CONDITIONS OF APPROVAL: i• 1. Site plan Noted "C" , received and dated September .29 , 1.979, shall be the approved layout. The applicant will be required to file a conditional exception with the Board of zoning Adjustments in order to allow a five (5) foot encroachment into the front yard setback for the proposed racquetball facility. 2. All facilities, both existing and proposed, shall be brought into compliance with all requirements of the Huntington Beach Fire Department as set forth below: a. The existing drive at the west property line must remain for adjacent emergency access and circulation. The project must also be signed for parking control as required by the Fire ' Department. b. The entire club facility containing the restaurant, offices , guest rooms , etc. , shall be fire sprinklered throughout, as per Huntington Beach Fire and Building Codes . c. Use Permit No. 79-20 to a date certain to permit the applicant time to develop plans in compliance with the Huntington Beech Ordinance Code. Commissioner Bazil spoke against this motion, noting that it ie tanta- mount to denial , because without the consideration for mixed rise parking the project cannot be constructed . Motion failed for lack of a second. A motion was made by Commissioner Bazil to continue the application to the next regular meeting of October 16 , 1979 for decision only. The Cnminission conferred with legal counsel to ascertain the result to. the application if four affirmative votes are not obtained for any motion, and was advised that failure to act within the mandatory pro- cessing date would result in automatic denial of the project unless the proponents agreed to a continuance. Mr. Georges stated further that this automatic denial still provides the proponent with the opportunity to appeal to the City Council . Mr. French was called to the podium and advised the Commission that: he is not willing to accept anothzt: continuance. RECOMMENDATION: The Planning commission recommends that the City Council upheld its decision on the approval of Negative Declaraticn No. 79-52 and denial of Conditional Use Permit No. 79-20. The Planning staff recommends that the City Council approve both the Negative Declaration and the Conditional Use Permit with conditions outlined in this transmittal. BY BAZIL NEGATIVE DECLARATION NO. 79-52 WAS ADOPTED BY THE FOLLOWING VOTE: AYES: Higgins , Russell, Cohen, Bazil NOES: None ABSENT: Stern ABSTAIN: Paone Due to the Planning Commission ' s inability to obtain four affirmative votes to either approve or deny Conditional Use Permit No. 79-20 and the applicant ' s unwillingness to accept another continuation on said application , Conditional Use Permit No. 79-20 was deemed denied. (See attached Planning Commission minutes of October 2, 1979 . ) DISCUSSION: In July of this year, the owners of the Huntington Harbour Bay and Racquet Club applied to the Planning Commission for a conditional use permit and a request for a negative declaration in order to permit the expansion and remodeling of the existing bay and racquet club facility. Said expansion included the construction of a five-court racquetball facility, relocation of two existing tennis courts located on Warner Avenue to the eastern end of the property and the addition of one new tennis court, the addition of four guest rooms to be located over the existing men ' s locker room, 6 , 000 ± square footage of addition to the existing restaurant and clubhouse facility , the rearrangement of ehe two fingers of boat slips located at the east end of the facility and the addition of approximately 26 additional slips , the addition of a whirlpool spa on the Existing pool deck , the rearrangement of the existing parking lot and a 920-foot guest dock . The Planning Commission held a public hearing on these applications at three Planning Commission meetings . On October 2 , 1979 , the Planning Commission adopted Negative Declaration No. 79-52 . It was the Planning Commission' s determination at that time that adequate information had been submitted by the applicant regarding the proposed project and that a negative declaration was appropriate and that no further environmental assessment need be made on the proposed project. The appellant, Feldsott & Lee, appealed the Planning Commission ' s decision on behalf of objecting homeowners in the general area. These homeowners expressed a number of concerns related to the proposed expansion, which included the reduction of present onsite parking; the increase in the number of boat slips ; and the permitted relocation to, or additional courts being constructed, in or about the parking area by Edgewater and Courtney Lanes. However, the attorney for the objecting homeowners indicated by telephone that their main reason for appealing the Planning Commission ' s approval of Negative Declara- tion No. 79-52 is due to the already poor water duality of the bay --------------------- too-, Page 3 ti. - . sa.y riiM..Y...x..r..,•,r ........ ..:i;... ....•s ,.. ,•c,...._. .— _. .,,..,r.. . .. . .. . ....,. . . . . . . a nd their feeling that the construction of additional boat slips would further: deteriorate the water quality. 