DISCUSSION: Conditional Use Pe.-mit No. 81-3 is a request by the applicant to establish and operate a family amusement arcade within an existing building located at the northwest corner of Brookhurst Street and Hamilton Avenue. The proposed use mill utilize approximate y 1600 sq . ft. of floor I. area of a recently constructed commercial suite that is attached to an Alpha Beta Supermarket. The applicant has stated the proposed hours of operation will be j from 11 : 00 a.m. to 10: 00 p.m. Sunday through Thursday and from 11:0U a .m. to 12: 00 p.m. Friday through Sat:irday . In addition to the proposed amusement arcade, the applicant has � indicated that the following services will be offered within the � suite if the use is approved : 1. Sine of billiard supplits 2. Repair of billiard equipment 3. Sale of prepackaged ford items 4 . Sales of juices and soft drinks 5. Use of one Juke box. The following issues of concern regarding Conditional Use Permit No. 81.3 were identified by staff in the attached staff report dated February 17, 148 i. r 1. Possible noise created by the patrons, electronic games and music system. 2. They co%Vatibility of the proposed use with .surrounding land uses.. 3. Possible cohgv%stiom of patrons and bicycles adjacent to the proposed use. Page Three The existing land uses adjacent to the proposed amusement a,:cade include residential housing to the west, an Alpha Beta S"prr- market, fast food restaurant and a variety of miscellaneous commercial shops withir the shopping center. The commercial uses within this shopping center are intense uses, and the addition of an amusement arcade will increase pedestrian, bicycle and auto traffic. If the proposed use is not managed properly, loitering will also become a problem in the area of the amusement arcade. In addition to increasing tzaff is near the subject site, the staff iE concerned with the compatibility of the proposed use with the planned residential community located west of the proposed amusement center . The attraction of large numbers oc patrons to the amusement arcade will increase security problems for the shopping center and j.n the alley adjacent to the proposed use. This increase in pedestrlar traffic may spill over into the residential area -o the west creating additional security problems for the residents of Villa Pacific.- This association has previously stated their opposition to �-he pro- posed use, citing increased noise, traffic and security problems which may occur if the amusement center is approved . Staff analysis also indicates additional noise will affect the immediate area adjacent to the amusement arcade. The increased noise will be due to patrons, electronic games and a musical sound system that may be installed by the applicant. This situation will result in the 61 sraption of the residential community to the west and may cause undue tension, and conceris of security within the planned residential complex.. The facility shall be supervised at all times during operation hours by at least one attendant . 5 . The proposed use shall comply with all Building and Fire Depart- ment regulations . E . The Planning Commission reserves the right to rez3cind this Conditional Use Permit approval in the event of any violation of the applicable zoning laws; any such decision shall be preceded by ncti7e to the applicant and a public hearing , and shall be based upon sp,-:ci f is findings . It was clear that their decission to deny the permit was founded upon the staff report and not the public hearing. (c) The Development Services Staff sittinn adjacent to the Connission during the hearing would not support many of the argumerts raised by the persons who spoke against the proposed project. Nevertheless, it was apparent that the Commission ignored the facts presented by some rer,,bers of It.-he staff. (d) The land that the proposed project mould be situated on is zoned C•2 (general cormnercial ) . i In addition to the ibove reasons , I believe I was substantially mislead by the Planning Department in that when I first applied for the permit last December and presented them with ray plans for a family amuserient center I received no a indication of possible refusal . Furthermore, the Development Services Staff lead re to believe treat my proposed prof ett appeared Favorable in that it was family oriented and well situated in the shopping center. The staff member who prepared the report never told aye of such a report and furthermore, lead me to believe ne was acting on try behalf to the planning CoAmission. °_t ' '. • Predicated of the positiveness of the Planning Department , I securred a ten year lease on the proposed site , purchased store fixtures and game equipment . All of which has cost ere a great deal of rnoney. I nave been associated with the amusement business for approximately sixteen years. I know my business extrernely well and I especially know how to operate such a business as 1 propose here. If : were given some indication at the beginning as to the "general feeling" of the Planning Com , issic,, cr that there was going to be a report done by the Development Services Staff that 1 could closely follow I would have taken a different course of action. Katsampes Applicant i ;j I 1 Page 03 - Council Minutes - 4/6%81 