IIIII /• . •DI. 91 • J- ,i' is ' , � �' aw Vlfflu • r• . • d. ••Y r: 1 Analysis : Staff recommends that the City Council uphold the Zoning Administrator ' s and the Planning Commission' s action and deny the appeal because of the reasons cited by the Zoning Administrator. The lack of internal circulation between the two drive aisles results in double loading and traffic conflicts with Pacific Coast Highway. The goals of the Huntington Beach Ordinance Code Article 960, Parking includes reducing the points of ingress and egress along streets and arterials and ensuring safe traffic circulation. In addition, the southeasterly driveway does not meet the minimum 30 feet driveway width typically required by Caltrans as it is only 18 feet wide at Pacific Coast Highway. The applicant must also obtain a permit from Caltrans for the second driveway access . The 18 foot width is barely one-half (1/2) of the Caltrans requirement . Also, the actual driveable portion of the access way on the property itself is further reduced to ten (10) feet wide. Twenty feet is required for drive aisles such as this . The City' s Public Works Engineering Division recommends denial of this request because the potential for vehicle and traffic conflicts is great in this area as the drive can only accommodate one (1) car at a time for one-way travel . It is highly possible that first time visitors to the site will enter the driveway while another car is already there and then be forced to back-out onto Pacific Coast Highway. This situation results in an awkward traffic pattern which would be very confusing to a motorist unfamiliar with the site. Vehicles entering commercial sites should be able to travel to additional parking areas at the same area if a parking space is not available. The applicant' s appeal letter states that the southeasterly driveway is necessary because the trash enclosure can not be properly located on the north side of the property as previously required. The Zoning Administrator' s action on May 27, 1992 included the provision to relocate the trash enclosure to the south side of the building but prohibited vehicular access . A small concrete pathway from the trash enclosure to Pacific Coast Highway would allow the trash bin to be rolled down to the street as Rainbow Disposal requires. Another point of the appeal letter is that the addition of a parking space on the south side of the building brings the site into conformance with the number of parking spaces required by code. However, the nine (9) spaces currently provided on-site is consistent with the parking code that was in effect at the time of project approval. The tenth parking space is not necessary to bring the site into compliance and the potential conflict and hazardous circulation of the second access outweigh the benefits of gaining one (1) parking space. RCA 1/19/93 -4- (5397d) There is a feasible alternative to the driveway access on Pacific Coast Highway that the property owner could pursue which would comply with code. An on-site access easement between the property to the southeast, a motel, and the office building driveway would allow access to the tenth parking space while reducing traffic conflicts on Pacific Coast Highway. This would achieve the applicant ' s goal as well as comply with City' s circulation and driveway standards. The adjacent lot contains a drive aisle that terminates at the southeasterly property line. No driveway would be necessary off Pacific Coast Highway and the majority of landscaping area would be preserved. Summary: In conclusion, staff recommends denial of the appeal because: 1. There is a lack of on-site circulation; 2 . It will create potential ingress and egress conflicts on an arterial highway; 3 . The driveway width is only 18 feet in width (27 ' minimum is required by the city) which is not wide enough to accommodate adequate maneuverability into and out from the site; 4 . The on-site drive aisle is substandard (10 ' in lieu of 20' ) ; 5 . It will result in a loss of on-site landscaping and open space area pursuant to a previously approved use permit which justified a variance in conjunction with the use permit; and 6 . There is a design option available to the applicant which is to access the southerly portion of the site from an adjoining lot that contains a drive aisle terminating at the common property line. Alternative Action: Should the City Council overturn the Planning Commission' s action and approve Conditional Exception (Variance) No. 92-17, staff suggests a condition of approval to minimize potential traffic impacts . Staff recommends that the applicant designate the southeasterly drive as a private accessway and install a mechanized security gate across the driveway. The gate should be setback approximately eighteen (18) feet from the curbline so that it is visible from Pacific Coast Highway but allows a vehicle to wait while the gate opens . In addition, a sign shall be installed at the front of the property to identify the driveway as "Private-No Entry" . This option should help reduce traffic conflicts by preventing traffic other than authorized vehicles from entering the drive aisle. It is recommended that the gate be a rolling wrought iron structure approximately forty-two (42") inches high and painted white to match the building trim. It should be noted that ultimate approval of this driveway approach is subject to Caltrans approval because it is along Pacific Coast Highway. ALTERNATIVE ACTION: The City Council may overturn the Planning Commission' s action on December 1, 1992 by approving Conditional Exception (Variance) No. 92-17 with findings and conditions of approval (see Attachment No. 5) . Since the subject property can be fully developed within regular established setbacks, such a conditional exception for an additional driveway along Pacific Coast Highway for the existing office building and with no on-site internal circulation is not necessary for the preservation and enjoyment of substantial property rights . The renovation of the existing commercial building, approved under Use Permit No. 90-18 and Conditional Exception No. 90-19, complied with the parking requirements based on the code at that time. The additional driveway, has the potential to create additional vehicle, bicycle, and pedestrian conflicts along Pacific Coast Highway. The additional parking space does not warrant the conflicts between vehicles entering and exiting the site, and reduction in landscaping . In addition, there is a design option available to the applicant which is to access the southerly portion of the site from an adjoining lot. 2 . Granting of Conditional Exception (Variance) No. 92-17 for an additional driveway along Pacific Coast Highway for the existing office building and with no on-site, internal circulation between the two parking areas would constitute a special privilege inconsistent with limitations upon properties in the vicinity. Other parcels along Pacific Coast Highway in the vicinity have only one point of ingress and egress (driveway) . 