Califor thiR 40 Page Three CUP 8 0--21 Contained in the statement of facts were possible violations of Section 9536 (d) Screening of Outside Storage, Section 9534 (e) Block Wall. Screening Required and Illegal Expansion of the Anto ismantling/ Storage Yard. The Public works Department has also indicated that improvements to G, .thard Street have not been completed (no sidewalk) as per previous conditions of apprc.va l . The Land Use Section of the Dupartment: of Development Services stated on September 5, 1980 that the aforementioned violations have not been complied with. The City Attorney ' s office has stated that this matter will be heard in West Orange County Municipal Court on November 24, 1980. In seeking compliance with the City Attorney' s request, the applicant has been requested to file a Conditional Use Permit application with the City. In addition., the ap, licant has been requested to comply with all previous conditions of approval as stated in Conditional Use Permit No. 75-10. Section 9793 . 2 (c) of the Huntington Beach Ordinance Code requires one parking space for each five thousand (5000) square feet of gross lot area . The subject site and the existing auto disnaritling yard consist of. 34 , 209 sq. ft . of gross land area zequiring the applicant to provide Seven (7 ) on site parking spaces. Although the applicant is not proposing any additional parking stalls, the site plan approved in 1975 provided seven (7) on site parking spaces . Because the existing parking spaces meet current Ordinance Code standards, no additional on site parking is required for the proposed expansion . The staff concurs that the existing auto dismantling/storage yard is compatible with surrounding land uses , and that Further expansion of the facility will not be detrimental to surrounding land uses which include warehousing, scrap metal yard, oil tank farm, and an existing non-conforming single family dwelling . Furthermore, staff feels that the addition of an eight (8) Et. high masonry wall (in lieu of thy: pro- posed 6 ft. high wall.) and proposed landscaping will be accomplished in a manner compatible with the intent of the Civic District Suffix . 7. 0 RECOMNfENDATION: The staff recommends that the Planning Commission approve Conditional Use Permit No. 80-21 based on the following findings and subject to the following conditions. EIRRIMS 1. The . proposed expansion of the auto dismantling/storage yard is generally compatible with the surrounding land uses which are primarily industrial in. nature . Page Four CUP 80_- i 2. The proposed use is in st!bstantia.l conformance with applicable provisions of the Huntington ©each Ordinance Cede. 3 . The proposed use has adequate on-site parking to accommodate the use. CONDITIONS OF APPROVAL: 1 . The conceptual site plan received and dated ;;une 5, 1980, shall be the approved layout. (The conceptual plan is reviewed as a basic request for entitlement of the use applied for in relation to the vicinity in wh_'- ch it is proposed . The conceptual plan should not be construed as a precise plan reflecting conformance to all ordinance code requirements . ) . 2 . Prior to the issuance of building permits, a landscape• plan depicting plant type, size, location, and plan for irrigation small be sub- mitted to the Department of Uevoclopment Services for approval . 3 . No structures other than those s bown on the approved site plan shall be constructed. 4. Prior to issuance of ©wilding Permits, a Parcel Map shall be filed with the City of Huntington Beach for approval and recorded with the County of orange to consolidLt` the lots involved on the project site. 5 . Harriman Avenue, Talbert Ave. , and Gothard Street ;hall be dedicated and fully improved as required by the Department of Public WDrks . 6. An eight (8 ) ft . high decorative masonry wall shall be constructed on all s-J-?es of the proposed auto dismantling;storage yard , A solid .,ate of wall height shall be provided at the driveway opening on Harriman Ave . The materials and design of the wall and gate shall be approved by the design and review Loard prior to issuance of building permits. 7 . There shall be no stacking of storaqe materials above the height of the screening wall. 8 . The existing driveway located at the corner of Harriman and Gothard shall ze removed . 9. All previous eonditiona of approval (CUP 75-10) shall be complied with within sixty (60) days of this approval or this application shall be- conic null and void. RECCMMENDATION: The Planning Co�uniasion recommends that the City Council uphold the ` Planning Commission denial of Conditional Use Permit No. 80-21 . The Commission also recommends that the City Council adopt the findings imposed by the Planning Commission on September 15 , 1980. The staff reaffirms its decision to recommend approval of Conditional Use Permit No. 80--21 based on the findings as outlined in Section 7. 0 of the attached staff report . FOLLOWING FINDINGS BY THE FOLLOWING VOTE: FINDINGS: 1. The applicant has failed to comply with all previous conditions of approval contained in Cent?; tional Use Permit No. 75-10 . AYES: Kenefick, Bauer, Bannister, Winchell, Porter NOES: Schumachen, Greer ABSENT: None ABSTAIN: None DISCUSSION: Conditional Use Permit No. 80-21 is a request by the applicant to expand an existing auto dismantling yard and stcx-age yard originally approved by the City Council on October 6, 1975 . The expansion consists of a 13 515 s . ft . area full enclosed q Y proposed Q by a 6 ft. high decorative masonry wall. P_ 20 ft. opening is shown on the site plan which will provide access to the dismantling yard ani storage area adjacent to Harriman Avenue. A 10 ft. wide by 132. 5 ft. long landscaped planter will. separate the proposed storage/dismantling yard from Harriman Avenue. On November 21, 1979, the Land Use Section of the Department of Development Services prepared a request for prosecution regarding possible Ordinance Code violations at the subject site. Contained in the statement of facts submitted to the City Attorney 's Office on November 21, 1979 were possible violations of Section 9534 (d) Screening of Outside Storage, Section 9534 (e) Bloch Wall Screening Required and Illegal Expansion of the Auto Dismantling/ Storage Yard. In seeking compliance with the City Attorney ' s request to eliminate possible Ordinance Code violations at the subject site, the applicant was requested to file: a Conditional Use Perinit application with the Department of Development Services to allow the expansion of the existing dismantling yard. In addition to filing the Conditional Use Permit, the applicant has been requested to comply with all previous conditions of approval as stated in Conditional Use Permit No. 75-10 .
