J Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions: --AU STATEMENT OF ISSUE The City Council granted a reconsideration of Conditional Use Permit No. 78-13 and Tentative Tract 10414 at its September 18 , 1978 meeting, and pursuant to the staff recommendation a new public hearing was scheduled to review subject items at the October 16 , 1978 City Council meeting. i RECOM2•IENDATIOh : Deny Conditional Use Permit 78-13 & Tentative Tract 10414 As stated in my September 12 , 1978 communication to the Council , which is attached herewith, the reconsideration and action by the Council is discretionary . At its September 18 meeting the Council asked if the Planning Department would change the recommendation for approval on the proposed project. As z stated at that time I believe the Planning Depart- ment has to be consistent in its recommendation and that although the project is a desirable project a change it our recommendation could very well set a precedent that could affect future requests for small planned developments which may not be as desirable as the subject matter before you. Therefore, the Planning Department is. not prepared to change its _recommendation_ on•„this .prt,ject because of this precedent that we feel would bo' established and adversely affect staff working on future development of a~similar nature. .....:jOC�h;.whAtdYl�ifi�..i/+a.;.:.... -.. ... .. ... . ...... ... ...._ .... ..... ..� ..... .... ...... . . _ ......«...r. Gar..... ANALYSIS The developer, Mr. McKeighen, has revised his preliminary grading plans for his six unit planned development located on the north-, side of Los Patos between Lynn and Sims stree;:s. This revised grading plan has been checked by the City Grading Engineer as well as the Planning Department and has been found to greatly reduce the impacts of the proposed project upon the surrounding properties . This reduction in grade has been accomplished through the use of easements from subject property easterly to Lynn to accommodate surface drainage rather thzn to drain the total no 3M 0 CUP 78-13 AND TT 1041 Page 2 Site to Los Patos as was originally proposed. This reduced elevation also reduces to approximately 2 feet differential in grade between the proposed project and the surrounding properties which was of great concern when originally reviewed by the Planning Commission as well as the City Council at the time the Council sustained the decision of the Planning Commission for denial on this project. As of this date we have not received any copies from Mr. McKeighen of what we consider to be a bona fide offer fol.- acguisinion of the hold out parcel immediately adjacent to and on the west side of his entry from Los Patos Avenue. However, we have been informed that such copy of a letter is forthcoming . We have also investigated the ownership pattern of the surrounding properties and have found that no land locked parcel would be created by the construction of this proposed project, although the Assessor ' s Map shows a separate parcel immediately north of the proposed project. This separate parcel is at the present time under the same ownership as the parcel immediately east and abutting upon Lynn Street. There- fore, a project could be constructed upon these two parcels with access to Lynn Street without creating a land locked parcel. i i ALTERNATIVE ACTION Overrule the decision of the Planning Commission and approve Conditional Use Permit 78-13 and Tentative Tract 10414 subject to the necessary findings and cond:LLions of approval which will be pre- pared and presented to the City Council at its October 16 , 1978 meeting. Palin, Acting Planning Director DATE: September 12, 1978 SUBJECT: James McKeighen letter dated September 11, 1978 requesting reconsideration of Conditional Use Permit 78-13 and Tentative Tract 10414 Mr. Belsito has requested that I include supplemental information to the City Council on Mr . Mcheighen ' s request for reconsideration of the City Council action on September 5, 1978 , at which time the City Council sus- tained the decision of the Planning Commission and denied Conditional Use Permit 78-13 and Tentative Tract 10414 for a six unit planned develop-- meat located on the north side of Los Pantos . On September 11 Mr. McKeighen dropped by the Planning Department office and informed me that subsequent to the City Council 'S actions he had discussed his project with a couple of members of the City Council and indicated that there evidently was a misunderstanding of the Council on certain aspects of the development . He requested information , on an approach to get the item back before the City Council and I suSgested that he write a communication to you requesting such reconsideration and to state new facts as to why a re- consideration had merit. In our discussion I indicated that one of the major objections that the Planning Department originally had on this development was t::e massive wall required along the northerly porticn of his property to allow all surface drainage to flow southerly to Los Patos . Mr. McKeighen indicated that he had resolved this drainage problem and that the northerly portion of the property could be lowered through the use of drainage east within existing easements, thereby reducing the impacts of a massive retaining and perimeter wall on abutting properties. I also stated that should the City have to recognize prior lot configuration upon this property that Mr . McKeighen had consolidated. a less desirable project would be constructed through the use of the existing private easements. I also stated that the Planning Department would not oppose a reconsideration by the Council. however , such action is certainly discretionary. .. To date thu staff recommendations on this development have not changed nor 111.11 the staff recommendations change until such time as sufficient documentation has been submitted for review by the