3 . Exceptional circumstances do not apply that deprive the subject property of privileges enjoyed by other properties in the same zone classifications. 4 . Although the property is irregular in configuration, the proposed driveway access on the southerly property line will create a hazardous situation with vehicular ingress and egress and northbound traffic on Pacific Coast Highway. 5 . The proposed driveway would create awkward circulation movements on-site and cause potential ingress and egress conflicts on an arterial highway. The driveway width is only 18 feet in width (27 ' minimum is required by the city) which is not wide enough to accommodate adequate two-way maneuvering into and out from the site. 6 . The driveway will result in a loss of on-site landscaping and open space area pursuant a previously approved use permit which justified a variance for reduced planter width (1' 6" in lieu of 10 ' ) along Pacific Coast Highway next to the northerly parking area. T yy Hwy r T N Dear Honorable Mayor Winchell : By this letter, I am appealing the Planning Commission action taken on December 1 , 1992, in the above referenced matter . As background information , I am enclosing a copy of the original narrative I submitted to the Zoning Administration on May 20 , 1992 , and also the letter dated June 5 , 1992 , I submitted to the Planning Commission appealing the Zoning Administrator 's denial . As I have indicated in the attached letter , I had two driveways when I purchased the property. I decided to improve my property by renovating the interior by remodeling the bathrooms , installing new drywall , doors, ceiling and paint . The exterior was also completely renovated including new stucco, windows , awnings , and doors . I did not add square footage. In doing this work, I had to get a conditional use permit which required that I also install landscaping , redo my parking lot , remove the septic tank and connect to the City sewer system and pay the fees, dedicate seven feet of my property to the City along Pacific Coast Highway and construct curb, gutter and sidewalk and get all the permits from the City of Huntington Beach and Caltrans . I did not realize that when these plans were drawn , my driveway on the east side of my building was eliminated. This driveway has been a part of this property for over forty years , and just because I wanted to improve my property, to increase its value and make it more compatible with the surrounding area , I have lost a driveway which reduces the value of my property. I do not think that this is fair , and I believe that a property right I had when I purchased the property has been denied to me. This elimination of a driveway and a parking space reduced the value of my property. Our main concern is that he has failed to comply with the City 's original requirements for his occupancy permit. His apparent disregard of these requirements continues to contri- bute to hazardous driving conditions experienced by most of our residents as they enter or leave Pacific Coast Highway each day by way of our driveway . The most obvious requirement was to have the Utility Pole set back several feet . The wall between our property was also to be removed back several feet . He was to install curbs , gutters , and landscaping , none of which has ever been done. The Utility Pole is directly in line of vision when leaving our property . Its removal would greatly increase visability. Curbs and gutters would allow space for a right-turn lane for northbound traffic to enter our driveway in a more safe manner. Allowing Mr. Hadjian to add the use of a second driveway will only increase hazards already in place. His first driveway should be constructed in a safe manner before allowing him to proceed with another ! YOUR DENIAL OF THIS APPEAL will be greatly appreciated ! The conditional exception (variance) is necessary because there will be no internal circulation between the existing on-site parking area and the proposed parking area with driveway; and the proposed drive aisle is 10 ' in width in lieu of minimum 20 ' . As a result, vehicles must enter a public street in order to progress from one parking area to another within the same development. Conditional Exception (Variance) No. 92-17 was originally denied by the Zoning Administrator on May 27, 1992 and subsequently appealed to the Planning Commission. The Planning Commission upheld the Zoning Administrator ' s action by denying the request on December 1, 1992 . The applicant is seeking to overturn the Planning Commission' s denial because the driveway existed when the property was purchased and the elimination of the driveway results in loss of property values . Section 9601.2 specifies that all off-street parking spaces shall have access to a public street or alley, and shall have internal circulation, safe entrances and exits, drives, and aisles in conformance with City standards. Traffic circulation shall be designed so that no vehicle need enter a public street in order to progress from one (1) aisle to any other aisle within the same development. The applicant is requesting a second driveway and parking area that does not provide internal circulation and safe ingress or egress as vehicles entering the driveway must perform a three point turn-around or exit the same direction. Vehicles must then enter. Pacific Coast Highway to travel to the other drive aisle for additional parking opportunities on the site. In addition, the driveway is not wide enough to accommodate two (2) vehicles at one time and, therefore, does meet the circulation design section of the Huntington Beach Ordinance Code. The code requires minimum 20 feet and only 10 feet is proposed. Coastal Status : This project is located in the Coastal Zone but may be categorically excluded from coastal development permits pursuant to Section 989 . 5. 3 . 