Re: Release of the Guarantee and Warranty Bond for Tract Nos. 15037, 15081 & 15085
Please be advised that on Monday, November 19, 2001 the City Council of the City of
Huntington Beach took the following action;
(City Council) Approved the Release of the Guarantee and Warranty Bonds
(Maintenance Bonds) for Tracts No. 15037, 15081 and 15085—Turnberry Huntington
Beach, LLC — s/s Summit Drive, e/o Seapoint Avenue — (Holly-Seacliff Specific Plan)
(420.60) —1. Released Maintenance Bonds No. 3 SM 984 206 00, 3 SM 984 208 00 and
3 SM 984 207 00 the security furnished for guarantee and warranty of improvements
(American Motorists Insurance Co.); and 2. Instructed the City Clerk to notify the developer,
Turnberry Huntington Beach, LLC, of this action, and the City Treasurer to notify the Surety,
American Motorists Insurance Company, of this action.

SUBJECT: Approve the Release of the Guarantee and Warranty Bonds for Tracts
No. 15085, 15081 & 15037
Statement of Issue, Funding Source, Recommended Action, Alternative Action(s), Analysis, Environmental Status, Attachment(s)
Statement of Issue: Sufficient time has elapsed since the acceptance of improvements for
Tracts No. 15085, 15081 & 15037 located south side of Summit Drive, east of Seapoint
Avenue. The Guarantee and Warranty Bonds provided by the developer, Turnberry
Huntington Beach, LLC, as the security furnished for guarantee and warranty of
improvements are eligible for release.
Funding Source: Not applicable.
Recommended Action: Motion to:
1. Release Maintenance Bonds No. 3 SM 984 206 00, 3 SM 984 208 00 & 3 SM 984 207 00
the security furnished for guarantee and warranty of improvements; and
2. Instruct the City Clerk to notify the developer,Turnberry Huntington Beach, LLC, of this
action, and the City Treasurer to notify the Surety, American Motorists Insurance
Company, of this action.
Alternative Action(s): Deny the recommended action.
Analysis: The City . Council, on September 5, 2000, accepted the improvements
constructed and dedicated for public use within Tracts No. 15085, 15081 & 15037 and
accepted Maintenance Bonds No. 3 SM 984 206 00, 3 SM 984 208 00 & 3 SM 984 207 00;

the security furnished for guarantee and warranty of improvements. California Government
Code Section 66499.3(d) requires that security for the guarantee and warranty of the
improvements be posted upon acceptance of the public improvements, and that the security
remain in effect for a period of not less than one year. Public improvements constructed
consist of the domestic water system and appurtenances within the private streets.
The required time period has elapsed and the City Engineer has determined that the
improvements have been constructed in substantial compliance with the approved plans and
specifications, and recommends release of the security.
