The Planning Commission at their meeting of May 2 , 1978 continued
Cond.-Ronal Use Permit No. 78-5 and requested that the staff provide
the r-)llowing information at the I-lay 16, 1978 meeting .
The staff was requested to inquire into other ci.tie:: that presently
teenage discotheques and report back with their- findings .
'i'he% staff_ contacted the cities of Van Nuys , North Hollywood and
► estminster . Each of; these cities presently have operating teen
c1 Z. within their bouncltaries . The Pol i.cc:� Departments of (N ch
of: these cities were riot willing to provide conitnernts in writing to
our department , however , cli.cl furnish following general comments .
1 . Teenage discotheques have a tendency of creating unnormal amounts
of traffic due to the fact: that many young pr_ople .just like to
drive through (cruising) the parking lots and/or thu. general area
where such facilities are located .
2 . Such facilities also have the tendency of attracting young pt:!apple
from outside the community.
3 . Many teenage arrests are made for drunk driving and being under
the influence of: drugs in the (leriera l area- of such facilities .
4 . The noise level in the general. vi.cini.t:}• of such uses is normally
higher due to the large number of youncl peoplo c;ongre , t.i.nci ,
cruising and just hanging around .
The staff was also requested to contact the owners of the two r.o:lstau-
I ' rants located in the shopping center to make sure that they are aware,
of the proposed discotheque.
The staff contacted the corporation that owns both restaurants and they
indicated that they were ver, touch op,,osed to the proposed use .
They pointed out thz-,t the proposed disco would impact. t:hr: parki.ny
and would create an environR:-nt in the general area that. would riot. be
conducive to their restaurants or the overall. shoppin(t center .

said project. The staff has also included suggested findings that
the Planning Commission may use if they wish to approve Conditional
Use Permit No. 78-5.
FINDINGS:
1. The Proposed use is compatible with existing land uses of the
surrounding area.
2. The proposed use can be anticipated to fulfill. a public need for
this type of facility in the general area .
3 . The proposed facility is in substantial. conformance with the
Huntington Beach Ordinance Code,
CONDITIONS OF APPROVAL:
1. The plan received and dated February 16, 1978 sha11' be the approved

After reviewing the proposed facility the Staff outlined the
two following issues of concern;
1. The subject center was allowed a reduction in the required
parking at the time it was approved. The center already has
two restaurants that will utilize late hour parking. The
disco is proposed for an area that was designated on the
approved plot plan as office space. The disco will require
92 spaces based on the occupancy and square footage where
the office space %iac nn2-v 7.1 .1oted 11 spaces.

small neighborhood shops and offices . The proposed
discotheque is a .more intensive use than the shops, offices
or even the two restaurants . The proposed use will generate
both pedestrian and vehicular traffic above a level at
which the center was designed to accommodate .
Based on the analysis (Section G) included in the attached staff
report and the lette!.s of protest received from the Huntington Beach
Police Department, City of Fountain Valley and Jeremiah' s Restaurant,
also attached, the StGff ' s recommended to the Planning Commission
to deny Conditional Use Permit No. 78--5 .
The applicant contends that the proposed disco will be well
supervised both in the facility and in the parking area with private
security guards. He has also made the point that there are no
residential units that abut the subject site and that the main
hours of operation will be after most of the other uses in the
center will be closed. Mr. Williams , the applicant, requested
that the Planning Commission Limit the accuFancy to no more Clan
300 persons. The facility will only be opened to members and the
general public will not be admitted. This will help control .the
number of persons in the facility at any one time.

The' Commission also believes that .Conditions cof approval 2 and 3
(providing for review of. the project after. one year or at. change .
of ownership) allows the City ample ..protection if the disco operation
proves undesirable in operation.
Comm;ssioners Bazil and Higgins filed the following minority report
concerning their vote on Conditional Use Permit No. 78-5 :
Commissioner Bazil stated that he felt that in addition to the
reasons given by the Staff denying Conditional Use Permit No. 78-5
it was morally wrong for the owner of the property to enter into
an agreement with an anchor business such as Jeremiah' s and Carrows
restaurants and bring in a use that is not allowed in that zone .
He farther stated that he felt a more proper location for the
discotheque would be such as that behind the Huntington Center.
He also stated that the teenage center across the street was
more of a detriment than it would be were it located on the
same side of the street. He also said that the unlimited member-
ship could bring in problems .
Commissioner Higgins opposed the use because he felt it would jeopar-
dize the. operation of the two restaurants located in the center.
He felt the success of the entire commercial center rests consider-
ably on the success of those two facilities and the environment
created by the disco and its patrons would be detrimental to them.
ENVIRONMENTAL STATUS :