13 (g) , which exempts minor variances that do not negatively impact coastal access or view corridors, from coastal development permits . This variance request for a driveway and parking area that does not provide internal circulation on the site does not negatively impact coastal access or coastal views as none is currently provided. RCA 1/19/93 -2- (5397d) Project History: Use Permit No. 90-18 and Conditional Exception (Variance) No. 90-19, submitted by the applicant, for an exterior facade improvement to an existing 2, 541 square feet office/commercial building were conditionally approved by the Zoning Administrator on June 20, 1990. At that time, vehicles could enter the property from Pacific Coast Highway on either side of the building because the property was not improved to current code standards; there were no curbs, gutters or sidewalks. The conditional exception (variance) permitted a reduced landscape planter adjacent to a public right-of-way (PCH) for a larger parking area to accommodate enough parking stalls, and a reduction to the minimum turning radius requirement (23 feet in lieu of 26 feet) . The approved plans depicted a single driveway to the north of the building and the southerly area was depicted as landscaping and outdoor recreation area. Basis for approval of the variance was due to the fact that the layout, with one driveway and an open space area, complied with code. The applicant has not yet brought the project into conformance with the approved plans as there is a second driveway and the proper landscaping has not been installed. The property owner was cited by Code Enforcement for non-compliance with the conditions of approval of Use Permit No. 90-18 and Conditional Exception (Variance) No. 90-19 and required to remove the second driveway. The property owner then submitted Conditional Exception (Variance) No. 92-17 as a request to allow the second driveway to remain. He stated at the time of the 1990 submittal, he did not realize the approved site plan did not include the southeasterly driveway. The Zoning Administrator denied the current request on May 27, 1992 (see attached minutes) and again required removal of the second driveway in accordance with the originally approved plan. It was denied because the additional driveway for one (1) parking space off a major arterial (Pacific Coast Highway) without on-site, internal circulation would: 1. Create potential conflicts between vehicles, bicyclists and pedestrians along Pacific Coast Highway; 2 . Constitute a special privilege inconsistent with limitations upon properties in the vicinity because other parcels have typically only one (1) point of vehicular ingress and egress; and 3 . Eliminate landscaping and open space area that was used to justify a previously approved variance for reduced planter width (1' 6" in lieu of 10 ' ) between a parking area and Pacific Coast Highway. The denial has been appealed to the Planning Commission and now to the City Council. The property to the east is occupied by the Ocean View Motel. The property on the south side of Pacific Coast Highway is residential . This application requests that a second driveway be allowed to be installed on the east side of the building as shown on Exhibit "A" . The applicant has been working on -site improvements on this property since 1990 . Prior to that, this property had two driveways, but due to the property' s unusual size and the building site location on the property, it is impossible to maintain circulation on-site. On a previous Use Permit Application, the eastern driveway was eliminated and as a result , --- the trash enclosure and parking space had to be eliminated. The trash enclosure was relocated on the westerly parking lot and a new parking plan was approved which allowed for nine parking spaces including one handicapped space. This conformed to the parking requirements at that time, which were one parking space per each 300 square feet of building area. Current parking standards in this area require one space for each 250 square feet of building area or in this case, ten parking spaces. Also, the applicant has been told by Rainbow Disposal that a building of this size requires a three yard trash receptical at a minimum. This will require an enclosure of a minimum of 618" by 818" . See attached copy of trash enclsure size which was given to the applicant by Rainbow Disposal . The current site plan only has nine parking spaces and will not accommodate a trash enclosure of the size required. A trash enclosure of the size required cannot be installed in the westerly parking lot without either eliminating a parking space or blocking the handicapped access to the building. In order for the applicant to fully utilize his property to the highest and best use, it is requested that he be allowed to reconstruct the driveway on the east side of his building. This will enable him to have one more parking space. -thus bringing his site up-to-code and also providing an area suitable for a trash enclosure of the size required. This additional driveway will: not have on-site circulation to the existing parking lot and driveway on the western side of the building. It is possible, however, for a vehicle to drive in, turn around, and exit safely unto Pacific Coast Highway. Even if a car is parking� in the single parking space, a car can drive in, turn around and exit safely. Public safety will be maintained by stripping and providing signs as shown in Exhibit "A" . This site plan was approved. I wasn' t' aware that the driveway was eliminated and therefore, I did not appeal. I do not want to lose .my driveway. It will only be used ,by one car because there is only one parking space and it will not create a traffic hazard. The closest driveway to the east is 350 feet away andrmy other driveway to the west is 100 feet away. I do.-not think by keeping my driveway, it will create a significant traffic hazard. I need my driveway because I only have nine spaces now, and the code requires ten. Also I need my driveway because the trash enclosure as shown on the existing approved site plan will prevent the handicapped access . to my building. The trash enclosure should be on the -east side of my building where it has always been. The Rainbow Disposal Co. does not drive into the driveways along Pacific Coast Highway, so my driveway on the east side of my building would only be used to roll the trash bin in and out. This will be better than the way it is now because the trash bin has to be rolled out through the driveway on the west side of my building which interferes with the traffic in and out of my customers' parking area. I feel that I am being deprived -of -my rights just because of the fact that my building was built over forty years ago too close to my rear property line and therefore,-.-I cannot connect my east and west parking areas with..on-site circulation. At that time, vehicles could enter the property from Pacific Coast Highway on either side of the building . The conditional exception permitted a reduced landscape planter adjacent to a public right-of-way for a larger parking area to accommodate enough parking stalls, and a reduction to the minimum turning radius requirement (23 feet in lieu of 26 feet) .The approved plans depicted a single driveway to the north of the building and the southerly area depicted as landscaping and outdoor recreation area. Basis for approval of the request was due to the fact that the layout, with one driveway and an open space area, complied with code. The applicant has not yet brought the project into conformance with the approved plans as there is a second driveway and the proper landscaping has not been installed. The property owner was cited by Code Enforcement for non-compliance with the conditions of approval of Use Permit No. 90-18 and Conditional Exception (Variance) No . 