Dennis Sigel stated that he believed that there was enough space between the EZ an RZ zones to buffer noise and that the noise could be controlled. He stated that the wall of the building facing the residential area was a fire will and would reduce the noise level . C. Lockman, .Treasurer of the Villa Pacific Community Association, stated that e commwnity experienced vandalism problems and stated his concern that the proposed amusement center would attract more young people and add to the problem. Richard 'Wilson stated that he was a private citizen and that he believed that van a Ism was created by boredom and that there was a need for an amusement center for the young people in the area . Jack Matisoff stated that he lived behind the shopping center, near the pro- posed site, that he did not object to an amusement center per se, but that he did not want one so near his property or near a residential commnity. Barbera Bunker submitted two photographs of the wall behind the shopping center stet ng that i't was less than f:�,e feet high. She substantiated Mr. Lockman' s remarks regarding the vandalism their neighborhood had experienced. Margaret Williams stated her concern regarding children that come over the fence and the anger of truck traffic in the alley. C. Washburn stated tnat he lives behind the Alpha Beta Market and that the heighMoTMe wall is five feet. He stated that he believed that the proposed amusement center would be too close to a residential area. Marlene Chiareilo stated that she was the owner of the convenience store next to e Alpha Be Marker';. She gave photographs to Council of delivery trucks � near the building when the proposed amusement center would be located and stated that she believed it was a dangerous area for young people. . Shari Schreiber stated that she` 1 i ves behind the shopping center and that e has been vandalized three times. She stated that she believes that this would be an inappropriate and dangerous vacation for an amusement tenter. NaU Dmrt stated that she was the oldest resident in Villa Pacific and re- lated vandalism incidents in the area. George Katsam em�s, appellant, stated that there was thirty-two feet of asphalt between his building and the beginning of the driveway so he did not believe there would be any problem with the delivery trucks. He stated that the machines that would be used in the amusement center would be electronic games that could : be set at low volume so that there would not be a noise problem. He stated that there was no answer to vandalism but the center would give the young people something to do and that the center would be well supervised. He suggested that . the Remit be granted and be reviewed in six months. There being no one present to speak further on the mutter and there being no further protests filed, either oral or written, the hearing was closed by the 1. Specifically, and as discussed in Mr. Katsampes ' letter to Council dated 11ovember 23 , 1981, condition number 2 states that "A sound system shall.. ,ae prohibited within th,- amusement. center" . That. condition would apparently prohibit the placement of an interior sterio system designed to play only soft background music within the business. A second condition, not mention-3 in Mr. Katsampes ' letter, is condition number 8 which states that "The west side of the building � shall'. be . illuminated without disturbing the adjacent residents" . Was the intent of said condition to Completely light up the area . b+etween 'Mr. Katsampes ' building and adjacent residential development 1n such a manner as not to cause shadowed or dark areas? Mr. Katsampes has provided a 150 watt flood lamp above the west entrance door which does not provide adequate lighting between the building and adjacent residential development. All conditions had been met and the Amusement Center has proved to be most compatible with adjacent land uses. The reason I 'm writing you is bc;:ause of condition #2, "a sound system shall be prohibited within the Amusen-ent Center." Due to the miswording of Condition 42, there has been a misunderstanding of the Council ' s intent and objective of that condition , which shall require the Council to clarify it for the Planning Department. At the timer of my applicatior., as nLy file- will indicate, I had applied for and proposed a coin operated Juke Box. This was criticized by the Council because of the possibility of loitering around the Juke Box and also the possibility of adverse Effects of loud music on the surrounding ' premises. The other fact that was pointed out, was that Juke Boxes are also coin operated and another source of income from patrons. I agreed with these comments and did not install a Juke Box. a, However, what I installed in lieu of the Juke Box was a small , non- i coin operated stereo system in order to provide low level background music when there were few or no patrons in the Center. This application of music , is most cormon in many businesses as a means to "break the ice" so to speak. The music cannot be heard outside the Q remises and furthermore the music can barely be heard inside after several machines are in play. Mr. Kirby from Planning, who conducted the review, .ould not hear the music inside the Center when he was here due