1 During the Planning Commission ' s hearings on said application, this concern of the poor water quality in the bay was expressed by the Commission. Therefore , one of the proposed conditions of approval suggested by the staff to the Commission was that a pumpout system or systems be installed adequate to accommodate the total number of boats that can be docked or moored in the proposed facility. The staff feels that this condition would have helped to mitigate some of the problems that are cause of the deteriorated water quality in the bay. Some of this poor water quality problem is caused by inadequate tidal flow in the harbor area. The applicant appealed the denial of Condition=l Use Permit Plo. ' ')--20 based on the fact that the Planning Commission could not obtain adequate votes to either approve or deny said application. However, the applicant has requested that the City Council consider for the appeal only one of the three original alternatives presented to the Planning Commission. This alternative is the one that did not relocate the tennis courts that are presently existing along warner Avenue. All three of the presented alternatives have a deficiency in parking , ranging from 20 to 25 percent below that which is required by code; however, the alternative the applicant is requesting the City Council 4o review is the .least deficient in parking . This plan provides for 263 parking spaces , which is 20 percent below the combined parking requirements for all of the uses located on the site . In addition to the addition of four guest rooms over the existing men ` s locker room, the addition to the existing restaurant and clubhouse facility, the addition of a spa whirlpool , and the 420 feet of guest dock, this plan locates the proposed five-court racquetball facility at the west end of the project adjacent to the clubhouse facility. This plan indicates that there are 18 additional boat slips added , and it also provides for a 245-foot diameter turning area at the east end of the bay. The staff originally recommended conditional approval of this site plan to the Planning Commission . Attached are the minutes from the October 2 , 1979 Planning Commission meeting. Included in these minutes are suggested findings and conditions of approval on the proposed project. The Planning staff is recommending that , if the City Council wishes to approve Conditional Use Permit No. 79-20 , the conditions as stated be imposed on the proposed project, except for a modification of Condition No. 9 . The staff is recommending that this condition be changed to read as follows : 9 . A five (5) foot wide sidewalk shall be installed along the right-of-way on Warner Avenue, at such time Werner is dedicated and improved to its ultimate right-of-way width.. ENVIRONMENTAL STATUS : Discussed under the "discussion" section of this transmittal was in- formation on the environmental status of this project. The Negative Declaration was posted in the office of the City Clerk and with the al 'Appeal - C.U.P. 79�20/N 79-52 .Octobe'r- -26 , 1979 Page 4 . Huntington Beach Independent for the prescribed period of time. Any comments received, either in writing or orally, have been included in the attached staff report. A`11 of the mitigating measures set forth as a result of the enviran- mental . review process have been included as suggested conditions of. approval on the subject project. FUNDING SOURCE: Not applicable.. ALTERNATIVE ACTION: The City Council may overturn the Planning Commission ' s approval of. Negative Declaration No. 79-52 and require that the applicant have an environmental impact report prepared on the proposed project which would address issues of parking, water quality control , etc. The Council may also uphold the approval of the negative declaration and overturn the Commission ' s denial of Conditional Use Permit No. 79- 20 dnd approve said application with fin&inas and conditions as outlined in the Planning Commission minutes of October 2 , 1979 . Commissioner Cohen requested that the public hearing be reopened to permit members of the audience to comment on the revised plans . Chairman Higgins reopened the public hearing, requesting all speakers to restrict their comments to new information . Dennis French , applicant , requested that staff further expand on the revised plans . He also objected to the two alternative plans , saying that the people had come to the meeting tonight expecting to be presented with one plan only. Stan Feldsalt, attorney, again addressed the Commission in opposi- tion to the proposal in any form, citing contamination of the harbor, the disposition of street drainage into the bay, and the inader racy of parking on the site. Luis Cardenas addressed the Commission in support of the request and presented the original covenants under which t2:e subject properties had been purchased for the Commission ' s consideration . He also stated that many letters in support of the expansion have been directed to the Cowxtissioners from c:I uh members not present at this meeting . Firs . Walter Caine spoke in support of the proposal . M. De Lansdale , 17141 Edgewater, opposed the project because of its possible pollution , noise, and parking impacts . Joanne Kidd, 17172 Edgewater lane , also spoke in opposition to the proposal . French spoke Mr. F " in rebuttal to the issues raised. He said that he would be agreeable to no screening for the courts if it is found that it is indeed impossible to keep plastic clear and clean. He explained that the presentation of alternate plans had been made not to confuse the issue but to allow flexibility and to create a plan compatible with the club owners ' property rights as well as those of the ad-: -cent residential owners . The fact that the courts will not bk:: lighted and will be set back a dis- tance of 41 feet from the nearest dwelling unit should reduce any possible impacts , in, his opinion . Mr. French also indicated that he would oppose a condition calling for further improvements on Warner Avenue , pointing out that other developments along Warner are improved to the same degree as the club property , such as the golf course and some residential tracts . The public hearing was closed . The following extensive Comm: ssion discussion included review of k the parking , turning basin width , location of the tennis courts , and improvements or Warner Avenue. Legal counsel James Georges distributed a memorandum to the Com- mission; this communication verified his prior opinion that action on a negative declaration requires four affirmative votes . Jim Barnes addressed the three major points of concern the Com- mission had in regard to this project at its prior meeting : 1), Soils stability and chemical composition, 2) archaeological resources on the site , and 3) the drainage system. He