90-19 and required to remove the second driveway. The property owner then submitted Conditional Exception (Variance) No. 92-17 as a request to allow the second driveway to remain. He stated at that time that he did not realize the approved site plan did not include the southeasterly driveway. The Zoning Administrator denied the request on May 27, 1992 (see attached minutes) and again required removal of the second driveway. It was denied because the additional driveway for one (1) parking space off a major arterial (Pacific Coast Highway) without on-site, internal circulation would: 1 . Create potential conflicts between vehicles, bicyclists and pedestrians along Pacific Coast Highway; Staff Report - 12/1/92 -3- (5147d) 2 . Constitute a special privilege inconsistent with upon properties in the vicinity because other parcels have typically only one (1) point of vehicular ingress and egress; acid 3 . Eliminate landscaping and open space area that was used to jusitfy a previously approve variance for reduced planter width , (1 ' 6" in lieu of 10 ' ) between a parking area and Pacific Coast Highway. The denial has been appealed to the Planning Commission. Analysis Staff recommends that the Planning Commission uphold the Zoning Administrator ' s action and deny the appeal because of the reasons . cited by the Zoning Administrator. The lack of internal circulation .. := between the two drive aisles results in double loading and traffic conflicts with Pacific Coast Highway. The goals of the Huntington Beach Ordinance Code Article 960, Parking includes reducing the points of ingress and egress along streets and arterials and ensuring safe traffic circulation. In addition, the southeasterly driveway does not meet the minimum 30 feet driveway width typically required by Caltrans as it is only 18 feet wide at Pacific Coast Highway. The applicant must also obtain a permit from Caltrans for the second driveway access . The 18 foot width is barely one-half (1/2) of the Caltrans requirement. Also, the actual driveable portion of the access way on the property itself is further reduced to ten (10) feet wide. Twenty feet is required for drive aisles such as this . The potential for vehicle and traffic conflicts is great in this area as the drive can only accommodate one (1) car at a time for one-way travel . It is highly possible that first time visitors to the site will enter the driveway while another car is already there and then be forced to back-out onto Pacific Coast Highway. This situation results in an awkward traffic pattern which would be very confusing to a motorist unfamiliar with the site. vehicles entering commercial sites should be able to travel to additional parking areas at the same area if a parking space is not available. The City' s Public Works Engineering Division recommends denial of this request . The applicant ' s appeal letter states that the southeasterly driveway is necessary because the trash enclosure can not be properly located on the north side of the property as previously required. The Zoning Administrator 's action on May 27, 1992 included the provision to relocate the trash enclosure to the south side of the building but prohibited vehicular access . A small concrete pathway from the trash enclosure to Pacific Coast Highway would allow the trash bin to be rolled down to the street as Rainbow Disposal requires . Staff Report - 12/1/92 -4- (5147d) t` i 1 Another point of the appeal letter is that the addition of a: parking; ; . space on the south side of the building brings the site into conformance with the number of parking spaces required by code. However, the nine (9) spaces currently provided on-site is consistent with the parking code that was in effect at the time of a project approval . The tenth parking space is not necessary to bring the site into compliance and the potential conflict and hazardous circulation of the second access outweigh the benefits of gaining' one (1) parking space. There is a feasible alternative to the driveway access on Pacific Coast Highway that the property owner could pursue. An on-site access easement between the property to the southeast, a motel, and the office building driveway would allow access to the tenth parking space while reducing traffic conflicts on Pacific Coast Highway. This would achieve the applicant' s goal as well as comply with City' s circulation and driveway standards . The adjacent lot contains a drive aisle that terminates at the southeasterly property line. No driveway would be necessary off Pacific Coast Highway .and the majority of landscaping area would be preserved. In conclusion, staff recommends denial of the appeal because: 1. There is a lack of on-site circulation; 2 . It will create potential ingress and egress conflicts on an arterial highway; 3 . The driveway width is only 18 feet in width (27 ' minimum is required by the city) which is not wide enough to accomodate adequate maneuverability into and out from the site; 4 . The on-site drive aisle is substandard (10 ' in lieu of 20 ' ) ; 5 . It will result in a loss of on-site landscaping and open space area pursuant to a previously approved use permit which justified a variance in conjunction with the use permit; and 6 . There is design option available to the applicant which is to access the southerly portion of the site from an adjoining lot that contains a drive aisle terminating at the common property line. 10 . 0 RECOMMENDATION: Staff recommends that the Planning Commission uphold the Zoning Administrator ' s action and deny the appeal of Conditional Exception (Variance) No . 92-17 with the following findings: Staff Report - 12/1/92 -5- (5147d) FINDINGS FOR DENIAL - CONDITIONAL EXCEPTION (VARIANCE) NO 92-17 : . 1. Since the subject property can be fully developed within regular established setbacks, such a conditional exception for an additional driveway along Pacific Coast Highway for the existing office building and with no on-site internal circulation is not necessary for the preservation and enjoyment of substantial property rights . The renovation of the existing commercial building, approved under Use Permit No. 90-18 and Conditional Exception No. 90-19 , complied with the parking requirements based on the code at that time. The additional driveway, has the potential to create additional vehicle, bicycle, and pedestrian conflicts along Pacific Coast Highway. The additional parking space does not warrant the conflicts between .. vehicles entering and exiting the site, and reduction in landscaping. In addition, there is a design option available to: the applicant which is to access the southerly portion of the site from an adjoining lot . 