as Outlined by staff in Section 7 . 0 of this report. The
staff also recommends that the Planning Commission deny

lined in Section 7 . 0 of this report.

Conditional Use Perm.Lt No. 82-6 is a request by the ap licant
to construct a two-story, 13 , 250 square foot self-storage and

recreational vehicle storage facility at the southwest corner
of Ernest Avenue and Steuart Street . The pro:;ect will consist
of a two-story wood framt.. building fronting on Ernest Avenue.
The storage building will contain approximately forty-seven,
100-square-foot storage units on the first floor and approximately.,
ninety--four, 50-square-foot storage units on the second floor.
Fourteen parking spaces have been provided a' jacent to the storage
building for use by patrons of the storage- Facility. Ar. additional
fifty-six spaces have been provided for parking of recreational
vehicles , travel trailers , and boats . These spaces range in

size from 8 . 5 fee ; by 17 Feet to 8 . 5 feet by 30 feet.
The main access to the project will be from Ernest Avenue, with
additional access provided on Stewart Street. A third accessway
has been provided on Stewart Street; this ,access is designated
for " fire access only" and will remain locked at all times .
Conditional Exception No . 82-07 is a request to permit 10-foot
front and exterior side yard setbacks in lieu of the required
15-foot front an.-] side yard setback. Conditional Exception
No . 82-07 is also a request to construct an 8 foot high, wood
frame wall with stucco and wood trim in lieu of the required 8 foot
high block or masonry wall .
3 . 0 SUMMARY OF ISSUES:

After reviewing Conditional Use Permit 82-6 and Conditional Ex-
ception No . 82-07 , the staff has identified the following_ issues
of concern :
1 . Whether the storage facility is compatible with surrounding
land uses .
2. Whether the applicant has demonstrated sufficient hardship to
justify approval of Conditional Exception No. F2-07 .
4 . 0 ENVIRONMENTAL STATUS : j
Pursuant to the environmental regulations in effect at this time,
the Department of Development Services posted draft Negative
Declaration No . 82-13 for 10 days , and no comments either verbal
or written were received . The staff in its initial study of the
project has recommended that a negative declaration be issued for
Conditional Use Permit No . 82-6 . Prior to any action on Conditional
Use Permit 82-6 , it is necessary for the Planning Commission to
act on Negative Declaration No. 82-13 .

Transmitted for your consideration is an appeal to the Planning Com-
mission' s conditional approval of Conditional Use Permit No . 82-6 ,
a request to permit the construction of a recreational vehicle and
self--storage facility on property located at the southwest corner of
Stewart Street: and Ernest Avenue within the MI-O-CD (Light Manufactur-

wall in lieu of the required block wall and to permit a 10-foot front

In its approval 'of Conditional Use Permit k1a . 82.-6, the Planning Com-
mission imposed the Following condition:

The applicant is appealing the above condition, stating that "the
property owner has yet to dedicate this portion of Ernest Avenue and
has an existing fence on the centerline. We have had no problem
with our existing 20 feet of Ernest Avenue insofar as the turning

The staff will work with the property owner of the northerly 10 feat
of Ernest Avenue and. recommend that he provide an easement for vehicle

We are appealing portion of Condition '#9 , where we
are to provide improvements for the northerly 10 feet
of centerline on Ernest Avenue.
The property owner has yet to dedicate this portion

centerline. We have had no problem with our existing
20 feet of Ernest Avenue insofar as the turning radius
into our existing self-storage facility.

Z. The entrance gate located on Ernest Avinue shall be relocated
to reflect a 20 foot setbacy from the property line to prevent
stacking of vehicles entering the storage faci'- - ty.
3. All building spoils, such as ,unusable lumber, wire, pipe, and
other surplus or unusable material , shall be disposed of at an
offaite facility Equipped to handle them.

4 . It lighting is included in the parking lot, energy efficient
lamps shall be used (e.g . , high pressure sodium vapor , metal
halide) . All outside lighting shall be directed to prevent

