I tii�ne,ture j i - --- ---- - - -/ e..r.wn C,►r aA-r - STAFF REPORT CUP -25 3.0 ' SUMMARY OF ISSUES : Major issues of concern regarding Conditional Use Permit No. 79--25 are as follows: 1) The adequacy of existing parking to accommodate the proposed use. 2) The compatibility of the proposed use wit) :surrounding land uses. 4. 0 ENVIRONMENTAL STATUS : The proposed use is within can existing industrial complex. with the only new construction being min^r interior alterations ; therefore , pursuant to Section 15101 of the State EIR Guidelines, the project is categorically exempt. 5. 0 SURROUNDING LAND USE, ZONING, AND GENERAL PUN DESIGNATION: Properties surrounding the subject site are zoned M-1, Light Manufacturing and are designated on the General Plan as General Industrial. The properties to the north and south are vacant, and the properties to the east and west are developed l.ighc industrial. 6. 0 ANALYSIS : The proposed karate studio will utilize 1381 square feet of space in an existing industrial building which is one of nineteen existing buildings in a 243 , 962 square foot industrial complex. The industrial complex has a total of 394 parking spaces . Buildings fronting on Gothard Street were originally approved with a commercial parking ratio of one space for each 200 square feet of gross floor area . Because of this , staff feels that limited commercial activity on the site will not create any noticeable parking problems in the industrial complex. I The karate studio should be compatible with adjacent industrial uses � because of the limited weekly nighttime hours and Saturday hours . Instruction will be offered for members only between the hours of 4 :00 p.m. and 8 : 00 p.m. Monday through Friday, and from 1: 00 p.m. to 4 :00 p.m. on Saturday. The studio will be closed on Sunday.. The pro- posed use will not exhibit the level of activity in terms of adver- tising and traffic: volume as would many retail uses . The City has previously approved similar athletic instructional facilities located within industrial complexes and has not experienced any appreciable problems. 7.0 RECOMMENDATION: The Staff recommends approval of Conditional Use Permit No. 79-25 based on the following findings and subject to the following suggested conditions : ,STAFF .:REPORT CU* . -25 ,,.. The business license fee for a karate school is $37 . 50 annually . L::ke any industrial use permitted in the MI district, however, the karate school would also generate property tax and utility tax revenues . The only potential substantive difference between the karate school and industrial uses is in i the area of sales taxes . The karate school would produce i none wi t-h the exception of these on the indi reCt purchases made by the employees in the City . Depending upon the- type of business , industrial uses could generate no retail. sales or substantial retail sales . The way the 1•11 zoning ordina^we is presently structured to permit a wide range of uses , there is no guarantee that alternative industrial uses ;till he signifivantly superior to the karate school from a fiscal standpoint . At.=that time, the applicant requested the Planning Commission to also consider the use of the building for daytime instruction. It. was determined by Staff that parking for the proposed use during daytime hours or night-time hours would not create problems for the industrial complex because parking was originally approved at the higher commercial. parking ratio. The commercial parking ratio is one parking space for each 200 square feet of gross floor area for industrial. . Therefore, the 11381 square foot building is required to have seven (7) on site parkins; spaces. To insure that a minirrimn 'of parking problems would occur at the site, the Planning Commission imposed 3 fifteen minute separation between classes to allow students time to leave the parking lot and make room for the next class . The Planning Commission also conditioned the size of the classes to a maximum of six (6) students per daytime session (6 : 00 A.M. to 4 :00 P.M. ) and fifteen sutdents per evening session (4 : 00 P.M. to 10 :00 P.M. ) . The Department of Development Services has found that no a,,Qreciable land use problems have oc;ciirred since the Planning Commission started approving commercial recreation schools (i .e. , karate studios, ski schools , gymnastic schools and tennis schools) in the industrial districts . By conditioning the hours of operation, amo_tnt of parking and number of students per class , Staff feels that land use problems are kept to a minimum. ENVIRONN:ENTAL INFORMATION: The proposed use is within an existing industrial complex with the only new construction being minor inter=.or alterations ; therefore , pursuant to Section 15101 of the State EIR Guidelines , the project is categorically exempt. USE PERMIT NO. 79--25 A REQUEST TO ESTABLISH AND OPERATE A KARATE STUDIO IN AN EXISTING INDUSTRIAL BUILDING At the November 61 1979 Planning Commission meeting, the applicant for the proposed karate studio requested the Planning Commission to consider approval of daytime instruction as well as evening instruc- tion . At that time , Staff was requested to analyze this possibility and submit findings and recommendations . As stated in the previous Staff Report, the required parking for industrial buildings facing Gothard Street was originally approved with a commercial parking ratio of one parking space for. each 200 square feet of gross floor area. A- this ratio, the 1381 square foot industrial suite would be required to have seven (7) assigned parking spaces . Because of this, Staff feels that (6) students per session during the day would not be an unreasonable request. The applicant has also stated that many students will be dropped off after school by their parents and will not utilize any on site parking spaces .
