Belsito, City Administrator I RE: CONDITIONAL x;"E PERMIT NO. 76-17 - CONSIDERATION OF REVOCATION The Planning Commission at its meeting of December 7, 1976 , conditionally approved the above ref,.!renced application. This approval allowed for Life continued operation o'. an existing horse stable located on Ellis Avenue on the west side of �oldenwest Street. Sir-e this stable was an existing operation, the Commission imposed a j time deadline for completion of the various conditions of approval. It was determined that the applicant shall have all the necessary requirements fulfilled prior to December 1 , 1976, and that a status review of the applicant' s progress would be held on December 7 , 1976. The Planning Commission has determined that a number of conditions still. I have not been complied with. Specifically, the following conditions, which appear on the attached list of conditions , are outstanding: 3. Ellis Avenue and Goldenwest Street: shall be dedicated for street purposes prior to December 1 , 1976 . 5. Fire protection systems shall be subject to approval by the Fire Department. This system may include determinations as to the appropriate fire safety access and level of water source that will service the facilities . 6 . The applicant shall, submit a landscape plan showing a six (6) foot wide landscape planter on Ellis Avenue and Goldenwest Street to the Department of Building and Community Development for review and ap- proval. Said landscaping shall be completed prior to December 1 , 1976. 8. Temporary placement of waste materials shall not exceed forty--eight (48) hours in an all-concrete, three-Walled open storage bin, with removal to on-or off-site ranch use or destruction on a schedule subject to approval of the Orange County Health Department. Size of storage bin shall depend on projected daily volume of waste material. The Commission discussed these deficiencies with the stable operator, Mr. Ted Hennes at three (3) different Commission meetings . Mr. Hennes indicated that he was attempting to complete all of the conditions but has been unable to do so at this time. The city Council concurr6d and directed the staff to set the public hearing for February 7, 1977 . Subsequent to this .Council action the applicant filed a grant deed with the City, filly dedicating all the r-quired rights-of-way on both Ellis ... Avenue and Goldenwest Street. Additionally, the applicant has on numerous occasions attempted to file a landscape plan to the Department of Building and Community Development, but because the plan does not meet the standards normally required, it has been rejected by that Department 's staff. Specifically, the plan does not pospess the professional characteristics , such as traditional plant symbola, surface types, drive- way locations, topographic features, etc . , that would allow the staff to make a reasonable analysis . f The applicant has also been working with the Fire Department staff in an effort to complete tl. w fire safety systems. This process has been completed with the only exception being a final inspection of the fire access road surfacing . Fire Department personnel will again inspect the premises prior to the February 71 1977 Council meriting in order to ascertain whether full compliance has been achieved. The staff will further discuss thi3 issue on the night of the meeting . (See attached landscaping plans) Over 130 bushes and trees have: been planted an the stable. Before the stable? Was est.nblished, there were none. Originally, we thought the site plan voul t' suffice as the plantings were indicated thereon_. However, we prepared specific landscaping plans upon realizing that the site plan was not sufficient. We took the., plan to the Building Department as directed in Condition 6. There we were informed by the Building Department Staff that the man who actually approves landscaping layouts was the Landscaping Sup- ervisor in the Public Works Department. We took the plans to the Landscaping Supervisor who said the plates were generally acceptable but he would have to for- ward them back L•o the Building Department for logging in. Checking back with the Building Department later we were informed that the Planning Department Staff insisted that the plans ,go to the Design Review Donrd (which meets every two weeks) for .approval. This is in spite of the Eact tl,4t Design Review Board action is not required (City Code Article 967) •.UnlCnS an building permit: was required. This is per the City Attorney Staff. (Nunn w-:1s, secs Condition 4) We brought all this up garter the December 21 meeting during the public corm-eats portion (after the closed meeting) . But no note was made of: it at the January Ott: meeting. 7t is interesting to note �that A.C. Narion, nefos.; Ellin Avenue and run ping pnrallcl with me in the permit process, up to that time did not have to go before the Design Review Board. Condition 7. Paid required amount, nine--hundred-eighty dollars($980) . Condition 8. No such structure e.cists in any stable .in Huntington Bench nor have: I ever seen one in any stable anywhere. 1•1ntlure front this stable is placed in detail bins with covert, and removed four tinw-s a week by the I:ainbow Disposal Co.