to average business. In suwm ry, I need the music very much for good business reasons and further- more, it was not the intent of the Council to prohibit all forms of music, � only the form in which I applied for. The subject property located on the North side of Hamilton Avenue and West of B.rookhu.rs t Street is adjacent to our Recreational Vehicle Lot to the North and to our residences to the west. Our Community is not completely enclosed; consequently, we have young- sters from adjacent Communities trespassing on our private property in order to gain access to the Shopping Center. These youngsters have committed vandalism while passing through our Community , and our Aaso- ciation has paid thousands of dollars in structural repairs due to the i - vandalism and for professional security services. It is my understanding that there has been an application for a Conditional Use Permit, which is under consideration by you. This permit would allow the establishment of an Amusement er►terprise in the L am very much opposed to this permit being granted for the following reasons: 1. There would be an increase in the number of teenagers and young adults in and around a neighborhood shopping center. 2. This could lead to an increase in loitering, vandalism, and just plain � mischief in the center. 3. Most parents work full time in this area, and young children would be influenced by an increasing number of teenagers and young adults, in an unsupervised environment. 4 . The automobile t:raffi{='mainly young drivers would also increase, .tile presently there is a lot of foot traffic and bicycles . 5. Unfortunately, there also is an aysocittion with drugs, narcotics, tobacco, and betting in these establishments. It may not surface immediately, but eventually some exists. " BACKGROUND: At' the , April 6 , 1981 Council meeting , the Council approved Conditional Uee, Permit No. 81-3, a request to permit the establishment of a ,family amusement: arcade located at the northwest corner of Brookhurst Street and Hamilton Avenue. On December 14 , 1981, the City Council reviewed end ,`olarified two conditions which were imposed at the time of approval. One dohdition imposed at the time of approval required that the City , reserve the right to conduct an annual review of this family amusement arcade. Therefore, this information is presented to the Council in � order. ta. conduct said annual review. All of the adjacent property owners W* thin 300 feet of the project have been notified of this review. RECONWNDATION The Planning staff recommends that the City Council revoke Conditional Use Permit No. 81-3 based on the fact that the applicant has not com- plied with all of the conditions of approval and that the subject use im . not, compatible with the surrounding land uses and is creating a nuisance. DISCUSSION: The Department of Development Services, Land Use Section, conducted an inspection of the subject facility on May 31 1982 . This inspection revealed that all of the conditions of approval have not been complied with. Condition 18 which requires that the west side of. the building ,shall be illuminated without disturbing the adjacent residents has not been: complied with. The Land Use invegtigntor found that the only .i.11umination along the west side of the building is a single 150 watt Tight bulb which only Casts light within a few feet of either side of a door located directly below the light. no 4NI . Foster of the Huntington Beach Police depart ment indicated that there are certain inherent problems related to uses that attract young adults; however, this facility has not had an abnormal amount of police--related incidents in comparison to similar uses . Residents located in the condominium project adjacent to the subject use have complained a number of times to the City and have indicated that a number of youth-related incidents have been reported to the Police Department since this facility has been in operation. These residents contend that it is the family amusement arcade which attracts the children to the center and, in turn, crea tes .a problem within their condominium project. Toni Ayres, owner of Brookhurst Plaza, and the Villa Pacific Community Association adjacent to the subject arcade have submitted several petitions signed by, numerous residents in the area requesting the City Council to rescind Conditional Use Permit 81-3 . They have also submitted several incident reports and investigative reports prepared by Trail Security and Kale Investigation Agency. In conclusion, staff investigation indicates that the operator has not complied with all of the conditions of approval for Conditional Use Permit 81-3 . A finding for the approval of C.U.P. 81-3 states the family amusement center will be compatible with surrounding land uses , which are generally residential and commercial. As is indicated by the attached petitions and communications, "Games Plus" is not compatible with surrounding land uses and is creating a public nuisance . ENVIRONMENTAL STATUS: Not applicable. FUNDING SOURCE: Not applicable . ALTERNATIVE ACTION: If the City Council finds that the exisitng use is not creating a public nuisance and has basically complied with all of the previously imposed conditions of approval, the Council may choose to allow the continued use of this family amusement arcade. Our office was to observe the location for ABC board violations within 200 feet of the video arcade store with a street address of 9881 Hamilton Avenue , Huntington Beach , California, between the hours of 9 :00pm. and 1 : 00am. for Thursday, Friday , and Saturday starting March 18, 1982 . C.