reported that the additional information received does not contain the type of soils information which the staff feels is required. An archaeologist has been retained by the applicant; his report has been distributed to the Commission and is generally in agreement with the prior information and recommendations (i .e. , that the site ' s value has been diminished over time and that the services of a qualified archaeologist be provided during further gradinq opera- tions) . . The information submitted on the drainage is also felt by Planning and Public Works staff to be insufficient. In addition, a i communication has been rece ved from the Metropolitan Water Dis- trict, over whose adjoining property it is proposed to drain the subject site, stating that 'Ghe concentrated discharge z.s proposed is not acceptable to them but that sheet flow across their property might be allowed. Mr. Barnes informed the Commission that a decision must be made on the negative declaration within forty-five (45) days of the filing date of the application ; and action on the environmental documents for this project cannot be delayed to the next regular Planning Commission without exceeding that time limit. Frank Mola addressed the Commission to request approval of his project with such conditions the Commission may think fit to assure that their concerns are met. After the public hearing and extensive review by the Planning Commission, the Commission requested that the applicant submit revised plans that re- flected the concerns of the Commission and the concerns of the abutting property owners and that the staff prepare findings and suggested condi- tions of ,approval for the proposed project. Attached are two reNrised site plans on the proposed project. The first a:lternat.Lve relocates two tennis courts that are presently existing on Warner Avenue to the east end of the subject site. The previous sub- mittal indicated that three tennis courts would be located in this area and a racquetball facility. However, the applicant. is now providing a 41-foot separation from the existing abutting residential unit and only two .tennis courts in this location , the racquetball facility has been moved to the western end of the property near the restaurant and clubhous facility. The tennis courts have been separatel from Each other and from the abutting residential unit to provide a visual corridor for thos units on the east side of Edgewater Lane. This plan depicts the same proposed expansion for the restaurant and clubhouse facility, the four guest rooms above the existing locker facility, and 18 additional boat slips. Also depicted on this proposed plan i, a 245-foot turning radius at the east end of the channel. This plan provides 248 parking spaces which, based on the City ' s requirements, would be a 25 percent reduction of the overall requirements- for all uses. -The second alternative does not move the .tennis courts from their existing location to the east property and it relocates the racquetball, facility to the west end of the property near the restaurant and clubhouse facility. The eastern portion of the property is designated as parking . with an overall parking count of 263 spaces, this represents a 20 percent reduction of the parking requirements for all the uses. Again, on this plan there are IS additional boat slips added and the 245-foot diameter turning radius has also been provided on the proposed plan. Both site plans provide for a small boat launching winch at the east end of the site . The first alternative where the tennis courts are located at the east property line along Edgewater Lane provides a better parking distribution; however, overall less spaces, while Alternative 2 provides 16 additional parking. spaces . however , the location of the majority of those spaces is at the east end of the property some distance from the high activity areas . The applicant has indicated a preference for the first alternative with the relocation of the tennis courts to the eastern portion of the property. The applicant feels Lhat this plan would provide a better dis- tribtition of parking and an overall reduction in the congestion of the site. RECOME`dDATION: The staff is recommending that the Planning Comm-.ssion approve flegative Declaration No. 79-52 and Conditional Use Permit No. 79-20 . It is the Planning Commission ' s discretion as to which alternative they feel provides the least impact on the site and accommodates the concerns of the abutting property owners and the proponei,ts . The Eollowing is a list of findings and suggested conditions of approval that were developed as a result of the comments presented by the Planning Commission at the September 18 , 1979 meeting. r - I FINDINGS: 1. The proposed expansion of the existing Day and Racquet Club is con- sistent with the City ' s General Plan. 2 . The proposed expansion is consistent with the facility that is presently existing. 3. The proposed expansion is in substantial compliance with the exist- ing and surrounding land uses. SUGGESTED CONDITIONS OF APPROVAL: 1. The site plan .received and dated September 28 , 1979 shall be the approved layout. The applicant will be required to file a conda.- tional exception with the Board of Zoning Adjustments in order to allow a five (5a foot encroachment intothe front yard setback for the proposed racquetball facility. The relocation and addition of the tennis courts at the east end of the subject site will eliminate the visual access to the channel for those residences located on the east side of Edgewater Lane. 2 . The tennis courts located at the northernmost end of the property, abutting the residential dwelling , will create a noise problem. 3. The addition of additional slips at the eastern portion, of the bay will reduce turning radius for boaters on the bay and could create additional noise problems for abutting residents. 