Date: August 7, 2000
On June 14, 2000, the California Coastal Commission approved 15 minor amendments to the
Huntington Beach Local Coastal Program. This now allows the City to update the Zoning and
Subdivision Ordinance (ZSO) to remove the phrase: "(Note: Not certified by the California
Coastal Commission; however, these provisions are in effect and will be enforced by the City of
Huntington Beach.)" in various sections.
To assist the City Clerk's Office is completing this update, enclosed please find the approval
letter from the Coastal Commission and the Request for Council Action that originally
transmitted the items to the California Coastal Commission. Please note that the RCA identifies
16 items instead of 15. Item no. 1 was pulled by Commission staff for separate action. Thus,
the approval letter is only for items 2-16.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF HUNTINGTON BEACH
ADOPTING LOCAL COASTAL PROGRAM AMENDMENT NO. 98-2
AND REQUESTING ITS CERTIFICATION BY
THE CALIFORNIA COASTAL COMMISSION
WHEREAS, after notice duly given pursuant to Government Code Section 65090 and
Public Resources Code Sections 30503 and 30510, the Planning Commission of the City of
Huntington Beach held public hearings to consider the-adoption of the Huntington Beach Local
Coastal Program Amendment No. 98-2, and such amendment was recommended to the City
Council for adoption; and
The City Council, after giving notice as prescribed by law, held at least one public
hearing on the proposed Huntington Beach Local Coastal Program Amendment No. 98-2, and
the City Council finds that the proposed amendment is consistent with the Certified Huntington
Beach Coastal Land Use Plan and Chapter 6 of the California Coastal Act; and
The City Council of the City of Huntington Beach intends to implement the Local
Coastal Program in a manner fully consistent with the California Coastal Act,
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:

approve and certify Huntington Beach Local Coastal Program Amendment No. 98-2.
SECTON 3. That pursuant to Section 13551(b) of the Coastal Commission
Regulations, Huntington Beach Local Coastal Program Amendment No. 98-2 will take effect
automatically upon Coastal Commission approval, s provided in Public Resources Code Sections
30512, 30513, and 30519.

LCPA 98-2 MINOR AMENDMENT
1. CODE AMENDMENT NO. 93-5B: This application adds provisions to regulate Carts and
Kiosks on commercial properties citywide subject to Conditional Use Permit approval by the
Zoning Administrator. The provisions are added to Chapter 230, Site Standards, and
references to this section are included included in Chapter 211, Commercial Districts, and
the Downtown Specific Plan. The provisions are applicable on private property only.
Definitions are also added to Chapter 203, Definitions, and include cart/kiosk,private
property,public property, and specific event.
2. ZONING TEXT AMENDMENT NO. 95-1: This application amends the definition of
residential infill lot and the provisions applicable to development on vacant lots adjacent to
developed single family residential. There were no changes to these provisions
recommended by the California Coastal Commission (CCC) during the review of Local
Coastal Program Amendment(LCPA) 1-95. The previously certified provisions will be
removed from the Huntington Beach Zoning and Subdivision Ordinance upon approval of the
revision.
3. ZONING TEXT AMENDMENT NO. 95-2: The changes made to Chapter 210, Section
210.04C were to change the education-related term for adult businesses to that used in the
prior Huntington Beach Ordinance Code. The CCC made no recommended changes to this
section in LCPA 1-95.
4. ZONING TEXT AMENDMENT NO. 95-3: This application amends provisions
applicable to development within the floodplain. These changes were required by the
Federal Emergency Management Agency. Chapter 222, Floodplain Overlay District,
includes changes recommended by the CCC during the review of LCPA 1-95. The previously
certified sections will be removed from the Huntington Beach Zoning and Subdivision
Ordinance upon approval of the revision.
5. ZONE CHANGE NO. 94-1: This zone change rezoned a 0.91 acre site that is not located
within the coastal zone (north of Island Bay Lane adjacent to the Seacliff Golf Course.
6. ZONE CHANGE NO. 94-4: This zone change rezoned a closed school site (Gill) that is
not located within the coastal zone (north of McFadden Avenue; west of Goldenwest Street).
7. ZONE CHANGE NO. 94-5: This zone change rezoned property that is not located within
the coastal zone (south of Memphis Avenue, west of Beach Boulevard, east of Florida Street,
and north of Knoxville).

