Belito, City Administrator SUBJECT: CONDITIONAL USE. PERMIT NO. 76-31: APPEAL TO DENIAL PROPOSED SKATEBOARD PAR!' AT ATLANTA AND BEACH BLVD. The City Council at its meeting of February 7, 1977 continued action on the .above referenced matter in order to allow further analysis on various aspects of the environmental assessment for the project. Specifi- cally, this analysis was to address the concerns of noise, traffic, and lighting, . and. the impacts if any that these concerns would have on the surrounding properties. The applicant has met with the staff on these concerns and has provided supplemental material relating to these specified env.'ronmentel concerns. This report indicates that the present noise level reading on the east property line of. the subject site is 68 dBA and 74 dBA on the Beach Boulevard frontage. It was therefore concluded that since similar Ilk facilities did not measurably increase the noise levels, the project .yft through its proposed design would actually decrease background noise levels that presently reach the residential development to the east. The stapplementalmaterial indicates that the average age of users of similar facilities is somewhere between eleven (11) years of age and seventeen (17) years of :.ge. The use will therefore generate more bicycle .`,and pedestrian traffic than autos, however, assuming the use would generate normal commercial traffic trips (400) this would still only result in a .4 increase in the present traffic volume of 19 , 800 on Beach Boulevard. Therefore, since the traffic increase is minimal and the site is sertr,iced by the public transportation system, and bicycle trail system, the staff concurs on the report' s conclusion that no adverse traffic impact will be generated by this facility. The report discussed the potential impact of lighting spill-over onto the ;..: ad scent residential properties to the east. It was noted that the pro- po.sed use. will be 'termed up to a peak elevation height of seventeen (17) Additionally, the staff has suggested that the lighting .system not ti 'rued a height of twenty-two (22) feet measured from the finished grade of .the 'parkin.g lot which is the normal height of cos.7mercia parking lotlight' g. That the proposed use has a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood, or is detrimental to the value of property and improve- ments in the neighborhood; or 2. The proposed use is not contemplated under the Master Plan of Land Use; or 3 . The proposed use is not compatible with existing or other proposed uses in the neighborhood; or 4 . The location, site layout, and design of the proposed use does not properly adapt the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner; or 5.. The combination and relationship of one proposed use to another on a site are not properly integrated ; or 6: The access to and parking for the proposed use cret-Ates an undue traffic problem. If any of the above findings can be supported by factual data reasonably related to the proposed project, then according to the ordinance procedures , a disapproval of the project' s application (Conditional Use Permit) would be the most appropriate conclusion by the discretionary body . Therefore, .it is possible that a finding cf nc significant adverse effects (approval of a Negative Declaration) can be made and yet a project' s entitlement permit (CUP) could be disapproved based on the above enumerated findings . The applicant has stated that outdoor amplification systems are not necessary and will not be used if so stipulated. Therefore, the only source of noise that will result will be from the users of the facilities themselves. The staff had expressed this concern to the applicant who has concurred .on the suggestion of a noise attenuation wall that would be located on the peak height of the fill area. This wall would be similar to the noise attenu- ation concept that has been used on projects that are developed on properties adjacent to the freeways or high volume arterials. Lighting for the facilities should not have any more impact on the adjacent properties that which results from normal commercial develop- ment lighting. The staff had suggested to the applicant that all lighting be directed to the west, away from the flood control channel and that such lighting should not exceed an overall height of 22 ft. measured from the finished grade of the parking lot area (5 ft. on the peak of the slope area) . Parking for this type of facility is not categorized in the parking standards of the Huntington Beach Ordinance Code. A check of similar facilities has indicated that parking demands fluctuate, but do not parallel the rather intense use that these facilities experience at the peak periods. The plan proposas a total of 45 spaces for the initial phase I development which consists of approxi.ma-ely 1 . 