If a public hearinq is schedule•4 by the Council at a later date to discuss Conditional Use Permit No . 83-35 , � the public hearing would also allow the general public the opportuni .y to express their viewn '.nd concerns regarding the alleged riuiaances occurring in the parking lot adjacent to Garfield' s Nite Spot . RECOMMENDATION Based on action taken by the Planning Commission on September 18, 1984, the Commission recommends that the City Council schedule a public hearing at the earliest possible time to permit Garfield' s Ni.te Spot the opportunity to show cause why Conditional Use Permit No. 83-35 should Y..it be revoked and also to allow the general public the opportunity to express their views and concerns regarding the allegeu public nuisances occurring in the parking lot adjacent to the nightclub. Planning Commission Action r ■ r on September 18, 1984, on motion by Erskine and second by Higgi%n , the Commission vc ted to recommend tblit the City Council Schedule a public hearing ati the earliest possible time to permit Garfield' s Ole Mo"1 Vitc Spot, Inc . the opportunity to show cause why the Conditional Use Perm:. t No. 83-35 should not be revoked and also allow the general - iublic the opportunity to express their views and concerns by the following vote : AYES: Higginu , Winchell , Livengood, Erskine , Schumacher , Mirjahagir NOES : None ABSENT: Pirte.r ABSTAIN : None Discussion : At the September 5 , 1984 Planning Commission meeting, a citizen representing numerous homeowners in the area of Garfield' s Nite Spot had reported to the Commission that a number of problems were occurring in the parking lot at the southeast corner of Garfield and Magnolia Avenue due to the popularity of the recently approved nightclub. As reported by the citizen , the alleged problems included noise generated by customeza and vehicles within the parking area, litter in the landscaping and parking area, lights shining onto adjacent residential property, and beer bottles being thrown over the east wall onto residential properties . At the request of the Planning Commission, a staff member from Development Services visited the site on Wednesday, September 12, 1984 to evaluate the alleged problems rer nrted by the citizen at the September 5 , 1984 Commission meeting. Attached for the Council ' s review is a report prepared by staff dated September 18 , 1984 outlining numerous activities observed by the staff member between the hours of 10.30 p . m. and 2 : 30 a .m. on the evening of September 12 , 1984 and the morning of September 13 , 1984 . In general, the activities observed by staff on the evening of September 1112 and the morning of September 13 , 1984 included; three males observed drinking beer in the parking lot . people yelling to frl.ends within the parking lot, and cars honking horns and speeding i:i the parking lot of the shopping center . Staff observation also included numerous near collisions in the lot, and a beer bottle thrown from a vehicle exiting tba parking lot onto Garfield Avenue . on October 4, 1984 , a meeting was held in the City Attorney' s Office in an attempt to obtain voluntary compliance with the noise ordinance at Gas;field' s Nite Spot. Representatives from the Attorney' s dffiQe , Lcvelopment Services , the Property Owner and Garfield' s Nite Spot were prevent. After lengthy discussion by all parties , it was agreed that chains would be installed on the east tryd south aide of the existing building to prohibit traffic from going behind the shopping center, thus alleviating socializing and apseding vehicles ad�accat to the single-family homes and apartments. However, the installation of the chains is contingent upon ' e;d jac nt property owners who must a:ao agree to the installation of the chains . TO: Planning Commission FROM: Development Services DATE: September 18 , 1.984 SUBJECT : GARFIELD ' S NITE SPOT GENERALLY LOCATZD AT THE SOUTFI/EAST CORNER OF MAGNOLIA STREET AND GARFIELD AVENUE ( 19070 MAGNOLIA STREET) At the September 5 , 1984 Planning Commission meeting a citizen represent.--ng homeowners in the area of Garfield ' s Nite Spot reported to the Commission that numerous problems are occurring on the t,ubject property due to the popularity of the recently approved night club. As reported by the citizen, these ,roblems included noise generated by customers and vehicles within the parking area , litter in the land- scaping and parking area, lights shining onto adjacent residential properties, and beer bottles being thrown over the east wall onto residential properties . On Wednesday, September 11 , 1984 a staff member from Development Services visited the site to evaluate the alleged problems reported by the citizen on September 5 , 1984 . Approximately four hours were spent observing the acitivities occurr- ing in the Garfield Center parking area . The following observations were made by staff between the hours of 10 : 30 p.m. and 2 : 30 a . m . on the evening of September 12 and the morning of September 13 , 198.4 : 10 : 30 p. m. - Parking lot adjacent to _arffeid 's Nite Spot was approx- imately 3/4 full . Parking areaslocated t • south and east of center wereempty, with the exception of two vehir' .�s . Jet this ci.me the parking lot was generally quiet . Staff observed three males drinking beer ir, vehicle while. parked in parking area . One male finished the beer , opened the door of the vehicle and deposited the beer can under `.he vehicle . At this time the three mates exi'.ed the vehicle and we, ,. into Garfield ' s Nice Club. Staff observed one security guard patrolling parking area on foot . 