STATEMENT OF ISSUE:
Transmitted for City Council consideration is a Resolution to adopt Local Coastal Program No. 94-4
which incorporates Code Amendment No. 91-10 and Zone Change No. 94-2 (Zoning and Subdivision
Ordinance rewrite and related zone change) into the City's certified Local Coastal Program. The code
amendment and negative declaration were approved on September 19, 1994, and adopted by the City
Council on October 3, 1994; the zone change was approved on October 17, 1994, and adopted by the City
Council on November 7, 1994. Local Coastal Program Amendment No. 94-4 will be transmitted to the
California Coastal Commission for review and approval.

ANALYSIS:
The California Coastal Commission certified the city's Local Coastal Program in 1985. The California
Coastal Act requires that any amendments to the City's Ordinance Code (zoning) in the Coastal Zone be
approved by the California Coastal Commission. The method of transmitting Code Amendment No. 91-10
and Zone Change No. 94-2 is to adopt a resolution and then forward the resolution to the California
Coastal Commission.

AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY
CHANGING THE NAMES OF VARIOUS ZONING DISTRICTS
AND DELETING THE CONevIERCIAL DISTRICT SETBACK LINES
FROM ARTERIAL HIGHWAYS AS SHOWN ON SECTIONAL DISTRICT MAPS
(ZONE CHANGE NO. 94-2)
WHEREAS, pursuant to the Planning and Zoning Law, the California Government Code
Sections 65493 et seq., the Planning Commission of the City of Huntington Beach, after notice
duly given, held a public hearing to consider Zone Change No. 94-2, which will change the names
of various'zoning districts in the City of Huntington Beach, and delete the commercial district
setback lines from arterials as shown on sectional district maps; and
On " October 17 , 1994, after notice duly given, a public hearing was held before
the City.Council, and the zone change having been considered, the City Council finds that Zone
Change No. 94-2 is necessary to change the names of various zoning districts in the City of
Huntington Beach and delete the commercial district setback lines from arterials as shown on
sectional district maps,
NOW, THEREFORE, the City Council of the City of Huntington Beach does resolve as
follows:
SECTION 1. All commercial district setback lines from arterials as depicted on sectional
district maps are hereby deleted. The Director of Community Development is hereby directed to
amend all sectional district maps of the Huntington Beach Ordinance Code so as to reflect the
changes contained in this ordinance. The Director of Community Development is further directed
to file the amended maps. A copy of such maps, as amended, shall be available in the office of the
City Clerk.
SECTION 2. The names of the various zoning districts are hereby changed to reflect the
new names as shown on the table attached hereto as Exhibit"A" and incorporated by this
- reference as though fully set forth herein.

Code Amendment No. 91-10
Code Amendment No. 91-10 repealed the Huntington Beach Ordinance Code except Article 910,
Residential Agriculture, and established a new Zoning and Subdivision Ordinance as Titles 20, General
Provisions; 21,Base Districts; 22, Overlay Districts; 23,Provisions Applying in All or Several Districts;
24,Administration; and 25, Subdivisions, to the Huntington Beach Municipal Code. Articles 937, North
Huntington Center Specific Plan, and 964, Pacifica Community Plan, were established as separate
specific plans and not included in the new ordinance.
Zone Change No. 94-2
Zone Change No. 94-2 repealed and/or renamed zoning districts in the City of Huntington Beach to
conform to the districts established by the new Zoning and Subdivision Ordinance.
These entitlements will amend the city's Coastal Element (Local Coastal Program) by replacing the current
implementing ordinances of the Huntington Beach Ordinance Code with the Zoning and Subdivision
Ordinance of the Huntington Beach Municipal code to provide one set of zoning and subdivision provisions
citywide.
Environmental Status:
Local Coastal Program No. 94-4 is covered by Negative Declaration No. 91-32 which was adopted by the
City Council on September 19, 1994.
FUNDING SOURCE:
Not applicable
ALTERNATIVE ACTION:
The City Council may deny Resolution No. ('v which prevents Code Amendment No. 91-10 and
Zone Change No. 94-2 from becoming effective in the coastal zone..

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF HUNTINGTON BEACH ADOPTING
LOCAL COASTAL PROGRAM AMENDMENT NO. 94-4
AND REQUESTING ITS CERTIFICATION
BY THE CALIFORNIA COASTAL COMMISSION
WHEREAS, after notice duly given pursuant to Government Code Section 65090 and
Public Resources Code Sections 30503 and 30510, the Planning Commission of the City of
Huntington Beach held public hearings to consider the adoption of the Huntington Beach Local
Coastal Program Amendment No. 94-4, and such amendment was recommended to the City
Council for adoption; and
The City Council, after giving notice as prescribed by law, held at least one public hearing
on the proposed Huntington Beach Local Coastal Program Amendment No. 94-4, and the City
Council finds that the proposed amendment is consistent with the Certified Huntington Beach
Coastal Land Use Plan and Chapter 6 of the California Coastal Act; and
The City Council of the City of Huntington Beach intends to implement the Local Coastal
Program in a manner fully consistent with the California Coastal Act,
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:
SECTION 1. That the Huntington Beach Local Coastal Program Amendment No. 94-4,
consisting of Ordinance No. 3254 (Zoning and Subdivision Ordinance) and Ordinance No. 3258
(Zone Change No. 94-2), copies of which are attached hereto as Exhibits A and B, respectively,
and incorporated by this reference as though fully set forth herein, is hereby approved.
SECTION 2. That the California Coastal Commission is hereby requested to consider,
approve and certify Huntington Beach Local Coastal Program Amendment No. 94-4.
SECTION 3. That pursuant to Section 13551(b) of the Coastal Commission Regulations,
Huntington Beach Local Coastal Program Amendment No. 94-4 will take effect automatically

upon-toastal Commission approval, as provided in Public Resources Code Sections 30512,
30513, and 30519.

OF THE CITY HUNTINGTON BEACH
REPEALING THE HUNTINGTON BEACH ORDINANCE CODE
AND ADOPTING A NEW ZONING AND SUBDIVISION CODE
WHEREAS, the City Council of the City of Huntington Beach has previously adopted a
comprehensive zoning and subdivision ordinance, entitled the Huntington Beach Ordinance Code,
Division 9; and
Pursuant to the California State Planning and Zoning Law, the Huntington Beach Planning
Commission and Huntington Beach City Council have held separate, duly noticed public hearings
relative to adopting a new comprehensive zoning and subdivision ordinance,wherein both bodies
have carefully considered all information presented at said hearings; and
After due consideration of the findings and recommendations of the Planning Commission
., and all other evidence presented, the City Council finds that the aforesaid new ordinance is proper
and consistent with the General Plan,
NOW, THEREFORE; the City Council of the City of Huntington Beach does hereby
ordain as follows:
SECTION 1. That the Huntington Beach Ordinance Code, Division 9, is hereby
repealed,'except Article 910 thereof, entitled Residential Agriculture.