We are pleased to notify you that the City.of Huntington Beach (the City) Implementation Plan
Amendment No. 2-98B was approved as submitted by the California Coastal Commission (the
Commission) at their June 14, 2000 hearing in Santa Barbara.
Pursuant to Section 13544 of the California Code of Regulations, the City's amendment No.
2-98B will become effective with the filing of the "Notice of Determination"with the office.of
the Secretary for Resources.. To assist in our efforts to maintain current records, we request
that the City submit two additional copies of the updated Implementation Plan to our office.

Background.
The City's Local Coastal Program consists of two parts: the Coastal Element and the
Implementing Ordinances. The latter includes the Zoning and Subdivision Ordinance and
specific plans that encompass coastal zone property (Downtown Specific Plan, Holly Seacliff
Specific Plan, Seacliff Specific Plan and Magnolia Pacific Specific Plan). Any changes to the
Implementing Ordinances must be forwarded to the Coastal Commission as a local coastal
program amendment (LCPA). LCPAs are deemed minor or major. Minor LCPAs do not
directly affect property in the coastal zone or intensify standards; major LCPAs do. Major.
LCPAs are typically forwarded to the Coastal Commission immediately after the City Council
takes action and require a public hearing before the Coastal Commission. Minor LCPAs are
approved at the administrative level without a hearing. The City is allowed three major
amendments annually; there are no restrictions on the number of minor amendments.

B. STAFF ANALYSIS AND RECOMMENDATION:
The subject LCPA represents a minor amendment to the City's Local Coastal Program. All
of the entitlements have been approved by the City Council with public hearings and no
coastal related issues were brought forward. Staff has grouped these entitlements as one
LCPA to minimize staff and administrative time because they are minor from a coastal
perspective.
Some of the specific entitlements were approved by the City Council back in 1994 and 1995.
These entitlements were approved after the City had prepared its new Zoning Ordinance and
had already received comments on the document from the Coastal Commission. When the
final version of the Zoning Ordinance was forwarded to the Coastal Commission it included
the 1994 and 1995 entitlement changes. Staff is including them in-this LCPA, however,
because they were never directly sent to the Coastal Commission for approval and were not
in the version of the Zoning Ordinance for which the City received Coastal Commission
comments.
Staff anticipates delivering this LCPA to the Coastal Commission in November. Should
Coastal Commission staff decide that one or more of the specific entitlements constitutes a
major amendment, it will be separated from the minor amendment items and processed
separately. In either case the LCPA will be counted as a 1998 amendment and not affect
the City's right to apply for three major amendments in 1999.

8. ZONE CHANGE NO. 94-6: This zone change rezoned property that is not located within
the coastal zone by removing the Q zoning designation (east of Beach Boulevard and south of
Warner Avenue).
9. ZONING MAP AMENDMENT NO. 96-2: This zone change rezoned property that is not
located within the coastal zone from office to general commercial (north of Warner Avenue,
west ofAirport Circle).
10. ADULT BUSINESS: This amendment separates adult business into categories: adult
business excluding massage establishments and adult business-massage establishments.
Adult businesses without massage are considered permitted uses subject to compliance with
specific locational criteria. Massage Establishments continue to be subject to conditional
use permit approval by the Planning Commission and compliance with locational criteria.
11. ZONING TEXT AMENDMENT NO. 95-6: This amendment changed the sign code.
12. ZONING TEXT AMENDMENT NO. 97-4: This amendment repeals adult business
regulations, reclassifies adult businesses as sex-oriented businesses, establishes criteria for
location only within industrial zones, and establishes minimum parking requirements.
13. ZONING MAP AMENDMENT NO. 97-2: This amendment rezoned property that is not
located within the coastal zone from commercial and residential agriculture to public-
semipublic for an existing church (Magnolia, south ofAdams).
14. ZONING MAP AMENDMENT NO. 97-3: This amendment rezoned property that is not
located within the coastal zone from commercial to residential(Bushard at Indianapolis).
15. ZONING TEXT AMENDMENT NO. 97-3: This amendment modified the zoning code to
allow general day care uses in low density residential zones.
16. ZONING CHANGE NO. 96-4: This amendment rezoned property that is not located within
the coastal zone from public-semipublic and medium high density residential to general
commercial (Warner at Goldenwest).