11:M p. m. - Parking lot began to fill . up with customers vehicles, going to Garfield ' s . Hcwever , there was still no line of customers waiting t7 enter nite spot . 11: 00 p.m. to 1 : 45 a . m . - Activity within parking area included noise generated by people yelling to friends , cars honking horns an'd vehicles speeding in parking area . Primary parking lot in front of Garfield ' s was approximately 95 percent full at this time . 1 : 45 a . m, to 2 : 15 a .m. - Customers of Garfield ' s Nite Spot began exiting the parking area . Staff observed customers screaming , yelling and hootingwithin the parking area . Vehicles leaving the P g g parking lot began to speed , burn rubber , skid and iev engines . Customers continued to socialize in parking lot- in a boisterous manner . Approximately six near collisions between two or more vehicles were observed in the parking area during this time . Many of the customers in the parking area appeared Lo be intoxicated. S .aff observed one person throwa beer bottle onto Garfield Avenue as he exited the parking area . Lights from vehicles exiting the parking lot shined onto approximately three houses located on Randi Lane . 2 : 20 a. m. - Parking area was now empty with the exception of approximately ten vehicles . Staff observed a small amount of trash in parking area and approximately four beer bottles in landscaped areas at this time . At the request of Development Services , a representative of the Fire Department also visited the site on September 12 , 1984 . It was reported that the occupant load at 11 : 30 p. m. was approximately 280 persons.. This figure is below the occupant load of 402 persons for the 6280 square building established by the Building Division on April 16 , 1984 . Sta , has requested a report from the Police Department listing all complaints filed and incidents. recorded at Garfield ' s Center for the past three months . Since this information wPs not available at time of printing , the report will be handed to the Commission at the September 18 meeting , Based on complaints expressed by a resident representing homeowners in the area of Garfield ' s Nite Spot at the September 5 , 1984 Commission meeting and staff observation of the above described activities occurring within the night club parking lot , staff recommends the following action be taken by the Commission : j Schedule a public hearing before the Planning Commission to permit Garfield ' s Nite Spot , Inc, the opportunity to show cause why Conditional Use Permic No , 83--35 should not be revoked , ALTERNATIVE ACTION: Permit Garfield ' s Nite Spot , Inc, to provide a plan of action to eliminate and/or mitigate the above-described problems occurring within the parking crea of Garfield ' s Nite Spot . LISTORY: On July 27 , 1979 , Use Permit. No. 79-29 , a request to establish -an adult discotheque was submitted to the City for processing . On August 8 , 1979 , the 80' ard of Zoning Adjustment:. approved the request . Building permits for interior alterations were subsequently issued on August 30, 1979 , after the nc:rmal 10 day appeal was over . .3hertly after the appeal period orided, it was brought to the attention of the Department of Development Services than , due to a procedural error , three of the abutting property owners had not been notified of the August 8 , 1979 public hearing . Because of this , the Board of Zoning Adjustments re-heard Use Permit No . 79-29 . On October 31 , 19'?9 , the Board once again approved the ,applicant' s request to establish an adult discotheque on the subject property. Dear Mr. Strange : At your request- a noise study was made in an adjoining resi- (let-ice located at 19021 Randi lane to determine .if noise being generated by persons parked in automobiles behind the Garfield Night Spot exceeded the City of. Huntington Beach Noise Ordinance . The noise study was performed Friday and Saturday on August 3 j and 4 1984, usinq a Digital Acoustic type 603 recording sound level meter, with the microphone located at the second floor bedroom wi3dow. Analysis of the results indicated that the intruding noise did not exceed the noise ordinance standards so that an observed noise moni-toning would be of no assistance to reduce the noise in the parking lot. It is recommended that other means such as the police , should be used to abate this nuisance type of noise. I don ' t believe that we can do anything else at this time . Almost five years ago when- the entertainment center was first proposed For the California Sun Disco, A noise study was performed two doors to the south at 19071 Randi Lane . Al- though I did not perform the actual monitoring I did analize the date and wrote the report. To the best of my ability I believed that the recording location was similar in both cases , until I compared the data in the two studies. In general the results were nearly 15 dB higher in the last study indicating some• anomoly . Searching the investigators log I Found an obscure reference that the actual monitoring was performed in the second floor bedroom instead of outside as I has originally believed . Only by repeating the second study- with the inicrophono inside could this theory be proven . The public hearing would also permit the public to voice their concerns regarding this matter . RECOMMENDATION : Revoke Conditional Use Permit No . 83-35 , based on findings that the activities occurring in the parking lot adjacent to Garfield ' s Nite Spot constitute a public nuisance to area residents and business people. Direct the City Attorney to initiate appropriate legal action to abate this use . The inspection confirmed what the citizen had reported to the commission on September 5 , 1984 .
