It is further recommended that the City Council
accept the subdivision agreements and instruct the City Clerk to
file one copy and return the second to the subdivider . All the
bonds have been approved for amount by the Department of Public
Works and, as to form, by the City Attorney's Office.

DISCUSSION:
The map has been examined and certified by the Director of Public
Works and the Secretary to the Planning Commission as being
substantially in accordance with the tentative map as filed with,
amended, and approved by the Planning Commission.
ENVIRONMENTAL STATUS:
Environmental Impact Report No. 78-4 was approved by the Planning
Commission on March .2, 1983.

property; provided, however, that the entire cost thereof shall be
borne by SUBDIVIDER.
8. WARRANTY: All improvements shall be fully and
absolutely warranted by SUBDIVIDER as to materials and workman-
ship for one (1) year after the date of acceptance by CITY.
9. GENERAL PUBLIC LIABILITY INSURANCE: SUBDIVIDER will
maintain in force during the construction period and until CITY's
final acceptance of the work, at SUBDIVIDER' s sole expense, a
general public liability policy in which CITY is named as an
Additional Insured. Such policy shall indemnity CITY, its
officers and employees, against any and all loss, damage or
expense by reason of any suits, claims, demands, judgments and
causes of action arising out of or in consequence of SUBDIVIDER's
performance of this Agreement. The policy shall provide for not
less than the following amounts:
Combined single limit bodily injury and/or
property damage including products liability:
$1, 000,000 combined single limit per occurrence.
Such policy shall provide coverage at least as broad as
that provided in the Standard Form approved by the National
Board of Casualty Underwriters, together with such endorse-
ments as are required to cover the risks involved. SUBDIVIDER
shall arrange for the policies to be so conditioned as to
cover the performance of extra or unforeseen work, should such
work become necessary.
Evidence of such insurance shall be furnished to CITY
on the CITY' s form and shall be approved by the City
Attorney. Any such policy must contain a provision of written
notice to the CITY of the expiration or cancellation of any of
the insurance policies required hereunder not less than thirty
(30) days before each expiration or cancellation is effective.

10. WORKERS ' COMPENSATION: SUBDIVIDER shall comply
with all of the provisions of the Worker 's Compensation
Insurance and Safety Acts of the State of California, and
shall indemnify, defend and hold harmless CITY from and
against all claims, demands, payments, suits, actions,
proceedings and judgments of every nature and description,
including attorney's fees and costs, presented, brought or
recovered against CITY, for or on account of any liability
under any of said acts which may be incurred by reason of any
work to be performed by SUBDIVIDER under this Agreement;
SUBDIVIDER shall provide to CITY evidence of Workers '
Compensation Insurance, or self-insurance satisfactory to the
City Attorney.
11. PUBLIC WARNING AND PROTECTION: SUBDIVIDER shall
at all times until CITY' s final acceptance of the works of
improvement give good and adequate warning to the traveling
public of each and every dangerous condition within said
streets and highways, and will protect the traveling public
from such defective or dangerous conditions . It is understood
and agreed that until the completion of all the improvements
herein agreed to be performed, each of said streets and
highways not accepted as improved shall be under the exclusive
control of SUBDIVIDER for the purpose of this Agreement . With
the consent of the City Engineer, SUBDIVIDER may close all or
a portion of any street whenever it is necessary to protect
the traveling public during the making of the improvements
herein agreed upon. SUBDIVIDER hereby agrees to pay for such
inspection of streets and highways as may be required by the
City Engineer .
12 . INDEMNIFICATION-COVENANT TO SAVE AND HOLD HARMLESS:
SUBDIVIDER shall fully indemnify and save and hold
harmless CITY, its officers, agents and employees from any and
all liability, losses and costs imposed for injury occurring

by reason of anything done or omitted to be done by SUBDIVIDER
in performance of this Agreement and in construction of the
improvements, excepting when such error or omission is solely
the fault of the CITY, its officers, agents or employees, and
SUBDIVIDER agrees to enter and defend any suit or action
brought or arising out of its performance of this Agreement
against CITY, its officers, agents or employees.
13. LIABILITY FOR WORK: In addition to the covenants
to hold and save harmless and to provide insurance, the
parties agree that neither CITY nor any officer or employee
thereof shall be liable or responsible for any accident, loss
or damage happening or occurring to the work specified in this
Agreement prior to the completion and acceptance of the same
by CITY, nor shall CITY or any officer or employee thereof be
liable for any person or property injured by reason of the
nature of said work, but all of said liabilities shall be
assumed by SUBDIVIDER. SUBDIVIDER further agrees to protect
and defend CITY and the officers thereof from all liability or
claim because of, or arising out of, the use of any patent or
unpatented article in the construction of said work.
14. ATTORNEY'S FEE: In the event suit is brought by
CITY to enforce the terms and provisions of this Agreement or
any bond given to secure the performance hereof, a reasonable
attorney' s fee, to be fixed by the court, shall be paid by
SUBDIVIDER in CITY' s favor .
15. NOTICES: All notices required or permitted here-
under shall be delivered in person or by registered or certi-
fied mail to an authorized representative of the party to whom
delivery is to be made, at the place of business of such
party, or to any other place designated in writing by such
party.

ARTICLE II
RIGHTS IN THE COMMON AREAS
Section 1 . The undivided fractional fee interest
in the Common Areas within the Annexed Property hereby estab-
lished and which shall be conveyed with each respective unit is
one thirty-eighth ( 1/38) .
The undivided fractional fee interests in the Common
Areas established and to be conveyed with the respective units ,
as indicated above, cannot be changed.
Section 2 . The Owners ' exclusive use and easements of
enjoyment of the Common Areas of the Annexed Property, as des-
cribed in Section 5 of Article VI of the Declaration, shall be
subject to:
a. The rights of Owners of Units in the Property, as
that term is used in the Declaration, and in the pro-
perties annexed thereto, as set forth in the Declara-
tion.
b. The matters set forth in subsections 5(a) through
5 (k) of Article VI of the Declaration.

including reasonable attorney's fees, incurred by the Obligee in successfully
enforcing such obligation, all to be taxed as costs and included in any ,judgement
rendered.
The surety hereby stipulates and agrees that no change, extension of time,
alteration or addition to the terms of the agreement or to the work to be Performed