4 . The proposed facility has a deficiency in parking in relation. to Article 979 of the Huntington Beach Ordinance Code. 4 .0 ENVIR-ONMENTNL STATUS : Pursuant to environmental regulations in effect at this tine , the Department of Development Services posted tentative Negative • Declaration No. 79-52 for a 10--dad► period. This negative declaration was published in the Huntington Beach independent and posted in the office of the City Clerk on July 26 , 1979 and ran until August 6 , 1979 . All comments received either in writing or orally have been attaches] to the staff report for the Commission ' s review. In addition, the Planning Division has drafter] Negative Declaration No. 79-52, which is also attached for the Commission's review as required by S . 15033 (c) (4) of the State Guidelines of the California Environmental Quality Act. The initial study information is attached to the negative declaration as documentation in support of the findings . Prior to action on this conditional use permit, it is necessary for the Planning Commission to receive and review comments on and adopt Negative Declaration No. 79•-52 in conjunction with Conditional Use ` Permit No. 79--20 . As a result of the review of Negative Declaration 4 No. 79-52 a list: of mitigating measur:e5 has been completed and is included in the sugc;ested conditions of approval. 5.0 SURROUNDING ZONING, LAND USE, AND GENERAL PLAN DESIGNATION : The subject property is located an the north side of Warner Avenue between Edgewater Lane and Scepter Lane . The property is presently zoned ROS , Recreational Open Space , designated on the Lana Use Element of the General Plan as open space , and presently developed As a private recreational facility . , C.U.P. 79-20• f September 18 , 19?9 1 Page 3 The property located to the north of the subject site across the main channel and the properties located to the east of the subject site: and to the went are designated on thu General Plan , zoned and developed with R1 , Low Density Residential development. The property located to the south of the subject site; across Warner Avenue, is within the County jursidiction and is presently vacant of development. 6 .0 ANALYSIS : The Bay and Racquet club has existing since 1963. The proponents are proposing relocation of several of the facilities , addition of 36 boat slips , one new tennis court, a 5-court racquetball facility, four guest rooms above the existing men ' s lockers , approxima%:ely 420 feet of guest slip, addition to the existing restaurant and clubhouse facility, and the rearrangement of the parking facility. After analyzing the proposed plans , major issues of concern have been identified by the staff ir, relation to the relocation of the tennis courts along the easterly end of the property in an area that is presently utilized as parking , the auditional boat slips encroaching out into an area of the channel that is presently used as a turnaround , and the reduction in the number of parking spaces below the requirements of Article 979 . The applicant is proposing to relocate the two tennis courts that are presently loca;:ed along Warner Avenue to the eastern end of the j property adjacent to the single family residential unit and Edgewater Lane. These tennis courts with a minimum of a 10-foot high fence and some type of windscreening material would obstruct the view from the dwellings located on the east side of Edgewater Lane. The location of these courts would also reduce some of the existing parking ; however, additional parking will be provided for in the location where the courts are presently located. The staff is recom- mending that these courts located on the eastern portion of the property be recessed a miniraim of six (6) feet below the elevation of the existing sidewalk, with no more tLan a 4--foot high fence above the finished grade. This would help to mitigate possible noise from these courts and would also eliminate the blocking of the visual Corr.:.-'or now enjoyed by those dwellings on the east side of Edgewater. Lane. Staff further recommends that these courts not have lighting for night play. The addition of the 26 boat slips and the rearrangement of those slips at the eastern portion of the bay would reduce the turning radius of the bay at this location; therefore , the staff is recom- mending. that the two fingers of slips located at the eastern portion of the bay not be extended beyond the point of the present slips . .This will reduce the intrusion of boats next to the residential .units and will provide a larger area .for boat turnaround at this ;location. L.U .P. 79-20 September 18 , 1979 Page 4 The proposed plan presently has 237 parking spaces. Based on . 75 spaces per boat slip, the required number of parking to accommodate 182 slips is 136 spaces. This :Leaves an additional 84 spaces to accommodate the 5-court racquetball facility, which would utilize 15 spaces, and approximately 14 , 000 square feet of restaurant and clubhouse facility. Based on . the requirements for parking spaces in relation to maximum capacity , the clubhouse and restaurant facility would require 173 spaces . At maximum utilization of the entire facility, the parking requirements would be 324 spaces . The proponents are proposing 230 spaces . This is approximately a 30 percent reduction from that which is required by code. t;owever, the code does provide for a reduction in the required parking when the uses of one facility have different peak times . In the past, park- ing reductions for mixed use projects such as this one have ranged between 20 and 25 percent. It is the staff ' s feeling that with the water orientation and the addition of some 400+ .feet of guest docking the proposed project will be adequate in the number of park- ing spaces. . `the Fire Department has responded to the proposed site plan and has required that certain fire protection measures be taken. These re- quirements include fire sprinklers throughout the entire clubhouse and restaurant facility, fire protection standpipes for the boat dock facilities/ and the addition o` fire hydrants along Warner Avenu!.