of the soil on the subject property, shall be submitted to the

6 . 0 ANALYSIS: i
The staff has reviewed Conditional Use Permit No . 82-6 and finds
that the proposed recreational vehicle storage yard and self-storage
facility will be compatible with su::rounding industrial uses.
The applicant currently owns and operates a similar facility (self-
storage only) to the west of the subject property. The layout,
design, and building materials used for the proposed p._o-iect will
be similar to those used by the developer on the existing storage
facility . Additional land uses adjacent to the proposed facility
include a storage yard and vaunt proparty. The abutting prop-
erties are all currentll, designated on the General Plan as General Industrial.
Conditional Exception No. 82-07 is a request by the applicant to
allow a 10-foot front and side yard setback in lieu of the 15-foot
setback required by Section 95A. 2 . 1 of the ordinance code. Con-
ditional. Exception No. 82-07 is also a request to allow the
construction of a wood frame and stucco-finished well with wood trim
on the eastern property line in lieu of the 6-inch concrete block
or masonry wall required by Section 9533 . 2. 1 of the ordinance code.
After reviewing this request, the staff does not believe -th' at
sufficient hardship has been demonstrated by the applicant to war-
rant approval of a wood frame and stucco wall in lieu of a 6-inch

The applicant_ has also requested that a reduction in the front
yard and exterior side yard setback be permitted by the Coivnis-
sion. Section 91-33 . 2. 1 of the Ordinance Code requires a minimum
15-foot front yard and side yard setback in conjunction with all
outside storage operations . In its analysis of this request , the
staff could not find that a hardship exists based on the criteria
set forth in Article 983 of the Ordinance Code . The subject pr--) -
perty is not unique in its size and configuration , nor do o.iy
exceptional circumstances exist related to the land or buildings
that justify approval of Conditional Exception No . 82-07 .
7 . 0 RECOMMENDATION :
The staff recommends that the Planning Commission approve Condi-
tional Use Permit No. 82-6 based on the findings below. The
staff also recommends that t-he Planning Commission deny Condi-
tional Exception No. 82-0'/ based on the following findings :
FINDINGS FOR DENIAL: (Conditional Exception No . 82-07)
1 . There are no exceptional circumstances applicable to the land
and buildings that do not apply generally to other properties
within the same district.
2. The granting of Conditional Exception No. 82-07 will consti-
tute a grant of special privilege inconsistent with limita-
tions placed on other properties within the same zoning
classification .
FINDINGS FOR APPROVAL: (Conditional Use Perni:: t_ No. 82-6)
1. The proposed storage facility substantially complies with
all. provisions of the Huntington Beach Ordinance Code in-
cluding parking, setbacks, landscaping and architectural
design, with the exception of the 10 foot setback which shall
lie revised to show a 15 foot setback along Ernest Avenue and Stm.ort Street.
2 . 'The subject property iz suitable for the proposed at:orage
facility and will he compatible with surrounding industrial
land uses which include two storage yards and vacant ' ndus-
trially-zoned property.
CONDITIONS OF APPROVAL: (Conditional Use Permit No. 82-6)
1. With the exception of the 15 foot setback on Ernest Avenue and
Stewart Street, the conceptual site plan, floor plans and ele-
vations received and dated April 29, 1982 , shall be the approved
layout. The plan shall be revised to show a 10 foot set .,aak j
along Ernest Avenue and Stewart Street.

and other surplus or unusable material, shall ha disposed of
at an offsite facility equipped to handle them.
4 . If lighting is included in the parking lot , energy efficient
lamps shall be used (e.g. , high pressure sodium vapor , metal
halide) . All outside liallting shall be directed to prevent
"spillage" onto adjacent properties.
5 . A chemical analysis , as well as tests for physical proper--
ties of the soil oil the subject property , shall be submitted
to the City for review prior to the issuance of building
permits.
6 . The development shall comply with all requirements scat forth
by th;: duntington Beach Fire Department .
7 . The plan shall be revised to reflect a solid six (6) inch
concrete block or masonry wall not over eight ( 8) feet high
along ctewart St-.eet. This wall shall be reviewed and ap-
proved by the Design and Review Board for colors and design
prior to issuance of building pet.mits .

NOTICE IS HEREBY GIVEN that a public hearing will be held by thi City Council
of the City of Huntington tie-ch , in the Council Chamber of the Civic Center,
Huntington Beach , at the hour of 7: 30 P.M. , or as soon :hereafter as
pos:;ible on Monday the 21st day of June , 19 82.
for the purpose of considering an appeal to the Manning f.amnission 's conditional
approval of Conditional Use Permit No. 82-6, a request to permit the construction of
a recreational vehicle and self-starage facility on property located on the southwest
corner of Stewart Avenue and Ernest Street within the M1-0-CD (Light Manufacturing
combined with oil production and within the Civic District) . The applicant is apuealing
Condition of Approval No. 9 which requires improvements to the northerly 10 ft. of
Ernest street
(From Centerline) between Goldenwest Street and the first entrance to the
project located on Ernest Street. A legal description is on file in the Department
of Development Services Office.
