The relocation was required because - - hrtiicle 975 (Adult Entertainment Businesses ) hild rendered the original location non-conforming . Staff ',a review of the pro.9 ad new location revealed that the site met the loca tional cr i ter is -oontsaiined ' in Article, 975 . 'Prior to preparation of the staff report for the application, staff ■ub�altted a memo to the • Police Department requesting concerrin they ,;>jay, have with the pror+osal . No written carimalts were received; how+ayer , a detective verbally indicated over the telephone on August 29F `1984, that the Police Department had no concerns with the appl ics tior� . Proposed site met the locational + cri�ti ria, Development Services recommended approval of the At - the, city. The Police Department indicated no concerns with the request. After proper notification, staff recommended approval with conditions . ' Chapter 5 . 24 o: the hunicipal Code req:-fires approval by both the Police Department and the Planning Department prior to the change of 'oct!tion of a MassaUt establishment. Review and processing of the Cond.;ti,onal Use Permit constitutes the Planning DepaTtment' s share of the approval. Presumably the Police Cep&rttment would baeo their aptiroval of a Massage establishment relocation at least partially upon evidence of an acceptable . relocation site as confirmed by the approval of a Conditional Use Pcrmi. t. As Indicated in the attached memo from the Police Chief , t:.he Police Depar, teen t is also prepared to wi thhol d approval of a Massage estrabl$,shrent relocation based upon records of past Municipal Code an,d California Penal Code viola tior:s . Records cited by the Police indicate three violations by <<;e applicant' s establishment over the P. Y past two ears.. The Police Cc.: artment feels that these violations.. are sufficient tc withhold approval of the Masaage establishment relocation even Though a relocation site which meets the locational criteria of the zoning ordinance may have been found. STAFF ttMOMMENDATION: Staff .recommends that the city Council deny Conditional Use Permit No . 84�25 with the findings made by the Planning Commission . ANALYSIS : The attached Planning Commission staff reports and attachments Indicate the history of this item and the issues involved. Essentially, new. information on the business and the nature of the proposed relocation site came to light aicer the Planning Commission ' s original approval of the Conditional Use Permit. Staff concurs. that , the Police information on the Spa of Hawaii and the family nature: of the Westfair Shopping Center indicate that relocation of the business would not be c•ompatlble with the shopping center . Staff therefore recommends denial of the Conditional Use Permit with the findings made by the Planning Commission at their October 2, 1984 meeting . On. October 1.6 , 1984, the City Council adopted a six Month extension of the amortization period for relocation of not:-conforming massage parlors . This extension which will expire on June 2 , 1985 may permit the applicant time to find an acceptable location. A rear parking lot and the Wintersburg Flood Control Channel provide a greater than 200 foot separation from the RI property to the north . The Sea Aira West Mobilehorre Park to the east is within 200 feet of the east aide of the Plains Market at the east side of the shopping center . A four-hour fire wall , however , separates the set of suites (where the Spa of Hawaii will be located) from the Plains Market. For this reason, the west side of the Plains Market would be considered to be the nearest point of the building or structure used as a part of the premises where the adult entertainment business is located . This point is greater than 200 feet from the mobilehome park . There are no other residential areas , schools , churches or other adult entertainment businesses within the required distances to the south or west . The parking requirement of one space per 200 square feet of 'floor area is provided in the shopping center . The Spa of Hawaii is replacing a jewelry store which had the same parking requirement. Staff requested input from the Police Department and no concerns were expressed. 6.0 RECOMMENV ATION : Staff recommends that the Planning Commission approve Conditional Use permit No. 84-25 with the following findings and conditions: FINDINGS FOR APPROVAL OF CONDITIONAL USE PERMIT NO. 84•'25: 1 . The proposed project is in conformance with the City ' s adopted general Plan. 2. The proposed location of business meets the locational criteria for Adult Entertainment Busineuses contained in Article 975 of the Huntington Beach Ordinance Code . 3. The proposed project will not have an adverse impact on surrounding businesses or land uses . CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT NO. 84-25 : 1. A certificate of Occupancy for the Spa of Hawaii at 5915 Warner Avenue ohall not be issued until the Spa of Hawaii at 17434 1/2 Beach Boulevard has been discontinued. 20 Any expansion of the Spa of Hawaii at 5915 Warner Avenue shall be subject to approval of a new Conditional Use Permit . Beach Planning Commission on October 2 , 1984 in reconsidering the Conditional Use Permit granted my client on September 5 , 1984 and denying issuance of that permit. I have enclosed a check for $165 . 00 to cover the filing fee for the appeal. The appeal is based on three separate grounis . Firstly, it is the permit applicant ' s position that she applied for and was granted the above-captioned Conditional Use Permit on Sep- tember 5, 1984 . No challenge or appeal was filed within 10 days of that date as is required by the Huntington Beach Muni- cipal Code. The Conditional Use Permit therefore vested and became final on September 15, 1984 . Accordingly, any action by the Planning Commission to reconsider the granting of the Conditional Use Permit was beyond the jurisdiction of the Commission since the permit had vested , and further, since the Huntington Beach Municipal Code does not provide: for such a "reconsideration" procedure. Any .action taken by the Planning Commission to reconsider the applicant' s permit was void. Secondly , notwithstanding the applicant' s stated position on the first issue, the Planning Cos+iscion scheduled a hearing on October 2,- 1984 to reconsider the Conditional Use Permit granted on September 5, 1984 . After several discussions with the Huntington Beach City Attorney ' s Office, and mere. specifi�- dally, Deputy City Attorney Robert Sargstor , applicant' ss tonalse:l was informed that the Planning Staff and - thee ' City .. (A copy of that memo is attached hereto as Exhibit "A" . ) It was agreed that the memo would include a statement of the applicant ' s position that she did not agree to the continuance and further took the position that any recon- sideration hearing was beyond the jurisdiction of the Planning Commission. Additionally , the City Attorney ' s Office stated that it had the authority to represent- to applicant ' s counsel that tye reconsideration hearing would definitely be continued to the first meeting in November, 1984 . It was further represented that based upon this information, no appearance was required by counsel or the applicant at the October 2nd Planning Commission meeting. The foregoing was also agreed to by Art Folger, City Attorney advisor to the Planning Commission, and by the Planning staff. Relying on the foregoing representations, applicant' s counsel did not appear at the October 2nd hearing . Notwith- standing the foregoing agreements and representations , the Planning Commission went forward with its pan to reconsider the granting of the Conditional Use Permit and denied the permit. It is applicant ' s position that any action by the i Planning Commission following the agreements and repre- sentationsof the Cit,1 ;.ttorney ' s Office and Planning staff was unfair, arbitrary , rupr icious and the denial of due process of law. On this ba:,i% . at the ?east, the Planning Commission should be required to hear this matter at a full. hearing with applicant' s counsel. present. Finally, the applicant contends that any denial of the Conditional Use Permit is an abuse of discretion . Applicant' s relocation site meets the City ' s adult zoning criteria, is com- patible with existing uses in the neighborhood which include several other self-improvement and health maintenance businesues and will not be detrimental to the value of 'any property in the neighborhood. Additionally, applicant has shown for many years that the Spa ;.f Hawaii it well managed and maintained and hae caused no problems in the ccmmunity.