Conditional Use Permit No, 78-5 was assessed for Qnvironmental
impacts by Negative Declaration No. 78-19 . Negative Declaration
No. 78-19 was posted on February 23 , 1978 in the City Clerk' s
Office and the Huntington Beach flews . All comments that were
received by the Planning Department have been attached to the
accompanying Staff Report. On May 16 , 1978 the Planning
Commission approved Negative Declaration by the following vote :

1. We seriously question the compatibility of a tecnaRe disco
in the same shopping center as our restaurant facility . As

an atmosphere commensurate with bight-time dining and enter-

the real problem is not inside the disco itsolf-
but in the area outside . Teenagers tend to congr(.cq rte
outside where they get into fights , consume narcotics
and otherwise create the police problems .
Active Concepts intends to establish th r eans �1y
• which this problem can be averted . First , Active Concepts,

COMMENTS OF OTHER TENANTS
At the public hearing , several tenants of the center i
expressed support~ for the project. Many of those

diSLO.
Apparently , one firm owns both Je romi., s ind Carrows , the
two eating establishments .in the center. This fir!-,- is
concerned about ;,-rkinr? and the concert of tho youth
disco. It should be emphasized , however, that these
• restaurants in effect: consti.tutec on?v one tenant: in
opposition to the project: k-.hi,lc a dozen other tenants
favor the facility .

2. 0 GENERAL INFORMATION :
Conditional Use Permit is a request to establish a teenage rnemborship
disco. The subject use is proposed to utilize approximately 3300 sq . f_t .
of a shopping center that is presently under. construction . This 3300
sq. ft. space was originally designated on Ulu approved plan as offic:e-
professicnal space.
The proposed disco will include a daricc: floor, lounge area , a snack bar,
disc jockey booth , and miscellaneous offices .

1 . The subject center was allowed a reduction in the required parking
at the time it was approved. The center already has two resuti-

2. The existing shopping center was designed to accommodate small
neighborhood shops and offices . The proposed discotheque is a
more intensive use than the shops , offices or even the two
restaurants. Therefore, it is not compatible with the small
neighborhood shopping center.
4 . 0 ENVIRONMENTAL STATUS :
The subject shopping center was assessed for environmental effects at the
time it was approved for construction, however, because of the nature of
this proposed use additional environmental assessment was required.
Pursuant to environmental regulations in effect at this time , the Planning
Department posted Tentative Negative Declaration No. 78--19 for ten day,:
in the Office of the City Clerk and the Iluntington Beach Nevis. The posting
period ran between February 23 , 1978 and March G , 1978 . As of that time
no comments either written or oral had been received. The Staff in its
initial study of the project however, identified potential significant j
environmental effects of traffic/parking and noise. These comments have
been attached to this report for the Planning Commission ' s review. In
addition, the Planning Department has drafted Negative Declaration No.
78-19 which is also attached herewith for the Planning Commission ' s review
as required by Section I5083 (e) (4) of the State Guidelines of the
Calitornia Environmental Quality Act. The initial ,study information is
attached to the negative declaration as documentation in support of the
finding.
Prior to action on this conditional use permit , it is necessary for the
Planning Commission to receive and review comments on and adopt Negative
Declaration No. 78-19 in conjunction with Conditional Use Permit 78-5 .
5. 0 SURROUNDING ZONING, LAND USE AND GENERAL PLAN DESIGNATION:
ThQ subject property located at the northwest corner of Warner Avenue and
Magnolia Street is zoned C2 , Community Business District. A 49 , 000 sq . ft.
commercial/office complex is presently being constructed or, the site.
This center will include two detached restaurants, 21 , 000 sq. ft. of
retail space and 18 ,000 sq. ft . of office space. The subject site is
designated on the General Plan as Ceneral Commercial .
The property located north of the subject site, across the flood control
• channel is zoned A--1 , Agricultural and Rl , Low Density Residential and is
.used for agricultural . This property is designated on the General Plan
for Low Density Residential . The properties located tc, the east,
-,..----,., across Magnolia Street and to the south, across Warder Av�nue are in the
Cit:y 'of_ Fountain Valley. The property to the east is developed with an
amusement center complex and the property to the south is developed with
a shopping center. Located to the west of the subject site the property
is zoned, general planned, and developed as commercial .