2 . Granting of Conditional Exception (Variance) No. 92-17 for an additional driveway along Pacific Coast Highway for the existing office building and with no on-site, internal circulation between the two parking areas would constitute a special privilege inconsistent with limitations upon properties in the vicinity. Other parcels along Pacific Coast Highway in the vicinity have only one point of ingress and egress (driveway) . 3 . Exceptional circumstances do not apply that deprive the subject property of privileges enjoyed by other properties in the same zone classifications . 4 . Although the property is irregular in configuration, the proposed driveway access on the southerly property line will create a hazardous situation with vehicular ingress and egress and northbound traffic on Pacific Coast Highway. 5 . The proposed driveway would create awkward circulation movements on-site and cause potential ingress and egress conflicts on an arterial highway. The driveway width is only 18 feet in width (27 ' minimum is required by the city) which is not wide enough to accomodate adequate two-way maneurvering into and out from the site. 6 . Thia will be better than the way it is now because the trash bin has to be rolled out through the - driveway on the west side of my building which interferes with the traffic in and out of my customers ' parking area . Staff indicated that the Department of Public Works and Community Development were opposed to the request . Staff concluded by recommending denial with findings . THE PUBLIC HEARING WAS OPENED . Dick Cahl , representing the applicant , indicated that when the Use Permit was approved in 1990 , the applicant did not understand that outherly driveway was required to be eliminated and replaced Z'- Eny landscaping . He further stated that the Rainbow Disposal is requiring a larger trash container . However, the approved trash location was not adequate in space, and would require taking up an additional required parking space . Joan Peoples , representing the homeowners association directly to the north of the .property, spoke in opposition to the request . She indicated that the property owner did not comply with several conditions imposed as a result of the use permit approval . She also stated that the second entrance creates a very hazardous situation. Fred Hadajian, applicant, advised that the two driveways were at that location for forty years . He bought the property and had spent a lot of money improving it and now felt he was being punished by the City. There were no other persons present to speak for or against the request and the public hearing was closed . Scott Hess , Zoning Administrator , stated that he would allow the trash container to be placed on the south side of the building but would prohibit vehicular access and installation of a driveway. Although the property is irregular in configuration, the proposed driveway access on the southerly property line will create a hazardous situation with vehicular ingress and egress and northbound traffic on Pacific Coast Highway. Coastal Status : This project is located in the Coastal Zone but may be categorically _ excluded from coastal development permits pursuant to Section . . 989 . 5.3. 13(g) , which exempts minor variances that do not negatively_ impact coastal access or view corridors, from coastal development permits . This variance request for a driveway and parking area that does . not provide internal circulation on the site does not negatively impact coastal access or coastal views as none is currently provided. •� RCA 1/19/.93, ._ -2- (5397d) Project History: Use Permit No. 90-18 and Conditional Exception (Variance) No 90-19 , submitted by the applicant, for an exterior facade improvement to an existing 2, 541 square- feet office/commercial building were conditionally approved by the Zoning Administrator on June 20, 1990. At .that time, vehicles could enter the property. from Pacific Coast Highway on either side of the building because the property was not improved to current- code standards; there were no curbs, gutters or sidewalks. The conditional exception (variance) permitted a reduced landscape planter adjacent to a public right-of-way (PCH) for a larger parking area to accommodate enough parking stalls, and a reduction to the minimum turning radius requirement (23 feet in lieu of 26 feet) . The approved plans depicted a single driveway to the'-north of the building and the southerly area was depicted as landscaping and outdoor recreation area. Basis for approval of the variance was due to the fact that the layout, with one driveway and an open space area, . complied with code. The applicant has not yet brought the project into conformance with the approved plans as there is a second driveway and the proper landscaping has not been installed. The property owner was cited by Code Enforcement for non-compliance with the conditions of approval of Use ' Permit No. 90-18 and Conditional Exception (Variance) No. 90-19 and required to remove the second driveway. The property owner then submitted Conditional Exception (Variance) No. 92-17 as a request to allow the second driveway to remain. He stated at the time of the 1990 submittal, he did not realize the approved site plan did not include the southeasterly driveway. The Zoning Administrator denied the current request on May 27, 1992 (see attached minutes) and again required removal of the second driveway in accordance. with the originally approved plan. It was denied because the additional driveway for one (1) parking space off a major arterial (Pacific Coast Highway) without on-site, internal circulation would: 1. Create potential conflicts between vehicles, -bicyclists and pedestrians along Pacific Coast Highway; 2. Constitute a special privilege inconsistent with limitations upon properties in the vicinity because other parcels have typically only one (1) point of vehicular ingress and egress; and 3 . Eliminate landscaping and open space area that was used to justify a previously approved variance for reduced planter width W 6" in lieu of 10" ) between a parking area and Pacific Coast Highway. The denial has been appealed to the Planning Commission and now to the City Council . RCA 1/19/93 . -3- (5397d) � ATTACHMENT NO. Analysis: Staff recommends that the City Council uphold the Zoning Administrator ' s and the Planning Commission' s action and deny the appeal because of the