Council Members : We wish to appeal the negative zes onses of the Hoard of Zoning Adjustments and the ,sue P t Planning Commission who denied our Conditional Exception �u'�'L�' requests #7f,-32 and 76-36. These would have allowed the construction of a carport with a. 10' setback from the front property line and the retention of a converted garage area as livini, space in our single family dwelling at 3271 Devon Circle . Granting these exceptions wodld have satisfied our living needs and met the provisions of Sec. 9106 of the N. B. Ordinance code . Detailed reasons for this request, and justification of"hardship" are a part of the record in this matter,. The unusual aspect of this appeal lies in the fact that the garage conversion is at least 13, and possibly 15 years old, that it existed 10 years ago when the property was purchased by us . No action was taken by the city during; that period, nor were any complaints filed against it. We feel that purchasers of homes in Huntington Beach should have protection against retroactive action of this type While the r ra tin� of this appeal might not set precedent under these circumstances, we also suggest that an instruction by the City Council not to pursue the enforcement of S--!c . 9106 in this instance because of prior neglect to do so by the City Attorney, need not be .)recedeiit setting either. , and would provide an equitable solution for all parties. Applicant: George Shibata Appellant: Edwarl and Margaret Brady The request is to parmit a 12-foot encroachment into the required - 22-foot setback for a front entry carport in lieu of Section 9106 . 2 of the Huntington Beach Ordinance Code. The subject property is located on the notth side of Devon Circle approximately 60 feet east of Channew Lane in an R1, Low Density Residential D-i.stricv:.. _ , Use Permit No.-- 76-36 is a request to allow the construction of a carport to satisfy the covered off--street parking requirements of � the R1 district . This existing garage was illegally converted to a family room several years ago. The present property owner has filed this request as the result of a recent building violation notice issued by the Department of Building and Community Development . I Conditional Exception No. 76•-32 was filed in conjunction with the Use Permit and is a request to reduce the required setback from 22 feet to-'12 feet for carports that are entered directly from a street. The proposed setbac'r, for the carport is 10 feet from the right-of-way of Devon Circle. I John Cope stated that he had no information to add to that contained in the staff report. The public heating was opened. I Mrs. Brady, Appellant , addressed the Commission and stated that she and her husband had purchased this home ten years ago and at the time they bought it the garage had been converted into a family room. She further stated that she did not realize she was in violation of the code until she received a notice to reconvert the garage back to its original use within a fourteen day period . The Commission inquired as to whet brought about the- notice of violation. Walt Lipps , Building Department representative, stated that the notice of violation was brought to the attention of the Building Department by a -roue of Huntington Harbour residents. r The public hearing was closed. Bob Van Gerpen addressed the Conunission and stated that the pro- posed sign was to be a srift-sell image on the corner of wood construction with no lighting, and that it would be in keeping with the character of the neighborhood. Hans Smith, resident of the area, spoke in opposition to the construction of the sign, stating that it would be totally un- necessary. I ' . PLANNING COMMISSION ACTION: ON MOTION BY BOYLE AND SECOND BY PARKINSON APPEAL TO DENIAL OF CONDITIONAL EXCEPTION NO. 76-32 AND USE PERMIT No. 76--36 WAS DENIED FnR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: 1. SUMMARY ANALYSIS : Use Permit No. 76-36 is a request to allow the construction of a carport to :satisfy the covered off-street parking requirements of the R1 district. The existing garage was illegally converted to a family room several years ago. The present property owner has filed this request as the result of a recent building violation notice issued by the Department of Building and Community Develop- ment. Conditional Exception No. 76-32 was filed in conjunction with the Use Permit and is a request to reduce the required setback from 22 feet to 12 feet for carports that are entered directly from a street. The proposed setback for the carport is 10 feet from the right-of-way of Devon Circle. Both applications were considered by the Board of Zoning Adjustment^ at its meeting of July 14 , 1976 and were denied. The applicant thus appealed to the Planning Commission. The Commission in its discussion on the requests considered the intent of the carport setback requirement, which is to enhance pedestrian and traffic safety and vision and to provide for a more desirable street scene. The Commission members felt that there were no unusual circumstances attributable to the subject property, that the applicant failed to demonstrate any legal hardships, and that ouch a setback precedent would adversely affect surrounding properties . The Commission therefore denied Conditional Exception No. 76-32 and Use Permit No. 76-36. The proponents explained the need for the carport and the difficulties imposed upon them by the illegal addition which -had been made to the home they purchased some years ago. There being no other persons present to speak in regard to the proposed project, the public hearing was closed. The Board addressed the criteria of hardship on the property, determining that the property is a conforming lot with no unusual aspects to justify the exception. The precedent-setting . nature of an approval on this request was also considered. ON MOTION BY COPE AND SECOND BY ELLSTROM CONDITIONAL EXCEPTION NO. 76--32 WAS DENIED FOR THE FOLLOWING REASONS , BY THE FOLLOWING VOTE: REASONS FOR DENIAL: 1.