6 .0 ANALYSIS:
The subject shopping center was approved in December 1976 and includes
two (2) restaurants of approximately 10 ,000 sq. ft . , 21 , 000 sq . ft. of
retail commercial on the ground floor and approximately 18 , 000 sq. ft . of
commercial office space on the second floor . The center will be provided
with 219 parking spaces which were based on the square footage of each
of the proposed uses . This figure reflects a small reduction of the
rsquired number of parking space;; based on the overlap of parking space
use of the office daytime versus the. restaurant night time use .
The proposed disco will occupy approximately 3300 sq . ft . of the: office
space which would be provided with 11 perking spaces based on one space
Jr each 300 sq . ft. of gross office area . However , Article 97�? rLq��ires
that establishments of this type be provided with one space for each 35
sq. ft. of eating and/or drinking area . The service area of the proposed
project is 3218 sq. ft. which would require 92 parking spaces . Therefore ,
an 81 parking space deficit exists .
The applicant has indicated that becuase of the young ago group of much of
the patronage many of them will be dropped off and pickod up. Bcc4aLiSo
of the shopping center ' s layout: and circulation design, this could in �
itself create some traffic problems not only within the center but also
on Warner Avenue and/or Magnolia Street: . Somr; increase ever and above
the normal generated traffic can be expected due to the close proximity
of the proposed use to the amusement center complex east of: Magnolia St .
Because of the design of the second floor of the exist:inq shopping canter
there is no physical way to secure the rest: of the floor from the proposed
disco. '.Chis could create some problems with late hour office users plus
require the need for additional security guards .
The Staff concurs that the proposed teenage disco is not- a compatible use
with the rest of the shopping center nor was the shopping c enter dosiyrned
properly to accommodate the proposed use . All of the units located on
the second floor take access from a continuous walkway. There is no
physical wayto secure this walkway from the pi-rrpored c3iscotheyue . 'Phis
will. require the need for additional policing to prevent patrons of the
disco from loitering in this area. ttestroom facilities are only access
i.ble from outside the discotheque, which are the same rostrooms that. will.
be used by the other tenants of the second floor . This will also require
the freed for additional supervisory staff from the, disco .
The Staff also concurs that this is a much needed use , however, due to
parking , circulation, and security iA;r.oblems and t:he three other est:abl.i.shcd
nictht time uses within the subject center , this is not it compatible site
for such �.
7 . 0 RSCOMi•1ENOATION:
In vjew of the above information, the Staff is recontmendinq that: Cond3.tion al

Gentlemen:
The following program is submitted to you in the hope that
you may realize the immediate need of this project . Young
people of today have been stripped of activities which we
all enjoyed in our youth . The following is a tale-off oL
the old Cinnamon Cinder , which was located in Long Beach,
California , and successfully operated for six years. . The
reason for its closing was that in 1968 , with the Viet Nam
war and hard narcotics influencing young people to rebel
any organization and lose interest in group activities , all
such establishments were forced to close. In 1972 , the Viet
Nam war finally was drawn to a close; and with the police
crackdown on narcotics, we found the young people becoming
again interested in simple enjoyment, with youth game centers
opening in many communities. The largest impact responsible
:for the youth to again return to simple trouble free enjcy-
ment was due to the television media and the influencing
programs of "Happy Days" and "The Donny and Marie Gsmond
Variety dhow" . The young people, once again, are in search
of entertainment strictly designed for them. With summar �
vacation rapidly approaching, the following Frogram is de-
signed to give the ,young people a place that they can go to
dance, enjoy, and meet new friends . With the following pro-
gram, youths will concentrate for enjoyment, rather that
seeking uut shopping malls to cure their boredorr+.

Cigarette Smokinq :
During the early hours , the younger group ages (14 through
seventeen years) will not be allowed to smoke within club.
No ash trays will be distributed . Cigarette smoking will
be permitted during later hours with ages 18 through 20
years . No cigarettes will be ;gold on our premises at any
time .

During hours there will be a club manager, assistant mana-
ger and snack bar attendant, all of whom will be over the
age of 21 . Also, there will be two waitresses and a disc
jockey who must be at least 18 years of age . In addition
to our staff within club, we will have 2 security men
covering exterior areas .