reasons cited by the Zoning Administrator. The lack of internal circulation between the two drive aisles results in double loading and traffic conflicts with Pacific Coast Highway. The goals of the Huntington Beach Ordinance Code Article 960, Parking includes reducing the points of ingress and egress along streets and arterials and ensuring safe traffic circulation. In addition, the southeasterly driveway does not meet the minimum 30 feet driveway width typically required by Caltrans as it is only 18 feet wide at Pacific Coast Highway. The applicant must also obtain a permit. from Caltrans for the second driveway accesw% `The 18 foot width is barely one-half (1/2) of the Caltrans requirement. . Also, the actual driveable portion of the access way on the property itself is further reduced to ten (10) feet wide. Twenty feet is required for drive aisles such as this. The City' s Public Works Engineering Division recommends denial of this request because the potential for vehicle and traffic conflicts is great in this area as the drive can only accommodate one (1) car at a time for one-way travel. It is highly possible that first time visitors to the site will enter the driveway while another car is already there and then be forced to back-out onto Pacific Coast Highway. This situation results in an awkward traffic pattern which would be very confusing to a motorist unfamiliar with the site. Vehicles entering commercial sites should be able to travel to additional parking areas at the same area if a parking space is not available. The applicant' s appeal letter states that the southeasterly driveway is necessary because the trash enclosure can not be properly located on the north side of the property as previously required. The Zoning Administrator' s action on May 27, 1992 included the provision to relocate the trash enclosure to the south side of the building but prohibited vehicular access . A small concrete pathway from the trash enclosure to Pacific Coast Highway would allow the trash bin to be rolled down to the street as Rainbow Dispds'al requires . Another point of the appeal letter is that the addition of a parking space on the south side of the building brings the site into conformance with the number of parking spaces required by code. However, the nine (9) spaces currently provided on-site is consistent with the parking code that was in effect at the time of project approval. The tenth parking space is not necessary to bring the site into compliance and the potential conflict and hazardous circulation of the second access outweigh the benefits of gaining one (1) parking space. a RCA 1/19/93 -4- (5397d) There is a feasible alternative to the driveway access on Pacific Coast Highway that the property owner could pursue which would comply with code. An on-site access easement between the property to the southeast, a motel, and the office building driveway would allow access to the tenth parking space while reducing traffic conflicts on Pacific Coast Highway. This would achieve the applicant 's goal as well as comply with City' s circulation and driveway standards. The adjacent lot contains a drive aisle that terminates at the southeasterly property line. No driveway .would be necessary -off Pacific Coast Highway and the majority of landscaping area would be preserved. Summary: In conclusion, staff recommends denial -of the appeal because: 1. There is a lack of on-site circulation; 2. It will create potential ingress and egress conflicts on an arterial highway; 3 . The driveway width is only 18 feet in width (27' minimum is required by the city) which is not wide enough to accommodate adequate maneuverability into and out from the site; 4 . The on-site drive aisle is substandard (10 ' in lieu of 20 ' ) ; 5. It will result in a loss of on-site landscaping and open space area pursuant to a previously approved use permit which justified a variance in conjunction with the use permit; and 6. There is a design option available to the applicant which is to access the southerly portion of the site from an adjoining lot. that contains a drive aisle terminating at the common property line. Alternative Action: Should the City Council overturn the Planning Commission' s action and approve Conditional Exception (Variance) No. 92-17, staff suggests a condition of approval to minimize potential traffic impacts . Staff recommends that the applicant designate the southeasterly drive as a private accessway and install a mechanized security gate across the driveway. The gate should be setback approximately eighteen (18) feet from the curbline so that it is visible from Pacific Coast Highway but allows a vehicle to wait. while the gate opens. In addition, a sign shall be installed at the front of the property to identify the driveway as "Private-No Entry" . This option should help reduce traffic conflicts by preventing traffic other than authorized vehicles from entering the drive aisle. It is recommended that the gate be a rolling wrought iron structure approximately forty-two (42") inches high and painted white to match the building trim. It should be noted that ultimate approval of this driveway approach is subject to Caltrans approval because it is along Pacific Coast Highway. Other parcels along Pacific Coast Highway in the vicinity have only one point of ingress and egress (driveway) . 3 . Exceptional circumstances do not apply that deprive the subject • property of privileges enjoyed by other properties in the same zone classifications. 4 . Although the property is irregular in configuration, the proposed driveway access on the southerly property line will create a hazardous situation with vehicular ingress and egress and northbound traffic on Pacific Coast Highway. 5. The proposed driveway would create awkward circulation movements on-site and cause potential ingress and egress conflicts on an arterial highway. I am enclosing a copy of the original narrative I submitted to the Zoning Administration on May 20, 1992 . and also the letter dated June 5, 1992 , I submitted to the Planning Commission appealing the Zoning Administrator's denial . As I have indicated in the attached letter , I had two driveways when I purchased the property. I decided to improve my property by renovating the interior by remodeling the bathrooms , installing new drywall , doors, ceiling and paint . The exterior was also completely renovated including new stucco, windows , awnings, and doors . I did not add square footage. In doing this work, I had to get a. conditional use permit which required that I .also install landscaping, redo my parking lot , remove the septic tank and connect to the City sewer system and pay' the fees , dedicate seven feet of my property to the City along Pacific Coast Highway and construct