Construction Inc. is requesting approval of Parcel Map No. 92-203 to consolidate two (2) legal, non-conforming lots into one, 6750 square foot lot for multiple family residential purposes pursuant to the provisions of the Subdivision Map Act and Section 9921 of the Huntington Beach Ordinance Code. RECOMMENDED ACTION: Approve Parcel Map No 92-203 with a finding that the Parcel Map is in substantial conformance with the tentative map previously approved by the Zoning Administrator on October 7, 1992 and instruct the City Clerk to affix her signature to the map, and to release the map to the County for processing. ANALYSIS: Tentative Parcel Map No. 92-203 was approved by the Zoning Administrator on October 7, 1992. Parcel Map No. 92-203 has been examined by the City Engineer and certified by him as being in substantial conformance with the approved tentative map. Pursuant to Government Code Section 66474.1, the Council may approve the Parcel Map with a finding that the parcel map is in substantial conformance with the previously approved tentative map, or may deny approval with a finding that the parcel map is not in substantial conformance. BOX 190.92648 October 8 , 1992 PHONE(714) 536-5271 Petition/Document : TENTATIVE PARCEL MAP NO. 92-203 Applicant : Gilbert Engineering 4552 Lincoln Avenue #206 Cypress , CA 90630 Request : To consolidate two (2) legal , non-conforming lots into one, 6 , 750 square foot lot for multiple family residential purposes pursuant to Section 9921 of the Huntington .Beach Ordinance Code . Location: 1541 and 7555 Warner Avenue Dear Applicant : Your application was Conditionally Approved by the Zoning Administrator of the City of Huntington Beach on October 7, 1992 . Included in this letter are the Conditions of Approval for this application . Under the provisions of the Huntington Beach Ordinance Code, the action taken by the Zoning Administrator is final unless an appeal is filed to the City Council by you . Said appeal must be in writing and must set forth in detail the action and grounds upon which you deem yourself aggrieved . Said appeal must be accompanied by a filing fee of Two Hundred Dollars ($200 . 00) and must be submitted to the Secretary of the City Council within ten ( 10) days of the date of the Zoning Administrator ' s decision. The last day for filing an appeal and paying the filing fee for the above-noted application is October 19 , 1992 . Provisions of the Huntington Beach Ordinance Code are such that the application becomes null and void twenty-four (24) months after the final approval, unless a covenant to hold the parcels as one has been recorded with the County Recorder or an extension of time has been granted by the Zoning Administrator . FINDINGS FOR APPROVAL: 1 . The proposed consolidation of two (2) parcels into one for multiple family residential purposes is in compliance with the size and shape of property necessary for that type of development . The proposed consolidation is consistent with the Medium-High Density Land Use Designation in the General Plan. Attachment(c) SUGGESTED CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. Tentative Parcel Map No. 92-203 received by the Department of Community Development on August 19 , 1992 shall be the approved layout . 2 . A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. A copy of the recorded parcel map shall be filed with the Department of Community Development . 3 . Water supply shall be through the City of Huntington Beach' s water system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s) . 4 . Sewage disposal shall be through the City of Huntington Beach' s sewage system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s) . 5 . All utilities shall be installed underground at the time said parcel(s) is/are developed. 6 . Compliance with all applicable City Ordinances . 7 . All vehicular access rights along Warner Avenue shall be dedicated to the City of Huntington Beach except at locations approved by the Zoning Administrator . 8 . The applicant/property owner shall be responsible for paying the Park and Recreation Fees in effect at the time the final map is accepted by City Council or release of the map for recordation. (4624d)
