Use Permit No. 82-26 is a request to convert an existing Arco service station into a convenience market combined with gaso- line sales- subject to provisions contained in Section 9430 . 0 . 2 of >..the•,'Ord, i uance Code. The proposed convenience store will provide eight onwmite parking spaces and the existing landscaping will be increased from .6% to 10% of the site. However, as stated in Section 5.0 -of this report, the i i CUP 32-26 November 2 , 1982 Page 3 surrounding land uses to the west and south of the subject property consist of an L-shaped medical facilitty. 'ro the north of the sub- ject property , across Heil Avenue and to the east of the subject property , across Goldenwest Street, are existing single family dwel- lings and apartments . A convenience market will be compatible with these surrounding lend .uses since the medical facility to the west and south of the subject property serves as a buffer separating the convenience market: from surrounding residential properties. In addition, Heil Avenue and Goldenwest Street also serve as buffers between the residential properties and the proposed convenience mar- ket. The staff has also identified on-site traffic circulation as an issue to be considered in the review of this application . To meet the Ordinance Code requirements of eight on-site parking spaces , the applicant has proposed that six, 45-decrree angle parking spaces be located along the west property line and that two parallel spaces be placed alone the south property line. This par}:ing 7.ayout is suffici- ent for vehic?.LS entering the facility from Heil Avenue, but creates a hardship for vehicles entering the facility from Goldenwest Street and driving into the parking area along the south property Line. These ►ehicles woul•1 be forced to back into the 45-degree angle park- ing spaces if the two parallel spaces are occupied. In the staff' s view, this will create an unsafe traffic situation on the site. To mitigate this situation, the staff recommends that the southerly drive- way be marked as "one way only" and that a sign be posted on the build- ing indicating the sou` er y Elriveway as "one way only" . Proposed signs for the convenience market include or►e freestanding sign located at the corner of Heil Avenue and Goldenwest Street and three wall signs , two of which will be located on the east elevation of the convenience market and the other wall sign will be located on the north elevation of the convenience market. The proposed signs will comply with the standards set forth in Section 9430 . 8 .2 and Article 976 of the Huntington Beach ordinance Coda. In reviewing the site plan for the proposed convenience market, the staff has noted that lighting within the proposed parking area lo- cated on the west property line is currently not sufficient for a facility of this type . Staff recommends that a minimum of three Tight standards be constructed on the west property line to suffici- ently light the parkins area. This light-inn should be installed in such a manner so that Sight spillage will not occur on adjacent properties. In summary, the haft is recommending approval of this application because the facility is compatible with surrounding land uses and is buffered from residential property by commercially zoned property on the west and south and on the north and east by Heil. Avenue and- Gal- denweat Street. On site traffic circulation will be adequate if the driveway. is stenciled "one way only" and a .3ign is posted on the building ,indicating '-one way only" . De- velopment Standards of the Huntington Leach Ordinance Code. A 6 . 0 RECOWIENDATION: Based on the above analysis and the following findings , the staff recommends that the Planning Commission approve Conditional Use Permit No. 82-26-. FINDINGS FOR APPROVAL: 1. The proposed use is compatible with surrounding land uses because the proposed convenience market is buffered on the west and south by commercially 2:oned property and the north and east, }-v Heil Avenue and Goldenwest Street. 2 . `.!'he proposed convenience market substantially complies with the ovisions outlined in Article 947 of the Huntington Leach Ordinance Code . SUGGESTED CONDITIONS OF APPROVAL: 1. The site plan dated September 15, 1982 , shall be the approved layout. 2. All signing for the convenience market/gasoline station shall comply with provisions outlined in Article 943 and 976 of the Huntington Beach Ordinance Code . 3. Light standards shall be constructed on the west property line to provide sufficient lighting for the parking lot. This lighting shall be directed in such a manner as to not affect surrounding properties . r 4 . The southerly driveway shall. be stenciled "one way only" in large letters and a sign shall be posted on the east elevation indicating "one way only" . The proposed use would be materially detrimental to the public health, welfare, and safety of persons residing in the neigh- borhood . 2 . AYES: Porter, Livengood, Winchell , Paone, Schumacher, Mirjahangir NOES: Higgins ABSENT: None ABSTAIN: None DISCUQSION: On November 2, 1982 , the Planning Commission denied Conditional Use Permit No. 82-26 , a request to permit the conversion of an existing service station into a convenience market combined with gasoline dales located at the southwest corner of Heil Avenue and Goldenwest Street. In reviewing Conditional Use Permit No. 82-26 , the Commis- sion felt that the proposed convenience market would not be compatible with surrounding residential properties located to the west and south of the subject property and to the north and east of the subject property. The Commission felt that the proposed use would be detr -- mental to the residents .living within the surrounding residential *neighborhoods . In its review, the Commission also felt that a 24- hour facility would not enhance the surrounding residential (roper- ties and that a convenience market would be detrimental to the health, safety, and welfare of persons residing in the neighborhood. The Planning Commission asked the applicant if he would be willing to limit his operation to less than a 24-hour business . The applicant indicated that it was necessary for him and the operation of the business to maintain the 24-hour business day. It should be noted, at the time the ordinance was prepared which allowed for conversion ol existing gas stations to mini-marketu in conjunction with gasoline sales , the staff had prepared some loca- tional criteria. After the Planning Commission' s review, tre Com- mission determined that the locational criteria wQs not necessary since the Commission would review each request under the conditional into permit. In my opinion, the reason for the denial was the Commission' s concern for the impact of the project on the surrounding neighborhoods . The Planning Sinff had considered this as an issue but recommended approval as the service station is buffered on the north by the width of Heil Street , cn the east by the width of. Goldenwest Street , and on the south and west by an L-shaped medical office complex . It was the Staff recommendation that the buffers sufficiently insulated the project and mitigated the issue . It is our opinion that the Planning Commission has not givt!n sufficient weight to the Planning Staff recommendation and for this reason we find it necessary to appeal to the J City Council .