curb, gutter and sidewalk and get all the permits from the City of Huntington Beach and Caltrans . I did not realize that when these plans were drawn , my driveway on the east side of my building was eliminated. This driveway has been a part of this property for over forty years , and Just because I wanted to improve my property, to increase its value and make it more compatible with the surrounding area , I have lost a driveway which reduces the value of my property. I do not think that this is fair , and I believe that a property right I had when I purchased the property has been denied to me. This elimination of a driveway and a parking space reduced the value of my property. Pacific Coast Highway just east of Mariner Drive. The property to the north is occupided by carports for the Huntington MarAna- Condominiums. The property to the west is a planter area and entrance to the Huntington Marina Condominiums. The property to the east is occupied by the Ocean View Motel. The property on the south side of Pacific Coast Highway is residential. This application requests that a second drivaway be allowed to be installed on the east side of the building as shown on Exhibit "A" . The applicant has been working "on -site improvements on this property since 1990. Prior to that, this property had two driveways, but due to the property's unusual size and the building site location on the property, it is impossible to maintain circulation on-site. On a previous Use Permit Application, the eastern driveway was eliminate&and as a result, the trash enclosure and parking space had to be eliminated. The trash enclosure was relocated on the westerly parking lot and a new parking plan was approved which allowed for nine parking spaces including one. handicapped space. This conformed to the parking requirements at that time, which were one parking space per each 300 square feet of building area. Current parking standards in this area require one space for each 250 square feet of building area or in this case, ten parking spaces. t ' I I, Also, the applicant has been told by Rainbow Disposal that a building of this size requires a three yard trash receptical at a minimum. This will require an enclosure of a minimum of 618" by 818" . See attached copy of trash enclsure size which was given to the applicant by Rainbow Disposal. The current site plan only has nine parking spaces .and will not accommodate a trash enclosure of the size required. A trash enclosure of—the size required cannot be installed in the westerly parking lot without either eliminating a parking space or blocking the handicapped access to the building. In order for the applicant to fully utilize his property to . the highest and best use, it is requested that he- be allowed to reconstruct the driveway on the east side of his building. This will enable him to have one more parking space, thus bringing his site up-toy-code .and also providing an area suitable for a trash enclosure of the size required. This additional driveway will. not have on-site circulation to the existing parking lot and driveway on the western side of the building. It is possible,' however, for a vehicle to drive in, turn around, and exit safely unto Pacific Coast Highway. Even if a car is parking,. in the single parking space, a car can drive in, turn around and exit safely. Public safety will be maintained by stripping and .providing signs as shown in Exhibit "A" . When I purchased the property,. I had two driveways; one on the east side and one on the west side of .my building. My building was too close to my rear property line to have circulation between them. In 1990, a site plan was prepared for Use Permit 90-18 and Conditional-'Exception No. 90-19. This site plan was approved. I wasn' t' aware that the driveway was eliminated and therefore, I did not appeal. I do not want to lose my driveway. It will only be used by one car because there is only one parking- space and it will not create a. traffic . hazard. The closest driveway to the east is 350 feet away and :my .other driveway to the west is 100 feet away. I do not think by keeping my driveway, it will create a significant traffic hazard. I need my driveway because I only have nine spaces now, and the code requires ten. Also I need my driveway because the trash enclosure as .shown on the existing approved site plan will prevent the handicapped access to my building. The trash enclosure should be on the east side of my building where it has always been. The Rainbow Disposal Co. does not drive into the driveways along Pacific Coast Highway, so my driveway on the east side of my building would only be used to roll the trash bin in and out. This will be better than the way .it is now because the trash bin has to be rolled out through the driveway on the west side of my building which interferes with the .traffic in and. out of my customers' parking area. I feel that I am being deprived of -my rights just because of the fact that my building was built over forty years ago too close to my rear property line . and therefore, --I cannot connect my east and west parking areas with on-site circulation. At that time, vehicles could enter the property from Pacific Coast .Highway on either side of the building. The conditional exception permitted a reduced landscape planter adjacent to a public right-of-way for a larger parking area to accommodate enough parking stalls, and a reduction to the minimum turning radius requirement (23 feet in lieu of 26 feet) .The approved plans depicted a single driveway to the north of the building and the southerly area depicted as landscaping and outdoor recreation area. Basis for approval of' the request was due to the fact that the layout, with one driveway and an open space area, complied with code. The .applicant has not. yet brought the project into conformance with the approved plans as there is a second driveway and the proper landscaping has not been installed. The property owner was cited by Code Enforcement for non-compliance with the conditions of approval of Use Permit No . 