Use Permit No. 79-8 is a request by the applicant to establish a growing ground and wholesale nursery in a portion of the Southern California Edison Power Line Easement. This proposed facility will be located on the south side of Heil Avenue, approxi- mately _1Q 0 0 feet south to the Orange County Flood Control Channel and approximately 190 feet in width. 3 . 0 SUMMARY OF ISSUES: The typical issues related to this type of use located adjacent to residential dwellings are : 1. Hours of operation to be confined to normal business hours. . . r 2. Requirements for the precaution of plant material placement, soils and soil amendment placement, and spraying for insects. 3. Allowing only wholesale operation to take place on site . CUP 79-8%ND 79-20 Page `•Two 4 . 0 ENVIRONMENTAL .STATUS: Pursuant to environmental. regulations in effect at this time, the Planning Department posted Negative Declaration No. 79-20 for a 10-day period. This negative declaration was published in the Huntinciton Beach Independent and posted in the Office of the City Clerk on March 9 , 1979 and ran until March 19 , 1979 . All comments received either written or oral , have brjen attached to this report for the Commission' s review. In addition , the Planning Department has drafted Negative Declaration No. 79-20, which is also attached for the Planning Commission ' s review as required by Section 15083 (c) (4) of the .State Guidelines of the California Environmental Quality Act. The initial study information is attached to the negative declaration and documentation in support of the findings . Prior: to action on this conditional use permit, it is necessary for the Planning Commission to receive and review comments on, and adopt Negative Declaration No. 79-20 in conjunction with Conditional Use Permit No. 79-8 . 5_,_0 _ SURIj_GUNDING LAND USE, 20NING,T AND GENERAL PLAN DESIGNATION : The subject property is located on the south side of Heil between Newland Street and Magnolia Street and extends approximately 1900 feet south to the Orange County Flood Control Channel . 'Phis property is presently zoned R1 and is designated on the General Plan as low density residential . The subjer_t property is vacant of development except for the Southern California Edison High Tensiop, Power Lines . n'he properties located to the north of: the subject site, across Heil Avenue, are located within the fountain Valley City Limits and are presently developed with single family dwellings . 'i'he portion of the Edison right-of-way extending north from Heil Avenue is presently developed as a wholesale nursery and growing around. The prnpc;:ties surrounding the subject: site on the west, south, and east are designated on the General Plan , zoned , and developed with low density residential. 6. 0 A14ALYSIS The proposed operation consists of the storage of and the (Irow ng of nursery Plants and stock. This pror,c)sed facility will. utilize the land directly below the Southern California Edi -�on High Voltage Lines . � The proposed operation is a cottinon land use for many of the Edison ; right-of-ways in the neneral area . In the past several nears , no major cotr,nlaints have beEn filed with the .Planning Department by the residents that residp. next to or near one of the existing similar facilities . Only plant materials lower than the fence height that separates the residential uses from the nursery be located next to those portions of the nursery abutting residential uses. 2. Taller trees and shrubs be located in the center of the facility to reduce the major portion of overspray that may result when spraying insecticides on these plant materials . 3 . The bulk soils and soil amendments, such as redwood compost, fertilizers, etc. also, be stored at maximum distance from any property line abutting residential property. These soil amend- ments and planting mixes should be kept damp to minimize the possibility of such materials blowing onto adjacent properties. 4 . The straying of insecticides and liquid fertilizers be done in a manner that will insure the safety of the adjacent property owners . This can be accomplished by spraying from the property line into the premises of: the site or inward away from residential properties, and to utilize the prevailing ~,rind direction to mini- mize oversp_aying . 5. To limit the hours of operation to only normal business hours and From Monday through Saturday only. This would also include the movement and/or trucking of any of the plant materials. In conclusion, the pr.op�-sed operation , when maintained properly and operated with precautioi,s, provides for a compatible land use to abutting residential neighborhoods. The placement of plant materials and trees on the subject site will be a N-isual improvement and will. also aid in the control of weeds and rodents. 7.0 RECOMMENDATION: Based on the above information and the following findings , the staff is recommending that Negative Declaration No . 79-20 be approved and Conditional Use Permit No . 79-B be conditionally approved . The staff offers th^ following conditions and findings for the Commission ' s consideration. FINDINGS: 1. The Proposed use is compatible with the surrounding land uses . 2. The proposed use. when operated with precaution , results in a positive environmental effect, , includi.ng weed and rodent control and an improvement-, in the vi s:ual aesthetics of the site. 3. 1 The subject site is adequate to serve the proposed use. AYES: Higgins , Russell, Stern, Finley, Cohen, Bazil, Paone NOES: Nune ABSENT: None ABSTAIN: hone Discussion : Conditional Use Permit No. 79-8 is a request to establish a whole- sale nursery and growing ground within the Edison easement right- of-way that is presently unoccupied and undeveloped. The proposed operation consists of the storage of and growing of nursery plants and stock. This proposed facility will utilize the land directly below the Southern California Edison high voltage lines. The pro- posed operation is a common land use for many of the Edison rights-of-way in the general area. The appellant has indicated in her letter of appeal that the nega- tive declaration submitted for the project did not identify all of the environmental effects created by the proposed use. However, the negative declaration was posted for the prescribed length of time and in the prescribed manner, and no comments were received on Negative Declaration No. 79-20. .I The Planning Departments: 6taff report identified several areas of concern that are comm.:�n with this type of use . It further discussed measures that would mitigate the majority, if not all, of the issues involved with a nursery within --,lose proximity to residential units. The Planning Commission upon approval of the proposed use conditioned this conditional use permit to further ensure that any problems with the proposed use would be held to a minimum if not completely eliminated. The analysis section of the attached staff re-aort concluded with the following statement: The proposed operation; when maintained properly and operated with precautions, provides for a compatible land use to abutting residential neighborhoods . The placement of plant materials and trees on the subject site will bz a visual im- provement and will also aid in controlling weeds and rodents. ENVIRONMENTAL STATUS: Conditional Use Permit No. 79-8 was assessed for environmental impacts by Negative Declaration No. 79-20. Negative Declaration No. 79-20 was posted on March 9 , 1979 in the office of the City Clerk and was also advertised in the Huntington Beach Independent at the same time. As of March 19 , 1979 , the end of the prescribed posting period, no comments had been received in writing or orally.