-Lockman, Treasurer of the Villa Pacific Community Association, stated that he community experienced vandalism problems and stated his concern that the proposed amusement center would attract more young people and add to the problem. Richard Wilson Stated that he was a private citizen and that he believed that vandalisi was created by boredom and that there was a need for an amusement center for the young people in the area. Jack Matisoff stated that he lived behind the shopping center, near the pro- pose s te, t at he did not object to an amusement center per se, but that he did not want one so near his property or near a residential community. Barbara Bunker submitted two photographs of the wall behind the shopping center i` stating twit w,.s less than five feet high. She substantiated Mr. Lockman' s remarks regarding the vandalism their neighborhood had experienced. Margaret Williams stated her concern regarding children that come over the fence an the anger of truck traffic in the alley. ,r... C. He stated that he believed that the proposed amusement center would be too close to a residential area . Marlene Chiarelio stated that she was the owner of the convenience store next to tree Alpha BFta Market. She gave photographs to Council of delivery trucks near the building when the proposed amusement center would be located and stated that she believed it was a dangerous area for young people. Shari Schreiber stated that she lives behind the shopping center and that e ias een vandalized three times. She stated that she believes that this would be an inappropriate and dangerous location for an amusement center. Mar Dewart stated that she was the oldest resident in Villa Pacific and re- lated vandalism incidents in the area. Goo a Katsam es, appellant, stated that there was thirty-two feet of asphalt wean his building and the beginningof the driveway so he did not believe y problem with the there would be an delivery trucks. He stated that the machines that would he used in the amusement center would be electronic games that could be set at low volume so that there would not be a noise problem. The family amusement center will be compatible with surrounding r , land uses which are generally residential and commerical if the following conditions of approval are adopted by the City Council . 2. A sound system shall be prohibited within the amusement center. 3. A bicycle rack capable of holding six (6) bicycles shall be pro- vided in front of the amusement center. 4. The facility shall be supervised at all times during operation hours by at least one adult attendant. 5. The proposed use shall comply with all Building and Fire Depart- ment regulations. 6 . The City reserves the right to. review this conditional use permit for possible rescission of entitlement in the event of failure to comply with the conditions of approval of any applicable Cit ordinances. The first review shall take place within six (6� months of beginning aeration and annually thereafter. 7. No alcoholic beverages shall be sold, distributed or allowed on the premises at any time . 3. The Land Use Investigator found that the only illumination along the west side of the building is a single 150 watt light bulb which only casts light within a few feet of either side of a door located directly below the light . A discussion with Lt. Foster of the Huntington Beach Police Depart- ment, indicated that subject use has not created any mo:e police problems than was normally found around similar uses in the City. Lt. Foster indicated that there are certain inherent problems re- lated to uses that attract young adults, however, this facility does not have an abnormal of police-related incidences . Residents located in the condominium project adjacent to the subject use, have complained a number of times to the City and have indicated that a number of youth-related incidences have been reported to the Police Department since this facility has been in operation. And , therefore, contend that it .is the Family amusement arcade which attract the children to the center and in turn, create a prolllem f within their, condominium project . This theory has not been sub- stantiated by the Huntington Beach Police Department. A representative of the homeowners associe !.ion adjacent to the subject arcade has indicated to the staff that several petitions have been prepared and signed by numerous residents in the area j requesting for the City Council to rescind Conditional Use Permit 81-3 . However, as of the preparation of this transmittal , none of this material has been submitted to the staff . In conclusion., staff investigation indicates that the operator has complied with all of the previously impose%! conditions of approval except for completely lighting the west side of the building, and that the existing use does not. contribute to youth-oriented problems any greater than any other similar type facility would.