90-18 and Conditional Exception (Variance) No. 90-19 and required to remove the second driveway. The property owner then submitted Conditional Exception (Variance) No. 92-17 as a request to allow the second driveway to remain. He stated at that time that he did not realize the approved site plan did not include the southeasterly driveway. The Zoning Administrator denied the request on May 27, 1992 (see attached minutes) and again required removal of the second driveway. It was denied because the additional driveway for one (1) parking space off a major arterial (Pacific Coast Highway) without on-site, internal circulation would: 1. Create potential conflicts between vehicles, bicyclists and pedestrians along Pacific Coast Highway; Staff Report - 12/1/92 -3- (5147d) , 2 . . Constitute a special privilege inconsistent with limitations upon properties in the vicinity because other parcels have typically only one ( 1) point cf vehicular ingress and egress; andle 3 . Eliminate landscaping and open space area that was used to jusitfy a previously approve variance for reduced planter width ( 1 ' 6" in lieu of 10 ' ) between a parking area and Pacific Coast Highway. The denial has been appealed to the Planning Commission. Analysis Staff recommends that the Planning Commission uphold the Zoning Administrator ' s action and deny the appeal because of the reasons cited by the Zoning Administrator. The lack of internal circulation between the two drive aisles results in double loading and traffic conflicts with Pacific Coast Highway. The goals of the Huntington Beach Ordinance Code Article 960, Parking includes reducing the points of ingress and egress along streets and arterials and ensuring safe traffic circulation. In addition, the southeasterly . driveway does not meet the minimum 30 feet driveway width typically required by Caltrans as it is only 18 feet wide at Pacific .Coast Highway. The applicant .must also obtain a permit from Caltrans for the second driveway access . The 18 foot width is barely one-half (1/2) of the Caltrans requirement . Also, the actual driveable portion of the access way on the property itself is further reduced to ten (10) feet wide. Twenty feet is required for drive aisles such as this . The potential for vehicle and traffic conflicts is great in this area as the drive can only accommodate one (1) car at a time for one-way travel . It. is highly possible that first time visitors to the site will enter the driveway while another car is already there and then be forced to back-out onto Pacific Coast Highway. _ This situation results in an awkward traffic pattern which would be very confusing to a motorist unfamiliar with the site. Vehicles entering commercial sites should be able to travel to additipnal parking areas at the same area if a parking space is not available. The City' s Public Works Engineering Division recommends denial of this request . The applicant ' s. appeal letter states that the southeasterly driveway is necessary because the trash enclosure can not be properly located on the north side of the property as previously required. The Zoning Administrator ' s action on May 27, 1992 included the provision to relocate the trash enclosure. to the south side of the building but prohibited vehicular access . A small concrete pathway from the trash enclosure to Pacific Coast Highway would allow the trash bin to be rolled down to the street as Rainbow Disposal requires . Staff Report - 12/1/92 -4- (5147d) yam;« Another point of the appeal letter is. that the addition of a parking ; space on the south side of the building brings the site into conformance with the number of parking spaces required by code. However, the nine (9) spaces currently provided on-site is consistent with the parking code that was in effect at the time of project approval. The. tenth parking space is not- necessary to bring the site into compliance and the potential conflict and hazardous circulation of the second access outweigh the benefits of gaining'. :,..'... one (1) parking space. There is .a feasible alternative -to the driveway access on Pacific Coast Highway that the property owner could pursue.— An on-site access easement between the property to the southeast, a motel, and the office building driveway would allow access to the tenth parking space while reducing traffic conflicts on Pacific Coast Highway. This would achieve the applicant's goal as well as comply with City' s circulation and driveway standards. The adjacent lot contains a drive aisle that terminates at the southeasterly property - line. No driveway would be necessary off Pacific Coast Highway and the majority of landscaping area would be preserved. In conclusion, staff recommends denial of the appeal because: 1. There is a lack of on-site circulation; 2. It will create potential ingress and egress conflicts on an arterial highway; 3 . The driveway width is only 18 feet in width (27 ' minimum is required by the city) which is not wide enough to accomodate adequate maneuverability into and out from the site; 4 . The on-site drive aisle is substandard (10 ' in lieu of 20 ' ) ; 5 . It will result in a loss of on-site landscaping and open space area pursuant to a previously approved use 'Permit which justified a variance in conjunction with the use permit; and 6 . Staff indicated that the Department of Public Works and Community Development were opposed to the request . Staff concluded by recommending denial with findings . THE PUBLIC HEARING WAS OPENED. Dick Cahl, representing the applicant, indicated that when the Use Permit was approved in 1990 , the applicant did not understand that southerly driveway was required to be eliminated and replaced landscaping . He further stated that the Rainbow Disposal pany is requiring a larger trash container . However, the approved sh. location• was not adequate in space, and would require taking up an additional required parking space . Joan Peoples , representing the homeowners association directly to the north of the property, spoke in opposition to the request . She indicated that the property owner did not comply, with several conditions imposed as a result of the use permit approval . She also stated that the second entrance creates a very hazardous situation . Fred Hadajian, applicant , advised that the two driveways were at that location for forty years . He bought the property and had spent a lot of money improving it and now felt he was being punished by the City. There were no other persons present to speak for or against the request and the public hearing was closed . The granting of a conditional exception for a second driveway with no internal circulation is necessary in order to preserve the enjoyment of one or more substantial property rights. 3 . The granting of Conditional Exception (Variance) No. 92-17 for a second driveway with no internal circulation will not be materially detrimental to the public health, -safety and welfare, or injurious to the conforming land, property, or improvements in the neighborhood. 4 . The conditional exception (variance) for a second driveway with no internal circulation is consistent with the goals and objectives of the City' s General Plan and Land Use Map designation of Visitor Serving Commercial. 5. The gate shall be subject to approval of the Public Works Department and Community Development Department. 4 . The entire site shall be reasphalted, repaved, and relandscaped in accordance with the plans dated November 23, 1992. 5.
