SUBJECT: Default of Subdivision Agreement -- Tract Nos. 1 d 13270

Statement of Issue:
Mr. David Dahl is in default of his subdivision agreement by failing to comply with the final
map conditions as they pertain to the improvements on Ellis Avenue between Goldenwest
and Edwards Streets.
Funding Source:

Recommended Action:
Find that Mr. David Dahl is in default of Tract Nos. 13269 and 13270 subdivision agreement
by failing to comply with the final map conditions requiring installation of the Ellis Avenue
improvements between Goldenwest and Edwards Streets, including the completion of the
water system; and, authorize the City Attorney to file any and all necessary legal actions
against Mr. David Dahl and Golden Eagle Insurance Co., the bonding company.

Analysis:
The Planning Commission, on April 18, 1989, approved Tentative Tract Nos. 13269 and
13270 with condition No. 2(b) which states: "As required with tentative Tract 13629, Ellis
Avenue shall be constructed to approved design grades from Edwards Street to Goldenwest
Street. Also the water main system in Ellis shall be completed." Both tracts have been
constructed, however the Ellis Avenue conditions were never complied with.
The City Attorney, on May 24, 1996, sent a letter to both Mr. David Dahl and Golden Eagle
Insurance Co., the bond underwriter, ordering the work on Ellis Ave. to commence within 30
days. On July 2, 1996, a meeting was held with Mr. David Dahl, the City Attorney and Public
Works. At that meeting, Mr. David Dahl indicated that he would proceed with installing the
improvements on Ellis Ave. within 30 days. On July 5, 1996, a second letter was sent to Mr.
David Dahl ordering him to start work on Ellis Ave. within 30 days. To date, the required
work still has not been started. Permission is now requested to find Mr. David Dahl in default
of his subdivision agreement.
