The properties to the south, east Lind west of the subject Property
are zoned I11, Single Family Resi.dontial and are designated Low Density
on the General Plar. . With the exception of the property located to
the south of the site, the lat: t.er areas are developed with residential
uses; this property is presently t:ei.ng utilized as an Edison Company
easement for overhead power lines. The easement is approximately 200
feet wide, and separates the family amusement center from an existing
single family hoasing development located further south.
6. 0 ANALYSIS:
At the February 18, 1981 Panning Commission meeting, the Commission
requested staff to develop locational criteria for the estabi.ishment
of family amusement centers . Based on staff analysis of the influence
of amusement centers on residential areas, the following three guide--
lines are submitted for the Punning Commission ' s consideration:

1 . Proposed amusement centers shall have no direct access to resi-
dentiO ly zoned properties .
2. Amusement centers shall be Separated from all residential property
by a qualified buffer including , but not limited to, buildings,
utility easements, permanent open space and major arterial streets .
Block walls shall not be considered as a primary buffer between
family amusement centers and residential. properties.
3 . Family amusement enterprise, shall not be, located closer than one
half (1/2) mile from the nearest amusement center.
iiA,I-r the above criteria , the proposed use would be allowed because of
the foilnwirg factors :
1 . Residential uses to the south are buffered because of the 200 ft.
Edison power line easement.
2. Magnolia Ave . serves as a buffer between the-- proposed use and the
residentially zoned properties to the east .
3 . The existing commercial building located west of the proposed use
also serves as a buffer between the family amusement center and
properties zoned residential .
Staff analysis indicates the proposed use is compatible with surrounjin

land uses, which are generally commercial . However, as a precaution
against possible noise, the staff suggests prohibiting any type of
sound system within the building .
Although the five ( 5 ) on-site parking spaces available to serve the
proposed family amusement center are adequate, it is recommended that
the applicant be required to place a bicycle rack adjacent to the
amusement center to prevent congestion on the sidewalk.
1 . 0 RECO&MENDATION:
Vased on th-a above analysis and the following Eindinc;s, the staff
recorraciends that the Planning Commission approve Conditional Ilse Permit
No. 81--5 .
ND-INGS:
1. The proposed use is generally compatible with surrounding land uses
based on the above locational criteria and if the following con-
ditions are adopted by the Planning Commission .

STATEMENT OF ISSUE:
Transmitted for consideration is an appeal to the Planning Commission ' s
denial of Conditional Use Permit No. 81-5 , a request to allow the
establishment of a family amusement arcade . The proposed site is
located west of Magnolia Street , approximately 725 ft . south of
Garfield Avenue.
RE('11OMMENUATION:
The Manning Commission recommends that the City Council uphold the
Planning Commission ' s denial of Conditional Use Permit No. 81-5 . The
Commission also recommends that the City Council adopt the findings
imposed by the Planning Commission on March 3, 1981 .
The staff ' s recommendation was for approval of Conditional Use Permit
No. 81-5 based on the analysis found in Sec'--ion 6 . 0 of the attached
staff report.

FITIDINGS FOR DENIAL:
1. The us" it permitted would attract persons from the residential
tracts across Magnolia Avenue to the east, thereby adding
pedestrian traffic to the already hazardous condition of the
entrance to this shopping center. This would result in an
unacceptable impact on the safety acid Welfare of the adjacent
community .
DISCUSSION:
Conditional Use Permit No. 81-5 is a request to establish a .family
amusement arcade in an existing shopping center suite located west.
of Magnolia Avenue , approximately 725 .feet south of Garfield Avenue.
If approved , the amusement arcade would utilize approximately 900
sq. ft . of floor area for miscellaneous electronic games and three
vending machinea for use by the patrons . The proposed hours of
operation for the amusement arcade will be from 12 : 00 noon to j
10: 00 P ,M. Sunday through Thursday and 10 :00 A.M. to 12 : 00 P .M.
Friday, Saturday, and holidays .
At the February 18 , 1981 Planning Commission meeting , the Commission
requested staff to develop locational criteria for the establishment
of family amusement arcades . Based on staff analysis of the influence
of amusement arcades on residential areas, three guidelines were
developed to ansist the Planning Commission in making decisions
regarding the location of proposed amusement arcades . These criteria
are outlined in Section 6 . 0 of the attached Staff Report.
In denying Conditional Use Permit No. 81-5, the Planning Commission
voiced their concerns regarding pedestrian safety and traffic con-
oestion at the main entrance to the shopping center . Pedestrian
traffic from the residential tracts located to the east of t'le proposed
amusement arcade would increase due to the proposed use, creating add-
itional hazards in this area of the City. In addition, the Commission
was concerned with increased traffic volumes due to the amusement
arcade , and felt that this situation would result in an unacceptable
impact on the safety and welfare of the adjacent community.

ENVIRONMENTAL STATUS :
Pursuant to the provisions of the California Environmental Quality
Act, the proposed use is categorically exempt and no environmental
zeview is required.
ALTERNATIVE ACTION:
The City Council can reverce the Planning Commission ' s action and
approve Conditional Use Permit: No. 81-5 with findings and Conditions
as outlined in the attached Staff Repert.

(disapproval) on March 4, 19810 of said Conditional Use Permit by
the Planning Conanission, on each and all of the following grounds:

1. There was no evidence or testimony presented to the
Planning Commission which would support, or tend to support, the
"finding for denial" , i.e. , the Planning Commission "found" the
"use if permitted would attract persons from the residential tracts

A. When this matter was heard as Item 0-4 on the j

March 3, 1981 , page 3 thereof, unequivocally recommended
approval of Applicant' s Conditional Use Permit and specifically
supported that recommendation by finding that Applicant' s
"proposed use is generally compatible with surrounding land

The below listed tenants believe that the Planning Commission ' s reason for
denial is a sound one, "The use,,- if permitted , would attract persons from
the residential tracts across Magnolia Street to the east , thereby adding
pedestrian traffic to the already hazardous condition of the entrance to
this shopping center . This would result in an unacceptable impact on the
safety and welfare of the adjacent community . "
There are numerous other issues which would apply to fortify the reason
for denial of this permit , such as ; adequacy of on-site parking for
bicycles and vehicles , possible noise created by the proposed use ,
compatibility of the l ..eposied use with surrounding businesses , the
potential for police enforcement problems ; curfew violations , vandalism,
petty theft , commercial burglary , etc.
The Council ' s consideration of this request for denial is sincerely
appreciated .

Permit 81-5 as submitted to the Council at their regular meeting of

The below listed tenants believe that the Planning Commission ' s reason for
denial -is a sound one, "The use, if perndtted , would attract persons from
the residential tracts across Magnolia ,Street to the east, thereby adding
pedestrian traffic to the already hazardous condition of the entrance to
this shopping cert:er. This would result in an unacceptable impact on the
safety and welfare c >f the adjacent cono.unity . "
There are numerous other issues which would apply to fortify the reason
for denial of this permit, such as; adequacy of on-site parking For
bicycles and irehicles , possible noise created by the proposed use ,
compatibility of the proposed use with surrounding businesses, the
potential fer police enforcement problems ; curfew violations , vandalism,
petty theft, commercial burglary , etc.
The Council ' s consideration of this request for denial is sincerely
appreciated.