department to assure that drainage can properly be accommodated over the existing easements and that the drainage for the property would crown approximately 1/3 of � the depth of the property north of Los Patos to Lessen the impacts of , Page , Z this p bj'ect upon surrounding properties . Belsito City Administrator City of Huntington Beach 2000 Main Street Huntington Beach, California 92648 Subject: Conditional Use Permit No. 78-13 Tentative Tract No. 10414 Dear Mr. Belsito: At the suggestion of Mr. James Palin, Acting Planning Director, Z am submitting this request for a reconsideration by the City Council for approval of the above applications. One of the questions that arose in several of the Council members ' minds was that the development might create land locked lots. Please be advised that surveyors parcels No. 25 and No. 26 are owned by the same individual and that immediately opposite parcels 60 and 61 are likewise owned by a single individual , and in fact a home is presently constructed on parcel 61. Over the past months we have worked very diligently in an effort to solve our joint problem as to how to best develop these interior lots. We have successfully solved all the drainage problems through discussions with Mr. Ullrich Stenzel in the Building Department. As the enclosed phut,�graph will show, there is no further develop- ment possible in the westerly direction. There is also no further development possible in the easterly direction due to present litigation involving parcel 34 . On the Los Patos frontage parcel 31 can be purchased for about $85 ,000 which of course only means that the present owner has no desire to sell. Parcel 38 , which is the only other possible direction for development, can not be purchased at any price. In summing up the above, we reel we have made a significant contri- bution to the Planning Department' s problems concerning these interior lots and their development, and as can readily be seen there is simply no direction in which we can acquire additional property. This issue was the principle matter of consideration at the Subdivision Committee meeting . Discussion centered on the possible land use impacts approval of this map would have in relation to future development options in the immediate area and as a precedent-setting action for this; type of development in the future. The staff cited c-)ncerns that the project would tend to limit potential for development of the surrounding properties in a desirable configuration, that approval of th - map may inhibit future consolidation of property in the area and that projects with such -mall frontages would increase the number of access points in the vicinity .. his p..'-�iject alone would rto,. preclude development of adjacent parcels . f land but would diminish the capacity of the parcels to be consolidated a P I into larger, more uniform sized wrojects . The staff' s policy in regard to development proposals in the area has been to strongly encourage the consolidation of land to create symmetrical project sites . The Committee could not reach a cor,census agreement: in regard to the degree of possible impacts this project may pose. In view of the size of the 'project area there was not total agreement that the arguments discussed in section would be precedent setting or that significant a problem -to the area . The Committee requested the staff to provide thew.:- analysis of the issue as a basis for a recommendation to the Planning Commission. • 7 . 2 SEWERS: The . applicant was informed that sewer hookupscould not take place until the Phase 11 portion .o.f the relief sewer on Warner Avenue has boon completed. The Department of Public Works estimates that a minimum. of 12 months or longer will be necessary to provide sewer service br.caupe of economic' constraint, in the Country Sanitation District ' s program. Under the special permit provisions of the Ordinance Code, the Planning Commission m&y apprcve reductions from minimum regulations provided thz-.t (a) the project will promote better living environments, (b) the project will provide better land planning techniques with maximum use of aesthetically pleasing types of architecture landscaping site layout and design, (c) the project will not be detrimental to the general health, welfare, safety and convenience of the neighborhood and City in general nor detrimental or injurious to the value of property or improvements of the neighborhood or of the City in general, (d) the project would be consistent with objectives of planned development standards in achieving a development adapted to the terrain and compatible with the surrounding environment. It was the concensus of the Committee that the design of the development adheres to these criteria and is therefore justifiable. Access to the project via a 20 foot drive does not meet Fire Code i standards. If the Planning Commission wishes to approve the project , an acceptable alternative to meeting the code would be to require the Homeowners Association to post and enforce no parking along the proposed drive area . if the Planning Commission desires to approve the project, a condition of approval reflecting this alternative will be drafted . Grading of the property was discussed. In order to drain toward Los Patos Avenue, raising: the property from the north mus4% be accomplished. A resulting retaining wall. of approximately five -Zeet would then be necessary around the northerly perimeter of the property. This impact was not a substantial issue in view of the amount of vacant land sur- rounding the property, however , the staff believes the developer :7hould further demonstrate that the relationship of this g::ade differential would not be detrimental to adjacent properties . This cuuld be accomplished through the use of cross sections and plotting of adjacent parcel elevations. 8 . 0 RECOMMENDATION: The staff recommends adoption of.
