The Commissioners discussed the con- cerns raised by the public testimony anu felt that there were many questions which were not heretofore addressed by staff, as follows: Can dedicated and gift properties be sold? What would the cost be to prepare the property for R1 use? W.%at is the history of this land and h vw was .it acquired by the City? (Include a map and address the treatment record of each segment. ) Although the Open Space/Conservation Element was addressed by staff, there are other elements that were not addressed by staff (i . e. , traffic , seismic , etc. ) . including a statement from the City Attorney ' s of" '.ce on an EIR. The original .request was to establish retail sales in an existing building located on the northwest corner of Beach Boulevard and Holt Avenue. The applicant stated that the conditions imposed by the BZA regarding landscaping were now solved, however, 'the applicant was still taking exception to the requirements re- garding signing . The public hearing-was opened. D. Graham, representing _ Sun Computers , spoke in favor of granting the appeal. The applicant introduced herself to the Board and stated that Sun Computers consists of specialists in microcomputer sales and services and as they need more space, wish to relocate in the City of Huntington Beach. As there was no one else present wishing to speak in favor or opposition of this request, the public hearing was closed. Board discussion carried on the Conditions of Approval . The applicant was informed by the Board that the existing sign on the property 'did not meet the Sign Code and that it would have to be brought into compliance with the Code which would require a reduction in height from 25 ft, to 20 ft. The applicant stated she was unaware of the fact that the sign wzs illegal but stated that the sign would not be a problem. Upon review of the plans submitted , it was noted that the plans were dated September 1, 1975. The applicant explained that the building 'as shown is still the same and has not been modified in 'the past seven "years. I I j UP 82-19 (APPEAL) August 3, 1982 Page 2 DISCUSSION : Should a new entitlement for an existing building be subject to the minimum requiremen's of the Ordinance Code? On June 9, 1982 , the Board of Zoning Adjustments approved Use Per- mit No. 82--19, a request to permit retail computer sales within an existing 3, 432 square foot building. In approving the subject use permit, the Board of Zoning Adj»stments imposed several conditions (see attached minutes) , one of ...rich (as stated below) is being appealed. The Planning Commission upheld the Board of Zoning Ad- justments ' decision on Use Permit No. 82-19 , therefore, Coldwell Banker (the appellant) is appealing this Planning Commission action to the City Council. -- (Condition being appealed) On-site skirling shall be brought into conformance with Article 976 of the Ordinance Code prior to occupancy. " NOTE : It should be noted that subsequent to the Plann..ng Commission ' s action on this application, the appellant withdrew an appeal pertaining to conditions of approval for landscaping. Pursuant to Section 9816 . 1. 2 of the Ordinance Code, "Wizen any use of land , building, oL premises established under the provisions of this article ha-:~ been discontinued for a period of one year, it shall be unla�.-ul to use such land , building , or premises for such discontnued use unless subsequent conditional exception or use per- mit is zpproved. " The subject property has not been utilized for a period of time greater than one year, therefore, the appl .cant had ; to re-apply for a new use permit to establish retail sales on the site. At that time, the Board of Zoning Adjustments reviewed and approved the site plan with the condition that the property be brought up to current day development standards. Be- cause the site is located on a major arterial highway, the Board did not view the upgrading of the site as an unreasonable request. Bacause the: site is located on a major arterial highway , tha Board did not view the upgrading of the site as an unreasonable request . in fact, the Board has been consistent in requiring addi- tional landscaping on nevy entitlements . Secondly, the Board of Zoning Adjustments required a reduction in the height of an existing 25 foot high pole sign to comply with the 20 foot height limitation . The sign is located within a landscaped planter 0 ' -12 ' from the property line, which limits the sign height to 20 feet. It: has been the philosophy of the Board to require com- pliance with the minimum standards set forth in the Ordinance Code � through the entitlement p-•ocess. In order to achieve a "clean-up" of Beach Boulevard, compliance with minimum standards is necessary . The require- ment for six ( 6) percent landscaping was discussed with the applicant as well as replacement of deteriorated landscaping on the site. Ms. Graham stated that she has hired a licensed landscaping contractor to do the work. Formality !or dedication of Holt A% enue was explained to Ms. Graham. A lengthly discussion ensued between the Board , applicant and Jim Costanzo of Coldwell Banker regarding the Tentative Parcel Map. � Mr. Costanzo. stated that if his clients who are purchasing the building were unable to open their doors for business until the parcel map was recorded, that due to th,..z length of time involved, it would affect the closing of escrow &s he felt as the applicant wishes to open for business on July So 1982 , she would not want to purchase a building which could not be occupied immediately. The Board realizing the complexities involved , with the applicant' s concurrence, agreed that should the parcel map not be recorded within 90 days after occupancy, a Notice of Violation •will be filed with the Orange County Recorder ' s Office by the City which will put a cloud on the title. The applicant agreed to file a Tentative Parcel Map at her earliest convenience.