2 acres. The staff feels that this amount of automobile parking is sufficient for the size and capacity of phase I. However, realizing that the use will generate large numbers of young people that are not of driving age, the applicant should provide bicycle racks that can provide locking Facilities for at least 200 bicycles at one time. Therefore, the staff recommended that the bike storage area be relocated to the north of the office and sales/service building , which if combined with the proposed four parking. spaces that are adjacent to this area, the 200 bicycles could then be accommodated. In summary, the use is a new development concept that is difficult to locate because of area requirements and the fact that it is basically an outdoor recreational use. The proposed location of this use is one that the staff felt could be compatible with surrounding uses if the proposed modifications as discussed were implemented and the suggested conditions of approval were adhered to. The staff therefore recommended approval of the proposed skateboard park. ADDITIONAL INFORMATION: The Planning Commission held a publi_ hearing on the proposal at its meeting of January 18, 1977. The Chairman indicated that approximately 250 people, most of whom were residents of the adjacent residential development, signed letters and petitions stating their opposition to the proposed use . The facili- ties will consist of bermed and mounded areas with concrete pathways or runs on which the skateboarders will ride . As the proposed site plan indicates through cross section A-B, the applicant has proposed a maximum fill height of approximately 17 feet which slopes gradually toward Beach Boulevard to the finished grade of the site. This slope concept is .necessary in order to provide the downhill skateboard courses. Because the use is primarily an outdoor operation , the planning issues will involve noise and lighting considerations and whether a skateboard park will be compatible with surrounding uses. The applicant has stated that outdoor amplification systems are not necessary and will not be used if so stipulated. Therefore , the only source of noise that will result will be from the users of the facilities themselves. A petition containing sigha tunes from over 70 people who are, residents in the immediate area supporting the proposal was received by the staff on January 13, 1977. Additional petitions, containing over 1000 signatures of persons in support of the pro- posal who shop at the adjacent commercial center was also received by the staff on January 13 , 1977. The Planning Department has also received 45 signed petitions stating their opposition to the use from residents of the residential develop- ment located to the east of the site. . If-he staff will make available all of these petitions to the Commission on the night of the meeting. 5. 0 RECOMMENDAT?ON: The staff recommends approval of Conditional Use Permit No. 76--31 based on the following findings and subject to the fallowing suggested conditions of approval .- FINDINGS: I. The proposed plan is in substantial conformance with applicable provisions of the Huntington Beach Ordinance Code. 2. The location of the proposed use will be compatible to the sur- rounding uses if the recommended conditions of approval are im- plemented. 3 . The proposed site is adequate for the use as depicted on the con- ceptual site plan. CONDITIONS: 1. The. conceptual site plan dated December 14 , 1976, shall be the approved layout subject to the following modifications : a . A six (6) foot high decorative masonry wall shall be constructed on the highest peak (17 . 3 feet elevation) of the fill area in order to attenuate noise. The applicant has stated that outdoor amplification systems are not necessary and will not be used if so stipulated. The staff had expressed this concern to the applicant who has concurred on the suggestion of a noise attenuation wall that would be located on the peak height of the fill area . This wall would be similar to the noise attenu- ation concept that has been used on projects that are developed on properties adjacent to the freeways or high volume arterials. Therefore, the staff recommended that the bike storage area be relocated to the north of the office and sales/service building , which if combined with t:he proposed four parking spaces that are adjacent to this area, the 200 bicycles could then be accommodated. I in summary, the use is a new development concept that is difficult to locate because of area requirements and the fact that it is basically an outdoor recreational use. Additionally, a petition containing approximately 1 , 000 signatures, 70 of which were from residents residential development and the remainder from users of the adjacent commercial center had been filed indicating their support of: the . project. The facili- ties, will consist of uen.ied and mounded areas with concrete pathways or runs on which the skateboarders will ride. As the proposed site plan indicates through cross section A-B, the applicant has proposed a maximum fill height of approximately 17 feet which slopes gradually toward Bcich Boulevard to the finished grade of the site. This slope concept is necessary in order to provide the downhill skateboard courses. Because the use is primarily an outdoor operation , the planning issues will involve noise and lighting considerations and whether a skateboard park will be compatible with surrounding uses. The applicant has stated that