Parking :
More than sufficient parking exists for this project, as
we have designed our hours of operation to r3quire non-
driving youths attendance during ether tenants ' business
hours. Youths of driving, age will be attending club during
later evening hours .
We would like to emphasize that special consideration
should be taken by the City of Huntington beach when cal-
culating required parking. This request is due to the
fact that unlike adult night: clubs where many singles
attend and drive their automobiles , the young people will
be accompanied by friends who will occupy the same ve-
hicle, therefore greatly increasing the persons attending
over the amount of parking spaces. We understand the code
requires 1 parking space for every 3 persons and urge your
` consideration to calculate 1 parking space for every 4
persons.

Club Security:
The manager will be in the manager ' s office with continuous
observation of interior activities through the use of three
closed circuit cameras . He is also in touch with the two
exterior security guards by walky-talkies. The office will
be equipped with three emergency buzzer systems that may
be turned on by either the identification , snack bar
attendants, as well as the disc jockey. This buzzer sys-
tem will only be used when police assistance i:3 required,
allowing the manager to mare the call without any delay.
The snack bar, identification and disc jockey attendants
'. are located in key areas in order to oversee all activities .
The exterior security guards will be continuously observing
stores within the shopping center and parking areas . They
will keep youth, from loitering around exterior walkways
and parking areas . In tl-.e event assistance is needed,
they will communicate with manager ' , office through walky-
talkies. Waitresses will continually serve tables and
clean tables.
Dance Contests :
Every Saturday evening the club will hold a dance contest.
The judges will be randomly selected out of. the audience .
Contest winners will receive gift certit:ic, -es purchased
by the club management from nearby retail stores.
A monthly contest; consisting of the weekly contest winners
will be held with contestants competing for a free stereo
donated by the club management.
Daytime Use:
We will offer the facilities for rent to local women, titan,
bridge clubs , etc . , for meet•.Lngs only. During dayL*L!11 0
hours (before. 6 : 00 p.m. ) the sound system will not. '.ae used.

The references: property is situated adjacent to the Fountain V.71ley
City Limit lines and .lies in proxitnity to several Food sized commercial
complexes within the City of Fountain Valley. It has always; been the
City of Fountain Valley's post:-ion, as I have interprCLcd it in discussions
with our. Planning Commission, that a teenrgv discotheque or something
of this sort is not an appropriate use within a neighborhood ,hopping,
center. Parking and policing problems nssoclatvd with a teenage. disco-
theque simply make the rise incompatible w*.th.in the rather confined shopping
center setting;.
Unfortunately, the scheduled hearing; date is prior to our next. Planning
Commission meeting so 1 will not have ,an orportunity to secure our
Commission's opinion regarding the specific prnprsal utiless yeti contlntiv
the item. Albeit, In my opinion, this teenas;e discotheque will. detract
from the area and should be denied. Perhaps there is a location within
the City of Huntington Beach where the use could he situated in a free-
standing building, relatively isolated from coiimierci.al and residential
neighbors.

will downplay the problems and give an indication that they can handle the situation.
The experience of the Police Department is that the City has no guarantee that the

Dear Mayor and :vfuinl)ers of thrs City Council:
It was recently brought to my attention that a permit
ha3 been issued for a teen-age disco (Saturday Night Fever, I believe)
on the corner of Warner and Magnolia. I wag alarmed to loarn that this
was done in spite of protests by the police over the traffic congestion and •
possible loitering, littering, vandalism, and even drug and alcohol abuse.
`onsequently, I launched my own investigation into this to
1 earn that there was, indeed, cause for concern. I am sure by now you
are aware of the problems that exist in relation to other such establieh-
ments in neighboring cities. I am sure, also, that you have investigated
the location and have learned that the parking lot is not large enough to handle
r without in w� ss ., t
the traffic ith ut interfering with the operation of other busine a �.n that
center.
I hope, also, you know that many citizens are oppooed to the
kinds of problems that such an establishment seems to attract. I want to
have my name registered as one. I do not feel we need these kinds of prob-
lems in Huntington Beach.
I trust that the city council will act in a responsible manner and
vote to repeal this permit before we have in our city thekinds of problems
they have had in others.

city of Orange regarding the problems they havo had with the 'Peen Disco
there, whose lieenss they axe currently trying, unsuccessfully, to have