outdoor amplification systems are not necessary and will not be used if so stipulated. Therefore , the only source of noise that will result will be from the users of the facilities themselves. The staff has expressed this conre::n to the' applicant who has concurred on the suggestion of a noise attenuation wall that would be located on that peak hcIght of the fill area . A petition containing signatures from over 70 people who are residents in the immediate area supporting the proposal was received by the staff on January 13, 1977. Additional petitions containing over 1 ,000 signatures of persons in support of the pro- posal who shop at the adjacent comceercial center was also received by the staff on January 13 , 1977. The Planning Department has also receivrn 45 signed petitions stati;�g their opposition to the use from residents of the residential develop- ment located to the east of the site. The staff will make -available all of these petitions to the Commission on the night of the meeting. 6 . 0 RECO1414ENDATION: The staff recommends approval of Conditional Use Permit No. 76--31 based on the following findings and subject to the following suggested conditions of approval : FINDINGS: 1 . The proposed plan is in substantial conformance wi i applicable provisions of the Huntington Beach Ordinance Code . i 2 . The location of the proposed use will be compatible to the sur- rounding uses if the recommended conditions of approval are im- plemented. 3 . The proposed site is adequate for the use as depicted on the con- ceptual site plan. CONDITIONS : 1 . The conceptual site plan dated December 14 , 1976, shall be the approved layau* subject to the following modifications : i a . A six (6) foot high decorative masonry wall shall be constructed j on the highest peak (17 . 3 feet elevation) of the fill area in order to attenuate nn:ise. The design and materials of the wall shall be subject: to the approval of the Planning Department prior to the issuance of building permits . b. It is bounded mainly by the Santa Ana Freeway to the South and apartments to the North. The apartments are separated from this facility by a twenty foot alley. While .standing at the apartment site, noise ratings were taken before the park opened for operation. The readings obtained average 73 DBA. Later the same day, Sunday, February 27 , 1977 a bright, sunny day, readings were taken when the park was at full capacity. The readings obtained were again, 73 DDA. The conclusion to be drawn here is that the park did not proluce enough noise to be heard above the bacground levels. It is f(A t, therefore, that the proposed facility in Huntington Beach will resent even less of a noise impact in the Anaheim facility due to the he. . elevated configuration at the East boundary line topped by a six foot wall . On the previously mentioned Sunday in February, noise ratings were taken at the proposed site in Huntington Beach. From the service road adjacent to Beach Boulevard , levels were averaging 74 DBA. Similar readings were taken at the East property line of the property and those noise levels reached to 68 DBA, We, therefore, conclude from -these analyses that the construction of the Huntington Beach facility which will encompass a seventeen foot high embankment witn a six foot block wail on to of that 9 p will actually decrease background noise levels reaching the dwellings to the East, Furthernare, based on these findings genprzited from the Anaheim facility, we can lajically conclude that there will be no noise impact generated from the construction and operation of this prO ect. TRAFFIC Observations and conversations with operators of similar facilities indicate the average age of users to be between eleven years of age and seventeen years of age. Therefore, the majiority of traffic to and from this facility will be bicyclists and pedestrians. Youngsters can utilize bike routes and Orange County Transit District routes to reach this facility. Surrounding streets can handle project's generated auto traffic based on similar facilities at thirty vehicles ;)e,,,, hour. No adverse traffic impact will be i generated by this facility, LIGHTING' As can be seen from Exhibit A. View A, the elevation of the East boundary of the park will be seventeen feet above existing street elevations. In addition, the City of Huntington Beach has asked for a six foot block wall atop the seventeen foot elevation. This wail was originally for the purpose of attenuating noise, However, at the same time, it will block out light. This meads that. any lights aimed Eastward wculd have to be more than twenty- three feet high to adversely affect residents to the East of the park. r a. 4 Let it be perfectly understood that no lights mounted higher than twenty- three feet above the' Western boundary of the park will be aimed Eastward. Those lights mounted on the East will be aimed towards the West and therefore, lighting will present no adverse affect towards the East. The other points of the compass are either commercial or arterial highway. Therefore, it can be concluded that lighting associated with this project will have no adverse impact on any surrounding property.
